Abstract:
The issue of physician-assisted death is now firmly on the American public agenda. Already legal in five states, it is the subject of intense public opinion battles across the country. Driven by an increasingly aging population, and a baby boom generation just starting to enter its senior years, the issue is not going to go away anytime soon. In Physician-Assited Death L.W. Sumner equips readers with everything they need to know to take a reasoned and informed position in this important debate. The book provides needed context for the debate by situating physician-assisted death within the wider framework of end-of-life care and explaining why the movement to legalize it now enjoys such strong public support. It also reviews that movement's successes to date, beginning in Oregon in 1994 and now extending to eleven jurisdictions across three continents. Like abortion, physician-assisted death is ethically controversial and the subject of passionately held opinions. The central chapters of the book review the main arguments utilized by both sides of the controversy: on the one hand, appeals to patient autonomy and the relief of suffering, on the other the claim that taking active steps to hasten death inevitably violates the sanctity of life. The book then explores both the case in favor of legalization and the case against, focusing in the latter instance on the risk of abuse and the possibility of slippery slopes. In this context the experience of jurisdictions that have already taken the step of legalization is carefully reviewed to see what lessons might be extracted from it. It then identifies some further issues that lie beyond the boundaries of the current debate but will have to be faced sometime down the road: euthanasia for patients who are permanently unconscious or have become seriously demented and for severely compromised newborns. The book concludes by considering the various possible routes to legalization, both political and judicial. Readers will then be prepared to decide for themselves just where they stand when they confront the issue both in their own jurisdiction and in their own lives.

Abstract:
Assisted death is an extremely contested topic in bioethics. Despite the strongly influential role human dignity plays in this debate, it still has not received the appropriate, multifaceted treatment it deserves. Studies show that the notion of dignity already plays an important role in medical contexts. However, its use in these contexts needs to be analyzed and explained in more detail. A detailed philosophical analysis of dignity and how it relates to assisted death will benefit both the general discussion and the specific bioethical context to which it is applied. The goal of this first in-depth examination of the application of human dignity to assisted suicide is threefold. First, it aims to enlighten and explain the widely shared intuitions about human dignity, which has a specific usage in the medical context of terminal illness, because opponents as well as supporters of assisted suicide lay claim to that notion. Second, it aims to push the debate an important step forward because arguments that are often taken for granted can be more fairly reconsidered once their relationship to dignity has been clarified. Third, by making sense of dignity even within the complex and seemingly confused context of this debate, one will have taken an important step toward a clarification of it in general, which might lead to its application in other contexts as well.

As more people live into their later years, more of them become susceptible to Alzheimer’s disease and other age-related dementias. Many people fear dementia, and some argue that physician-assisted death should be available to those seeking to avoid the indignity of life with dementia. Distinct issues surround the relationship of dignity and assisted death for potential or actual dementia patients. This chapter examines the role of dignity concerns in addressing (1) requests for assisted death by at-risk individuals to avoid a possible future with dementia, (2) requests for assisted death by individuals with mild or moderate dementia, and (3) advance directives requesting assisted death in the event of a later dementia diagnosis or appearance of specific behavioral manifestations of dementia (e.g., apparent inability to recognize family and friends).

Abstract:
Because of their focus on psychopathology, mental health clinicians may overlook the potential significance of medical illness as a risk factor for suicide. In this chapter, the author presents evidence that physical illness, particularly certain physical illnesses, can be independent risk factors for suicide. In a number of these illnesses, depression is clearly a confounding risk factor, while in others the illness itself or its consequent functional impairments may lead to increased risk. When an individual has multiple physical illnesses, as often happens with the elderly, the cumulative burden can become overwhelming and heighten the risk of suicide. When physical illness becomes terminal, the competent patient has the right to refuse life-sustaining treatment. Whether that individual can receive assistance in dying has been more controversial. The chapter concludes with a presentation of data from a state where assisted suicide, also known as assisted death, has been legalized.

Abstract:
This chapter deals with physician-assisted dying (PAD) in the Netherlands. The focus is on the emergence, regulation, and effects of this practice that allowsonly physiciansto help patients die actively. To understand the adoption of this widely contested practice, it is necessary to describe the social context, changing legal landscape, medical profession policies, and political stalemate surrounding agreement on a law well after the practice existed and was accepted. Dutch development of regulation by the medical profession and multidisciplinary review committees realizes the goals of societal control, transparency, and physicians’ protection from criminal charges. On the other hand, even when a practice that is regulated by the medical profession is in place, pressure groups in society strive for more options for death with dignity—with orwithout physicians’ involvement. A large part of this physician-independent practice originates in physicians’ refusal of a request and is directly connected to it.
