Abstract:
A thesis presented on the political history of Fiji from cession to Britain in 1874 compares and analyses the country’s four political coups. A military coup occurred in 1987 by Lt. Col Sitiveni Rabuka. Six months later he staged a self-coup. In 2000 George Speight staged an armed civilian coup or putsch, and in 2006 Commodore Frank Bainimarama, head of Fiji’s military forces, overthrew the government of Laisenia Qarase. This paper is an internal comparison of the four coups of which the aim is to examine why coups occur in Fiji. The conclusion is that the level of influence of the country’s traditional paramount chiefs is a strong causal factor in events leading to the political overthrows. Issues such as ethnicity, constitutionalism, democracy, traditionalism, and modernity make the study of the Fiji coups complex. All of the major actors involved have been present or have been somehow linked to each coup. Questions of leadership arise as do issues regarding pluralism and multiculturalism. These issues are discussed in this paper. The end result is that if the question of traditional leadership is not addressed within a democratic framework then Fiji will continue to have coups.

Abstract:
This study develops a leader-centric theory of civil-military relations that expands upon three broad areas of research. Specifically, the study suggests that leaders will evaluate multiple threats to their political survival and will ultimately implement strategy that is most likely to keep them in power. While Downs (1957) has noted such a tendency in democracies, this study expands this rationale to authoritarian regimes by focusing on the primary means of authoritarian removal: the military coup. In contrast to the state-centric nature of traditional international relations theory, this dissertation finds that leaders frequently undermine the power of the state in order to accomplish the self-interested goal of political survival. First, the study carefully describes a number of coup-proofing strategies that leaders can implement. These are broadly defined in terms of influencing either the military’s willingness or its ability to attempt a coup. In addition to testing the effectiveness of these strategies, this study also theoretically explores the implications of coup-proofing for other political development of the state: interstate and intrastate conflict. Second, the study considers the influence of coup-proofing on interstate conflict. This study builds on the diversionary literature by investing coup risk as an incentive to use diversionary tactics as well as coup-proofing as a potential disincentive. The latter can both undermine the necessity of diversion as well as military capabilities, making leaders less capable of utilizing international conflict as a political tool. Third, the dissertation considers the influence of coup-proofing on intrastate conflict. The theory argues that the capability-reducing practice of coup-proofing can have important domestic consequences. Specifically, the practice can increase the mobilizational potential of would-be insurgents, can reduce the mobilizational capacity of the state, and leaders that are particularly fearful of a coup will likely tolerate the rise of an insurgency.

Abstract:
This study analyzed the causes of military coups and the consequences of military rule in the Third World during the 1960-1985 period. Using a coup d" etat score, including both successful and unsuccessful coups, as a dependent variable and collecting data for 109 developing nations from the World Handbook of Political and Social Indicators, The New York Times Index, and public documents, sixteen hypotheses derived from the literature on the causes of military coups were tested by both simple and multiple regression models for the Third World as a whole, as well as for four regions (Sub-Saharan Africa, Asia, Latin America, and the Middle East and North Africa) and in two time periods (1960-1970 and 1971-1985). Similarly, three models of military rule (progressive, Huntington's, and revisionist models) were analyzed to assess the consequences of military rule. The results of the study concerning the causes of military coups suggest four conclusions. First, three independent variables (social mobilization, cultural homogeneity, and dominant ethnic groups in the society) have stabilizing consequences. Second, six independent variables (previous coup experience, social mobilization divided by political institutionalization, length of national independence, economic deterioration, internal war, and military dominance) have destabilizing consequences. Third, multiple regression models for each region are very useful; most models explain more than 50% of the variance in military coups. Fourth, the time period covered is an important factor affecting explanations of the causes of military coups. In the analysis of the consequences of military rule, this study found that military governments did not differ significally from civilian governments in terms of economic, education, health, and social performances. However, the study found that military rule decreased political and civil rights. Its findings are thus very consistent with the best of the literature.

Abstract:
Military mutinies are occurring more frequently in the last two decades than ever before. Mutinies impact every region of the world. Given that they are occurring more frequently, impact every region, and often have disastrous implications, scholars must answer the foundational question: why do mutinies occur? What are the proximate domestic conditions that give rise to military mutinies? This project makes three contributions. First, I set out to formally define mutinies and collect a new dataset that will allow scholars to examine mutinies empirically. Second, I present a theoretical framework that explains when and why mutinies will occur. Finally, I present three novel empirical tests of the theory. The first portion of this dissertation defines mutinies and describes the data collection process. I present the Military Mutinies and Defections Databases (MMDD). Using news articles from various sources, I code 460 mutiny events from 1945 – present day. I code a number of other variables that give users details about the event, such as: whether or not violence was used, whether or not civilians were killed, and whether or not soldiers defected from the military apparatus. Next, I utilize a nested principal agent model to describe when mutinies are likely to occur. Agent models describe hierarchical relationships of delegation. A nested structure allows for multiple agents and multiple principals in a given model. I apply this nested structure to the military to generate three various nests. The first examines foot soldiers as an agent of the military leadership. In this nest, policy failures (e.g., bad strategy) secured by the military leadership will drive foot soldier mutinies. The second nest explores foot soldiers as agents of the executive, a civilian principal. In this nest, I expect that situations that place soldiers in conflict with the executive will generate shirking. The final nest considers foot soldiers and military leadership as collective agents of the executive. I theorize that risk aversion and divergent preferences will drive shirking, or mutinies, in this nested structure. The final nest presents an interesting trade-off for a coup-worried leader. I argue that while executives can utilize regime securing strategies, such strategies might actually agitate the military and drive low level military rebellions. Coup proofing, a common practice among executives that are worried they will be ousted by the military, effectively wards of coups but can generate unintended consequences. Specifically, I expect that counterbalancing measures and other coup proofing tactics should spur mutinies because the intended purpose of these measures is to create coordination challenges which likely spur military splintering. The first empirical chapter sets out to explore the relationship between civil conflict and the likelihood of mutinies. I expect that when civil wars are extremely bloody or long lasting, mutinies will be more likely as war-weary soldiers no longer want to invest in the war effort. I find evidence that indeed civil war intensity and duration contribute to the probability of a state experiencing a mutiny. The second empirical chapter explores scenarios that pit foot soldiers preferences against the executive’s. I expect that scenarios that impose steep costs on foot soldiers, yet provide some benefit to the executive are likely to spur mutinies. I find evidence that protest events and divisionary conflict spur mutinies. The final empirical chapter explores the military apparatus as a whole. I find that coup proofing measures increase the likelihood of mutinies. Additionally, I find that scenarios that are likely to spur widespread dissent among military actors will increase the likelihood of a mutiny in the context of steep coordination challenges that stifle coup activity. The final chapter concludes by providing policy recommendations. I offer recommendations for leader states (e.g., major powers and democratic leaders in the international system) and for states experiencing mutinies. I conclude by discussing the many possible extensions for this project. This section seeks to emphasis the fact that this is a young, novel research program with many promising avenues for future research.

Arch., Massachusetts Institute of Technology, Department of Architecture, 2014.<br>Cataloged from PDF version of thesis.<br>Includes bibliographical references (page 99).<br>Eighteen billion gallons of toxic waste, nine billion dollars in damages, trials across five countries, hundreds of lawyers, millions of dollars in litigation fees, and a corporation with an annual revenue of two hundred billions dollars-this is the story of Texaco's drilling operations in the Lago Agrio region of Northern Ecuador, referred to by locals as "rain-forest Chernobyl". This thesis proposes that the Lago Agrio case, and others like it highlight not only environmental issues, but issues that fall under a much larger umbrella of International Law. With its current cases myopically focused on crimes of African warlords, the International Criminal Court, seated in The Hague, has a latent capacity to work in a new set of crimes of international concern. There is a wide scope of environmental, technological, political and economic phenomena that are not yet part of our definition of International Law. To consider these issues as such, is to drastically rethink the institution of International Law itself, and with it, this thesis argues, the role of architecture in this new form of (highly contentious) universality. Events such as: crimes against nature or shared natural resources, crimes against labor, crimes pertaining to uncoordinated attempts at geoengineering, the development of harmful synthetic biology and nanotechnology, would not only implicate Western and developed, but also corporations, special interest groups and individuals. The thesis is literally cited in the contemporary configuration of the International Court and its Hague reality but it is conceptually cited with a few towards this potentially changing landscape of international law. These crimes, ones that we are all victim to, as well as implicated in, codify the new Global Collective centered around the activities of the Court, there is a multiplicity of vested interests, and one of the key disciplinary questions the thesis addresses is the form of monumentality that this architecture could take given both the multiplicity and scale of those interest-in a climate in which neither the Western and developed countries have the moral upper-hand nor the survival of the planet seems a given.<br>by Kyle Coburn.<br>M. This study investigates the role of records management in the functioning of Magistrates courts in the Eastern Cape using Middledrift Magistrate court as a case study. The objectives were to determine types of records created, received and used at MMC, to describe the available infrastructure, security and preservation for the management of court records in MMC and to identify the obstacles encountered in management of court records at MMC. Forty respondents selected randomly and purposively were interviewed. The research findings showed that MMC creates, receives and maintains many court records, MMC is aware of the importance of managing court records from their creation to disposal, there are storages for semi- current and non-current records although there is lack infrastructure for managing court records. The study also revealed that there were occasional misplacement of court records, there was no case file tracking system and the security of records was satisfactory. This study recommends that MCC must have adequate storage space, training for the personnel and security systems to protect court records.

Following the recent success of statistic-driven baseball franchises, many basketball executives and followers are beginning to mine the sport's production in search of an all-encompassing player value rating. Teams could thus exploit undervalued players, leading to increased team and fan welfare. My thesis addresses this ongoing debate by examining various player and team statistics in the National Basketball Association (NBA). While I find significant relationships between individual efficiency statistics and team success, I also discover the paramount importance of defensive statistics and balanced team payrolls. Abstract:
Tennis is a popular sport and in summer it’s often played outside. When an outdoors tennis court has been used it needs to be brushed. First the whole court is brushed witha large brush and then the white lines with a smaller brush. The aim of this thesis was to design and build a working prototype of a robot who can do all of this by itself i.e sweep the court and then the white lines. The budget for components to the prototype was limited to 1 000 SEK. Tools and other resources such as 3D-printers, soldering equipment and laser cutters was provided by KTH for free. First information and inspiration about self-driving cars and driving patterns was collected and some important sources were old bachelor’s thesis. Then, needed components and dimensions could be determined. In this project the main components were an Arduino Uno, two DC motors, an L298H-bridge, an ultra sonic distance sensor, an on/off switch, AAA batteries and a 9 V battery. The conclusions that could been drawn was that the robot can work good enough to sweep a court with only a preprogrammed path. However, to sweep the white lines, sensors would be necessary. It could also be concluded that a robot could sweep the court at the same speed as two people could do it.<br>Tennis är en populär sport och på sommaren spelas den ofta utomhus. När en utomhustennisbana har använts måste den borstas. Först borstas hela banan med en stor borste och sedan de vita linjerna med en mindre borste. Syftet med denna uppsats var att designa och bygga en fungerande prototyp av en robot som kan göra allt detta av sig själv dvs. sopa tennisbanan och sedan de vita linjerna. Budgeten för komponenter till prototypen var begränsad till 1000 SEK. Verktyg och andra resurser så som 3D-skrivare, lödutrustning och laserskärare tillhandahölls av KTH gratis. Det första som gjordes var att samla information och inspiration om självkörande bilar och olika körmönster och några viktiga källor var gamla kandidatexamensuppsatser. Sedan kunde nödvändiga komponenter och dimensioner bestämmas. I detta projekt var huvudkomponenterna en Arduino Uno, två DC-motorer, en L298 H-brygga, en ultraljudssensor, en på/av-omkopplare, AAA-batterier och ett 9 V batteri. Slutsatserna som kunde dras var att roboten kan fungera tillräckligt bra för att borsta en tennisbana med endast en förprogrammerad bana. För att sopa de vita linjerna skulle sensorer dock vara nödvändiga. En annan slutsats var att en robot kan sopa banan på samma tid som det krävs för två personer att sopa varsin halva.

An overview is given of the difficulties surrounding the concurrent jurisdiction of the Labour Court and High Court The main categories of the jurisdictional dispute are identified and systemised. The main branches are those of statutory overlap and interpretation of statutes. Statutory overlap concerns matters remaining from the industrial court era, urgent applications, delict and law of contract. Statutory interpretation mainly involves the interpretation of provisions in the Bill of Rights of the Constitution. An overview of the principles of jurisdiction with respect to the different courts, as well as a brief historical review of the development of such jurisdiction is given. Particular attention is given to the role of fundamental rights in the Constitution. Broad principles are identified whereby the difficulties may be addressed.

Abstract:
This thesis provides a comprehensive analysis of the process by which decisions are made in magistrates' courts as to whether adult defendants charged with either way offences should be tried or sentenced in that court or at the Crown Court. An empirical study of three magistrates' courts in England suggests that a series of piecemeal initiatives geared explicitly towards a policy objective of restricting the number of cases reaching the Crown Court have only had a limited impact because they have failed to become part of the culture of the lay magistracy. It is argued that there is a lack of impetus coming from within magistrates' courts to complete more cases as court participants in general do not appear to acknowledge the validity of that objective. A secondary objective has been the enhancement of consistency between courts when determining which cases can be completed by magistrates in the public interest. The findings of this study suggest that the prime explanation for variations between courts lies in individual court culture and the effect that this has on the working practices of all court participants. It is suggested that most mode decisions are effectively not taken by magistrates, but are the outcome of prior negotiation between lawyers. But this negotiation is conducted within the context of a shared understanding as to which cases that particular court was likely to retain and which were likely to be committed to the Crown Court.

Abstract:
This study examines the factors related to completion outcomes of the East Central Judicial District Drug Court (ECJDDC). The ECJDDC has a 71% graduation rate which far exceeds the national average of approximately 40-45%. The dataset included information on 250 participants who entered the drug court from 2003-2011. Factors included in the analysis include those related to living situation, family situation, socioeconomic status, veteran status, current offense, and prior criminal history in addition to sex, race, and age. Logistic regression determined that the strongest predictors of graduation relate to education, income, employment, and living situation. Policy implications, practice, and future research are discussed with respect to the current results.

Within the framework of the process of constitutionalization of Law, the treatment towards antitrust  regulation is being discussed on the jurisprudential level. An idea has appeared that suggests that deciding against antitrust regulationis  beneficial for companies, but has a negative impact towards societyIn the present article, the author does a comparison between the Peruvian Constitutional Court jurisprudence about antitrust and the jurisprudence of the Supreme Court of the United States, demonstrating that tending towards regulation is harmful for society.The author also raises the question about the reasons for which the Supreme Court of the United States has a clear and defined criteria to decide when it is convenient to regulate antitrust, called “decision theory”, while the Peruvian  Court  has an erratic and unjustified criteria to decide aboutregulation of antitrust.<br>En el marco del proceso de constitucionalización del Derecho, el tratamiento de la libre competencia se ha venido discutiendo a nivel jurisprudencial. Así, ha surgido la idea de que decidir no regu-lar la libre competencia beneficia a las empresas,mas no a la sociedad en general.En el presente artículo, el autor propone una comparación entre la jurisprudencia respecto a la libre competencia del Tribunal Constitucional peruano y la de la Corte Suprema de los Estados Unidos, buscando demostrar que, más bien, tender a la re- gulación es perjudicial para la sociedad.Asimismo, el autor abre la interrogante acerca de las razones por las cuales la Corte estadounidense tiene un criterio claro respecto a cuándo no es conveniente la regulación, mientras que el Tribunal peruano tiene un criterio errático y no justificado para tomar decisiones al respecto.

Abstract:
This thesis is an historical anthropology of the role of the Methodist Church in Fiji, from the arrival of Methodist missionaries in 1830. At that time Fiji was a fragmented society. Fijians lived in villages on various islands, so there was no cohesion within the society. The insertion of Methodism into traditional Fijian society irreversibly changed the society, and this thesis traces the key changes that occurred. The rise to prominence of Chief Cakobau from Bau Island marks the beginning of unification of a fragmented Fiji. He formed the first Fijian government in 1871.The British Colonial authorities and the Methodists were also centrally involved in unification and the development of a national society as they set up structures to govern and evangelise the Fijians. However, the thesis argues that with the arrival of Indo-Fijians as indentured labourers to Fiji in 1879, the seeds of polarisation were planted and Indo-Fijians were left out of the frame of Fijian society. The thesis traces the involvement of Methodism, always in close relationship with the state in the twin processes of unification and polarisation. The coups that have changed the political landscape of Fiji served to alter the relationship between the Methodist Church and the state. A schism occurred in the Methodist Church following the 1987 coup, where violence against some ministers occurred, and the Methodist constitution was suspended. Members belonging to i taukei Methodist hierarchy who insisted on Fijian paramountcy to the exclusion of Indo-Fijians have been separated irretrievably from members of the Methodist hierarchy who believe in an inclusive society irrespective of race. Increasing diversity of socio-economic status allied with hierarchical divides and different interpretations of the Church�s mission have generated conflict in the Church and society at large. Diminution of the power of the Methodist Church in Fiji has occurred since 1987, and there are both internal and external factors at work which continue this trend. The various factors influencing the Church in the present along with its future prospects are discussed.

Abstract:
The past is the prologue. We must understand where we have been before we can understand where we are going. To understand the Blackfoot Nation and how we have come to where we are today, this thesis examines our history through Indian eyes from time immemorial to the present, using traditional narratives, writings of early European explorers and personal experience. The oral tradition of the First Nations people was a multi-media means of communication. Similarly, this thesis uses the media of the written word and a series of paintings to convey the story of the Blackfoot people. This thesis provides background and support, from the artist’s perspective, for the paintings that tell the story of the Blackfoot people and the events that contributed to the downfall of the once-powerful Nation. Abstract:
This thesis is concerned with social inquiry and/or pre-sentence reports in criminal cases. These reports are compiled by probation officers, at the request of the court, to assist the court in reaching an appropriate sentencing decision in some criminal cases. This study takes place against and draws upon a wealth of material that has contributed to what is now a considerable body of knowledge but which has also left gaps in our understanding of the ways in which probation reports are constituted and constructed and the implications of this to the wider administration of justice. Empirical accounts of probation reports have largely consisted of documentary analyses or quantitative data. The inherent partiality of these approaches has meant that reports have been artifically decontextualised from their operational moorings. Probation practice has been theoretically located along a care-control continuum that has reflected the historical evolution of sentencing strategies and state intervention into welfare practice. The aim of this thesis is to present a contextualised account of probation reports. In order to unravel and reveal the processes, philosophies and strategies related to report writing and to address the impact of these in the judicial arena, the study was conducted from a grounded observational perspective that acknowledges the complexities of report compilation at the interactive, organisational and systems levels. In adopting this approach it is clear that the care-control model that has been applied to other areas of probation practice is not necessarily conducive to the practice of report compilation because whilst it applies to the role of the probation officer in relation to supervising offenders, it is not readily transferable to the relationship that exists between report writers and sentencers. This relationship is extremely important to both the impact and the content of reports, to the extent that the offender becomes incidental. as opposed to central, to the final document if not to the process. I suggest therefore that, whilst different areas of probation practice are not mutually exclusive, probation reports might be understood in terms of a role-function model. The role of the report writer and the function of the report emanate from an historical context that continues to have an impact on contemporary probation practice but which has rarely been the object of study at an operational level. This thesis attempts to redress the theoretical and empirical balance by adopting a qualitative approach that incorporates an historical perspective into the analysis.

This case study examines a Philadelphia suburban school district, Lower Merion, and its failures to substantively integrate African-American students in the 21st century. Through a close analysis of the high school's basketball program, largely funded and popularized by Lower Merion alumnus Kobe Bryant, this case study exposes how extracurricular programs structure unequal expectations for African-American students in otherwise "excellent" public schools. By using oral history and local archival materials, Winning off the Court examines an all too common issue across modern American suburbia: public schools failing their minority populations while still purporting to be successful on a national scale.

This research examines the Supreme Court's agenda setting behavior. Specifically, I examine the impact of the external environment on the Supreme Court's certiorari process. It is hypothesized that the Court's behavior during this process is conditional upon: 1) its ideological relationship to Congress and the public, and 2) the types of issues before the Court. I argue that the Court behaves strategically, and that as the Court's ideological distance from other actors increases, it will be more likely to structure its agenda in favor of issues that fall within the Court's domain. Conversely, it is argued that the Court would be less likely to focus on issues within the congressional domain as this distance increases. The results indicate that the Court is engaging in strategic behavior in that the agenda setting process is contingent upon issue type, the Court's relationship to Congress, and the Court's relationship to the public.

Cette étude consiste à embrasser dans un même mouvement les différents récits courts stendhaliens. Elle s'articule en cinq temps. Les trois premiers moments consistent à analyser, séparément, les anecdotes, nouvelles et récits inachevés stendhaliens. Une fois ces différentes typologies établies, l'étude se focalise sur la notion d'énergie, dénominateur commun de l'ensemble des récits courts composés par Stendhal. Enfin, le dernier chapitre cherche à montrer aussi bien la portée que la place de ces textes hétérogènes dans le vaste ensemble de la création stendhalienne. L'un des principaux intérêts de ce travail est de réhabiliter des textes qui, pour des raisons aussi bien génériques qu'éditoriales, n'ont pas encore été l'objet d'une étude exhaustive. Notre réflexion vise également à montrer tout à la fois la permanence et l'unité du genre bref dans l'œuvre de Stendhal, malgré l'existence d'indéniables différences entre les textes. Notre étude établit également une continuité entre récits courts et récits longs, ce qui permet de mieux comprendre des phénomènes stendhaliens aussi essentiels que l'inachèvement, la réécriture ou encore l'intertextualité<br>This study is to embrace in the same movement the various short stories Stendhal. It is divided into five times. The first three stages are to analyze separately the anecdotes, news stories and unfinished Stendhal. After these established typologies, the study focuses on the concept of energy, the common denominator of all short stories composed by Stendhal. The last chapter seeks to show both the extent that instead of these heterogeneous texts in the broad set of Stendhal's creation. One of the main interests of this work is to rehabilitate texts that, for reasons both generic editorial, have not yet been subject to a comprehensive study. Our thinking is also intended to show the permanence and unity of the short kind in Stendhal's work, despite the undeniable existence of differences between the texts. Our study also establishes continuity between short stories and long stories, allowing a better understanding of phenomena as essential as Stendhal incompleteness, rewriting or intertextuality

Wir können Mathematikleistungen über fluide Intelligenz (FI) vorhersagen. Der Einfluss von FI auf kognitive Prozesse und neuronale Mechanismen, die mathematischen Fähigkeiten in verschiedenen Teildisziplinen zugrunde liegen, ist jedoch wenig verstanden. Vorliegende Arbeit spezifiziert FI-bezogene Unterschiede in diesen Prozessen und Mechanismen beim Lösen von Geometrie-, Arithmetik- und Algebra-Aufgaben. Mithilfe eines multimethodalen Ansatzes beleuchtet sie das Zusammenspiel zwischen FI, Leistung und Faktoren wie Aufgabenkomplexität, Lernen und Strategiewahl, die kognitive Prozesse und Anforderungen beim Problemlösen beeinflussen. Leistungsunterschiede wurden durch Messung von Reaktionszeiten und Fehlerraten, Strategien durch Augenbewegungsanalyse erfasst. Als Indikator kortikaler Aktivität diente die ereigniskorrelierte (De-)Synchronisation (ERD/ERS) im Alpha-Band. Um kognitive Prozesse zu unterscheiden, haben wir die ERD/ERS im Theta-Band und den Alpha-Unterbändern einbezogen. Beim Lösen unvertrauter geometrischer Analogien zeichnete sich hohe FI durch verstärkte Verarbeitung visuell-räumlicher Informationen zum Repräsentieren von Merkmalszusammenhängen aus. Schüler mit hoher FI passten ihre Strategiewahl den Anforderungen flexibler an. Erstmals konnten wir durch trialweise Identifikation von Strategien FI-bezogene Unterschiede in der neuronalen Effizienz der Strategieausführung feststellen. Beim Lösen vertrauter arithmetischer und algebraischer Terme zeigten sich bei Schülern mit hoher im Vergleich zu Schülern mit durchschnittlicher FI geringere Anforderungen zur Aktualisierung numerischer Repräsentationen und eine bessere Leistung in komplexen Aufgaben. Weitere Analysen legen nahe, dass Schüler mit hoher FI Zusammenhänge in der Aufgabenstruktur besser erkennen und passende Routinen abrufen können. Die Fähigkeit Zusammenhangsrepräsentationen zu bilden könnte demnach ein Schlüsselaspekt zur Erklärung FI-abhängiger Unterschiede in mathematischen Fähigkeiten sein.<br>Fluid intelligence (FI) is a strong predictor of mathematical performance. However, the impact of FI on cognitive processes and neural mechanisms underlying differences in mathematical abilities across different subdivisions is not well understood. The present work specifies FI-related differences in these processes and mechanisms for students solving geometric, arithmetic, and algebraic problems. We chose a multi-methodological approach to shed light on the interplay between FI, performance, and factors such as task complexity, learning, and strategy selection that influence cognitive processes and task demands in problem-solving. We measured response times and error rates to evaluate performance, eye movements to identify solution strategies, and the event-related (de-)synchronization (ERD/ERS) in the broad alpha band as indicator of general cortical activity. Further, we considered the ERD/ERS in the theta band and the alpha sub-bands to distinguish between associated cognitive processes. For unfamiliar geometric analogy tasks, students with high FI built relational representations based on a more intense processing of spatial information. Strategy analyses revealed a more adaptive strategy choice in response to increasing task demands compared to students with average FI. Further, we conducted the first study identifying strategies and related cortical activity trial-wise and thereby identified FI-related differences in the neural efficiency of strategy execution. For solving familiar arithmetic and algebraic problems, high compared to average FI was associated with lower demands on the updating of numbers leading to a better performance in complex tasks. Further analyses suggest that students with high FI had an advantage to identify the relational structure of the problems and to retrieve routines that match this structure. Thus, the ability to build relational representations might be one key aspect explaining FI-related difference in mathematical abilities.

Drug offenders continue to cost citizens and governments money, while drug courts attempt to rehabilitate offenders and reduce recidivism. The Level of Service Inventory-Revised (LSI-R) is a risk assessment tool used by courts and probation offices to determine needs and risks of offenders, and often determine levels of supervision. The purpose of this quasi experimental study was to determine if there is a statistically significant association between the initial LSI-R scores of offenders entering drug courts and their successful completion of the drug court program. Therapeutic jurisprudence theory, the theoretical framework for this study, suggests that the courts and the law are therapeutic to people and that drug treatment will promote positive behavior changes for the offenders. Data for this study were acquired from a database provided by a Kansas drug court, including initial LSI-R scores, completion records, and demographics of 210 drug court participants. A one-way ANOVA was used to test the hypotheses. Significant statistical results were found, indicating that drug court success was positively associated with the LSI-R score. The study may lead to social change by providing information about participants, most likely to benefit from drug court programs, which will save governments money and make room in the programs for more successful candidates, thus producing more productive citizens in the community.

Indaga-se se existe, atualmente, equivalência entre a função exercida pelo Poder Moderador durante o Império e alguma das funções constitucionalmente designadas aos três poderes da República. Acredita-se que exista uma abertura à tendência moderadora no conjunto de competências do STF, revelada pela jurisprudência da corte. Compreendendo o direito como atividade de construção da ordem jurídica, o estudo alinha-se à vertente das pesquisas jurídico-descritivas. Promove um processo de inferência, não-dedutivo, que considera além dos próprios textos analisados, os respectivos contextos. A oposição entre as formas de governo permite compreender o sentido expansivo do conatus de uma comunidade política que se pretende democrática. O constitucionalismo, sobretudo na sua versão moderna, conhece conformação alternativa à clássica tripartição das funções estatais, na qual o Poder Moderador desponta como elemento central da estabilidade política. A recuperação do passado institucional brasileiro permite compreender tanto a dimensão da concentração do poder de decisão, reinserida no arranjo atual através do sistema de última palavra; quanto a perspectiva antidemocrática que se inscreve na sobredeterminação dos poderes constituídos à prática política não-representativa. A inter-relação entre as diversas matrizes de controle de constitucionalidade torna o sistema brasileiro uma criação singular, de onde despontam tendências moderadoras de marcas schmittianas, ressaltadas pelo dever de autocontenção e pelo discurso competente da corte.<br>This study intends to analyse the constitutionally established limits to the separation of powers at the federal level, especially with regard to the competencies of Brazilian s Supreme Court (BSC). It is asked whether there is, currently, some equivalence between the tasks of the moderating power during the Brazilian Empire and some of the functions constitutionally assigned to the constituted powers. It is believed that there is an opening to the moderating tendency in the BSC competencies, which is revealed by the court s jurisprudence. Methodologically, the theoretical references here applied consist in a dynamic perspective that distinguishes democracy from monarchy and aristocracy thought a difference of directions. In a democracy the desire to govern is open to fulfilment meanwhile in the other forms of government this desire remains captive. In fact, this methodological approach proposes the reconstruction of a system of analytical concepts based on contemporary constitutional theory in order to understand the role play by the BSC. The Brazilian judicial review system is a unique creation, from which emerge a moderating tendency with autocratic trends, highlighted by the self-restraint duty and the court s competent speech, whereby it calls itself the constitutional authority empowered to arbitrate institutional quarrels, interpreting, above all, its own constitutional competencies.

Thesis (MPhil)--Stellenbosch University, 2003.<br>ENGLISH ABSTRACT: Violence against women is a serious offence. Emotional and physical abuse can happen to our daughters, sisters and wives. Rape is a form of violence against women. It violates a woman's privacy, dignity and it makes her feel as if she has lost control. The criminal justice system is there to protect the citizens of a country and this protection should extend to women when they have been violated. The criminal justice system has different structures, for example the courts, medical services and police services. The staff of the criminal justice process do not have an inherent duty to care about rape survivors but they can be trained to treat survivors with consideration and sympathy to counteract the effects of the rape and secondary victimization experienced by rape survivors. It is important that there are guidelines for the staff of the criminal justice system to assist them in rape cases. This thesis explores whether women experience secondary victimisation during court proceedings. To assess whether it occurs, court transcripts were analysed with a focus placed on the background of the court case and the verdicts of the judges. Findings indicate that secondary victimisation do occur during court cases. Rape survivors feel as if they are on trial and not the rapist. Survivors furthermore believe that they will have to live with the label that they had been raped and humiliated. The thesis recommends that officials of the criminal justice process should receive extensive training, and looks at the Sexual Offences Court in Wynberg as an example of an improved system for rape survivors. It is recommended that the procedures of the Sexual Offences Court should be evaluated on a regular basis to address secondary victimisation problems that may persist. Communication is very important during the rape trial. The rape survivor has to be informed about her case and about the location of the rapist at all times.<br>AFRIKAANSE OPSOMMING: Geweld teen vroue is 'n ernstige oortreding wat plaasvind in ons samelewing. Die lede van die Kriminele Sisteem werk met verskillende individue wat voel dat die hof die uitweg sal wees wat geregtigheid sal laat geskied. Die lede van die Kriminele Sisteem het nie 'n persoonlike verantwoordelikheid teenoor die verkragtings oorlewendes nie, maar hulle moet sensitiwiteit en empatie betoon teenoor die dames wat verkrag was. Die gedrag van die personeel speel 'n groot rol in terme van hoe die vrou wat verkrag was die aangeleentheid verwerk. Die verskillende lede van die Kriminele Sisteem moet gedurig opleiding verkry wat hulle in staat sal stel om die gevoelens van die slagoffers in ag te neem. Die howe wat spesiaal opgerig is om verkragting sake te verhoor moet geevalueer word sodat dit 'n sukses kan wees. Kommunikasie moet bevorder word tussen die verskillende departemente en nie -regerings organisasies wat 'n rol speel gedurende die hof sake.

Dans le cadre de l'usinage des aciers austenitiques en coupe orthogonale, les aspects micro et macroscopiques sur les differentes zones d'action de l'outil sur le materiau ont ete etudies. A l'echelle microscopique, une analyse fine des mecanismes physiques intervenant dans la generation du copeau et en surface de piece usinee est effectuee. Un modele micromecanique permet de relier les mecanismes microscopiques de deformation de la matiere a la sollicitation mecanique macroscopique imposee par la coupe. Les aspects macroscopiques lies a la generation de chaleur induite par la coupe sont egalement envisages. Une technique de determination des temperatures de coupe par imagerie ccd-infrarouge est utilisee pour etudier le role associe a l'utilisation des revetements d'outils et l'influence des proprietes du materiau usine sur la nature des transferts thermiques dans la zone de coupe. Les resultats experimentaux sont confrontes a un modele simplifie de simulation thermique de la coupe et a un modele analytique. L'identification des parametres d'une loi de comportement du materiau en sollicitations dynamiques est utilise dans un critere analytique permettant de decrire l'apparition des instabilites plastiques dans la zone primaire de cisaillement. Une description des etats d'ecrouissage et de contraintes residuelles (integrite de surface) a ete conduite et des idees d'interpretation des causes de ces contraintes sont proposees.

Abstract:
Drug courts have become an important part of adult and juvenile corrections. Since the establishment of the first adult drug court in 1989, the therapeutic court model has developed, and can now be considered a significant component in American criminal justice. The problem is adult drug courts have faced considerable disapproval in the area of evaluation and documentation. Through the Bureau of Justice Assistance (BJA), the federal government allots millions of dollars to support drug court programs; there have been attempts to count and record the activities of these programs with little success, there is little uniform data on actual drug court success nationwide. The intent of this dissertation was to systematically and critically analyze drug court evaluations. My major goal was to demonstrate the need for uniformity in regards to assessing the impacts on outcomes. I analyzed drug court evaluations and their attempt to identify factors that contribute to graduation, in-program recidivism/ retention rates, drug treatment relapse and postprogram recidivism rates. Forty drug court evaluations were used in this examination. Further, I introduced a model that will aid in examining the impacts on outcome. My studies' unit of analysis is the evaluation report. I attempted to explain specific issues, such as how well drug courts work for different types of offenders. I was also able to generate a well founded policy recommendation for the evaluation of drug courts based on empirical data and literature. Conclusions show that Drug Courts do reduce post-program recidivism however there were certain impacts on graduation and termination rates. I also demonstrated the need for more methodologically sound and uniform evaluations in order to determine effectiveness.<br>Ph. D.

<p> This project analyzes a long-neglected dimension of Early Modern Peninsular Studies: court theater. My thesis explores theoretical, political, and scenographic frameworks of court drama written for and produced in the court of Carlos II of Spain. I explore the notions of imagined communities and agency in order to understand how the theater functioned within the Habsburg court, and I juxtapose the role of the king as a spectator to that of the individual consumer of the public theater to confirm it is possible not to identify as part of the mass public during theater consumption. From there, my archival research exposes the political conflicts during the 1670s between Queen Regent Mariana of Austria and her illegitimate step-son, Don Juan Jos&eacute;, as their opposing factions vied to dominate the terrain of courtly politics in Madrid. My research investigates how these tensions were reflected in the 1670s works: <i>La estatua de Prometeo</i> and <i>Fieras afemina amor</i> by Pedro Calder&oacute;n de la Barca. This then led me to consider the political anxieties around the topic of succession in the 1690s as well. I illustrate that Francisco Antonio de Bances Candamo&rsquo;s political trilogy offered viable options for an heir through his presentation of what I term the nephew-king paradigm. My research illustrates how politics and royal theater production in the 1670s and 1690s were linked due to theater&rsquo;s status as a facet of the royal Baroque identity. My project concludes by establishing court drama as its own genre through an investigation of court performance, the scenographic advancement, and the musical evolution in Baroque Spanish court drama&mdash;a highly original artistic genre in seventeenth-century Spain. I establish staged performance as malleable and trans-dynastic as it outlasts the performance of the monarchs for which the work was staged. Ultimately, this project proves that theater is a part of royal Baroque Spanish identity. </p><p>

The aim of this thesis is to discuss and develop the Unified Patent Court project to account for the role it could play in implementing judicial specialisation in the Intellectual Property field. To provide an original contribution to the existing literature on the topic, this work addresses the issue of how the Unified Patent Court could relate to the other forms of judicial specialisation already operating in the European Union context. This study presents a systematic assessment of the not-yet-operational Unified Patent Court within the EU judicial system, which has recently shown a trend towards being developed outside the institutional framework of the European Union Court of Justice. The objective is to understand to what extent the planned implementation of the Unified Patent Court could succeed in responding to the need for specialisation and in being compliant with the EU legal and constitutional framework. Using the Unified Patent Court as a case study, it is argued that specialised courts in the field of Intellectual Property have a significant role to play in the European judicial system and offer an adequate response to the growing complexity of business operations and relations. The significance of this study is to analyse whether the UPC can still be considered as an appropriate solution to unify the European patent litigation system. The research considers the significant deficiencies, which risks having a negative effect on the European Union institutional procedures. In this perspective, this work aims to make a contribution in identifying the potential negative consequences of this reform. It also focuses on considering different alternatives for a European patent system, which could effectively promote innovation in Europe.

Depuis l’abolition de la monarchie absolue en 1932, le royaume a connu des situations politiques variées : les activités « contre-révolutionnaires » des royalistes ; l’arrivée au pouvoir des militaires ; l’émergence de nouvelles classes politiques ; les massacres de civils ; les compromis entre les militaires, les royalistes et les progressistes ; l’incertitude sur l’avenir du royaume et de la couronne... L’échec de la transition démocratique thaïlandaise est expliqué généralement par un argument convenu : l’immaturité de la société thaïlandaise ; la démocratie libérale de type occidental ne serait pas appropriée pour le pays, notamment pour des « pauvres ruraux ignorants » ; l’armée est le seul acteur capable d’encadrer le développement d’une démocratie. Pourtant, cette étude présente une explication alternative ; elle démontre que la vie politique du royaume est déterminée par trois axes du pouvoir : les élites traditionnelles, dont la monarchie, l’armée et la haute fonction publique ; c’est cette situation qui explique l’échec du progrès démocratique. Et le coup d’État est la méthode préférée pour protéger le statu quo ; quant à la constitution thaïlandaise est semblable à une « lettre morte » ou à un « instrument de la politique au quotidien » ; elle ne représente plus la norme suprême qui exprime l’idéologie politique du pays ; au contraire, elle est utilisée non seulement pour légitimer a posteriori un coup d’État, mais également pour défendre la domination politique des groupes dominants. Nous pouvons donc conclure que le coup d’État thaïlandais est déclenché par l’armée royale avec l’appui de la monarchie et son réseau de conseillers ; puis, il est justifié par le roi et le judiciaire, en assurant l’impunité de ses auteurs par les lois et la constitution<br>Since the abolition of absolute monarchy in 1932, the kingdom has experienced the various political situations: the ‘counter-revolution’ of the royalists, the dictatorial regime, the emergence of the new middle classes, the massacres of civilians, the political compromise, the uncertainty about the future of the kingdom and the crown… The failure of a transition to democracy is usually explained by the usual arguments: the political immaturity of Thai society, the ‘Western-style liberal democracy’ would not be appropriate for the country especially for ‘the ignorant masses’, the army is the only actor, who capable to promote democracy. However, this study presents an alternative explanation. It demonstrates that the political life of the kingdom is determined by three axes of power: traditional elites, including the monarchy, the army and the senior civil servant. It is this situation that explains the failure of the democratic process. And the coup is the traditional method to protect their status quo. As for the constitution, it is similar to a ‘dead letter’ or an ‘instrument of everyday politics’. It isn’t represented as supreme norm that expresses the country’s political ideology. On the contrary, it is used not only to legitimize a coup, but also to defend the political domination of the traditional elites. We can conclude that the Thai coups are triggered by the royal army with the support of the monarchy. Then, justified by the king and the judiciary, and assuring the impunity by the laws and the constitutions

This paper comparatively compares compliance to the rulings of the United States Supreme Court and the ECJ by the state/member state courts. Besides comparing the compliance to the two courts judgements, the paper also tries to establish how to increase compliance with these rulings in the future. This is done because compliance is an important aspect of a functioning judicial system, and a comparison might reveal solutions from one side that could be utilized on the other. The main resources used in this book are: articles, books, webpages and statistics on the subject. The main focus lies on the legal approach, but as a comparative study, elements of political science have been used as well. The results of the comparison show that although statistical compliance is quite high, the actual compliance might be lower due to lack of knowledge or political divisions. Increasing the actual compliance is then a good strategy to be sure that lower courts follow the rulings correctly. The conclusion of this paper is that political and policy divisions in a country, or between an organization and its members results in non- compliance. Reducing this kind of friction will help increase compliance to decisions, not only statistically but also in practice, as the lower courts will feel more comfortable with the rulings. An increase of knowledge of the subject, and the development of efficient judicial mechanisms in a state will also help assure correct interpretation of the rulings.
