Abstract:
The ArgumentCarl Gottfried Neumann was born in Königsberg, Prussia, in 1832 and died in Leipzig in 1925. His father was the physicist Franz Neumann (1798–1895), notable for his contributions not only to the study of electricity and magnetism but also to the development of physics education in nineteenth-century Germany. Carl Neumann studied at the University of Königsberg and received his doctorate in 1855 with a work on the application of elliptic integrals to mechanics (Neumann 1856). In 1858 he became Privatdozent, and in 1863 Professor of Mathematics at Halle. Later that same year he moved to Basel, and in 1865 he became Ordinary Professor of Mathematics at Tübingen. Finally in 1868 he was appointed Professor of Mathematics at Leipzig, a post he held until he retired in 1911; of the two mathematics professorships at Leipzig, this was the one formerly held by F. A. Möbius, and it was officially devoted to “the higher mathematics, especially physics” (quoted in Jungnickel and McCormmach 1986, 1:181). So Neumann's academic career, along with his role as one of the founding editors of the Mathematische Annalen beginning in 1869, can be seen as reflecting the enormous advance in mathematical sophistication that German physics underwent in the latter part of the nineteenth century.

Este artigo discute a visão de poder constituinte de Antonio Negri à luz da teoria do direito de Franz Neumann. O texto apresenta as características essenciais do constitucionalismo e a sua crítica por Negri (2015) no livro O Poder Constituinte. Para Negri (2015), o constitucionalismo tem como função central impedir a transformação social radical por meio da con- tenção do poder constituinte. A seguir, o texto discute essa crítica à luz de Franz Neumann (2009; 2013) procurando mostrar que nem toda transformação radical é necessariamente progressista, especialmente se deixar de lado algumas garantias presentes na tradição do constitucionalismo.

Abstract:
Este artigo apresenta a construção conceitual de Franz Neumann elaborada no texto “O conceito de liberdade política”, cuja finalidade principal é diferenciar poder e dominação. Para Neumann, a teoria política deve consistir em uma reflexão sobre a efetivação da liberdade em formas legítimas de poder, as quais se caracterizam por garantir a efetivação da liberdade humana. A liberdade, na visão do autor, é composta de três elementos historicamente construídos, o jurídico, o cognitivo e o volitivo, os quais permitem identificar seis patologias da liberdade que resultam da valorização excessiva ou da desvalorização de cada um de seus elementos; respectivamente, autarquia e legalismo, medo e naturalização, alienação e voluntarismo. Com a utilização deste aparelho conceitual Neumann analisa problemas políticos concretos como o Macartismo que marcou os Estados Unidos dos anos 1950.

En el presente artículo nos proponemos explicitar cuáles son las principales características que Franz Neumann –autor del círculo “externo” de la primera Teoría Crítica– le atribuye a la dominación socio-política. Para abordar esta cuestión es necesario reseñar algunas de las principales tesis de su clásico libro sobre el nacional-socialismo titulado Behemoth, prestando especial atención a su análisis relativo a la destrucción de la racionalidad jurídica. Nos interesa, puntualmente, responder a la siguiente pregunta: ¿hay en su propuesta una concepción de dominación que presuponga, además de coerción, consentimiento y participación de los grupos dominados? Para poder dar cuenta de las distintas aristas que detenta este interrogante, consideramos necesario retomar los aportes que hace Axel Honneth –uno de los tantos teóricos contemporáneos que instan a recuperar los estudios de Neumann– en su libro Crítica del poder, donde hace mención a la existencia de “relaciones bilaterales de dominio”. Aquí veremos que Neumann ofrece precisiones para responder al problema de la “dominación bilateral” –así lo llamaremos–, pero con limitaciones nada desdeñables. Limitaciones que, y ésta es una sugerencia que haremos al final del artículo, podrían sortearse a partir de un diálogo más abarcador que involucre a otros miembros del círculo “externo”

The English version of this article was first published in 1957. The journal tripleC: Communication, Capitalism & Critique republished it 60 years later in 2017. In this essay, Franz L. Neumann discusses the role of anxiety in politics. The article asks: How does it happen that the masses sell their souls to leaders and follow them blindly? On what does the power of attraction of leaders over masses rest? What are the historical situations in which this identification of leader and masses is successful, and what view of history do the men have who accept leaders? For answering these questions, the author suggests a combination of political economy, Freudian political psychology, and ideology critique. He sees anxiety in the context of alienation. Alienation is analysed as a multidimensional phenomenon consisting of economic, political, social and psychological alienation. Neumann introduces the notions of Caesaristic identification, institutionalised anxiety and persecutory anxiety. He obtained a doctoral degree in legal studies at the University of Frankfurt with the dissertation „Rechtsphilosophische Einleitung zu einer Abhandlung über das Verhältnis von Staat und Strafe“ (A Legal-Philosophical Introduction to A Treatise on the Relationship between the State and Punishment). Neumann became the German Social Democratic Party’s (SPD) main legal advisor at a time when the Nazis and Hitler gained strength in Germany. At the time when Hitler came to power in 1933, the legal office had to be closed and Neumann had to flee from Germany. In London, he in 1936 obtained his second doctoral degree from the London School of Economics with the work “The Governance of the Rule of Law” under the supervision of Harold Laski and Karl Mannheim. Neumann moved to New York in 1936, where he became a member of the Institute of Social Research (also known as the “Frankfurt School”) that was then in exile in the USA. In 1942, he started working for the Office of Strategic Service (OSS), where he together with Herbert Marcuse and Otto Kirchheimer analysed Nazi Germany. In 1942, Neumann published his main book is Behemoth: The Structure and Practice of National Socialism, 1933–1944 (2nd, updated edition published in 1944), one of the most profound analyses of Nazi Germany’s political economy and ideology. Franz L. Neumann died in 1954 in a car accident.

Reflecting on his academic exile in the United States, the Germanpolitical scientist Franz L. Neumann emphasized the cross-fertilizationof ideas as a result of the confrontation of different scientific andpolitical cultures.1 According to Neumann, the migration of hundredsof European academics to the United States led to a growinginternationalization of the social sciences and a two-way learningprocess. The Europeans became accustomed to the practice of theAmerican liberal democracy and learned to value its political culture;émigré scholars, on the other hand, brought with them a differentacademic Denkstil and contributed to a more critical self-understandingof American democratic theory.

Le concept de totalitarisme élaboré par Hannah Arendt à partir de 1951 est aujourd'hui une référence incontournable. Son examen critique, ici proposé, commence par resituer cette théorie arendtienne dans l'histoire des idées juridiques. Ce faisant, il apparaît que non seulement la terminologie, mais également une partie des arguments et des conclusions de la philosophe ont été élaborés dès les années 1920 par la doctrine juridique, aussi bien anti- que pro-totalitaire.Dans un second temps, la théorie du droit, qui a nourri les réflexions de Hannah Arendt, est utilisé comme un instrument pour la critique. En particulier, la thèse la plus polémique défendue par la philosophe - à savoir qu'il n'y eut que deux régimes totalitaires, l'Allemagne nazie et l'Union soviétique – ne résiste guère à l'examen juridique et théorique.À travers ce dialogue historique et critique entre le droit et la philosophie, cette thèse interroge l'idée d'un droit totalitaire, qu'il s'agisse de sa nature, de ses conditions de possibilité ou de sa distinction avec l'Etat de droit<br>The concept of totalitarianism developed by Hannah Arendt from 1951 is a major reference today. Its critical review, proposed here, begins by re-placing this arendtian theory in the history of legal ideas. In doing so, it appears that not only the terminology, but also some of the arguments and conclusions of the philosopher were developed from the 1920's by the theory of law, anti- and pro-totalitarian as well.In a second step, the theory of law, which nourished Hannah Arendt's reflections, is used as an instrument for criticism. In particular, the most controversial thesis defended by the philosopher - namely, that there were only two totalitarian regimes, Nazi Germany and the Soviet Union - can hardly withstand a legal and theoretical scrutiny.Through this historical and critical dialogue between law and philosophy, this thesis questions the idea of a totalitarian law, its nature, its conditions of possibility and its distinction with the rule of law

Franz Neumann (1900-1954), teórico do direito ligado ao Instituto de Pesquisas Sociais de Frankfurt, discorda desse ponto de vista. Esta tese examina seus escritos da década de 30, especialmente O Império do direito (1936), para mostrar que o autor vê potenciais emancipatórios no direito liberal, num debate com o conceito de materialização do direito de Max Weber. Estes potenciais nascem da práxis parlamentar da classe trabalhadora e do advento do nazismo e se referem à possibilidade de o direito expressar a vontade da sociedade, inclusive o objetivo de controlar os meios de produção. Além disso, a tese mostra que o potencial emancipatório do direito não deve ser avaliado em abstrato, mas conforme um determinado diagnóstico do tempo. Franz Neumann (1900-1954), a law theorist of the Institute of Social Research in Frankfurt, disagrees with this point of view. This Thesis examines his writings from the 30¿s, especially The rule of law (1936) to show how he sees liberal law as potentially emancipatory, engaging to a debate with Max Weber¿s concept of Law materialization. This potential emerges with working class parliamentary praxis and with the Nazism, and refers to Law¿s capacity to express social will, even the aim to control the means of production. Furthermore, this Thesis argues that Law¿s emancipatory potentials should not be evaluated in abstract, but in the context of a diagnosis of the time. Abstract:
Both after World War I and during World War II Franz L. Neumann confronted the question of how to bring about a genuine democratization of Germany. In both instances he advocated an economic and social revolution in theory but in practice he acquiesced in the failure of the revolutionary forces. The inconsistencies in Neumann's theoretical works, his double emigration and his passage through the Office of Strategic Services witness the German-Jewish socialist's revolutionary dilemma and the cycle of repetition-displacement that both sustained and trapped him in his troubled position. The trademark of the OSS Research and Analysis Branch, which was to misrecognize a stylistic "neutrality" for an institutional one, suited Neumann's emigration tactic of fighting a political battle under the cover of scholarly discourse. At the same time, with that he accepted a neutralization of his "radical" agenda for post-war German de-nazification and re-democratization.
