AbstractThis contribution deals with a manuscript, containing lecture notes made in 1827–1828 by a Ghent student named Callenfels and relating to the lectures on ius publicum universale et Belgicum, given by Jacob Joseph Haus (1796–1881), professor of jurisprudence at Ghent University and native of Würzburg. As the course programme of the law faculties in the southern provinces required courses in natural law as well as in ius publicum and ius gentium, the assumption has been put forward these lectures would be restricted to the ius publicum universale such as lectured in many German law faculties in the 18th century. On further examination of the manuscript under consideration this presumption proves to be wrong. After the first 13 sections, which refer in fact to the ius publicum naturale in an enlightened sense, the remaining 253 sections outline the then positive constitutional law of the Netherlands, mainly on the basis of the Dutch written constitution of 1815.

This is the written form of a lecture delivered at the Law Faculty on 28 April 2010 by Justice Baragwanath as part of a series of lectures delivered the various New Zealand law schools, to mark the judge's retirement from the New Zealand Court of Appeal. In this lecture the judge argues for the creation of a New Zealand public law that both acknowledges the special nature of New Zealand society and recognises the global context within which all New Zealand law must now fit and to some extent must be judged.

Abstract:
For decades, both economists and legal scholars have regularly used the metaphor of a ‘bundle of rights’ to describe property. In recent and growing literature, the bundle formulation has been the target of a number of critiques, some of which point to Adam Smith, among others, as a source for an alternative perspective on property. This paper examines Smith's work and argues that Smith is an appropriate authority and focal figure for a traditional, in-rem view of property. It illustrates how Smith's usage of concepts in the civil-law tradition, his appreciation for Hume, and especially his unique theory of the impartial spectator, together make clear that Smith's understanding of property is irreconcilable with the modern bundle formulation.

Abstract:
The present study analyzes a little explored work of Adam Smith: his Lectures on Jurisprudence, understanding it as a "bridge" between his Moral Philosophy and his Political Economy. We show that Smith states in Theory of Moral Sentiments some tensions facing the sympathy once the bonds of affection between members of the same society began to reveal weak. This lead Smith into the study of Jurisprudence, the study of a society of strangers that need a common identification under a State that imposes rules of justice unveiled by science. In his Lectures on Jurisprudence, Smith finds that the division of labor was the result and the ultimate expression of opulence and freedom of humanity. These conduct him to answer why does the division of labor contribute to opulence and why does the division of labor brings about man’s freedom and these two questions ended in the creation of The Wealth of Nations.

Abstract:
The purpose of this paper is to present an investigation on the relevance of the historical water legislation which would adapt to the modern sustainable water management. It is mainly based on the book by Ernest Feline related to the qanat system in the arid M'Zab valley in southern Algeria. It also refers to some related lectures on the traditional water legislation in the Sahara region and more generally on the Islamic water jurisprudence which does reveal a specific culture perpetuated through a relevant adaptation of al-hisba principles. Subsequently the present paper argues that if updated and adapted, the traditional knowledge can serve current water management issues within the framework of the water sensitive urbanism associated with the integrated water resource management. With this respect the spatial concept called ‘harim al-ma’ and the traditional community actions towards the qanat system can contribute to protecting water quality and improving public health.

The article examines the current state of higher legal education in Russia in the context of the transition to the digital format with the use of distance education technologies. In the XXI century, high-quality training of legal personnel is an effective means of establishing and developing the law-bound state. The authors attempt to analyze certain difficulties in training legal specialists, as well as offer recommendations for improving the quality of legal personnel training in universities. The study suggests new ideas for improving distance learning at the university in the light of the new requirements of the state educational standards of higher education in jurisprudence, which is an integral component of the educational process. Today, educational technologies are undergoing a new rebirth under the conditions of the pandemic spread. Jurisprudence is moving to a new level of creating a digital educational environment where advanced technologies for conducting lectures and practical classes are used remotely, as well as forms of organizing independent work and training students are created.

After three or more decades of mainly positivistic readings of the economics of Adam Smith, there was a decided movement following the bicentennial of the publication of the Wealth of Nations to broaden the agenda of Smithian studies. The publication in 1978 of the Report of 1762–63 of Smith's lectures in jurisprudence added impetus to this movement. In particular, historians of ideas began to pay increased attention to Smith's concern with justice in economic life. That attention has evoked renewed interest in certain of Smith's intellectual antecedents who may have played a part in shaping his ideas, but whose influence has remained a matter of relative neglect in modern scholarship.

Dans la longue histoire du droit civil romain, je cherche le moyen de questionner l'évolution normative des sociétés contemporaines. Pour aider la philosophie politique à mesurer l'effacement des repères classiques de la pensée juridique, je propose de remonter le fil de deux traditions d'étude disjointes. Ma première partie étudie la propension des philosophies idéalistes du droit à ignorer la dimension technique de la pensée juridique. Je montre alors les conséquences ironiques de ce parti-pris : chez Kant la mise en place d'une conceptualité du jugement d'allure nettement juridique ; chez Hegel une valorisation paradoxale du droit romain, tour à tour attaché à la Rome historique et voué à définir ad aeternam la forme abstraite de l'esprit objectif. Consacrée aux interprétations successives du droit romain de la possession, ma seconde partie explore alors la tension entre deux manières d'« habiller les faits », c'est-à-dire de rapporter les catégories juridiques au réel. En confrontant la scolastique médiévale principalement italienne des XIIe au XIVe siècle au Traité de la possession en droit romain de Friedrich Cari von Savigny (1803), je reconstitue les étapes, mais aussi les préconditions philologiques, de l'enrôlement du principe kantien de l'autonomie de la volonté dans la science juridique. Par contraste, je montre l'originalité « ontologique » de la technique juridique médiévale, lorsqu'elle imagine des espèces de possession « plus ou moins factuelles » ou des transferts fictifs de propriété. Dans ces libertés prises avec le réel, j'entrevois la clé d'une analyse à nouveau frais du déclin de la place du droit dans le gouvernement des sociétés contemporaines<br>In Roman law's far-reaching tradition I search for conceptual resources helping to analyse the normative patterns through which contemporary societies are governed. Aiming at refining our theoretical assessment of the décline of classical légal science, I recover and re-read two traditions. First, I examine idealist Systems of légal philosophy and their propensity to ignore the historical dimension of légal techniques. This is shown to have ironical conséquences, when Kant sets himself up as a judge at the tribunal of reason, or when Hegel treats Roman law as both spécifie to the history of ancient Rome and germane to the eternal and abstract form of « objective spirit ». The second part of my research hence turns to the Roman law of possession, a topic which testifies to long-run shifts in the scientific style of légal thinking. In confronting mainly Italian scholastic interprétations of jus possessionis, dating from Xllth to XlVth century, with Von Savigny's Treatise on Possession of 1803, I show how philology and historical érudition were involved in a romantic attempt at embedding Kant's idea of the autonomy of free will into the realm of jurisprudence. As a resuit, médiéval ways of employing légal techniques independently of any external ontological constraint tended to be overshadowed. Whereas glossators felt free to imagine types of légal possessions which were « more or less facts » or to posit fictitious property transfers, I consider this loose attitude towards rèality as a valuable touchstone for analysing law's spécifie part in the government of contemporary society

La population - en son sens originel de processus de peuplement - est un sujet étonnamment absent de l'énorme volume d’études sur Adam Smith. Ce thème était au centre de la philosophie morale et de l'économie politique du 18e siècle, les deux domaines auxquels les contributions de Smith sont les plus connues. Son importance dans l’œuvre de Smith a été obscurcie au 20e siècle par une focalisation étroite sur les questions économiques dans la littérature secondaire. Pour une analyse intégrale de son œuvre, il est essentiel que la place centrale du peuplement soit révélée. Trois thèmes aujourd'hui considérés comme essentiels au projet de Smith sont ainsi intimement liés à la population : le lien entre division du travail et étendue du marché ; la théorie des quatre stades du progrès de la société ; et le lien entre développement rural et urbain, lui-même au centre du plaidoyer de Smith pour la liberté du commerce. Le marché est un concept aujourd'hui assimilé au fonctionnement du système économique capitaliste ; pour Smith, il décrivait la faculté de commercer, aux vecteurs essentiellement démographiques et géographiques. Le progrès de la société est à la fois cause et effet de la croissance de la population. En son sein se trouve l'interrelation symbiotique entre le développement rural et urbain que Smith appelait le «progrès naturel de l'opulence». Adopter l’optique smithienne plutôt que néo-malthusienne dans l'examen des dynamiques de population et de développement - y compris l'analyse de la transition démographique - conduit alors à une reconsidération fondamentale des interactions causales entre mortalité, fécondité, richesse et variables institutionnelles<br>Population - in its original sense of the process of peopling - is a topic surprisingly absent from the huge volume of scholarship on Adam Smith. This topic was central to 18th century moral philosophy and political economy, the two fields Smith most famously contributed to. Its importance in Smith’s work was obscured in the 20th century by a narrow focus on economic matters in the secondary literature. For an undivided analysis of Smith’s oeuvre it is crucial that the central position of the peopling process be brought to light. Three topics that are today recognised as essential to Smith’s project are thus intimately connected to population: the relation between the division of labour and the extent of the market; the stadial theory of progress; and the link between the development of town and country, itself central to Smith’s advocacy of the freedom of trade. The market is a concept read today through an institutional lens linking it to the functioning of the capitalist economic system; Smith conceived of it as facility for trade, with essentially demographic and geographic vectors. The progress of society is both cause and effect of the growth of population. At its core is the symbiotic interrelationship between rural and urban development that Smith called the “natural progress of opulence”. In turn, looking at dynamics of population and development - including the analysis of the demographic transition - through a Smithian rather than a neo-Malthusian lens leads to a fundamental reconsideration of causal interactions between mortality, fertility, wealth and institutional variables

A travers l'analyse de la jurisprudence de la Cour européenne des droits de l'homme sur le cumul des fonctions judiciaires depuis 1979 jusqu'à l'année 2001, deux des principes fondamentaux consacrés par la Convention européenne ont pu être étudiés: d'une part le principe du droit à ce que sa cause soit entendue par un magistrat indépendant au sens;:de, l'article 5 de la Convention et d'autre part, le droit à ce que sa cause soit entendue par un tribunal impartial au sens de l'article 6 de la Convention. Par une méthode originale de lecture des arrêts de la Cour européenne, en ce qu'elle s'attache à prendre systématiquement en compte l'expression des opinions individuelles des juges jointes aux arrêts de la Cour, ont été mises en exergue deux démarches opposées de la Cour dans l'appréciation du cumul des fonctions judiciaires : une démarche in abstracto et une démarche in concreto. Dégageant des principes applicables à l'ensemble des Etats par le biais de l'appréciation in abstracto, dépassant les seules particularités de l'affaire et les contraintes organisationnelles des Etats, la Cour est parvenue à imposer, grâce aux revendications individuelles des juges exprimées dans leurs opinions dissidentes et concordantes, une véritable exigence de non- cumul des fonctions comme garantie de l'indépendance. En revanche, résistant aux revendications de certains juges de faire également du non-cumul des fonctions une véritable garantie de l'impartialité; la Cour a opté, dans ce domaine, pour le choix systématique d'une appréciation in concreto, la conduisant à ne pas censurer les Etats malgré l'existence d'une situation de cumul des fonctions judiciaires propres à jeter un doute sur l'impartialité du tribunal.

La presente investigación versa sobre las resoluciones del Tribunal Fiscal emitidas en los años 2013 a 2015 que resuelven controversias respecto del principio de causalidad del gasto, bajo la hipótesis de que estas no conformaban una doctrina jurisprudencial que contribuya al mejor entendimiento de dicho principio. Para poner a prueba esta última, se propuso un marco conceptual sobre el mencionado principio, de conformidad a la legislación, la jurisprudencia nacional y la doctrina nacional e internacional. Con esa base conceptual, se procedió a la revisión de las resoluciones del Tribunal Fiscal emitidas en los años 2013 a 2015, encontrándose tres criterios recurrentes: el de “vinculación entre el gasto y la actividad empresarial del contribuyente”, el de “obligatoriedad del gasto”, y el de “finalidad y/o destino del gasto”. Tales criterios se contrastaron con el marco conceptual propuesto, con lo cual se pudo concluir que en los años 2013 a 2015 se desarrolló una doctrina jurisprudencial que, en efecto, contribuye a un mejor entendimiento del principio de causalidad del gasto.<br>Tesis

A significant leap in the development of information technology over the past twenty years has made the global legal community respond to new challenges that have come along with the progress in the digital environment. Together with the convenience of using electronic resources, society has developed a need for a simple and understandable legislative regulation of legal relations arising from the use of computer information technologies and various products of electronic digital activity in order to protect their interests potentially. The concept and types of electronic evidence in civil proceedings in different countries have different meanings. Meanwhile, the regulations of their procedural admissibility and applicability differ. The common thing is the tendency towards an increase in the use of electronic information carriers in court proceedings, increasing importance for establishing specific facts, and the decisive evidentiary role in making decisions by the court. India became one of the first countries to realize the growing level of implementation of Internet technologies, electronic digital storage media, and computer dominance in society and the state's daily life [1] (Artemyeva, Y.A. et al.). The consequence of this understanding was the timely development and implementation of the substantive and procedural bases in evidence law for practical, understandable, and convenient use of electronic evidence in civil proceedings. The article examines the types and procedural status of electronic evidence and analyzes the current legislation and law enforcement practice in the admissibility and application of electronic evidence in civil proceedings in India. The study identifies the existing system of electronic evidence in the legal field of India, the determination of the advantages and disadvantages in the gathering, presentation, research, and evaluation of electronic evidence by the court in civil proceedings, as well as the identification of the procedural order for their provision. The researchers have identified the following tasks to achieve the goals: • to define and research the legislation of India governing the concept, types and procedural order of applicability and admissibility of electronic evidence in civil proceedings in India; • to develop a particular procedural order for the effective use of the institution of electronic evidence in civil litigation in India; • to identify the current trends in the gathering, presentation, research, and evaluation of electronic evidence in India's courts, based on the established judicial practice study. The research methodology is based on general theoretical and scientific methods of cognition, including abstraction and specification, analysis and synthesis, modeling and comparison, and systemic, logical, and functional analyzes. The scientific novelty of the research consists of a comprehensive study of the instruments of legal regulation of the institution of electronic evidence in India's legal field, including regulatory legal acts and judicial precedents, and a consideration of the possibility of applying Indian approaches in the jurisdictions of other countries. The analysis of legislation and jurisprudence regarding electronic evidence in India's civil proceedings was carried out using the synergistic principle of object study, statistical-sequential analysis, and empirical research method. This study's results can be used in lawmaking to develop and improve regulations regarding the procedural status and use of electronic evidence in civil litigation in any country. The reference, citation, and use of this article's conclusions and materials are permissible when conducting lectures and seminars on civil procedure and private international law, research activities, law enforcement practice, and teaching.
