Abstract Causa and titulus. Qualifications of possession and a change of terminology in Ulp. D. 5,3,13,1. – In D. 5,3,13,1, Ulpian states that every title to possession (like pro emptore, pro donato etc.) could be accompanied by a general title pro possessore, which becomes decisive if the other title failed. The text is interesting in two aspects: First, it is one of only a handful of classical texts which speak of titulus instead of causa possessionis. Therefore, the text is still today suspected of interpolation. Second, it is heavily disputed which circumstances lead to a possession pro po

AbstractIn German legal literature a theory of so-called 'Nebenbesitz' ('co-ordinate possession') is being discussed since more than half a century. It would be applicable when a detentor, a lessee e.g., makes a delivery constituto possessorio to a new lessor, making him possessor, but goes on paying rent to the old lessor, which would leave this lessor in possession. Both possessors would be co-ordinate possessors. Some authors have been referring to Roman law (D. 41,2,32,1) as though it already knew co-ordinate possession. Since the earliest times of Roman law, possession has passed through the history of law maintaining its status as an institution, and adapting its functions to meet changing social and economic circumstances. Apart from its evidential effect, which is preserved in all legal systems, it must be remembered that the mediaeval maxim en fait des meubles, possession vaut titre applies frequently today, in nearly every country, to trade in movable property, in spite of a certain tendency towards the need for contractual formalities, given further force by legislation on consumer protection. The use of the language of rights as a metalanguage is questionable for it is culturally specific, having developed in the Early Modern period in Europe in the context of the spread of market relations and the growth of contract law. One might ask, how are “rights” expressed and constituted in the indigenous languages? AbstractIt is common for a legal system to allow a person, in certain circumstances, to gain ownership of land by possessing it for a period of time. This is certainly true of both Scotland and England, although what is precisely required for possession to be established may differ on particular points between the two. One point on which the two may differ is the effect of a unilateral permission to occupy that is given to someone currently occupying the land without any right to be there. On what grounds can we justify the transformation of squatters into owners? To understand the moral significance of adverse possession, the author proposes an analogy. Much of the moral analysis of adverse possession has proceeded on the basis that adverse possessors are land thieves. Then, she argues that there is a much closer analogy between adverse possession and revolution or, more precisely, a bloodless coup d’état. But, while virtually everyone accepts that possession of land or chattels is a source of title and that titles are relative, the doctrines have long been a focus of debate. The nature of possession, the nature of the possessor's title, and the relationships between possession, relative title and ownership have been particularly contentious. The analysis of the law is conducted by relying on doctrinal and empirical research methodologies. Furthermore, an increased awareness of community noise issues has proved to be the impetus for investigating and developing more effective noise control methods and treatments for natural gas compressor facilities. This project investigates the feasibility of applying Active Noise Cancellation (ANC) to the exhaust of a large, internal-combustion reciprocating type engine. Large reciprocating internal combustion engines pose significa
