Abstract:
Shape and Thermodynamics is a two-day international Workshop focused on the Constructal Theory of generation of configuration in nature and engineering. From the early developments related to tree configurations for the cooling of electronics, today Constructal theory is being applied to conceptual design of transportation net-works, river basins, living bodies, building materials and many other flow systems. Constructal theory is also enriching thermo-dynamics, from basic theory to design and optimization. This theory approaches design "as science", with the generation of configuration regarded as a phenomenon of all physics, based on principle (the Constructal law). For example, Constructal Theory contributes to the evolution of fuel cells, in the design of cooling channels, the optimal feeding of reactants, etc. Important applications are also found in the design of heat exchangers, district heating networks, etc. The growing scientific literature on Constructal Theory has an important Italian component, although further dissemination is timely. Here we focus primarily on Bayes factors and minimum description length, explaining how these procedures strike a balance between goodness-of-fit and parsimony. This book, on the construction of contracts, explores the legal principles involved in contract formation and interpretation as well as the current trends in commercial contract litigation, providing practical guidance on how courts would interpret contractual terms with reference to recent commercial contract litigation. This third edition gives principle-by-principle coverage of the main elements of contract formation and updates them with reference to recent case law. Recent major construction of contract cases are discussed, including Pink Floyd Music (CA) and the recent UK Supreme Court ruling in the case of Rainy Sky v Kookmin Bank (2011) together with first instance commentary on the role of commercial purpose. The issue of rectification is given expanded coverage in the new edition reflecting the law's state of flux in this area with recent cases such as Daventry (2011), Cherry Tree v Landmain (2012), and Tartsinis v Navona (2015) demonstrating this uncertainty. Recognition of good faith is discussed with reference to Leggatt J in Yam Seng and MSC C Mediterranean Shipping v Cottonex (2015) and Prime Sight v Lavarello (2013) reflects the Privy Council's recent interpretation of the law of contractual estoppel.

The talents and ideas of the new men can be elucidated using contemporary fiction and satire in verse and drama as well as their own writings, notably Edmund Dudley’s Tree of Commonwealth. They valued order and justice, the elevation of royal power, and the promotion of the common weal. Their attachment to the crown was shaped by the common law, their loyalty to the king by chivalry. They were quick to punish treason and to display the king’s badges on their possessions. They were efficient, persuasive, and shrewd. While they did not scorn what ancestry they had, they drew their status more from the positions the king gave them than from their blood. But contemporaries were alarmed by their rise and charged them with ruthless self-advancement and overweening pride.

Because this book’s central claim is that the moral community can authoritatively introduce new moral norms in the course of history, it seems to clash with the claim that all moral truths ultimately trace to eternally true principles of morality. This chapter considers the views of two philosophers whose added assumptions convert this into a real conflict—the seventeenth-century neo-Platonist Ralph Cudworth and the recently deceased Oxford philosopher G. A. Cohen. It challenges Cudworth’s addition to the claim—namely, that the route back can be traced only by reference to the nature of the relevant actions. And it undercuts Cohen’s contribution by reinforcing Thomas Pogge’s point that fact-sensitivity in a principle can reflect due humility rather than a lack of clear-headedness, by endorsing Sarah Moss’s claim that two final ends can contingently support each other, and by neutralizing Cohen’s attempt to disparage fact-sensitive principles as mere rules of regulation.

The Harm Principle maintains that the only legitimate reason for limiting a person’s freedom is to prevent that person from harming others. The Posthumous Harm Thesis maintains that it is possible for an act to harm a person even if the act takes place after the person is dead. If this is true, then acts that might otherwise appear to be harmless may in fact prove to harm someone, and acts that might otherwise appear to be consistent with the Harm Principle might turn out to violate it. One must therefore consider whether posthumous harm is possible. This chapter sets out a three-premise argument in defense of the Posthumous Harm Thesis, considers some of the objections that have been raised against them, and examines ways to overcome these objections. Its goal is to show that the argument for the Posthumous Harm Thesis is considerably more robust than is often thought.

Abstract:
This chapter examines the Cold War experience of composer Aaron Copland. It argues that after suffering at the hands of Senator Joseph McCarthy and his cronies in the early 1950s, Copland reoriented himself. He not only turned away from musical Americanism as a composer but also took advantage of opportunities to tour overseas for the State Department, both to remove the taint of leftism from his image and to politically neutralize the Americanist style. Yet Copland’s Cold War choices were not simply a strategic response to a radically altered political landscape. Both his work with government and his musical works from this period show his enduring commitment to a set of strong personal principles that shaped his compositions, his writings, and his cultural diplomacy work across his long career. Copland’s ability to stay true to what he believed in ensured he never succumbed to cynicism, as did many other members of the Old Left.
