AbstractThe sea areas of Bangladesh are reportedly rich in straddling fish stocks and mineral resources, including hydrocarbons. But a long-standing dispute over maritime boundary delimitation with India and Myanmar remains a major stumbling block in exploration of these resources. The overlapping claims of these three countries over the maritime zones in the Bay of Bengal need to be settled for peaceful exploration of natural resources. While India and Myanmar want to delimit the maritime boundary on the basis of the equidistance principle, Bangladesh demands that delimitation should be based on the equitable method. The special geographical circumstances of the coastal zones of these countries warrant that any delimitation, whether agreed or determined by a third party, must result in an equitable solution. The decisions of the international courts and tribunals, state practice, and the Law of the Sea Convention clearly demonstrate that there has been a shift from the equidistance principle to the equitable principle of delimitation and strongly indicate that the equitable principle is the preferred method of delimitation.

While border areas are usually perceived as peripheral in nature, denoting only a limited level of economic development, it is clear that a border location might also be in a position to offer measurable benefit. In that context, work described here in relation to Poland has focused in on: (1) the delimitation of border areas; and (2) an identification and subdivision of units into those whose location by a state border brings either positive or negative economic consequences. The criterion applied most often in designating border areas is administrative (cf. Kałuski, 1990), with different hierarchical levels referred to (e.g. the NUTS 3 where pursuit of the EU policy on Territorial Cooperation is concerned; or LAU 2 where the need is to designate areas characterised by small-scale border traffic, with account then taken of the criterion of distance of a given administrative unit from the border). Alongside the administrative, a second main criterion relates simply to physical distance from a border, and usually gains application in denoting a zone of particularly intensive scrutiny by the Border Guard and other state services such as the Customs Administration (e.g. in the United States). Use of this criterion actually does much to hinder scientific research, given the lack of concordance with units of administration. Neither of the divisions referred to above embraces real functional linkages, while the real-life zone of impact of a border is likely to be indicated by just such linkages, of a socioeconomic nature, and specific in the sense that other parts of a country do not manifest them (Węcławowicz et al., 2006). Such linkages would seem to offer a basis to determine, first, if border areas actually exist at all, and, second, how they can be delimited in a detailed way, by reference to multiple criteria. It is certain that a key aspect is involved here, as the attempt is made to set the benefits of a border location against the “non-benefits”. But it is clear that attention also needs to be paid to the configuration of internal interactions, as aspects of a border location become all the more unfavourable the more peripherally a given unit is located. Ultimately, it is possible to indicate which border areas are actually problem areas, and to set these apart from other areas by a border whose geographical position ensures that a border represents no barrier to development and/or does not determine peripheral status. For the above reasons, the work presented here does indeed propose a delimitation based on real economic linkage (levels of export), as well as the degree to which regional centres are accessible from the given area. The first stage of the delimitation procedure thus takes in the designation of a border area formed from a belt of Polish communes (LAU 2) “two deep”. A second stage then sees elimination from this set of those units with a favourable location vis-à-vis the nearest regional centre (s), it being assumed that the proximity of these centres helps even out any potentially negative impact of the border; as well as with a high value for the statistic regarding the value of exports to the neighbouring country (the assumption then being that such units benefit from a border location, rather than suffering as a result of it). Units left behind following the application of this procedure were deemed to be border communes of problem status, potentially in need of support if they are to develop. In the event, such units are found to be located primarily along Poland’s borders with the Russian Federation, Lithuania, Belarus and Slovakia (as opposed to Germany, the Czech Republic and Ukraine). Unsurprisingly, it is communes by the Polish-German border that are seen to benefit most from their location. The authors set other divisions and classifications already in effect against the proposal for delimitation which is offered here, along with relevant recommendations for the development of regional policy.

The method for calculation of geodetic problem on earth ellipsoid surface is the basic premise for the realization of high-precision marine delimitation technology. Based on the analysis of the construction principle of the existing solution of geodetic problem method, the algorithm for direct geodetic problem solution(DGPS) based on nested coefficient method and Bessel’s inverse geodetic problem solution(IGPS), which are suitable for various distance solutions, are optimized. Then, the experimental verification scheme of the solution of geodetic problem is designed. Finally, the crossing and reducing accuracy of different calculation examples are verified by different geodetic problem solution methods, and the experiment shows that: the verified accuracy of point-position plotting, distance calculation and azimuth calculation meet the requirements of the indexes of high-precision marine delimitation.

Abstract:
This article is dedicated to the relevant problem of delimitation of the Arctic territories. There are currently several different approaches towards this question, but the effective one is the mechanism proposed by the United Nations Convention on the Law of the Sea. The absence of consensus on delimitation of continental shelf is substantiated by the intersection of interests of the countries in the Arctic region and strategically crucial consequences of dividing the Arctic: this is the matter of national security, geopolitical supremacy, increase of economic potential, energy and environmental security. The goal of this research consists in the analysis of recent achievements and prospects for delimitation of continental shelf. The subject of this article is the problems of delimitation of the jurisdiction of countries in the Arctic region. Methodological framework is comprised of the chronological method and method of analysis. The conclusion is made that the definition of state boundaries in the Arctic is a long process; since the decisions of the Commission on the Limits of the Continental Shelf is of advisory nature, it may lead to the disputes between the countries over the rendered decisions. It should be noted that international law has the essential mechanisms and means for the peaceful delimitation of maritime boundaries in Arctic waters. The author believes that the final definition of boundaries in the Arctic would be achieved through the compromise between the polar countries, and thus signing bilateral agreements without relying on recommendations of the Commission. It is underlined that the conventional principle of delimitation of boundaries in the Arctic Ocean does not meet the national interests of the Arctic Five, and requires a different approach due to the peculiarities of the ocean. The scientific novelty lies in the analysis of existing principles, instruments and problems of delimitation of boundaries in the Arctic, as well as in conclusions formulated by the author. The solution to the outlined problems can become the preservation of the international seabed within the framework of the concept common heritage of mankind in the area of the Gakkel Ridge, and in the area of Lomonosov Ridge delineation by the sectoral principle.

AbstractPractitioners of nematode taxonomy have rarely been explicit about what species represent or how data are being used to delimit species prior to their description. This lack of explicitness reflects the broader species problem common to all biology: there is no universally accepted idea of what species are and, as a consequence, scientists disagree on how to go about finding species in nature. However, like other biologists, nematologists seem to agree that species are real and discrete units in nature, and that they result from descent with modification. This evolutionary perspective provides a conceptual framework for nematologists to view species as independent evolutionary lineages, and provides approaches for their delimitation. Specifically, species may be delimited scientifically by methods that can test the hypothesis of lineage independence. For sequence data, such hypothesis testing should be based on sampling many individual organisms for multiple loci to avoid mistaking tokogeny and gene trees as evidence of species. Evolutionary approaches to analysing data and delimiting species avoid the inherent pitfalls in approaches that use all observed sequence differences to define species through calculation of a genetic distance. To illustrate evolutionary species delimitation, molecular data are used to test the hypothesis that hookworms parasitic in northern fur seals and in California sea lions represent separate species. The advantages and potential caveats of employing nucleotide sequence data for species delimitation are discussed, and the merits of evolutionary approaches are contrasted to inherent problems in similarity-based methods.

Recent excitement over the development of an initiative to generate DNA sequences for all named species on the planet has in our opinion generated two major areas of contention as to how this ‘DNA barcoding’ initiative should proceed. It is critical that these two issues are clarified and resolved, before the use of DNA as a tool for taxonomy and species delimitation can be universalized. The first issue concerns how DNA data are to be used in the context of this initiative; this is the DNA barcode reader problem (or barcoder problem). Currently, many of the published studies under this initiative have used tree building methods and more precisely distance approaches to the construction of the trees that are used to place certain DNA sequences into a taxonomic context. The second problem involves the reaction of the taxonomic community to the directives of the ‘DNA barcoding’ initiative. This issue is extremely important in that the classical taxonomic approach and the DNA approach will need to be reconciled in order for the ‘DNA barcoding’ initiative to proceed with any kind of community acceptance. In fact, we feel that DNA barcoding is a misnomer. Our preference is for the title of the London meetings—Barcoding Life. In this paper we discuss these two concerns generated around the DNA barcoding initiative and attempt to present a phylogenetic systematic framework for an improved barcoder as well as a taxonomic framework for interweaving classical taxonomy with the goals of ‘DNA barcoding’.

Šio darbo problema yra ta, kad esant draudžiamų reklamuoti sričių, institucijoms ir teismams yra sudėtinga atskirti, kada verslo subjektų pateikiamoje informacijoje yra reklamai būdingų bruožų ir kada ne. Neteisingo reklamos ir informacinio pobūdžio pranešimų interpretavimo pasekmė – didžiulės piniginės baudos įmonėms už neleistiną reklamą. In Lithuania, a number of laws define advertising, however, none of them specifically regulate the criteria based on which advertising should be delimitated from other forms of information on goods or services or informative messages. The problem of the thesis is that since there are prohibited areas of advertising, institutions and courts have difficulties in distinguishing the cases where information provided by business entities has specific advertising features and where it does not. False interpretation of advertising and informative messages results in huge fines for companies due to prohibited advertising. A scientific research is made in regard to those legal and practical issues of the demarcation of the state border of the Republic of Lithuania, which impede the demarcation works and legalization of the demarcated border line and which make the process additional money consuming, as well as the circumstances of establishing an incorrect state border line. The thesis provides conclusions and proposals in regard to optimization of the border demarcation. A proper determination of the state borders of the Republic of Lithuania is of utmost importance to the territorial integrity and sovereignty of the country. This family is traditionally divided into two subfamilies: Plataleinae and Threskiornithinae. One of the more interesting taxonomical questions within this group is the case of the species Eudocimus ruber and Eudocimus albus. They are usually considered as separate species, but they show similar behavior and there are also records of hybridization in nature. This study aims to reconstruct the phylogenetic relationships within the family Threskiornithidae as well as assess the level of genetic differentiation between Eudocimus albus and E. rubber, using mitochondrial and nuclear gene sequences. DNA was extracted from blood and tissue samples from 13 species of Threskiornithidae (seven genera) and two outgroups. For the Eudocimus study were extracted 10 individuals of each species. We sequenced the 16S rRNA and the intron 7 of &#946;- Fibrinogen for all species. For Eudocimus Cytochrome B, Cytochrome Oxidase I, intron 11 of Glyceraldehyde-3-Phosphate Desidrogenase, intron 4 of the Myelin Proteolipid Protein and intron 2 of Myoglobin were also sequenced. Sequences for other five species of the family were obtained from GenBank. Phylogenetic trees were constructed using Neighbor-Joining, Maximum Parsimony, Maximum Likelihood, Bayesian inference and Bayesian inference of species tree. Networks and genetic distances were determined for Eudocimus haplotypes. Several approaches for species delimitation using multilocus data were applied. All analyses strongly supported the family Threskiornithidae (18 species) as a monophyletic group. However, the current classification of two subfamilies was not supported by our data: Plataleinae formed a monophyletic group, but nested within Threskiornithinae (a paraphyletic group). Tests of monophyly rejected the hypothesis of monophyly of Threskiornithinae. The family Threskiornithidae also showed a division into two groups: one with only genera endemic to the American continent (Theristicus and Eudocimus) and another with the remaining species. Within the latter clade, species of genus Plegadis are observed in a basal position, while subfamily Plataleinae was grouped with the remaining species. This pattern of species distribution suggests an initial Gondwana division and subsequent colonization by species from the Old to the New World. The divergence within the family was estimated at 35-40 million years, which is before the separation between America and Antarctica. Mitochondrial genetic analysis showed Eudocimus species as two different lineages. Multilocus analysis based on nuclear genes revealed a strong signal of speciation despite the polyphyly found in three of the four markers.<br>A família Threskiornithidae inclui 13 gêneros e 32 espécies e suas relações interespecíficas, assim como as designações dos gêneros, espécies ou subespécies foram pouco estudadas. Os objetivos do presente estudo foram reconstruir as relações filogenéticas dentro da família Threskiornithidae e avaliar o nível de diferenciação genética entre Eudocimus albus e E. ruber, baseando-se nos dados de sequências de genes mitocondriais e nucleares. DNA foi extraído de amostras de sangue e de tecidos de 13 espécies de Threskiornithidae, representantes de sete gêneros da família e de dois grupos externos. Para o estudo do caso de Eudocimus foram analisadas amostras de 10 indivíduos de cada espécie. Foram sequenciados os genes 16S rRNA e o íntron 7 do &#946;-fibrinogênio para todas as espécies. Nos indivíduos de Eudocimus foram sequenciados também os genes Citocromo B, Citocromo Oxidase I, o íntron 11 da Gliceraldeído-3-Fosfato Desidrogenase, o íntron 4 da Proteína Proteolipídica da Mielina e o íntron 2 da Mioglobina. Sequências para outras cinco espécies da família foram obtidas do GenBank. Árvores filogenéticas foram construídas pelos métodos de inferência de Neighbor-Joining, Máxima Parcimônia, Máxima Verossimilhança, Análise Bayesiana e Estimativa Bayesiana de árvore de espécies. Redes de haplótipos e distâncias genéticas foram determinadas para as sequências de Eudocimus. Diversas abordagens de delimitação de espécies usando informação multilocus foram realizadas. A família Threskiornithidae com 18 espécies se apresentou como grupo monofilético fortemente sustentado em todas as análises. A classificação atual das duas subfamílias não foi corroborada: Plataleinae se apresentou como grupo monofilético, mas agrupada dentro dos Threskiornithinae, sendo este último um grupo parafilético. Os testes de monofilia rejeitaram a hipótese de Threskiornithinae ser um grupo monofilético. A família Threskiornithidae pode ser dividida em dois grupos: o primeiro agrupando somente gêneros endêmicos do continente americano (Theristicus e Eudocimus) e o outro com as demais espécies. Dentro deste ultimo clado, observa-se em posição basal as espécies do gênero Plegadis e a subfamília Plataleinae agrupada com o restante das espécies. Este padrão de distribuição de espécies concorda com uma divisão inicial Gondwânica e uma posterior colonização por espécies do velho ao novo mundo. A divergência da família foi estimada em 35 40 milhões de anos, data anterior à separação do continente Americano da Antártica. Abstract:
This thesis analyses student success and dropout (attrition, wastage, non-completion …) and their reflection in the Czech higher education policy. Strategic documents of the Ministry of Education, Youth and Sports declared student dropout to be a problem already in 2000 and 2005. However, only limited and vague measures were proposed, and even those have not been fully implemented while the dropout rates have continued to increase every year. The thesis applies the perspective of "problem delimitation" in the public policy process, discovering that many actors determining the policy formulation do not share the belief that dropout is a problem and that it should be dealt with by public policy means. It seems that no actor has been so far able to present the issue as a well-structured, and therefore solvable, problem. Besides, a lack of consensus on relevant underlying values and goals, a deficiency of suitable means aligned with other essential values - in particular the effort to increase the quality in higher education - is observed. When confronting the stakeholders' expectations of mechanisms and causes behind dropout with the academic theories, recent research as well as students' stories, it appears that the insight of policy makers into the topic is often incomplete and unfitting and that...

Diploma thesis "Czech apprenticeship at a crossroads" deals with the controversial topic of apprenticeship. Thesis is based on theoretical concepts of educational reproduction, positive functions of diversified educational systems, lifelong learning and problem delimitation in public policy. It brings the international perspective viewpoint and identifies strengths and weaknesses of different systems. Author looks into causes and consequences of negative phenomena while trying to understand different positions of employers and apprentices. Key areas are based on the delimited problem. These areas are: sole system of vocational education, which favors students with higher socioeconomic background; career guidance field, whose role in the process of decision making of students entering apprenticeship is small; the area of cooperation with social partners, which is crucial in enhancing the quality of apprenticeship. Author introduces possible ways of political change in these areas. This work is an attempt to define an alternative definition of rural as compared with the OECD methodology applied to the NUTS 3 units. In the specific nature of the Czech population is necessary to use other methods of defining rural. Bibliography outlines other possible ways of definic, as a empirical research reflects a descriptive approach to the definition of rural based on statistical indicators which are assessed in seven groups. The results are shown in the cartograms. Differences between rural and urban areas are in the Czech Republic according to the chosen methodology very small or not visible. Countryside as defined by statistical indicators have shown similar results as the definition of internal peripherals. The chosen method for the identification is very difficult and demanding. The renewed interest in imperialism after the wars in Afghanistan and Iraq has re-cast a vexed problem regarding the delimitation of the scope of the term imperialism. The urge to distinguish ‘imperialism’ from ‘empire’ has surfaced as some scholars seek to dissociate the United States' actions from the term imperialism and affiliate it with the less negative, if not positive, vision of empire. In that light, this article describes empire and imperialism in history; the historiography of imperialism; principal developments in modern imperialism; and the mid-nineteenth century transformation of imperialism or ‘new imperialism’. Imperialist competition in the first half of the twentieth century was catalyzed by a particular configuration of capitalism and nationalism. The nationalist foundations of modern imperialism have made it very difficult for the imperialist nation, whether Japan in Manchukuo or the United States in Iraq, to transition to a federated polity or cooperative economic entities or even ‘empire’.

Chapter 10 highlights a confluence of factors in the United States that produce a high percentage of wasted votes and a system of governance that largely fails to reflect the will of the majority of voters, widely considered a cornerstone of democracy. This study judges the fundamental integrity of key elements of the electoral process in the United States by applying the same standards used to evaluate developing democracies around the world. Several acute challenges to the U.S. electoral process are identified: boundary delimitation for the House of Representatives, the role of the Electoral College in presidential contests, processes of voter registration, and the decentralized administrative framework. The chapter concludes that despite obvious vulnerabilities, the United States is resistant to acknowledging these problems, to reform its electoral process in line with international standards, or to learn from the comparative experience of other countries that have strengthened their elections over time.

This chapter analyses Article 7 TEU on sanctions against Member States for certain potential and actual breaches of the values enshrined in Article 2 TEU, and the related ‘Rule of Law initiatives’. It argues that the debates over these reveal a twofold boundary issue: that of the legal delimitation of the procedures and powers under Article 7, and that of the fuzzy boundaries of the Member State political orders as distinct from the EU political order. The very identity of the foundational values of the Union and of the Member States makes it impossible to delimit the scope of EU law from that of Member State orders when it comes to guaranteeing these values. This also explains the politically highly sensitive nature of doing so. Thus, this chapter seeks to define the contours of the ensuing problems with a precise legal reconstruction of Article 7 TEU and its development.

Рассмотрена типология указанного вида текста. The article deals with the study of media text in the context of a variety of scientific approaches. The main concepts in which the phenomenon of this text represents itself are defined. An attempt is made to determine the primary contexts of the existence of media texts, which allows identifying the socio-cultural field of the existence of the media text, establishing its socio-historical conditionality. The typology of this type of text is considered.

Однако эти обстоятельства поспособствовали формированию вокруг Восточной Арктики достаточно широкого круга международных проблем. Их основой являются неразрешённые вопросы российско-американского акваториального разграничения и заинтересованность ряда стран АТР в получении свободного доступа к арктическому минеральному сырью и судоходству по Северному морскому пути. Наиболее конструктивный подход к их решению демонстрирует Китай, реализующий в Восточной Арктике подход стратегического партнёрства с Россией. The Eastern Arctic of Russia is a remote and highly isolated region of the country. Recently, its importance has increased significantly due to the unique, strategically important natural resource potential and new transit and transport prospects of its geographical location. However, these circumstances contributed to the formation of a fairly wide range of international problems around the Eastern Arctic. They are based on the unresolved issues of the Russian-American aquatorial delimitation and the interest of a number of APR countries in gaining free access to Arctic mineral raw materials and shipping along the Northern Sea Route. The most constructive approach to their solution is demonstrated by China, which is implementing an approach of strategic partnership with Russia in the Eastern Arctic.

The novice researcher, such as the graduate student, can be overwhelmed by the intricacies of the research methods employed in conducting a scholarly inquiry. As both a consumer and producer of research, it is essential to have a firm grasp on just what is entailed in producing legitimate, valid results and conclusions. The very large and growing number of diverse research approaches in current practice exacerbates this problem. The goal of this review is to provide the novice researcher with a starting point in becoming a more informed consumer and producer of research. Toward addressing this goal, a new system for deriving a proposed study type is developed. The PLD model includes the three common drivers for selection of study type: research-worthy problem (P), valid quality peer-reviewed literature (L), and data (D). The discussion includes a review of some common research types and concludes with definitions, discussions, and examples of various fundamentals of research methods such as: a) forming research questions and hypotheses; b) acknowledging assumptions, limitations, and delimitations; and c) establishing reliability and validity.

During the eighteenth century Portugal developed a large military construction process in the Ultramarine possessions, in order to compete with the new born colonial trading empires, mainly Great Britain, Netherlands and France. The Portuguese colonial seashores of the Atlantic Ocean (since the middle of the sixteenth century) and of the Indian Ocean (from the end of the first quarter of the seventeenth century) were repeatedly coveted, and the huge Portuguese colony of Brazil was also harassed in the south during the eighteenth century –here due to problems in a diplomatic and military dispute with Spain, related with the global frontiers’ design of the Iberian colonies. The Treaty of Madrid (1750) had specifically abrogated the Treaty of Tordesillas (1494) between Portugal and Spain, and the limits of Brazil began to be defined on the field. Macapá is situated in the western branch of Amazonas delta, in the singular cross-point of the Equator with Tordesillas Meridian, and the construction of a big fortress began in the year of 1764 under direction of Enrico Antonio Galluzzi, an Italian engineer contracted by Portuguese administration to the Commission of Delimitation, which arrived in Brazil in 1753. In consequence of the political panorama in Europe after the Seven Years War (1756-1763), a new agreement between Portugal and Spain was negotiated (after the regional conflict in South America), achieved to the Treaty of San Idefonso (1777), which warranted the integration of the Amazonas basin. It was strategic the decision to build, one year before, the huge fortress of Príncipe da Beira, arduously realized in the most interior of the sub-continent, 2000 km from the sea throughout the only possible connection by rivers navigation. Domingos Sambucetti, another Italian engineer, was the designer and conductor of the jobs held on the right bank of Guaporé River, future frontier’s line with Bolivia. São José de Macapá and Príncipe da Beira are two big fortresses Vauban’ style, built under very similar projects by two Italian engineers (each one dead with malaria in the course of building), with the observance of the most exigent rules of the treaties of military architecture.
