Full textReminiscence of the organisational and decisional way of the cities, the local planning documents are indisputably topical because of both their multiplication and their expanding diversity. Besides they are still outstanding in the french legal system so much so that from now on we can legitimately ask ourselves about the future of the law (more particularly the administration law and its corollary the administration). Activities organisation ways in a restricting temporal and territorial defined case, they can be distinguished not only because they organise the administrative action but also because they set up a power which ensures the modification of legal situations with the only will of the authorities in charge of its elaboration. In spite of numerous legislative attempts to make the decision process clearer and fuller of democratic adhesion, these particular masterpieces of the public administration are the last expression of the breathless local democracy. Two caracteristics make them different from the numerous implements the administration can use to bring its general benefit mission to a successfull conclusion. The first one is the temporalized plannification “which rhyms” with the anticipation of a close future. The second one is the spatialisation which equals the territorial application of the law. Then they evolve with the time before becoming a complete category. Unity or disparity(ies)? Reformation cause or not of our administration ? Will this new serie of conventional acts will drag with her the administrations? Will they turn them towards more administrative coherence and maybe the end of unceasing wrestlings between administrations? Do we have to foresee the progressive standardization of the administration? As we have to wait and see, the main point will consist in identifying the divergent and convergent elements in the way of the constitution of a new series of acts. It will also consist in setting up how this new legal implement induces consequencies in the organisation of the administration

Full textAs a pastoral tradition, the plain of Bled ̀amra (Gafsa) following the example of the High Tunisian Steppes to which it belongs, was the theatre of series of alterations which affected the economical and social structures, following the application of the privatization of the collective lands from1973. The current research whose central problem articulates around socio-spatial effects of this land policy, is organized in three parts, privileging each a temporal or spatial scale. The land policy is first of all approached globally through the exam of policies applied on the municipal and collective lands of the Mediterranean countries, while emphasizing the countries of the Maghreb. Then, we present the abstract frame and the methodological approach that allowed us to produce and to analyse the necessary data, before studying the geographic field through its three : human, physical and administrative constituents. In the second part, the Tunisian land policy and its application in the High Steppes are put in evidence as well as the application of the privatization of the collective lands of Bled ̀amra : the procedures, the consequences and the balance. The analysis of social dynamics and that economical alterations, object of the last part, raise the question of the management and exploitation of the natural resources. It is so, a question of seizing in closer the effects of this liberal land policy, previously applied on the society, economy and environment in a fragile and poor region

Full textRural areas are often reified : they appear sometimes aesthetic, disqualified. Talking about segregation would emphasize the inner differences of these spaces. First, I question how the link between segregation and urban places has become nearly exclusive and organic. Then, I define the concept using a “structuralist-constructivist” reading. As sociologists question the legitimate culture, I try to specify which neighborhoods are more likely to be valued. Two methodological approaches are employed. The first one is quantitative : I use databases about land ownership and housesales in Vendee, to associate some neighborhoods with unequal social values. The second is qualitative : I deal with 80 interviews achieved in a Vendeen borough of 603 inhabitants and 300 housings, in order to confront legitimation records with trajectories and residential locations

Full textDecentralization in rural Senegalese medium has followed a long process. Since 1972, the authorities always have posted a real will of promotion of the local participation by the means of several reforms aiming the local organization and the operation of the communities. These reforms will devote the responsabilisation of the local actors in a collective development of resources and stock management. These decentralization occurs in a context of disengagement of the State which transfers to the local communities more competences than means. Thus the rural role of the council, authority of decision elected within the rural community was to harmonize the development on the communal level of the territory. It must articulate in a coherent way the practices and logics of action of the whole of the village soils to sit as a common management space with the aim of a better integration in the various activities one the whole of the community. The interest of this research is to account for the various strategies of the socio-professional groups around the capacity transferred for the stock management. These strategies which are the cause of various conflicts between the actors, in particular between the peasants and the stockbreeders, made it possible to found a process of negotiation to find a compromised allowing a common management of the space of the community and its resources. This compromised means at the rural Community level of Ross Béthio, the installation of a Plan of Occupation and Assignment of the Grounds

Full textThe recurrence and Scale of natural disasters have currently significant societal challenges, especially when looked at from the angle of territorial planning and land management for the reduction of the risk inherent to human settlement in vulnerable areas. As a matter of fact, the region of Dakar, Senegal, has been facing recurring seasonal floodings for decades, causing significant damage. Pikine, a town in the suburbs, is the most affected. Between 2005 and 2009 it is estimated that 360,000 people have been directly affected by floodings in that suburban area of Dakar (IAGU, 2009). These seasonal events continue to increase the vulnerability of the population who is often poor and has no option but to live in those areas at risk. This case study will address the following question: What are the factors associated with the settlements in those areas at risk? What are the interrelationships between land management and vulnerability to natural disasters? What land-management-related interventions have been implemented to mitigate the risk of flooding? The answers to these questions will enable us to better understand the land-management-related characteristics of vulnerability.

Full textThe rapid growth of population and the accelerated urban expansion create more demand of the urban travel which can't be satisfied by the conventional mode of public transport. For that matter, a mass rapid transit system is regarded as a solution for a metropolitan of third word countries. After the second word war, more then ten projects of the mass rapid transit system has been constructed in the developing countries. In spite of this reality, we can't always reasoning the pertinence of the mass rapid transport on the third countries. Otherwise, the contribution of the mass rapid transit system is rarely more then 20% of public transports travelling against 80% in the developed countries. The estimation of the future demand for transport must, as a matter of fact, be based on the comprehensive approach and related to socio-economic, geography and culture factors of its environment. An internal analyse properly isn't enough to justify the pertinence of the construction of a mass rapid transit system, with out take on consideration of the complexity of problems linking with the local condition. Lack of land-use control and regulation conduct the development of jakarta uncontrollable. These are some of conditions requisite for the good operation of the mrt. In this case, the application of conventional approaches to estimate the transport demand in jakarta (or in other metropolitan of third word countries) is questionable

Full textThe urban development law is traditionally perceveid as the city expansion law. Yet, the town planning low does not grant the notion of the "opening to urbanization", the place it deserves. There is no definition of it, its judicial regime shall be deduced from a complex combinaison of various articles of the code. The "opening to urbanization" can be defined as the statutory transformation of a local town planning document which has the effect of classifying a wild environment into a built-up area or intro an area suitable for development. This tranformation can be made thanks to a modification or a review of the local urban development plan. The hypothesis of the creation of an united planning area, has been repealed by the solidarity and renewal urban act of december 13th 2000. The notion had an obvious signification in the soil managment, but the previous legislation granted it little attention. The "opening to urbanization" was just the occasion to organise a double procedure for the consultation of the people. The notion had a range of application limited to the future urbanization zones of the soil occupation plan, whereas in practise it had a larger scope. In december 2000 the lawmaker decided to expand the range of application of the notion, to natural and urbanisable future zones. The function of that notion has also been reinforced by the Solidarity and Renewal urban act of december 2000. On that occasion, the lawmaker has assigned to the notion of the "opening urbanization", new objectives which forestshadow a renewal about the urban development law. More than ever that law seems to be a receptacle for the various sectorial politics the purpose of which is the urban space

Full textThis thesis discuss the theme of integration and articulation between urban and transportation planning, with the aim of evaluate and studyi the sense and potentialities of the application of a Regional Plan for Transit Oriented Development (TOD) in Nord-Pas-de-Calais. In this regard we have chosen to use the tool of land use and transport integrated modeling (LUTI), and in particular the integrated simulation software Tranus, to implement a model which could answer to several research questions.We propose in this paper an integrated, inclusive and interactive perspective about problems and issues concerning land-use and transport policies at a regional level. A multidisciplinary and multi-scalar approach, following the principles of interdependence between all different elements of the territory, which is found in the concept of "networked city" of Dupuy. The aim is to address the themes of mobility and transport, according to a new paradigm, based on the concepts of accessibility, connectivity and multimodality and therefore according to the idea of an urbanism and a development oriented to transit and non-motorized transport, rather than car-oriented. The thesis is part of a phd research in urban and transportation planning, held at the University of Science and Technology of Lille 1, through a joint supervision between the Laboratoire Ville MObilité et Transport (LVMT - IFSTTAR) and the University of Calabria (Italy) and a scientific collaboration with Venezuelan engineering firm Modelistica

Full textIn 2000, the law Solidarity and Urban Renewal aims at refurbishing strategic spatial planning. Local authorities are pushed to group in order to lead the writing of new master plan (schéma de cohérence territoriale). In the following years, 400 SCOT are being studied. This implementation is analyzed through a focus on urban planner works. From 2002 to 2006, interviews with these planners enlighten the master plan creation main phases : create the perimeter, drawing the maps, writing the guidelines.This PHD shows how planners play negotiation and mediation roles through this normative production, how they succeed in raising an agreement on collective rules. This analysis shows that normative planning is not an end but a beginning : Law argument on possible effects of a to-be rule -such as litigation through courts, or master plan cancellation- is a way to organize public decisions and begin negotiation. An historic analysis on law production and master plan elaboration during the last 40 years, today's interests and involvement of the profession on legislative production and law arguments complete the situated-work observation

Full textOn account of the sustainability principle and because of the complexity of land-use policy, public sector players in spatial planning are wondering about the evolution of space uses and about our knowledge of land markets. The work for this thesis was conducted in the context of workshops associating local authorities and state authorities This thesis builds on a set of socioeconomic data, on public land-use policies, on land markets and on land use at various spatial and temporal scales. First of all, it maps the changing themes in land studies over the past thirty years and attempts to define an observation framework to deal with the recurring problem of access to comprehensive data on land markets. The land planning methods implemented in the Nord-Pas de Calais region are also analysed by comparing them with the methods used in the rest of France. Secondly, the uncertainties regarding information about land markets and land use led us to collect, estimate and select data adapted to an observation framework intended for public sector players. Thirdly, land use and its changes are studied between 1990 and 2005 in Europe, in France and in the Nord-Pas de Calais region by means of a method combining spatial analysis techniques with the identification of the stakes involved in spatial management through reading planning documents and interviews with territorial managers. Fourthly, the spatial and temporal dimensions of land markets are analysed between 1989 and 2005 in the Nord-Pas de Calais region. Particular attention is paid to the relations between property sales and land use changes, as well as to the roles of sellers and purchasers in the uses and values of space

Full textSustainable development is a major baffling problem for Ha Noi. It is first necessary to know what is meant by sustainable development as the meaning this key concept was overused in recent years. Is it a perception by strong sustainability or by the weak sustainability model? What are the models of a practical implementation of this paradigm that allow to question the Vietnamese practices? One of the main objectives of the thesis is to document the Ha Noi urban analysis in the light of its objectives in sustainable development. We are insisting the emergence of a new type of Vietnamese cities composed of three subcategories: relay cities, satellite cities and ecological cities. We have tried through case studies to show the specificities and similarities between these different areas assuming that these new cities were in one in between two urbanistic in terms of different viewpoints. In-Between both because the allotment of Western model influenced by Asian developers and built with the resources of Vietnam. This also means in-between a progressive and modern urbanism and a neoculturalist urbanism which gives the impotant place for the garden city and green belt in view of a more sustainable metropolization. However, the thesis shows that it revealed in the same time the relationship between landscape and environment and the history of Vietnamese culture. The thesis also deals with willingness to preserve the green belt, in spite of land and real estate pressure created by capital city. Finally, our thesis confirms the hypothesis that we are in a sustainability of small steps, thanks to keeping the focus on the governance pillar for urban projects of the Master Plan

Full textExtreme disasters related to climate change have become an increasing research topic,particularly due to the cost of damage (economic, human, social and environmental), whichhas a negative impact on GDP and from which the poorest countries suffer most. More locally,the city of Praia, the capital of Cape Verde, has to face to various disasters, especially flashfloods. These hazards occur between July and August, following heavy rains, and tend tointensify. These floods, aggravated by the conquest of urbanized areas in high‐risk areas, invalley bottoms and steeply sloping areas, increase the level of exposure of residents. The latterare also vulnerable because someone’s live in precarious illegal habitats. In response to thissituation, this research proposes to create, test and deploy a prototype cadastral LandInformation System, with spatial reference, to propose indicators of the risk of buildings in theface of rapid flooding and to increase the knowledge of land administration. The system isstructured around two aspects: a "mobile gisweb" component, which allows electronic datacollection from the field, thus promoting the participation of households in the process ofassessing their own risk and vulnerability, while allowing in situ collection; and a "workstation"component, allowing the processing and dissemination of risk information while consideringrisk management at the city level. To do this, html, JavaScript and CSS languages and opensource technologies (Google API, PostgreSQL/PostGIS, PHP, OpenLayers 3, QGIS software,Geoserver) were used to make the tool both transposable and operational. According to thesample surveyed, the level of risk of housing in the face of rapid flooding is high (33%), and it isexplained by geographical and environmental vulnerabilities of buildings, associated with thesocio‐economic insecurity of households

Full textHuman mobility depends not only on the supply of transport services, but more indirectly, on the organization of our living space. Our residential and working location, as well as our travelling mode and itinerary choices are based on our monetary and time budgets, besides, personal preferences. Therefore, the organization of our living space has wide implications on the space and energy consumption. Can we design this space in 2040 in a more sustainable way? To achieve a new balance, we propose to apply the theoretical urban concept of Transit-Oriented-Development and the model of Urban Corridor to Lille metropolitan area. We aim at concentrating activities of all kinds along the existing mass transit axis, thus, revitalizing the city within its public transport (PT) corridors so as to promote dense, diverse and designed neighborhoods. By limiting constructions outside PT corridor, we control urban sprawl and encourage short-distanced and less time-consuming travelling patterns. To test this scenario, we set up a land use and transport integrated model including main economic activities, real estate market in addition to the complete transport network. Three visions of redevelopment strategy are tested in order to measure their long-term consequences related to different actions, such as the territorial morphology, the location choices of household and firms, the travel behavior for various activities and associated environmental impacts. By providing a reference for the spatial organization and for the transport services planning, the results stemming from this prospective analysis may also enhance our global understanding of the city - how this complex system works

Full textThe thesis explores the role of the large public landowners (Army, University, Hellenic Public Real Estate Corporation, other large national-organizations or institutions) to the production of urban space in Greece. The object of research is thus to explore from the outset the mechanisms and procedures that create public spaces and communal facilities in Greece, and, in particular, to reveal the ways in which the management of various categories of public land has influenced and continue to influence the making of towns and cities. The city of Thessaloniki constitutes a privileged ground for this analysis. Due to its geographical situation and recent history, the city has hosted institutional bodies that were bestowed by large parcels of urban land, and made a significant and visible impact on urban fabric. The integration of the city into the Greek State in 1912 is a chronological starting point, since at that time the future economic and political role of the city was set within the new national context. The thesis examines the following topics: On the national level, the evolution of a framework for the production of urban space and communal facilities, the formation of policies on the public land management, and in this context the function of institutional owners through the study of concrete examples. On the local level, the role of two institutional landowners and the management of their land in the making of urban space of Thessaloniki: These are the University, spreading out under increasing demand, and the Army, gradually withdrawing under the pressure to cede underused military sites, already sought after by other urban functions

Full textIn a context of strong spatial urban growth and given the social emerging issues related to peri-urban farmland preservation against sprawl, we look into the elements that determine local public choices of urban development, in terms of land consumption and densities. We first consider economic frameworks of analysis from Urban and Welfare Economics that address urban planning decision making. Then, we analyze how a multi-method approach (discourse analysis, text statistics and econometrics on a large municipal database) can help build a theoretical framework adapted to a regulated and decentralized context as the French one. We apply this approach to Southeastern France municipal land use plans (Provence-Alpes-Côte d'Azur, "PACA" Region). The result is an enriched framework of analysis that shows the importance of determinants rarely mentioned in the literature and an assessment of their effect on public decision. Particular roles of some agricultural activity characteristics, elected officials' legitimacy, some of the political characteristics, supra¬municipal policies and interactions between municipalities are outlined. We also highlight synergies between qualitative and quantitative methods such as between discourse, text analyses and econometrics, namely in a perspective of generalization to heterogeneous geographical and institutional contexts. Avenues for future research and some recommendations to public decision-makers are lastly proposed for an in-depth examination

Full textThis aim of this study is to determine the total stresses at the soil-fondation boundary by using special strain gauges « mini-glötzl ». A litterature search reveals firstly the present state of the art concerning strain gauges and thier inehent problems. Secondly ; the use of pressure mesurement both in the laboratory as well as in situ is discussed After having shown the limitation od reaction methods as well as finite element methods a laboratory experiment is described for rigid circular plates 50 cm diameter anf 12 cm thick. The influence of the follwing factor is studied: - the operation of plates : prefabricated, constructed on site, - the position of gauges : depth, orientation, - the compaction of the soil. The results are used to determine the contact pressure distribution. The use of the special pneumatic strain gauge « mini glötzl »is shown to offer certain advantages

Full textThis thesis aims at providing insights on the (objective and subjective) determinants of the heterogeneity of project evaluations. At first, I analyze how (objective) quantities are incorporated in the cost-benefit analysis. The first main chapter deals with the way cost-benefit analysis is affected by the time distribution of impacts considered. Through the example of land use change from biofuel production, I find that decisions regarding projects with non-constant environmental impacts rely on distorted net present values, which may result in the implementation of actually non-desirable projects or the non-implementation of actually desirable projects. This work is both theoretical and numerical.Second, I investigate the role of the structure of preferences, i.e. whether private goods and environmental goods are substitutable or complementary in providing utility, on individual decision-making in an individual framework and a collective framework. At the individual level (second main chapter), we develop a theoretical model which allows either for substitutability or complementarity depending on the context (income and environmental quality). It results that the income elasticity of willingness to pay can be negative in contexts of between-goods substitutability, which contrasts with usual frameworks which only allow for positive income elasticities (thus the environmental good can never be inferior but is always normal). Our framework also affects the way consumption and environmental quality are discounted, which is all the more relevant in the context of income shocks. At the collective level (third main chapter), we use an experimental approach to analyze the effect of the interaction between individuals with different structures of preferences on contributions to the public good. It results that perfect substitutability is associated with more free-riding than complementarity. However, an aversion to advantageous inequality also emerges from individuals whose preferences underlie perfect substitutability towards those whose preferences are based on complementarity

This dualism in the access to soil and housing should persist in the town of meknes while economic freezing and absence of purchasing power remain the lot of a majority of potential consumers
