Abstract:
Introduction. In the present work, the authors investigated the main aspects of the reform of procedural legislation initiated by the Supreme Court of the Russian Federation concerning changes in the legal regulation of the use of conciliation procedures in resolving legal conflicts. Until recently, Russian legislation did not have a regulated list of conciliation procedures. Purpose. The aim of the work is to identify the features and place of conciliation procedures in the institute of alternative ways to resolve legal conflict. Methodology. The work was performed on the basis of special methods of knowledge, including historical, legal, logical, and formally legal. Results. The paper analyzes the results of consideration of the draft Federal Law No. 421600-7 “On Amendments to Certain Legislative Acts of the Russian Federation Due to Improving Conciliation Procedures” in the first reading by the State Duma of the Russian Federation, taking into account the opinion of the relevant committee of the State Duma of the Russian Federation on state construction and legislation which caused a wide resonance in the Russian legal community. It is concluded that the world experience in applying reconciliation procedures, indicating a positive dynamic in the peaceful resolution of legal disputes, is also spreading within the framework of the Russian legal system. In the framework of the Russian judicial procedure, two fundamental conciliation procedures were consolidated – the mediation procedure and the judicial conciliation procedure. The introduction of special subjects (intermediaries) as judicial conciliators for the settlement of disputes in court is aimed at reducing the workload of judges, its concise and effective distribution. Conclusion. The material contained in the work is of interest for further research on the problems of alternative ways of resolving a legal conflict, can be used when giving lectures and conducting practical training in the course of the civil process

The aim of this research is to show the implementation of literary works in literary translation by giving the way how to implement the literary work in revealing cultural terms found in a literary work, namely Achmad Tohari’s Ronggeng Dukuh Paruk Novel. Based on the literary work, the research on literary translation is done by investigating the translation procedure applied in translating the cultural terms from Indonesian into English. This research used a descriptive qualitative method with content analysis technique done by taking the flow model followed by data reduction, data presentation, and conclusion. The analysis used a semantic approach and Peter Newmark’s translation procedures. Result of the research shown by implementing literary work, the research of literary translation reveals that there are 16 cultural terms and classified in 6 different categories, they are musical instruments, clothes, accessories, work and leisure, activities and procedures, and religious terms. In translating the novel, there are 7 translation procedures used by the translator, they are transference, naturalization, cultural equivalent, functional equivalent, descriptive equivalent, couplets, and notes.

This study investigates the moderating role of social support (i.e., supervisor, co-workers and the family) in the relationship between organizational injustice (i.e., distributive and procedural) and work interference with family (WIF; i.e., strain and behaviour based). Quantitative data were collected from employees working in public sector health-care organizations of Pakistan through survey questionnaires ( N = 255). This study finds significant effects of distributive and procedural injustice in engendering the negative experiences of strain- and behaviour-based WIF, in the employees of health-care organizations. The moderating effect of co-worker and family support provided mixed results. The supervisory social support was not found as a moderator. Findings of this study suggest that health-care organizations should pay serious attention to the ineffective work family policies and procedure to develop a family-friendly work environment. The supervisors should be given a role in work family policies and procedure development. The mitigating effect of co-workers’ support showed that the employees should be provided with proper knowledge on the policies and procedures of their organizations. The support of family members can also be either benign or harmful.

Written procedures are an important artifact in maintaining the safety in high risk industrial operations. Procedures set out the steps required to complete safety and process critical tasks. However, as Sidney Dekkar noted, while procedures spell out how to do the job safely, “following all the procedures can lead to an inability to get the job done” (Dekker, 2003, p. 235). For instance, while a procedure will set out a safe step-by-step approach to achieving a desired outcome, a work environment, filled with uncertainty and constraints may not allow for a procedure to be executed correctly (Dekker, 2003). Although procedures are used to support safety, procedure misuse has been identified as a contributing factor in incidents and near misses in multiple industries (e.g. Alper & Karsh, 2009; Bullemer, Kiff, & Tharanathan, 2011). Such findings are often based on retrospective, case-study approach to describe deviations from expected steps and order within the procedures. While misuse of procedures has been identified as a contributing factor in major incidents, little research has been conducted on how procedures are used under normal conditions. Thus, the aim of this research is to demonstrate the applicability of an objective approach to assess adherence and worker behavior with written procedures. Consequently, the method presented will identify how and when workers deviate from procedures through the conduct of normal work. The proposed objective assessment of worker use of procedures consists of a two-tier assessment of a worker’s adherence to each step within a procedure. Within Tier 1, a worker’s compliance to each step is assessed as either completing correctly without issue (i.e., WAD = WAI) or work not completed as expected (i.e., WAD ≠ WAI). Tier 2 provides a more detailed description of how WAD is different to WAI. Specifically, for those steps not completed as expected, 7 types of deviations, ranging in their severity to potentially unforeseen consequences, are used to assess worker use of procedures. Specifically, the worker could: require assistance, struggle, iterate between steps, skip a step and go back to it later, complete a step out of order, incorrectly execute a step, or not complete a step. Using analysis of audio/visual data, the assessment method was used to test if experienced and inexperienced workers use written procedures differently in a high fidelity simulated training environment. Results identified that there is a difference between experienced and inexperienced workers, with experienced workers complying with the procedures at a higher rate. Results also identified that when experienced operators deviated from the procedure it was through either by skipping or incorrectly executing a step in the procedure. For inexperienced workers, deviation from the procedure occurred through gaining assistance or struggling with the action required in the procedure. When combining correct procedure use (Tier 1), assistance and struggle (Tier 2), there is little difference between experienced and inexperienced workers. The assessment approach described how workers use written procedure under normal work conditions. To our knowledge, this is the first time this particular assessment technique has been used. While the method offers, at the coarse level, a binary correct/incorrect assessment of procedure step compliance; it also allows for an understanding of how deviations occur. The method provides safety engineers, managers and procedure writers with data which can be used to change or modify written procedures and to improve process and safety training. Furthermore, data collection for the method is relatively unobtrusive (small camera on a safety helmet) and low cost. Given the capabilities of small portable cameras, the approach could also, theoretically, be applied in real time. From a WAD/WAI perspective, the assessment approach allows for a detailed understanding of how work occurs under normal conditions. Such an approach provides an ability to understand how deviations from WAI as a preventive approach to safety within high risk environments.

AbstractThe paper analyses the dynamic procedures that work during the formation of international law in international organizations and conventional frameworks. These procedures organize and structure the interactive exercise of the normative function by law-creating bodies and law-applying bodies. The paper conceives of this ‘way’ of making international law as a law-making method that the concept of standardization helps to understand. Grounded in Aristotelian dialectic logic, standardization indeed conceptualizes the dialogic and procedural law-making that works for normative coherence in contexts characterized by co-operation and the heterogeneity of interests. Introducing this concept, the paper insists on the fact that it is the procedural nature of the dialogue that is crucial to reach normative coherence. Drawing on the consequences of standardization, and regarding dynamic procedures, it reappraises the status and the importance of both the different sources of international law and the different participants to international law-making. Also, the paper points out the predominance of normative coherence, as well as that of its ‘guarantor’, namely procedure that its author considers the cornerstone of legal certainty in the co-operative context of the international society.

Abstract Background Prior studies of resident experience in gynecology looked only at the year before and after adoption of ACGME duty hour standards. This study sought to determine whether procedure volume differed after completion of a 4-year residency training program, before and after work hour reform. Method Inpatient and outpatient procedures performed by MetroHealth Medical Center/Cleveland Clinic program residents from 1998 to 2006 were obtained from Annual Reports of Institutional and Resident Experience. Four-year experience before and after duty hour restrictions were compared: hours worked were collected from resident schedules, ambulatory hours and procedures were compared directly, surgical procedures and deliveries were compared using a 2-tailed t test. Data were also obtained for institutional volume changes, and a corrected value, based on the rates of resident cases per available cases, was analyzed. Results Ambulatory hours worked per resident decreased after implementing work hour reform from 674 to 366 hours. The types of ambulatory and surgical procedures performed varied over time. Overall, basic surgical and obstetrical volume per resident did not change before and after work hour reform (mean before reform, 723 ± 117, mean after reform, 781 ± 200, P = .58 for gynecologic procedures; mean before reform, 611 ± 107, mean after reform, 535 ± 73, P = .18 for basic obstetrics and vaginal and cesarean deliveries). Institutional volume did not change significantly, although the percentage of the institutions' cases performed by residents did decrease for some procedures. Conclusion The ACGME duty hour restrictions do not limit the overall ambulatory or surgical procedural volume in an obstetrics and gynecology residency-training period.

At present there is no standardised procedure for music therapy assessment in the UK. Music therapists use a wide variety of methods to review their clients' progress. This paper begins by examining some of these different procedures and looking at their advantages and disadvantages. A particular system of analysis developed by the author is then explained in detail. Information about four different clients with severe learning difficulties from this analysis is compared to information gained simultaneously through video-analysis. The results seem to indicate that the author's assessment procedure is an efficient way of collecting information about music therapy sessions with these clients. The paper then looks at whether this same procedure can be used with other types of clients. Suggestions for further investigations are made.

Abstract The air operations in controlled airspace performed according to Instrument Flight Rules (IFR) are composed of three main flight phases, i.e. departure, cruise, arrival. Controlled airspace is divided into the terminal area and en-route airspace. The terminal area encloses the departure and arrival phases while the en-route airspace encloses the cruise phase. The IFR procedures are designed for manned aviation to ensure the safety of air operations. Development of the aviation concerns among others the increase in the number of unmanned aviation operations. Currently, on the European level, there is an on-going, long-term program of integration of the unmanned aviation in the uniform (non-segregated) airspace. This work concerns the research in the integration of the Remotely Piloted Aircraft Systems (RPAS) in the IFR procedures of the controlled airports. The objective was to build the reference models of Standard Instrument Departure and Arrival Procedures (SID and STAR). Basing on the procedure design guidelines the models of procedural nominal track, tolerance area, obstacle clearance area, climb or descend gradient, manoeuvres in SID and STAR were done. The guidelines describe the operational minima thus the statistics of existing procedures was done to select the suitable procedure parameters such as a number of navigational points, segments lengths, altitudes, climb or descent gradients. Reference models of SID include straight departure and turning departure procedures. Reference models of STAR include non-precision approach procedures according to used navigational aids, i.e. GNSS, VOR. The reference procedures were numerically implemented which will be used in the further works on RPAS integration problem by simulations of the RPAS ability to execute of the SID and STAR.

Unfortunately, the pedagogical and research literatures are weak in this area. Here, we attempt to initiate further discussion by defining and describing policy and procedure documents, and identify a third kind, work instructions. A genre approach is used to outline characteristics based on information type, institutional purpose, and organizational functions. Rhetorical, audience, and functional linguistics analyses are used to describe more specific characteristics.

660 Background: Competitive market forces on healthcare have led to increasing demands on work effort of academic surgical oncologists. This has to be balanced against resource constraints of limited operating room space and block time availability. We hypothesized that current work RVU (wRVU) requirements pose an unrealistic expectation of practicing surgical oncologists. Methods: University HealthSystem Consortium (UHC) median wRVUs were utilized to determine the effort expected of a surgical oncologist. Surgical oncology subspecialties were divided into breast, colorectal, melanoma, sarcoma, liver and pancreas. Representative procedures from each specialty were determined using Healthcare Common Procedure Coding System and median wRVUs were obtained per procedure including a single consultation cost without incorporating modifiers and adjustments for multiple procedures. A work year was assumed to include 48 weeks of work time to account for CME, and vacation. Night and weekend call was excluded from the analysis. Results: The median UHC wRVU for a surgical oncologist is 7800 wRVU, which corresponds to a theoretical reimbursement of $383,387-493,459 in a pure Medicare population. In order to meet the work RVU requirements, the number of annual major procedures performed varied from 124-1625 procedures (breast 365-701, colorectal 192- 324, melanoma 677-1625, sarcoma 234-334, liver 124-571, pancreas 139-264). The number of major procedures performed per day varied from 3 procedures/day for a 4 day block time to 12 procedures/day for a single day block time. Conclusions: Current wRVU expectations and block time schedules need to be better aligned to account for increasing demands on surgical oncologists. Society driven surveys as recently conducted by ASBS might be effective ways to truly understand workforce demands in the nation.

Children undergoing procedures such as blood tests and X-rays experience less anxiety and upset if they are well prepared and informed. Currently the provision of information about procedures can be ad hoc and there are barriers to children understanding this information. This study explored the perspectives of 32 children undergoing procedures (aged between 8 and 12 years), 27 parents and 19 health professionals on the provision of preparatory information to children. Qualitative interviews, prompted by visual images, were thematically analysed. The three themes, ‘accessing information’, ‘understanding information’ and ‘using information’, resonated with the central tenets of health literacy. Children reported mainly accessing information second-hand through their parents and demonstrated misconceptions about their procedure. Children identified that procedural information would help them to know what was going to happen and enable them to feel less worried and scared about their procedure. This study highlights that children can have low levels of health literacy in relation to a planned procedure. Their health literacy in this context is heavily influenced by the adults (parents and health professionals) around them. There needs to be further work conducted, informed directly by children, to improve the health literacy of children attending hospital for planned procedures.

Prolonged standing at work has been linked to health problems including foot, leg and back pain, varicose veins, circulatory problems, including a possible increased stroke risk. [1]. There are many other potentially very serious health concerns. Worsening of existing coronary heart disease as well as varicose veins and chronic venous insufficiency has been associated with prolonged standing. Pain in the lower limbs and feet are also associated. [2] Studies suggest back pain associated with long surgery is about twice as common in those who stand compared to those medical staff who usually work sitting, even after controlling for age and lifting weights. The main reason is the back position must to be inclinate in the most part of the surgery. The design of orthesis for the lower extremity with chest support represents an alternative to medical staff health problems who standing for long periods on surgical procedure. The surgical orthesis system proposal in this research is positioned on middle side of the leg and is designed such that support the body weight during the surgical procedure. The system can be used for release pressure on ankle, knee and hip joints.

The Accreditation Council for Graduate Medical Education imposed 80-hour work week constraints on residency programs in July 2003. Certain programs were granted an additional 10 per cent for specific educational purposes, bringing restrictions to 88 hours per week. The increased demand for residents to leave the hospital has placed teaching institutions in exhaustive situations to provide comprehensive patient care. In response to the work hour constraints among residents and emergency room staff, a unique group of registered nurses, trauma nurse specialists (TNSs), were credentialed with advanced practice skill sets. Governed by practice guidelines and overseen by a medical director, TNSs perform invasive procedures that are normally the responsibility of the surgical resident. The purpose of this study was to evaluate work hours saved for surgery residents using credentialed nurses (TNSs). Procedure logs were maintained by the TNSs over a 6-month period, and surgical house staff (postgraduate year 1–3) over a 4-month period. A total of 423 procedures were recorded, reflecting time taken for attempted/completed procedures and complications. Resident procedures numbered 98; TNS procedures numbered 325. TNSs spent an average of 42 hours per month (10.6 hours per week) completing advanced procedures with no statistical difference in time or complications compared with surgical residents. By using the TNSs, work hours for surgery residents were saved while maintaining a safe and reliable work atmosphere for patients.

The article examines the refraction of the doctrine of legal procedure in relation to the activities of parliament.The purpose of the article is to confirm or disprove hypothesis that parliamentary procedure is the kind of legal procedureThe methodology. The author uses formal legal interpretation of Russian legislative acts and decisions of Russian Constitutional Court and European Court of Human Rights as well as such general scientific methods as analysis, synthesis, systemic approachThe main results, scope of application. The author draws attention to the fact that at the present stage of the development of the theory of law, it can be stated that procedural social relations have developed in the parliamentary bureaucracy, which are not only regulated, but must also be regulated by procedural norms, which confirms the conclusions of the authors of a "broad" approach to the theory of legal process. However, there will be a window of opportunity for the supporters of the "narrow" approach in the parliamentary process. In accordance with the conclusions of the ECHR and the Constitutional Court of the Russian Federation, which have prerequisites even in the works of Montesquieu, the parliament, as a body with jurisdictional powers, must comply with the appropriate procedure in their implementation. Hence, the author deduces the tasks of further improving both the doctrine of parliamentary procedure and the need for clear and competent regulation of legal procedures in parliament, the ultimate goal of which is to observe and implement the rights, freedoms and constitutional guarantees of participants in the parliamentary process.Conclusions. The procedures governing the work of the Parliament and its organs are legal procedures in the broad sense of the term. This does not negate the understanding that the legal procedures of the parliament, corresponding to its quasi-judicial powers, has the nature of the jurisdictional process. This conclusion is consistently confirmed in the jurisprudence of the European Court of Human Rights and the Constitutional Court of the Russian Federation.

The article consists of four case-studies, analyzing examples of building procedures and institutions of the parliament work. The first one deals with the experience of inter-faction agreement on principles and procedures of distribution of leading positions in the Duma among party factions, providing the actual power-sharing arrangement and respect of factions’ interests. The second describes the attempts o the “young parliamentarism” to solve the relevant problem of “party discipline”. It needs to be said that Duma has proved to be able to avoid excessive regulation of the issue, ensuring at the same time reasonably high discipline. The third case describes the difficult process of building an inter-factional coalition to ensure the passage of the politically and symbolically important law on private property of agricultural land. The fourth case examines the practice of coordination between the cabinet and Duma majority factions on important government-initiated bills prior to their formal introduction to Duma (“zero reading”). For three out of the four cases, related to different Duma convocations and different years, an updated analysis of the current status of the same practice or procedure is provided. The overall conclusion is that all the cases are characterized by instrumental and creative approach of Duma members to the problems, and though the outcome was never predetermined, effective and lasting solutions.
