The work is about the formal equality before the material inequality on the domestic labour relation. Although the domestic employees are entitled of minimally fundamental rights to a worthy life, the constant human rights violations reveals that the conquest of equality still appears distant regarding the acknowledgment and respect from the society towards this segment. But why is so hard to secure the rights of the domestic employees? On a search to comprehend such fact, the research starts from the premise that the domestic employee is devalued for being a conflict point for class, gender and race discrimination, and also not considered a profit generating activity. This discrimination that affects the domestic labour is due to a historical, social and legal construction, therefore, firstly, the social and historical contexts regarding the emergence of the domestic class is analyzed, as well as the legal posture adopted referring the job, including the international level, trough the analysis of the 189th Convention from the International Labour Organization. Promptly, the work brings the conception for the equality principle and demonstrates, trough a gender perspective, that the domestic labour is much discriminated due to social residue from slavery and patriarchate, besides being an easy target for the capitalist exploitation. Beyond this, registers the peculiarity of the domestic labour not relying on a supervision system due the home inviolability principle, as well as the difficulty of producing proof on an eventual court litigation. At last, the study confronts the present scenario of the domestic labour in Brazil with the principles of human dignity, citizenship and the social value of work; and analyzes how the instruments from the affirmative actions are being used by the State on the combat agains inequality of this labour relation. The research concludes that the acknowledgment of ratified rights when confronting the inequalities have not produced any effects, as this occupation is widely socially devalued. This way, the implementation of actions aiming to promote a decent work for this category is indispensable, consisting on an important tool to include these historically excluded individuals. For this research there were used, essentially, the historical and bibliographic methods. The pertinence for this study advent from the rising debate around the legal regulation of the domestic employees which involves thousand of women.
O trabalho trata da igualdade formal ante a desigualdade material na relação empregatícia doméstica. Embora os empregados domésticos sejam detentores dos direitos mínimos fundamentais para uma vida digna, as constantes violações de direitos humanos revelam que a conquista da igualdade ainda se mostra distante quanto ao reconhecimento e respeito da sociedade por esta categoria. Mas por que é tão difícil assegurar os direitos dos empregados domésticos? Em busca de compreender tal fato, a pesquisa parte da premissa que o emprego doméstico é desvalorizado por ser ponto de embate de discriminações de gênero, raça e classe, além desta atividade não ser considerada geradora de lucro. Essa discriminação que afeta o trabalho doméstico é fruto de uma construção histórica, social e jurídica, por isso, primeiramente, analisam-se os contextos social e histórico do surgimento da classe dos domésticos, bem como, os posicionamentos legais adotados referentes à profissão, inclusive no plano internacional, através da análise da Convenção 189 da Organização Internacional do Trabalho. Seguidamente, o trabalho traz a concepção do princípio da igualdade e demonstra, através da perspectiva de gênero, que o trabalho doméstico é bastante discriminado devido aos resíduos sociais da escravidão e do patriarcado, além de ser um alvo fácil para a exploração capitalista. Além disso, registra-se a peculiaridade do trabalho doméstico não contar com um sistema de fiscalização do trabalho devido ao princípio da inviolabilidade domiciliar, bem como, a dificuldade na produção de provas em eventuais litígios trabalhistas. Por derradeiro, o estudo confronta o atual cenário do trabalho doméstico no Brasil com os princípios da dignidade da pessoa humana, da cidadania e do valor social do trabalho; e analisa como os instrumentos das ações afirmativas estão sendo utilizadas pelo Estado no combate às desigualdades desta relação de trabalho. A pesquisa conclui que o reconhecimento de direitos positivados no enfrentamento das desigualdades não tem operado efeitos, na medida em que, esta profissão é bastante desvalorizada socialmente. Deste modo, imprescindível se faz a implementação de ações que visem promover o trabalho digno para esta categoria, que consiste em uma importante ferramenta na inclusão de indivíduos historicamente excluídos. Para a pesquisa foi utilizado, essencialmente, o método bibliográfico e histórico. A pertinência para o estudo adveio do crescente debate que gira em torno da regulamentação jurídica das empregadas doméstica e que envolve milhares de mulheres.

Remiantis surinkta medžiaga, įvertinamos klitinių įvardžių linksnių reikšmės, apibrėžiama šių formų pozicija sakinyje ir pozicija žodžio, prie kurio šlyja klitinis įvardis, atžvilgiu, apžvelgiama klitinių įvardžių raida, jų vartosenos pokyčiai. Teorinėje darbo dalyje aptariami tipologiniai klitikų parametrai ir tyrimai, taip pat veiksmažodiniai ir antrosios pozicijos klitikai, kelių kalbų klitinių įvardžių sistemų raida — tarpinė padėtis tarp veiksmažodinių ir antrosios pozicijos klitikų. Nustatomi lietuvių kalbos senųjų raštų pirmojo ir antrojo asmens klitinių įvardžių pozicijos sakinyje tipai. Tiriamojoje darbo dalyje chronologiškai ir pagal atskirus autorius išsamiai analizuojama lietuvių XVI—XVIII a. raštų klitinių įvardžių vartosena. Nemažai duomenų apie klitinių įvardžių raidą, vartosenos pokyčius teikiama remiantis to paties teksto ar tekstų rinkinio skirtingų laikotarpių leidimais. Be kitų disertacijos išvadų, pastebėta, kad senosios lietuvių kalbos klitinių įvardžių raida yra tipologiškai artima slavų kalboms. Panašiai kaip jose, lietuvių kalbos senuosiuose raštuose klitiniai įvardžiai rodo stiprią tendenciją eiti greta veiksmažodžio lyčių, nors yra atvejų, kuriuos galima vertinti ir kaip atitinkančius archajišką Wackernagelio poziciją.

Texto completoIn a rental of the arable land of Shetland, written in the early 1770s, the following expression appeared: “The inhabitants of the Towns within the same Scattald are called scatt brethren.” These few words triggered a series of questions. What is a scattald? What is the scatt? Who are these ‘scatt brothers’? Research at the National Records of Scotland and at the Shetland Archives as well as the reading of academic literature on the questions of communities, commons, custom, local judicial systems and rural life in the early modern period led to the writing of a thesis on communities in the 18th century. These communities lived in a peculiar geographical context: the Shetland Islands. Without underestimating the role of the local environment in the life of the Shetlanders, this thesis shows that the surroundings of the Shetlanders were more a place of possibilities than a place of restrictions; it brought constraints, but any other surroundings in early modern Europe had its limitations. The life on the islands of Shetland was as anywhere else on mainland Scotland at the same period a life based on local resources and which saw the development of a market economy with its advantages and disadvantages for the inhabitants. In Shetland the market economy took the form of the fishing tenures with their specific share-cropping contracts.In order to understand these communities the thesis starts with how they were regulated. The regulations, the courts and their personnel all had a role to play in the social control of the members of the communities. This thesis also explores the activities of the communities’ members in their environment. Shetland as well as several regions in Northwest Europe at the same time was a place of pluriactivité, multi-tasking. Through multi-tasking and access to the commons, the scattald communities of Shetland kept a certain level of independence even in time of debt-bondage. This paradoxical relationship was rendered possible by an almost unlimited access to the commons throughout the 18th century, a time during which the movement on the commons were possible and the transmission of the memory of their boundaries stayed alive. Changes, however, happened on the islands during these times. The fishing tenures were only one element of these changes: women started to outnumber men, the size of the arable land cultivated by one household diminished, the protected commons were slowly nibbled, and a regional court offered more possibilities for justice to the higher ranks than to the tenants... Eventually, this thesis argues that local communities in 18th-century Shetland offered protection to women and men who through them had an organised support system

Texto completoŠio mokslinio darbo tikslams įgyvendinti buvo pasitelkti įvairių mokslo šakų rezultatai, didesnį dėmesį darbe skiriant archeologinių tyrinėjimų rezultatams. Tyrimų duomenų analizė, apibendrinimas įgalino pasiekti užsibrėžtus tikslus, iškelti naujas hipotezes, išskirti iki šiol buvusias mažiau ištirtas Vilniaus gynybinio paveldo objektų grupes, o tai suteikė galimybę nuosekliau apžvelgti Vilniaus gynybinės koncepcijos raidą. Dalis Vilniaus gynybinių įrenginių vis dar yra nepakankamai gerai ištirti, todėl apibrėžti tikslesnius jų parametrus, tūrinę ir planinę struktūrą problematiška. Tenka pripažinti, kad dalies darbe aptariamų objektų priskyrimas gynybiniams yra hipotetinis. Šis darbas ir jame iškeltos tyrimų metu gautais faktais pagrįstos išvados bei hipotezės gali suteikti kokybiškai naują impulsą Lietuvos sostinės senovės gynybinių įtvirtinimų tyrinėjimams bei Vilniaus urbanistinės raidos rekonstravimui. Įvertinus tyrimo rezultatus galima teigti, kad miesto plėtra ir gynybinių įtvirtinimų raida buvo glaudžiai tarpusavyje susiję procesai, todėl ir ateityje atliekant panašaus pobūdžio tyrimus tikslinga naudotis kiek įmanoma platesne duomenų apie senąjį Vilnių baze.

Texto completoIn this thesis, a group of eight rock cut tombs and two shaft-tombs located in Central Dra’ Abu el-Naga (CDAN) at the West Bank of Luxor were studied. The construction of these tombs dates mainly to the period of the New Kingdom (NK, c. 1550-1070 BCE), but they continued to be in use for many generations after the death of the original tomb owners. The framework of this study, as sketched in Chapter 1, is characterized by three approaches: the first section is titled The geographical and geological nature of DAN. The overview of The history of excavation at CDAN Finally, the focus is on the history of research on the necropolis of CDAN. In Chapter 2, the excavations conducted in the area by the Egyptian Ministry of State of Antiquities (MSA) are described. I described and discussed the architectural elements of the newly excavated tombs. At the end, the architectural styles that prevailed in the CDAN were described, as a step in clarifying the development of the history of the area. In Chapter 3, deals with the relics and traces of ancient burial customs, especially with the objects like statues, pottery, coffins, shanties, funerary cones, and other funerary equipment, which came to light during the excavations in the area. Particular attention was given to their dating. The last section, Chapter 4, the frequent re-use of the tombs in later periods, as illustrated, e.g., by ceramics and other small finds. At the end, the significance of the newly discovered tombs is highlighted. Further insights into the specific usages and functions of monumental tombs in CDAN in general were gained, and to increase the understanding of the connections, interrelationships and developments, this started from NK and ended to very modern time. The four main chapters are followed by a catalogue of objects.

Texto completoCastile enacted bullionist laws during more than four centuries, from the Late Middle Ages to mid-19th century. The laws fixed prices and placed bans on export. But these measures did not prevent the export of silver and instead caused a great deal of smuggling. This dissertation aims at understanding the logic of silver outflows focusing on the smugglers' point of view: arbitrage. In this regard, the archive of the merchant house Roux (Marseille), probably the best preserved 18th century commercial archive in Europe, has made possible the reconstruction of the specie-point mechanism for silver - the Old Mexican pieces of eight - between Cadiz and London as exactly practiced by contemporary merchants. The discovery of half-monthly data on silver black market in Cadiz for the period 1729-1741 has been a milestone in order to understand the logic of silver outflows.
Empirical result from these data for arbitrage equation presents a puzzle for our understanding of the specie-point mechanism: from 1729 to 1737 there was a systematic bias between the implicit spot exchange rate and the arbitrated parity, which made arbitrage systematically profitable. On the contrary, from 1737 to 1741 the bias was corrected because the Spanish government reacted to illegal bullion outflows with a devaluation, which equalized the exchange rates and the arbitrated parity.
This research explores both theoretically and empirically the reasons for the apparent mispricing for the first period and the effect of the devaluation on silver prices for the second period. The outcome is that bullionist regulations configured an oligopsony structure in Cadiz that had the power to drive down silver prices below the international price (i.e., London price). Oligopsony agents were the most important foreign merchants in Cadiz, organized in family and partnership networks which were rice-makers; their structure was maintained because the long-run international networks created entry barriers in the business of illegal export of bullion. Secrecy was reserved because both sides of the market cheated the Spanish government: importers from the Spanish American colonies saved the high import tax and exporters to the ain European bullion markets ignored the ban against exports.
Nevertheless, oligopsony power had a floor, which was the Official Parity (i.e., the number of units of account per coin). Below the Official Parity, the pieces of eight were used as money and went out from the commodity market. The devaluation of 1737 should be understood as an increment of the Official Parity for eliminating oligopsony power.
Some main lessons emerge from this dissertation. First, understanding the reasons of the specie flows in the Early Modern period demands comprehension of the specie-point mechanism. Second, the construction of the silver-points requires the location, collection and manipulation of the right data: market prices, exchange rates and costs of arbitrage. And third, the interpretation of the arbitrage results needs to focus on the special microeconomic features of the bullion market structure. This is an original approach which will provide a lot of insight into the workings of commodity money.
The first chapter describes the Castilian stagnated legislation and immobile institutions established with the aim of avoiding bullion outflows: fixed prices and bans on export. The second chapter analyses the specie-point mechanism in the institutional setting of bullion controls: the case of silver Pieces of Eight between Cadiz and London during the period 1729-1741. Arbitrage equation shows a systematic bias between the spot exchange rate and the arbitrated parity corrected by the 1737 devaluation. The third chapter analyses the specie-point mechanism in the institutional setting of free bullion movement: the case of gold and silver bars between London and Amsterdam during the period 1734-1758. London-Amsterdam bullion market was integrated, and arbitrage equation shows only few and non persistent breaks. The fourth chapter tells the story of the agents involved in the illegal exchanges of silver in Cadiz, and demonstrates that the smugglers were the French merchants who obtained the highest income of all merchants in Cadiz. The fifth chapter examines the contemporary Castilian reports against smuggling in order to describe how the illegal exchange took place. Smuggling was reserved to foreign merchants because they had achieved privileges which prevented them to be prosecuted. The sixth chapter demonstrates that the smugglers were organized in long-run networks which conferred them the market power to drive down bullion prices below the international price, and the international connections to illegally extract and distribute the bullion from Cadiz. The seventh chapter develops a static model of partial equilibrium for commodity-money in order to understand the workings of the oligopsonistic silver-commodity market and the effect of devaluation on the bullionist goal of treasuring silver. We will end offering some conclusions. Appendices explain the construction of the specie-point mechanism.

Texto completoThe market requires that exchanges are voluntary and the law may restrict the workings of a given market. This is the case with Castile bullionist regulations, which led to an illegal bullion market in Early Modern Cadiz. This paper focuses on the structure of this illegal bullion market in order to understand the logic of silver outflows. Arbitrage is explained by the presence of an oligopsony power that depressed the price of silver in Cadiz and created a systematic bias between domestic and international market prices. The lesson that emerges from this paper is that understanding the specie-flow mechanism in the Early Modern Period demands the comprehension of the bullion market structure for the place and time examined
