Resumen
This dissertation is comprised of a collection of poems preceded by a critical preface. The preface reconsiders the value of discontinuous poetic forms and advocates a return to lyric as an antidote to the toxic aspects of what Tony Hoagland terms “the skittery poem of our moment.” I consider poems by Wendy Xu, Kevin Prufer, Sharon Olds, and Stephen Dunn in depth to facilitate a discussion about the value of a more centrist position between the poles of supreme discontinuity and totalizing continuity. Though poets working in discontinuous forms are rightly skeptical of the hierarchies that govern narrative and linear forms, as Czesław Miłosz notes in The Witness of Poetry, “a poet discovers a secret, namely that he can be faithful to real things only by arranging them hierarchically.” In my own poems, I make use of the hierarchies of ordered perception in lyric and narrative forms to faithfully illuminate the collapsed structures of my own family history in the shadow of Detroit. I practice the principles I advocate in the preface, using a continuous form to address fractured realities in a busy, disordered age when poets often seek forms as fragmented as their perceptions. These poems are distinctly American, but because there is no true royalty in America, our great cultural and economic institutions—television, music, film, magazines, and big business—take the place of the castle (the book’s emblem) while Michael Jackson ultimately rises as the commanding dead king whose passing prompts contemplation of the viability of popular culture, family, history, and geography. The fallen structures that litter the work are many: the twin towers, chess rooks, bounce castles, nuclear families, the auto industry. However, the sole structure cohering the whole is that of a lyric voice whose authority is derived through lived experience and presented in rich, continuous poetic forms.

The diploma thesis is focused on corporate fraud problematic, on The Sarbanes-Oxley Act of 2002 and on problematics of internal control systems and corporate governance, which relate closely with the Sarbanes-Oxley act. The goal of my diploma thesis is to highlight the significance of corporate fraud problematic and create an integrated summary of requirements placed on companies, which either have to or want to comply with the Sarbanes-Oxley act. The opening part of the diploma thesis is focused on fraud theory, which is after that demonstrated on accounting scandal cases Enron, WorldCom and Arthur Andersen. The biggest losses were caused by fraudulent financial reporting. The Sarbanes Oxley act is a reaction on this fraud cases. The Sarbanes-Oxley act brought a range of significant changes in financial reporting, internal control, corporate governance, audit and other areas.

Uppsatsen är en tillämpning av Linda Hutcheons adaptionsteoretiska analysmodell på dokumentärfilmen The Act of Killing - en film som beskrivits som både modig, banbrytande, skrämmande, avslöjande och viktig, men också opolitisk, provocerande, vilseledande, manipulativ och exploaterande. Uppsatsen undersöker med hjälp av Hutcheons genomgripande metodfrågor vad, vem, varför, hur, var och när, hur frågor om representation kan uppfattas så olika och hur kritiken kan vara så polariserad kring filmen. Filmens komplexa bakgrund, innehåll och form kräver en bred och djupgående analys för att få fatt på vad som döljer sig bakom dramatiserade drömmar, fantasier, minnen, rekonstruerade mord, intervjuer, metainslag och bakom-kameran-scener. Uppsatsen går igenom bakgrunden till de massmord som begicks på omkring en miljon människor i Indonesien 1965/66, medialiseringen kring dem, fylld av inhemsk propaganda och exotiserande västerländsk rapportering, och filmprocessen för filmen. Filmen visar några av mördarna och hur de än idag åtnjuter en straffrihet vilken gör det möjligt för dem att för Oppenheimers kamera skryta om hur de gick till väga. The essay is an application of Linda Hutcheon's adaptation theory analysis model on the documentary film The Act of Killing - a film that has been described as both brave, groundbreaking, frightening, revealing and important, but also unpolitical, provocative, misleading, manipulative and exploitative. The essay examines with the help of Hutcheon's pervasive questions what, who, why, how, where and when, how representation can be perceived so differently and how criticism can be so polarized around the film. The film's complex background, content and form require a broad and in-depth analysis to grasp what is hidden behind dramatized dreams, fantasies, memories, reconstructed murders, interviews, meta parts and behind-the-scenes scenes. The essay examines the background of the mass murders of about one million people in Indonesia in 1965/66, the medialization around them, filled with domestic propaganda and exoticizing Western reporting, and the film process for the film. The film shows some of the murderers and how they still enjoy an impunity today, which allows them to boast in front of Oppenheimer's camera about their actions. The essay focuses on the representation of the persons involved in the events, of the real events in history and of Indonesians as an ethnic group and follows the same set of chapters as Hutcheon does in her book A Theory of Adaptation with the questions What, Who and Why, How and Where and When.

Resumen

The 2010 Affordable Care Act has affected access and availability to medical services because states have increased the number of individuals on Medicaid and health exchanges have offered coverage to those who previously lacked it. The purpose of this qualitative exploratory case study was to identify whether the Affordable Care Act affects access to and availability of medical services, and to identify alternatives to how medical practices are formed and operated to accommodate an increase in patients. The study was based on Geyman’s theory of economics and Glasser’s consumer choice theory. Research questions addressed the effects the Affordable Care Act has had on providers’ schedules and patients’ appointments. Data collection involved interviews with six health care providers (four from Michigan and two from Maryland), three administrators (one each from Michigan, Maryland, and Kentucky), and six patients (three from Michigan, two from Maryland, and one from Kentucky). Results showed that under the Affordable Care Act newly insured Medicaid individuals are seeking care more often, whereas those with private insurance are seeking medical treatment less often. Increased out-of-pocket costs were the reason given by privately insured individuals for the decrease in obtaining medical care. The study did not find evidence of patients waiting longer to book an appointment with a medical practice or shortened visits. The study will inform the efforts of providers to address changes in access and availability of medical care due to implementation of the Affordable Care Act.

This thesis is the start of a novel that explores the psychological complexities of maneuvering local politics, tense family dynamics, and romantic love through the lens of a man who proves to be unapologetically selfish, cunning, and surprisingly relatable. Set in the desert of Albuquerque, New Mexico, this piece forces the reader to engage with characters who are propelled by their own biases, experiences, and goals instead of a moral compass. The campaign trail raises questions of loyalty, prejudice, empathy, and determination in a city where nearly everyone is intertwined. Below is the official synopsis: James Rochford is technically the underdog in the 2012 New Mexico State Senate Election. He is the youngest to run for senate, has no prior experience in office, and has comparatively fewer resources in terms of money and name recognition. But James' charisma and cunning seem to give him an edge that no one else has. As the race heats up, James is caught up in a whirlwind romance and subsequent breakup which complicate his public image. Whispers of corruption and impending scandal jeopardize his chances. As James' family, romance, and election unravel, his sanity seems to depart with it, in a desperate attempt to win it all and maintain the grandiose life he clings to.

On my good days, I find that I am often generous with my species. I let the driver in the Hummer merge into my lane with a wave, pick up litter, open doors for stragglers, and give loose change to beggars. On my bad days, I too easily curse (quietly) at the rude and the clueless, keep my hands in my pockets, my head down, and my shoulders hunched. My gait becomes slightly simian. That I can swing with graceful agility from one orientation to the other (often without anyone actually knowing) used to disturb me. I suppose I grew up believing I had to be one kind of person or the other. Not anymore. Perhaps I'm finally reconciled to the fact that I am human; that is, a creature with a consciousness, a being of sometimes-exhausting contradictions, a repository of living memories, an almost-virtuous and curious animal. I've landed, finally, in gray territory, which is where, as it turns out, I always hoped I would. The personal essays in this thesis explore this fluid nature of my (our) creatureliness. As a Catholic priest and a writer, my intention was to use the sacraments of the Catholic Church (Baptism, Eucharist, Confession, Confirmation, Holy Matrimony, Holy Orders, and Anointing of the Sick) as points of departure, and to allow each sacrament to provide me a lens and a perch through which (and from which) I might see our species anew. Aware that these seven sacraments mark the life--from birth to death--of a Catholic, I saw them as a useful and invisible thread that would give these essays thematic cohesion. Recognizing that this exploration was going to be more spelunking than mountain climbing, this sacramental thread became a rope with which I could jump down into some fascinating dark places without getting lost or stranded. In the end, these seven essays attempt to get at a few questions that have haunted me for years: Why have I not given up on my species yet? Why do I still believe in the innate goodness of human creatures? From where do I draw the strength to go spelunking into the darkest warrens of the human heart? These essays eschew the easy answers. They rather delight instead in dark places, illuminated, for a second, by one shaky candle.

Il primo capitolo ha come obiettivo quello di individuare quali sono i problemi strutturali del mercato del lavoro italiano attraverso un cursus storico per individuare quali misure sono state attuate e i risultati ottenuti. Il secondo capitolo è dedicato all'analisi delle tipologie contrattuali riformate dal Jobs Act, al fine di capire quali sono stati i cambiamenti introdotti. Successivamente verranno analizzati i risultati ottenuti, se sono in linea con quanto era stato programmato e se i benefici hanno superato i costi. L'ultimo capitolo, il quarto, metterà alla luce le iniziative che sono state introdotte dalla legge 96/2018 e quali saranno i possibili scenari che verranno raggiunti nel breve e lungo perido.

The purpose of this study is twofold. Firstly, it is a feasibility study intended to contribute tofurther research on the municipal authority to mitigate green house gas emissions. This will bedone by studying the municipal authority on green house gas mitigation measures in threeSwedish municipalities. To fulfil the purpose the following questions are set to be answered.What is the municipal authority over green house gas mitigation measures in these threemunicipalities?- What is the formal ability of municipalities in Sweden to act on GHG mitigation?- What measures do these three municipalities use to mitigate GHG emissions?- How do the municipalities consider their climate authority?The study focused on measures within three sectors; traffic and transport; energy, andinformation and out-reaches. Transport and energy make up the main sources of GHGemissions in the municipalities, and information was a common measure.4 categories of authority were developed; Legal authority, Economic authority, Climatecompetence and Collaborations, this to get a picture of what influenced climate authority. Theidea for this came from previous research that involved aspects similar to the categories. Theresult showed that municipal climate authority is quite relative, the categories are relevant, butpolitical will and ambitions on tackling climate change are decisive. In the transport sector themunicipal authority was restricted due to the authority of other actors. The authority in theenergy sector was limited because national legislation had precedence.The municipal climate authority is considered strong within its own organisation, themunicipal role as wide and involving many responsibilities. The role was described as widerthan the municipal authority. Most of the climate measures are directed towards themunicipality’s own organisation, the premises of the municipality and the services it provides.Outside the municipal organisation and services, but within its geographic unit, in the specificmeasures developed in this study, the climate authority was weaker and mainly exercisedthrough collaborations. The municipalities are not using their climate authority in full. Byimplementing measures like climate considerations in public procurement, their authoritycould be improved.

Since the Food Safety Modernization Act (FSMA) was signed into law in 2011, the government has taken huge strides toward making the food safety system preventive rather than reactive. Specifically, the Preventive Controls for Human Food (PCHF) final rule has required collaboration from government officials, educational institutions, industry professionals, and stakeholders to assist in the rulemaking, education, and implementation of the new rule. The rulemaking process for the PCHF final rule took 4 years to finalize. The Food and Drug Administration funded a grant to the Illinois Institute of Technology’s Institute for Food Safety and Health (IIT IFSH) to help create an educational program about food safety risk-based preventive controls. Since then, the Food Safety Preventive Controls Alliance (FSPCA) has been coordinating training programs to certify food professionals as Preventive Controls Qualified Individuals (PCQI). After gathering minor statistical evidence through course evaluations for 10 FSPCA facilitated education programs, extension personnel of the Food Science Institute at Kansas State University found that the educational materials are a big help to those in industry and in regulatory agencies.

A Thesis submitted to The University of Arizona College of Medicine - Phoenix in partial fulfillment of the requirements for the Degree of Doctor of Medicine.
While it is known that over 266,000 Arizonans enrolled in health coverage through the federal Marketplace and Medicaid from October 2013 through May 2014, little analysis has been performed to examine whether enrollment by diverse racial and ethnic groups sufficiently reduced disparities in coverage. We obtained publicly available data from the Census Bureau comparing rates of uninsured by race/ethnicity from 2013 to 2014 in Arizona from the American Community Survey. The uninsured rate in Arizona for the total civilian no institutionalized population dropped from 17% in 2013 to 13.6% in 2014. The uninsured rate in Arizona for whites declined from 15.7% to 12.2%, for African Americans declined from 17.4% to 11.1%, for American Indian/Alaskan Natives declined from 26.9% to 24.1%, for Asian Americans declined from 15.1% to 11.0% and for Hispanic/Latino declined from 27.5% to 22.2%. We conducted interviews with nine community organizations in order to identify barriers that must be addressed moving forward to lessen insurance coverage disparities among various minority groups. Technological literacy and functionality, lack of funding, lack of personnel, physical vastness of many populations, language, and cultural differences were commonly identified as barriers to enrollment. Mistrust of government and confusion regarding the specific provisions within the ACA pertaining to Native individuals were also cited.

This study offers a critique of the First Nations Property Ownership Act (FNPOA), a contemporary proposal to implement private property regimes on First Nations reserves in Canada. First, I examine the arguments used by proponents of the FNPOA to motivate support for this legislation. I demonstrate how, despite its similarity with past attempts to privatize First Nations reserve lands, the FNPOA represents a re-articulation of these older proposals as a type of recognition, where the implementation of fee simple property on reserves is cast as “restoring” pre-colonial property rights regimes. Second, I discuss how this legislation informs discussions within Geography and Indigenous Studies concerning Marx’s theory of primitive accumulation. I argue the FNPOA would provide a number of mechanisms to facilitate the dispossession of Indigenous peoples from reserve lands. Finally, I look at how conflicts over First Nations land and property rights provide an important site from which to analyze how both the formation of colonized subjects and the continued existence of Indigenous subjects are inseparable from relationships with land. Specifically, I argue the FNPOA points to the act of settler colonial subject formation as part of the continued Canadian project of genocide, whereby attempts to reconfigure Indigenous relationships with land must be understood as attempts to eliminate Indigenous people as a subject position altogether. I conclude by discussing the need for Indigenous intellectuals and activists to engage in our own critical rethinking of the role reserves play, or could play, as sites for advancing an Indigenous politics of resurgence.

De acordo com a teoria lacaniana, o tema do ato é investigado a partir de duas entradas nesta dissertação. Na primeira, as modalidades de ato denominadas passagem ao ato e acting out e elaboradas por Lacan no seminário A Angústia (1962-63) são examinadas a partir dos conceitos de objeto a e angústia. Na segunda, o conceito de ato, definido no contexto de O Ato Psicanalítico (1967-68) é delineado a partir de cinco teses fundamentais. Essas teses nos conduzem, então, à concepção do caráter constitutivamente falho do ato, concepção essa que permite uma articulação entre a passagem ao ato falha e o objeto a. A prática psicanalítica num batalhão da Polícia Militar do Estado do Rio de Janeiro constitui o pano de fundo clínico deste trabalho.
According to the chief lines of Lacan s theory, we approach in the present study the theme of the act in two steps. Firstly, we investigate the types of act termed by Lacan in his 10th Seminary (1962-63) passage to the act and actingout in their connection with the concepts of object a and anguish. We than endeavor to characterize the concept of act, following Lacan s definition in The Psychoanalytical Act (1967-68), through the statement and commentary of five main thesis. These lead to the conception of the act as constitutively failed, which is at the basis of the connection between the failed passage to the act and the object a. The clinical background of the present study is provided by our psychoanalytical practice in the Military Police of Rio de Janeiro.

This thesis consists of a chamber-staged composition for soprano, baritone, modified Pierrot ensemble (flute, clarinet, piano, violin, viola and cello), Colombian tiple, and fixed media, together with an analytical paper in which I discuss my compositional techniques and their historical antecedents. The composition is an interpretation of an acute schizophrenic episode of a young female patient that is committed to a mental health facility. It was inspired by the need to bring awareness about mental illness and the struggles that these patients experience every day. In this work, I explore the inclusion of a folkloric instrument, the Colombian tiple, within a classical chamber ensemble to expand the color and timbre of the sound world of the composition. The purpose with this work is to investigate how much effect the value decrease following the expropriation has on the total compensation for acquisitions on expropriation grounds and the extent of acquisitions of entire properties where value decrease may have occurred. The value decrease originates from the business, which expropriation is made for. This value decrease is compensated in the influence rule in the Expropriation Act (1972:719). The reason value decrease has an impact on the total compensation is because no surcharge is given the compensation in the influence rule. While it three years ago was instituted a surcharge of 25% in the Expropriation Act (EA) for the compensation for the property's value at the acquisition date. The strongest reason for the introduction of the surcharge was to strengthen the property rights of property owners when their properties are acquired on expropriations purposes. But the difference in surcharge means that the compensation will be inconsistent, depending on whether the value decrease has occurred or not. The arising of the difference in total compensation has emerged from studies of the EA and its propositions. Furthermore, it emerges from the Environmental Code that properties acquired in its entirety as a result of environmental damage, i.e. activities that lead to damage to other properties, will also be compensated in the influence rule and thus no surcharge will be given. To investigate how many properties that have been acquired on expropriation purposes, where damage may have occurred and is compensated through the influence rule, there has been an empirical study of Trafikverket´s property acquisitions. Furthermore, Malmberget has been included in efforts to highlight the extent of land acquisition where properties may be subject to damages under the influence rule. In the empirical study, 166 properties acquired by Trafikverket in the past three years have been studied. 44 of these have been acquired for the construction of roads or railroads, whose activities may have resulted in a value decrease on the properties acquired. 122 properties were probably acquired as a result of environmental damage. Results from the study show that the influence rule might have been used in several acquisitions made in recent years and therefore had an impact on the total compensation. As the full compensation does not get the surcharge of 25%, the compensation as mentioned earlier becomes inconsistent. This does not seem reasonable when the motive behind the proposition was to strengthen the ownership. Thus, it should be the loss of the owner right that gets compensated and therefore the compensation through the influence rule also should be given the surcharge.
Syftet med detta arbete är att undersöka hur stor inverkan företagsskada kan ha på den totala ersättningen vid förvärv på expropriationsgrunder och i vilken omfattning förvärv av hela fastigheter, där företagsskada kan ha förekommit, har skett. Företagsskada är den värdeminskning en verksamhet, vilken expropriation sker för, leder till på fastighet som ska förvärvas. Denna skada ska ersättas enligt influensregeln i expropriationslagen (1972:719). Anledning till att företagsskada har påverkan på den totala ersättningen är att det inte utgår något påslag för ersättning enligt influensregeln, medan det för tre år sedan instiftades ett påslag om 25 % i expropriationslagen (ExL) för den ersättning som ska utgå för fastighetens värde vid förvärvstillfället. Det starkaste motivet till att införa detta påslag var att stärka äganderätten för fastighetsägare när deras fastigheter förvärvas på expropriationsgrunder. Skillnaden med påslaget kan leda till att ersättningen blir inkonsekvent, beroende på om företagsskada föreligger eller inte. Att det uppkommer en skillnad i den totala ersättningen har framkommit i studier av ExL och dess propositioner. Vidare framkommer det av miljöbalken att fastigheter som förvärvas i sin helhet till följd av miljöskada, d.v.s. verksamhet som leder till skada på annan fastighet, även denna ska ersättas enligt influensregeln och inte ges något påslag. För att undersöka hur många fastigheter som har förvärvats på expropriationsgrunder, där skada som ska ersättas enligt influensregeln kan ha uppkommit, har en empirisk studie av Trafikverkets fastighetsförvärv gjorts. Vidare har även Malmberget inkluderats i arbetet för att belysa omfattning av fastighetsförvärv där fastigheter kan vara utsatta för skada enligt influensregeln. I den empiriska studien har 166 fastigheter förvärvade av Trafikverket under de tre senaste åren undersökts. 44 styckena av dessa har förvärvats för att uppföra anläggning, vars verksamhet kan ha lett till företagsskada på förvärvad fastighet. 122 styckena har troligen förvärvats till följd av miljöskada. Resultatet från studien visar att influensregeln kan ha använts vid flertalet förvärv under de senaste åren och därför haft en påverkan på den totala ersättningen. I och med att ersättningen i sin helhet inte ges påslaget om 25 % blir ersättningen som tidigare nämnt inkonsekvent. Detta känns inte skäligt då det i propositionen framgår att det är äganderätten som ska stärkas. Således bör det vid förlorande av äganderätt, till följd av förvärv på expropriationsgrunder, utgå ett påslag även för ersättning som ska bestämmas enligt influensregeln.

This thesis discusses the multifaceted status of the photograph, as a contribution to understanding the mechanics of the production of meaning within the photograph. In order to get a better view of how photographs function, I both revisit discourses that have dealt with medium specificity issues and use my own practice, designing an apprehension model which can assist in the achievement of a more rigorous conception of the photograph. An integrative literature review, based on Photography discourses and debates shaped by both theorists and practitioners, provides the tools needed for defining the medium’s unique and shared properties. Ontological synecdoches of the photograph, issues of representation, time, automatism, agency, the twofold nature –trace and picture- as well as depiction theories of the medium are put into scrutiny towards formulating an apprehension scheme. This body or knowledge, along with my visual practice’s research outcomes, informs the construction of an appropriate model for understanding the medium’s effect. In specific, this study designs and applies a synthesized model of thought which considers photographs as a fixed unity of interdependent links in the chain called ‘act of photography’. This model is based on the parameters that contribute towards a photograph’s apprehension –Operator, Apparatus, Scenery, Photograph, Viewer (OASPV). A thorough illustration of the application of this model onto a specific photograph is provided, showing how a verbal articulation of apprehending a photograph can take place in order for bad or poor readings to be avoided. An explanation of the working strategy I applied throughout my creative practice along with a discussion upon the images chosen for the portfolio accompanying this thesis, is offered. In specific, it is shown how the apprehension scheme is reflected in my practice, along with a contextualisation of my photographs -placing emphasis in notions such as the ordinary, ineffable, serendipity, trace and picture as well as similarities to the work of other practitioners. This thesis discusses the elements that formulate the encrypted information inscribed on the surface of photographs, namely it unfolds their layers throughout creating, perceiving and conceiving them.

The solution, an infill language of columns, beams and gravity walls, is ordered by interpreting these ideas into architectural elements that express an open and harmonious environment that encourages the creative spirit to flourish.

Theoretical issues are also discussed, including the validity, criticisms, artistic nature and ethical concerns of autobiographical filmmaking. The filmmaker stresses the universality of her story, and how, despite the film's very personal nature, it is applicable for anyone who has dealt with the illness and/or disability of a parent.

This dissertation is a discussion of the challenge that cases of over-determination pose to Act-Consequentialism. Although there are many realistic examples of such cases – for example, pollution, overfishing, or the election of an inappropriate politician – I consider structurally purer examples, one of which I call “Case One.” Suppose that you and I independently shoot and kill a third person called “Victim.” Our bullets arrive at the same time and each shot would have killed Victim by itself. Finally, Victim would not have been killed, if neither of us had pulled the trigger. According to the Standard Version of Act-Consequentialism, an action is wrong if and only if it has an alternative whose consequences would be intrinsically better. Case One challenges the Standard Version because there does not seem to be such an alternative to my action: Victim would have died by your shot if I had not shot him, and similar remarks apply to your action. The dissertation is structured as follows. After Chapter One, which briefly introduces the main issues of the dissertation, I turn to Chapter Two – “Preliminaries” – where I outline the Standard Version and highlight the main characteristics of over-determination cases. These cases are divided into cases of redundant difference making and cases of redundant causation. Cases of redundant causation are subdivided further into cases of causal over-determination and pre-emption. I make an important stipulation in this chapter. I say that our actions in Case One and similar cases are “redundant negative difference makers.” In Chapter Three – “Replies” – I consider whether the proponent of Act-Consequentialism might question the intuition that you and I, respectively, act wrongly in Case One. The proponent might accept that we have this intuition but explain it away, or she might deny that we have the intuition and instead point to something else that is wrong in this kind of case. For example, she could suggest that although neither you nor I act wrongly individually, we act wrongly together. I argue that these replies are problematic.  For instance, explaining away this intuition might also force us to explain away intuitions that support the Standard Version. In Chapter Four – “Causal Consequences” – I discuss an alternative version of Act-Consequentialism that might seem to fare better. The Standard Version interprets the term “outcome of an action” as referring to the entire possible world that would obtain, if the action were performed. The version I have in mind, the “Causal Consequences Version of Act-Consequentialism,” understands “outcome of an action” as instead referring to the causal consequences of the action. It seems clear that you and I, respectively, cause the state of affairs that Victim dies in Case One. However, I show that the Causal Consequences Version has a number of unattractive implications. In Chapter Five – “the Non-Standard Version” – I suggest another alternative version of Act-Consequentialism. This version – the Non-Standard Version – implies that you and I act wrongly in Case One. Roughly, the Non-Standard Version says that an action is wrong if and only if it has an alternative whose consequences would be intrinsically better, or is a redundant negative difference maker. The Non-Standard Version is similar to a principle suggested by Derek Parfit. However, I shall argue that the Non-Standard Version is preferable to Parfit’s principle. In Chapter Six – “Further Cases” – I discuss a number of cases that challenge the Non-Standard Version. For example, what would the Non-Standard Version imply in a case very similar to Case One but where I would have killed another person, if I had not shot Victim? I argue that the Non-Standard Version handles this and other problematic cases, and that it is therefore a plausible alternative to the Standard Version.

The role of the prosecutor and the exercise of prosecutorial discretion can have an enormous impact on the outcome of criminal proceedings. The exercise of prosecutorial discretion is, however, often secretive and misunderstood. There have been concerns that a lack of accountability and transparency can result in a fertile bed for corruption. Australia has acknowledged this and taken steps to address the issue, but these measures have not come without their own costs. The concern is that these measures may, if anything, hamper the administration of justice and result in an inefficient criminal justice system. Indeed, these concerns have been noted by Singapore who has hesitant to replicate the Australian position for fear of the inefficiency in the criminal justice system that would inevitably occur. Accountability and transparency is thus weighed up against the efficient administration of justice. Both are necessary in a functioning criminal justice system, yet each comes at the expense of the other. This can be demonstrated by Professor Herbart Parker‘s ‗Two Models of Criminal Processes‘ – the Due Process and Crime Control models. How then does one balance the two competing interests? As this paper will argue, there is no perfect system and a careful examination of a community‘s cultural values and the objectives of criminal justice system will be necessary to find the appropriate equilibrium in the balancing act of prosecutorial discretion.

Ce moment électif, où le psychanalysant passe au psychanalyste, Lacan le nomme acte analytique. En 1971, Lacan nous fait une proposition pour le moins surprenante : grâce à son art, l’écrivain James Joyce en serait arrivé au même point que l’analysant en fin de cure. La passe déborde-t-elle la situation analytique et concerne-t-elle la création artistique ? Dès lors, peut-on penser qu’il existe un lien entre acte de création et acte analytique ?Afin de montrer en quoi l’acte de création du compositeur A. Schoenberg est concerné par les enjeux de la passe, nous avons choisi d’extraire trois points cruciaux : le rapport au savoir, la cause du désir et le symptôme. Les écrits d’A. Schoenberg nous permettent d’avancer que son acte de création présente des similitudes avec ce qu’on peut attendre d’un analysant ayant accompli la passe. The Pass is the procedure invented by Jacques Lacan in an attempt to seize and understand how emerges the desire of the analyst.Lacan named Analytic Act the point at which the subject passes from the position of the analysand to the position of the analyst. In 1971, Lacan suggested a surprising proposal: thanks to his art, the writer James Joyce would have attained the same point as the analysand reaching the end of his analytic cure. Does the Pass extend beyond the analytic situation and could it be related to the artistic creation? Consequently, does it exist a link between the act of creation and the analytic act?In order to show in what way the act of creation of the composer A. Schoenberg maintains connections with the issues of the Pass, we chose to extract three crucial points: the relation to knowledge, the cause of the desire and the symptom.A. Schoenberg’s writings allow us to assert that his act of creation shares some similarities with what is awaited from the analysand going through the Pass. He there attests a change in his relation to the knowledge required to create an original compositional system. He succeeds in subverting the composition laws guided by an inner necessity (cause of desire). A. Schoenberg’s music presents itself as a handling mode of the real. The environmental organisation F/ACT Movement started as a reaction to the unsustainable business that the fashion industry represents. Their ambition is to change the fashion industry and give it a sustainable direction. They intend to accomplish this in collaboration with counties, universities and companies - but their prime audience is the consumers. The purpose of this essay was to study how F/ACT Movement engages their audience on social media around the subject sustainable fashion. In addition I aimed to examine how it can help them shape a strong community and long term public relationships. To attain the purpose of this study the theoretical framework includes theories of sustainability, consumption behavior and multimodal critical discourse analysis (MCDA). MCDA helped me analyze how F/ACT Movements structures language and visual text to engage the followers. Furthermore I added theories of social identity, communities on digital platforms and public relations. The method used in this essay was a multimodal discourse analysis, which intent is to study the meaning of how language and visual texts are constructed. Eight Instagram posts were studied and several patterns were found in the analysis. The results showed that F/ACT Movement engage their followers by using both a strong and confident language as well as visual symbols that benefits fashion as a sustainable lifestyle. Moreover they present sustainable facts and solutions which support the ideology of how a green lifestyle and consumption behavior can create a sustainable future. The results also showed that F/ACT Movement combines several different discourses in a complex way, which indicates that their vision is to contribute with a change on a social and cultural scale. Finally the results showed that F/ACT Movement values the dialog, community and relationship with their followers deeply. By inviting their followers to be a part of the group identity “sustainable consumers” they create a strong community. Furthermore they are communicating with an audience who already has knowledge and a high interest in sustainable fashion, which gives them a beneficial position to build strong public relations. In conclusion the study shows that F/ACT Movement uses a strong but friendly approach as a strategy to make the fashion industry a sustainable business.

Investment law is one of the controversial disciplines in law. Since arbitration became more popular the number of arbitral cases, in terms of Bilateral Investment Treaties (BITs), also increased. It was found that the inconsistencies in the language used in the treaties caused most conflict as each person interpreted the treaty differently.1 Precisely in 2013, the South African government introduced a new Bill, The Promotion and Protection of Investment Bill (the Bill). The Bill was initiated in response to the arbitral case of Piero Foresti, Laura de Carli and Others vs The Republic of South Africa ICSDI, ARB(AF)/07/. The South African government became concerned because foreign investors challenged Black Economic Empowerment (known as BEE) on an international level in an arbitral matter. The government was concerned that certain policies would not be protected internationally, specifically arbitration as a dispute settlement mechanism.2 Some of the BITs were terminated between South Africa and various countries, after the draft Bill was introduced on the 1st of November 2013. BITs were normally used to regulate the investment regimes. After the Bill was passed and the existing BITs were cancelled, a revised Bill was introduced on 22 July 2015.3 The Act is now known as The Protection of Investment Act, Act 22 of 2015 (the Act) and will come into effect on a date to be determined by the President of South Africa and as published in the Government Gazette. After a careful study and analysis of the Act4 the Department of Trade and Investment has acknowledged that the Act is not in line with the Southern African Development Community (SADC) Protocol and their defence is that the Protocol has been through a review process and that the changes made to the Protocol would be in line with the act. It is however uncertain whether the Protocol and the Act would be in line with each other. There are numerous questions regarding the fact that South Africa is bound by the SADC Protocol and if it would be possible to pass the Act with regards to South Africa’s international obligations. Many of the BITs between South Africa and foreign investors have not yet been terminated and they are still protected under the BITs.5 Numerous people are of the opinion the Act should include the ISDS system or at least be more specific regarding the measures that should be taken before the parties can refer the dispute to arbitration. State-to-state arbitration is also a difficult route to follow because foreign investors would have to approach their government to get involved in the dispute. ISDS arbitration should be included in the South African Act, as it would restore the foreign investors trust in the system and might encourage more Foreign Direct Investments (FDIs). In a country where FDIs are important for economic growth, it is important to find a balance between (1) the government’s sovereign right to implement domestic policies, (2) its duty to protect foreign investors and (3) its objective of promoting sustainable economic growth.6 The fact that South Africa drafted its own investment legislation is a step in the right direction. The law is evolving alongside the new trends of international law regarding FDI. It is however important that the Act should be reconstructed in terms of SADC’s Protocols so that South Africa may meet its international obligations. Furthermore, the Act should contain the Investor- State Dispute Settlement (ISDS) system and be more specific regarding the procedures that should be taken before the parties are allowed to refer the matter to arbitration. To include the ISDS system and make the necessary changes with regards to SADC, would encourage FDIs and have a positive effect on the development and growth of South Africa.

SOA ställer bland annat krav på att bolagen har ett välutvecklat internkontrollsystem, vilket ska bidra till att den finansiella redovisningen blir mer korrekt. Genom SOA kommer företagens ekonomichef och VD att få personligt ansvar för företagens finansiella rapportering. De ska intyga att varje delårsrapport och årsrapport som lämnas är korrekt, skulle intygandet visa sig vara osant blir konsekvenserna böter och i värsta fall fängelse. De svenska företagen kommer i olika grad påverkas av ett amerikanskt arbetssätt vilket både kan ge positiva och negativa effekter. Syftet med uppsatsen är att utreda vilka effekter SOA får för tre Sydkraftbolag som nyligen har implementerat SOA.

Som undersökningsmetod har vi arbetat med fallstudier. Datainsamling har skett med hjälp av semistrukturerade djupintervjuer. Företagen vi har genomfört undersökningen på är Sydkraft AB, Sydkraft Nät AB och Sydkraft Försäljning AB. Sydkraftkoncernen ägs av ett tyskt energibolag, E.ON, och ett norskt elproducentbolag, Statkraft. Koncernen drabbas av SOA eftersom E.ON är introducerat på New York- börsen.

Eftersom SOA är en relativt ny företeelse har vi fått använda oss av två generella teorier, agentteorin och nyinstitutionell teori, som stöd i vårt analysarbete.

De olika företagen i Sydkraftkoncernen har i allmänhet varit positiva till implementeringen av SOA, då de kan ha nytta av SOA på flera olika sätt. Som exempel kan nämnas; ett beskrivningsverktyg för att hantera olika risker och kontroller i arbetet, harmonisera verksamheten och öka stringensen i bolagen. Negativa aspekter som dykt upp med SOA är att det krävs en allt för detaljrik nivå. Ytterligare en negativ aspekt är kostnaden för att implementera och hålla i gång systemet är hög. Dessutom kommer revisionskostnaden att stiga avsevärt. Trots alla dessa negativa aspekter ser bolagen mer positivt än negativt på SOA.

I vår undersökning har vi kommit fram till att kontrollen av agenten kommer att öka i form av ökad revision och därmed blir även agentkostnaderna större. Vi har dessutom kommit fram till att även om SOA är en tvingande förändring så har mottagandet varit överraskande positivt. Vidare har vi kommit fram till att förändringarna inte blir lika stora för de olika bolagen.

År 2002 infördes en ny lagstiftning i USA, Sarbanes-Oxley Act (SOX). Lagen är en reaktion på de redovisningsskandaler som ägt rum i landet där framstående företag varit inblandade. På grund av skandalerna tappade investerarna förtroendet för aktiemarknaden såväl som för revisionsbranschen. Ökade krav på företagens interna kontroller skall bidra till att minska fel i den finansiella rapporteringen, minska antalet bedrägerier samt återställa investerarnas förtroende. SOX berör såväl amerikanska som icke-amerikanska företag. Det som är avgörande för om företagen ska följa lagen är antalet aktieägare. Icke-amerikanska företag ska implementera lagen senast år 2006. Det svenska näringslivet har reagerat starkt på den del av lagstiftningen som handlar om intern kontroll. Reaktionerna tycks bero på att företagen drabbats av stora kostnader då de arbetar med att efterleva lagen. Anpassningen till SOX kan komma att medföra utgifter för berörda svenska företag på totalt över 1 miljard kronor. Det är stor skillnad mellan den interna kontroll som hittills varit praxis i Sverige och vad SOX avser med god intern kontroll. Då företagen fokuserar på att uppfylla de krav lagen ställer på intern kontroll riskerar de att tappa affärsfokus, alltså företagets huvudsakliga målsättning. Även företagskulturen spelar en avgörande roll då den är en annan i Sverige än i USA. Svenska företag är intresserade av processer som helhet medan amerikanska företag arbetar mer detaljorienterat. För svenska företag innebär det ett stort steg att börja redogöra för sina processer på detaljnivå. Syftet med denna uppsats är att kartlägga vilka effekter införandet av SOX har fått för svenska berörda företag samt att redogöra för vilken inställning svenskt näringsliv har till lagen. Undersökningen karaktäriserades av en kvalitativ metod. Det empiriska materialet samlades in genom besöksintervjuer med representanter från berörda svenska företag samt från ledande svenska revisionsbyråer. En sammanställning av de viktigaste sektionerna i SOX presenteras och exempel ges på de svenska företags intressenter. Ett antal företagsekonomiska teorier användes i den teoretiska och praktiska referensramen, dessa kopplades sedan till det empiriska materialet. I undersökningen framkom det att SOX är för detaljstyrd och formell för svenskt näringsliv. En god intern kontroll skapar tillsammans med hårda dokumentationskrav, nya rutiner och förändrade arbetssätt en bra struktur i företagen. Lagreglering av denna typ passar dock inte svenska förhållanden och självreglering anses vara en bättre lösning för att komma till rätta med problemen. Det har även konstaterats att lagstiftning inte är nödvändig för att minska fel i den finansiella rapporteringen och återställa investerarnas förtroende för kapitalmarknaden.

The Affordable Care Act (ACA) was designed to reduce the number of citizens who do not have health insurance, and reduce the prices of health insurance premiums. Using multiple regression analysis, the effects of the components of the ACA, along with baseline characteristics of the states, are examined in relation to ACA premium prices and the rate of uninsured. We find that premium prices are higher in states with more uninsured, and states with more obesity have more uninsured. This is most likely related to pre-ACA practice of excluding people with pre-existing conditions from health insurance coverage, yet still caring for those uninsured individuals in emergency departments and hospitals, while passing on the costs of their care to those with insurance. When examining the specific components of the ACA, we find that premium prices are lower in states that implemented state run Internet exchanges, and that less people are uninsured in states that implemented state sponsored Internet exchanges. The other elements of the ACA, namely the number of available insurance plans, and the number of ACO’s, had no effect on either the premium prices or the number of uninsured. Given the possible influence of the political opposition to the ACA on the general population’s cooperation with the ACA, the political dominance of the states was also examined, but found to have no effect on either premium price or the number of uninsured. In conclusion, we find that states with higher rates of uninsured have higher premium rates, and states with higher rates of obesity have more uninsured. After one year of the ACA, we can measure the effect of Internet exchanges on reducing premium prices and the expansion of Medicaid on reducing the uninsured.

This project looks at the experience of being sectioned under the 1983 Mental Health Act for acute psychiatric patients. The view is taken that sectioning in itself is a major intervention and hence should be the subject of research scrutiny. The views of two groups of participants, sectioned and informal inpatients, are compared using a variety of survey techniques including standardised questionnaires, structured interviews and open ended questions. It was found that being sectioned did not have a major impact on patients' experience of hospital treatment or their understandings of mental health issues although the sectioned patients did place less value on the medical aspects of their care and some sectioned patients showed a degree of internality for their health care that was not present in the informal group. Locus of control and transactional analysis were both found to be useful theoretical perspectives from which to examine patients' experiences. In general, the psychiatric patients who participated in the project valued the human contacts they made in hospital far more than their medical treatment. They also tended to attribute the cause of their psychiatric difficulties to non-medically based models of mental health based on childhood experiences, life events, human relationships and stress.

Identity is a concept discussed in many different areas and there are a lot of perspectives and theories around what it consist of and how it comes to be. But it is also a word seen and used in our daily lives in the form of self-image and self-esteem. Professor Beverley Skeggs notes that we can talk about identities in plural rather than in singular due to the context. From that we are children we intuitively explore who we are by playing and role playing and our identities and self-image is influenced by several factors. How we then appear to the world has an important role. The Swedish professor Margareta Melin tested the importance of physical appearance on her students which the results showed that different appearance got different responses. By changing our body appearance we can also change our self-perception. The things you wear have an effect on how you will act and appear. It may be that your choice of appearance is an expression for someone you wish to be or an alter ego. A concept that many artists investigated, e.g. Olivier De Sagazan. The appearance of ones body becomes like a masquerade of the human social life. Where we in the one hand confirm the roles and expectations we have in society, and in the other trying to find our own core in who we believe and feel we are. Jewelry have had and still has a big role in relations to the human identity and communication between people and societies. It also has the potential of being an interactive medium for the wearer. In my project I am exploring how physical attributes, jewelry, changes the self-image and how we as individuals, together with our surroundings, construct identities by the way we appear to the world. I’ve explored how objects we dress ourselves with can function as instruments for transformation to become aware of our body-appearance.

Cycling is increasing in popularity which is accompanied with a higher rate of injuries sustained due to collisions, crashes or falls. A high proportion of these events happen when the bicycle rider loses control of the bicycle. In order to improve bicycle rider control, the skill of riding a bicycle needs to be understood. Therefore, the overall aim of this PhD work was to explore bicycle rider control skills and to examine the effects of different constraints on the control of a bicycle. The first part of this thesis focuses on developing a valid and reliable methodology that can be further used for studying bicycle rider control skill. Firstly, a protocol to determine knee angle during cycling is being developed. Secondly, some technical approaches when studying muscle activity during cycling are being questioned. Lastly, a portable device based on a single angular rate sensor to record steering rate and bicycle roll rate was tested for reliability in an outdoor setup. Second part of the thesis examines the effects on bicycle rider control of three different constraints: 1) expertise, 2) body position and 3) cycle lane design. Results overall showed that all three constraints significantly affect steering and bicycle roll rate.

Regulation is a key part of product commercialisation, where different stakeholders must continually negotiate what are often conflicting regulatory drivers. High technology regulation is particularly problematic as is found in nanotechnology, and nanoparticle products, where there is much misunderstanding about what these products are and how they work. Nanotechnology is the application of small products, ranging between one hundred million and one billion times smaller than a metre, considered as the next 'industrial revolution'. At the vanguard of nanotechnology products, nanoparticles are examined in this study, where rapid technological advances are creating much debate within the discipline of law for how to best regulate the nuanced physicality of these products. Extant arguments have focused on how to regulate the R&D, production, sale, consumption and end-of-life of these products, with varying considerations of physicality which is pivotal to this endeavour. Critically, and fundamental to any discussion about regulating nanotechnology is whether these products sit inside of current regulations, or whether they require new regulatory approaches to more adequately capture their physicality. Confusingly, there has often been an erroneous presupposition that nanotechnology will function as a direct mirror of larger products, which is often not the case. On this basis, this study engages with the physicality of nanoparticles to build a foundation of knowledge, asking pivotal questions about regulation, to better inform academic and industrial regulatory discourses. Attention is given to regulatory frameworks including the Precautionary Principle, Regulation, Evaluation, Authorisation and Restriction of CHemicals (REACH), and potential for nanotechnology registries for monitoring nanoparticle physicality. Importantly, for any collection of highly nuanced novel physical products as found within nanotechnology, there can be no 'one-size-fits-all' with in depth examinations being made with different specific sectors to draw out the major challenges related to the physicality of this wide ranging collection of products.

The oil pollution act, american law regarding oil spills, was adopted by the american congress (and signed by president bush) on 18 august 1990 after the 1989 exxon-valdez grounding in prince william sound. This im@ortant act, is imposing new and increased liabilities on shipowners and operators for removal costs and damages resulting from spills or threatened spills in american waters. Individual states remain free to enact their own legislation on oil pollution liability tocomplement or supplement the federal law. The implications of the new us pollution law are beginning to emerge and the main problem is to know how tanker owners will be able to protect themselves adequately against the worst financial consequences of an oil spill in us waters
