Every historical film must contend with the possibility that its viewers will be scandalized by its mixture of fact and fiction, but no recent historical film has faced such pressure to justify its hybrid nature as Selma has, in large part because no recent film has taken on so momentous and controversial a historical subject: the civil rights marches from Selma to Montgomery that led to the passage of the Voting Rights Act in 1965. The renewed urgency of the issues Selma dramatizes, along with the film’s own commitment to the “moral certainty” of the civil rights movement, helps explain why S

It has been substantiated that legal fiction finds expression in the construction of a legal entity and the institution of fictitious transactions. Legal fiction is used to extend the legal regime of one object to another object, as well as the legal status of one subject to another subject. The circumstances existing nowadays effectively refute a statement that the system of international legal assistance stays on a way of linear progression. Many cases demonstrate a failure of international assistance, as the application of legal fictions becomes more common. This article is an attempt to offer a reasonable opinion on how to take an application of legal fiction within a service of legal process abroad. Based on an analysis of the origin and place of legal fiction, the author concludes that the fiction of service of legal process is a way to level down an existing standard of pro

The paper analyses the use of community conferencing for young people in various jurisdictions in Australia in the light of its impact in Indigenous communities. It argues that the manner in which these programs have been introduced has ignored Aboriginal rights to self-determination and has grossly simplified Indigenous mechanisms for resolving conflicts. In most jurisdictions, community conferencing has reinforced the role of state police and done little to ensure greater control over police discretionary decision-making. The changes have also been introduced in the context of more punitive

Building upon the concept of Human Rights Literature (HRL) developed by Pramod K. Nayar, the article conducts a critical analysis of the novel. Juvenile justice reforms in America today closely resemble the ones that occurred over a century ago. The reforms of both eras aim to separate juveniles from adults and emphasize rehabilitation over punishment. Why is policy repeating itself? In search of an answer, I look to a monumental series of liberal Supreme Court decisions made in the 1960s that constituted what is now known as the Civil Rights Era’s “due process revolution.” In these cases, the Supreme Court provided juveniles with procedural protections in attempt to prevent the manifestation of racial bias in the juvenile court. Both writers began their careers as social workers associated with War on Poverty programs; both were also influenced by the Student Nonviolent Coordinating Committee’s version of community action, implemented during the 1964 Freedom Summer. In their novels, Walker and Bambara explore the legacy of the civil rights movement, focusing on intraracial class divisions that community action was supposed to suture. In
