Texto completoThis research work addresses the problem being faced by developing countries in the commercial exploitation of their traditional cultural expressions (TCEs) by third parties without giving due attribution to nor sharing benefits with the communities from which these TCEs originate. This problem stems from the inability of customary law systems which regulates life in such communities to adequately cater for the protection of these TCEs. The legal systems of the developing countries have also proven to be ineffective in the protection of TCEs from such misappropriation and unauthorized commercial exploitation. This mini-thesis examines how TCEs have been protected domestically through national legislation and internationally through treaties and proposes means by which they can be protected in a manner that would preserve them, while promoting the dissemination of those which can be shared without destroying their inherent nature. This mini-thesis thus explores avenues through which the protection of TCEs would contribute to economic and human development in developing countries.

Texto completoThe aim of this study is the fulfillment of social rights through preventive action of the Government. Social rights are part of fundamental rights, legal positions of utmost relevance in the legal system, aiming the achievement of human dignity. Social rights are fundamental rights relating to the achievement of social justice through the transformation of social structures and, therefore, your non-compliance or violation represents serious disrespect to the founding principles of the Democratic State of Law. Currently, the existing legal mechanisms, in general, prioritize the repressive actions of the state. Therefore, the acting in defense of social rights (state duties of protection) usually happens after the non-compliance or violation of right. Then, this study proposes the preventive action of the Government for the realization of social rights, considering that this mode of working can be an achievement of fundamental rights, because it aims to prevent disrespect of such rights, and, aslant, a form of its implementation. In this sense, advocates the use of legal instruments of preventive character existing under Environmental Law for the protection of social rights, more specifically, the environmental licensing, which in this case would be called social licensing for cases of installation of industries.

Texto completoSea transport has seen strong growth over the past 30 years, which impacts on the marine environment, an environment sensitive to pollution. Maritime law generally adheres to a wait-and-see approach, developed as a reaction to successive environmental disasters, and arising from a much-needed reconciliation of shipowners' economic interests and the pressing nature of environmental issues. The States' decision making process is strongly influenced by the economic importance of sea transport who, in their triple function of coastal State, port State and/or flag State are often driven to make legislations of convenience in tax, economic, social and environmental matters. Measures could be proposed to develop laws in order to establish a balance within the IMO, and restore a transparent and genuine link between States, fleets and shipowners. In fact, modern maritime law allows room, in particular through lobbying tools, for other parties who intervene on the enactment and implementation of the law ruled by governance procedures. This widening of the normative process and avenues for sanction/redress to all stakeholders could ensure a better integration of environmental standards in maritime law. If the dialogue with local authorities is complicated by their status, at the same time victims, actors and obstruction of rights, the development of NGOs, currently limited in the international jurisdictional framework, would guarantee these objectives are achieved, including a better effectiveness of the law. The experience gained in the field of a CIFRE thesis, within the legal department of Surfrider Foundation Europe illustrates and establishes these avenues of improvement

Texto completoAfter being freed from colonization, the West African States have set up commonly economic integration organizations to promote their economic and social development.The creation of the majority of those organizations is based on the European example and they have an independent legal personality and a body with specific rules in charge of integrating uniformly the internal legal environment of the different Member States.The harmonious functioning of the system requires, among others, the existence of an independent structure designed to take control of the general balance organization and achieve a uniform interpretation of the Community norms. Within the framework of the WAEMU as well as in the ECOWAS, this protective function is delegated to integrated judicial bodies whose main mission consists in making sure that a submission to the law related to the interpretation and compliance with Treaties is effective.The goal of such a contribution is to point out that the settled protection device is functioning, on the one hand, by the cooperation mechanisms introduced by justice courts and the other components of the Community system and, on the other hand, by the judicial control over the community structures and the Member States

There are three major purposes of this study. First, to examine three female environmental organization leaders’ actions in the Hualien area, and their significant life experience in developing those actions; Second, to analyze the components of their successful environmental actions; Finally, to investigate the sources of hope and inspiration that the leaders draw on. Interview, participant observation and documents collection are main methods for this research. This study first generalized some significant life experience categories of the leaders’, which include: experiences of nature areas, returning to hometown, negative experiences, family, friends, organizations, sense of social justice, concern for children/grandchildren, principles, and admiration for literature. This study also discovered several essential factors for a successful environmental action: to be well informed about issues, to join an organization, to be politically active, to conserve yourself, to be patient/persistent, to use the media, to build a broad base of support, to use elastic action skill, to take legal action, to adopt pliable communication skill, and to treasure the land. In addition, the following sources of hope were found in this study, which the leaders draw on: the nature world, the support of colleagues and friends, the feedbacks came from previous efforts, the environmentalists who never give up, positive attitude, the sense of responsibility for the environment, and the concern for land and human beings. According to the research results, this study finally presented fundamental suggestions for the development of environmental education in Hualien area.
