Resumen
In this paper student Case Notes are analysed to exemplify the degrees of linguistic intricacy that come into play within the context of legal discourse – the ‘target discourse1-and to demonstrate that apprenticeship into this particular academic discourse community involves more than familiarisation with content specific material on the one hand and the control of common English structural conventions on the other. The discussion sets out to show that the intricate and often ‘hidden’ (as in ‘not made explicit’) linguistic demands academic discourses impose on NESB students need to be brought out into the open to highlight and clarify the association between specific lexicogrammatical realisations and generic meanings in the discourse. The paper concludes by emphasising the need for linguistically informed assistance for NESB learners at the tertiary level.

Resumen
A striking aspect of the current American cultural divide is divergent attitudes towards expertise, generally, and masking and vaccination to mitigate the Covid-19 pandemic, specifically. Liberal pundits profess shock that Red State America won’t just ‘trust the science’. On the right, politicians and television personalities reject mandates in the name of ‘freedom’. Lacanian discourse theory gives insight into this. The rejection of expertise is an example of an ‘hysteric discourse’ challenging a ‘university discourse’: the regime of experts. An hysteric discourse is a critique of rules imposed by experts by the subjects-subjected-to them. Hysteria can lead, in turn, to a ‘master discourse’ which rules through authority alone, without justification by external norms. I show how this helps explain the personality cult of love for Donald Trump. In addition, I suggest how these three discourses relate to law and jurisprudence.

Resumen
The paper describes legal media discourse, which is a hybrid discourse formation whose preconstructs are legal discourse and media discourse. The study was conducted using general scientific methods: induction, generalization, analysis, synthesis, description; and specialized linguistic methods: continuous sampling method, discourse analysis. The texts of legal media discourse presented on the official websites of the English-language media platforms such as The Guardian, BBC, The New York Times, The Washington Post, The Times, Washington Monthly, etc. form the empirical basis of the study. Legal discourse and media discourse are institutional discourses whose interaction results in forming an independent hybrid. The article provides the analysis of legal media discourse using the pattern of the institutional discourse description proposed by V.I. Karasik, which consists of the following criteria: typical participants, chronotope, goals, values, strategies, genres, precedent texts, and discursive formulas. The characteristics of the discursive hybrid under study are determined by referring to the preconstruct discourses features identified at the present time. The description of legal media discourse as a specific sphere of the intersection of law and media is viewed as not a mechanical sum of the characteristics of legal discourse and media discourse, but their synthesis which accounts for the independent nature of the hybrid discursive formation.

Resumen
Due to the nonrecognition of the origin of the business law in the commercial law, or, the law merchant, grown out of the customs and usages of merchants that existed before the emergence of law itself, and which, even in the process of formalizing the law into the legislation, characteristic for the continental law, in respect of commercial activities that introduced its public regulation, has reserved its self-regulatory and dispositive nature, the Russian legal discourse is quite different to what is generally represented as the Western legal discourse. Although Russian business law has been developed under the influence of Western law, the idea of the legislatively established legal surveillance of business activities, where written law is regarded as a progressive means of regulation, plays still an important role, and the breach of the law requirements is a sine qua non condition for civil liability (for damages) in Russia.

The article introduces legal discourse as part of a complex communicative activity. It is an integrative interdisciplinary phenomenon on the border of jurisprudence and linguistics. The research objective was to establish the constituent parts of legal discourse, which includes legal texts, related scientific literature, and other documents. Legal linguistics is a generalizing discipline that studies the interaction of language and law. The line between legal discourse and other discourses is hard to define. Legal discourse is characterized by unified subjects, procedures, circumstances, and impersonality, that is, the absence of recipient and sender, hence the abundance of impersonal verb forms and impersonal constructions. Legal texts are devoid of national marks, and the vocabulary has equivalents in other languages. The present research was the first to designate a set of texts that make up legal discourse, i.e. texts of laws, decrees, scientific literature on legal matters, various legal documents, judicial texts, texts of interrogations, court speeches, expert opinion, etc. Although legal discourse and legal linguistics have different subjects and tasks, they share the same object, i.e. the interaction of language and law. Legal linguistics is an integrative science based on linguistics and legal theory, which uses achievements of philosophy, psychology, sociology, ethics, cognitive linguistics, pragmalinguistics, linguistic conflictology, etc.

Resumen
The essay is an attempt to clarify some issues concerning the point of doing conceptual legal theory. It provides a reassessment of the relationship between conceptual legal theory, legal doctrinal scholarship and the legal practice. The analysis concentrates on what may be termed the ‘mainstream’ discourse on conceptual legal theory (characterised by authors like Hart, Raz, Dworkin, Finnis), and depicts the mainstream discourse as functionally connected to legal doctrinal scholarship. The essay argues that a more open commitment to reflecting current problems of legal doctrinal scholarship would make the position of mainstream conceptual legal theory more intelligible. If it wants to maintain its position as a complex theoretical discourse, mainstream conceptual legal theory must take direct responsibility for serving the epistemic needs of legal doctrinal scholarship – by way of providing conceptual and methodological foundations for it. Conceptual legal theory can make a contribution to doctrinal debates by relying on its ability to assess competing doctrinal claims in light of the epistemological characteristics of the legal doctrines in a modern legal system. The mainstream conceptual discourse can also have a vital role in in making sense of the external challenges to legal doctrinal scholarship. Such cionsiderations lead to a criticism of Hartian methodological legal positivism: it is blamed for becoming oblivious of the ways in which the mainstream conceptual discourse is parasitic on the conceptual tensions encountered or even generated by doctrinal scholarship.

Resumen
The paper as a research subject deals with the importance of a new interdisciplinary trend in studying the law – legal theology. The authors argue in favour of acknowledging the value of the theological dimension of law and legal awareness for the contemporary post-secular world. The aim of this paper is to substantiate the theoretical and practical value of legal theology for investigating legal awareness, shaping legal culture and legal theology of the contemporary Russian state. As a result of the theological dimension of law, the paper also focuses on spiritual and moral grounds of legal awareness, which determine legal values, ideals and beliefs of a personality as well as primarily impact the related criminal behaviour. For these purposes, to investigate legal awareness of a criminal, the authors appeal to orthodox anthropology based upon patristic concepts and teachings on combating egocentrism and aggression, as well as the reflection of passions which generate, originate the basic negative motives of legal mentality and legal awareness of an individual. The legal theology actualizes the ascetic study of legal awareness and enables in the context of the post-secular world to mobilize religious feelings and concerns in order to establish a steady rule of law.

Resumen
Abstract Despite the intention for precision and accuracy, legal discourse is oftentimes complex, archaic and ambiguous - which gives rise to contentious interpretation. Moreover, little or no attention is paid to the cultural dimension of legal discourse, which plays a critical role in the translation and interpretation of legal texts, as well as in the application of law. This paper endeavours to illustrate the impact the culture, or, more precisely, legal culture has on the way legal texts are construed or translated and to present problems which arise in the interpretation, translation and application of law as a result of cultural diversities

Resumen
This paper explores crime reports on verdicts and sentences in child/teenager murder cases in the British press with a view to demonstrating that ‘simplifi cation’ is one of the signifi cant values of crime reporting, regardless of the type of newspaper (Jewkes 2004). The analysis illustrates how both quality and popular British newspapers employ ‘binary oppositions’ (i.e. a typical feature of simplifi cation), such as good vs. evil, in order to communicate to their audiences the social status of victims and killers and at the same time traditional social values and norms. The employment of ‘binary oppositions’ in noun phrases that introduce and/or classify victims and killers thus enables newspapers to appeal to the public and act, or at least try to act, as moral guardians.

Resumen
Based on fieldwork interviews conducted in 2015–16 with lesbian, gay, bisexual, and queer-identified individuals who are from or living in small towns and rural communities in Croatia, this article draws from the personal experiences of these individuals and the ways in which they describe negotiating sexual difference, discrimination, and homophobia in their communities. This analysis reflects on the importance of locating antidiscrimination legal mechanisms in local contexts to assess the degree to which such an approach can address institutional and systemic discrimination based on sexual difference. The article explores how small town and rural contexts can raise specific concerns about the efficacy of antidiscrimination legislation as it has been developed in the EU and Croatia, and calls into question the neoliberal, individualist, and reactive legislative approach to the protection of sexual human rights. Finally, the article analyzes a recent survey/research on discrimination in the workplace that was conducted as a collaborative effort between several LGBTI and human rights organizations in Croatia and how these strategies can (re)produce neoliberal discourses of market incentives and diversity management in the workplace rather than address the structural inequalities that produce and enable discrimination.

Resumen
This article focuses on various approaches to the concept of legal collisions in the Russian legal science. Collisions first appeared in the Russian legal literature at the turn of the XIX–XX centuries. They were described as a clash or conflict of laws within the framework of private international law. Scientists developed a typology of legal collisions and linked them to living conditions in an attempt to consider the problem from sociological perspectives. Soviet researches studied legal collisions as part of private international and domestic law. In the 1960s, they declared the objective inevitability of legal collisions. Some major works on legal collisions were published in the 1970–1980s. Their authors chose legal positivism and considered a legal collision to be a divergence of legal or legislative norms. In the 1990s, legal collisions were determined as a discrepancy between an actual social attitude and its normative regulation, i.e., as a certain contradiction of claims or interests.

Resumen
The article views the specific communicative situation “frank confession” in institutional (legal) and personality-oriented (everyday) discourses. The author attempts to determine its genre affiliation in the discourses. Frank confession in legal discourse is a speech genre, which is addressed to the investigative bodies, it is characterized by a certain compositional structure, the accuracy of designation, concreteness, conciseness, standardization of presentation, the use of legal terminology and the absence of semantic ambiguity and expressive-emotional language means. Its communicative purpose is to outline the events and criminal actions committed by the author of the confession, to indicate the circumstances and information about other participants in the crime. Frank confession in everyday discourse is a speech action that varies in the degree of sincerity/frankness, does not have a strictly formal structure, correlates with three main types of actualization – a statement about guilt, an honest answer or a truthful utterance. In both discourses, there is a desemantization of the nominee’s attributive characteristic ‘frank’ found. The collocation «frank confession» functions as a term in legal discourse, it is conventionalized in everyday discourse, in which it is approximately equal to speech stamps that have lost their original connotation.

Resumen
The aim of the work is to present a comprehensive approach to the study of linguistic features of the UK written judicial discourse, describe its features in terms of professional communication and social practice. We give a consistent analysis of the major factors which scaffold judicial discourse as a whole – the formal structure of the legal discourse and the formal content (textual sources) of judicial discourse. We believe the legal sources (texts of previous decisions and texts of legislative acts) contribute to the multi-faceted nature of the judicial legal discourse in which we can observe various processes: legal interpretation, recontextualization of ordinary facts in the professional legal field, statutory treatment and nominalization of facts and deeds etc. These and other characteristics created the dynamic nature of judicial discourse which is commonly seen as a static relic. Proper analysis and understanding of the formal structure of the legal discourse and its formal content (textual sources) bears major importance when addressing the analysis of linguistic features of written judicial discourse. Based on the analysis, the main characteristics of the written judicial discourse of Anglo-Saxon system are identified and the framework for further study of its linguistic features is determined. From our point of view, the study of the phenomenon of professional discourse is interdisciplinary in nature, in particular, the study of written judicial discourse is based on the positions of sociologists, linguists, philosophers and legal scholars. We use description and synthesis methods, as well as comparative and contextual methods. The theo-retical significance of the study lies in the development of the comprehensive approach to the lin-guistic analysis of professional discourses as a means of actualizing a certain social practice.

Resumen
Governments in developing countries have adopted policies, laws, and programs to reduce carbon emissions from deforestation and forest degradation (REDD+), with the funding and rules provided by global institutions and transnational actors. The transnational legal process for REDD+, entailing the construction and diffusion of legal norms that govern the pursuit of REDD+, has been driven by discursive struggles over the purposes and requirements of REDD+. At the global level, the development of legal norms for REDD+ has been primarily influenced by coalitions committed to the discourses of ecological modernization, civic environmentalism, and to a lesser extent, climate justice. Through discourse analysis of the transnational legal process for REDD+ in Tanzania, I show how domestic efforts to operationalize REDD+ have been dominated by a government coalition that has emphasized green governmentality, made few concessions to the discourse of civic environmentalism, and completely neglected the climate justice claims of Indigenous Peoples. This case study reveals how discourse analysis may enhance the study of transnational legal phenomena by drawing attention to the complex interplay of global and domestic discourses and its role in shaping legal norms and reinforcing or challenging structures of power and knowledge within and across legal systems.

Resumen
The term sexting has come to be associated with media, political and public concern over young people’s involvement in the sending and/or receiving of nude or semi-nude images and/or videos of one another. Public discourses around sexting have framed the practice as problematic, reflecting long-held – and often very real – anxieties over young people and their sexuality. Of particular focus in relation to sexting have been the risks and harms associated with the practice and current or potential legal responses. Missing from much of this public discourse, however, have been the voices of young people themselves. In order to bring young people’s voices into the discourse, this article draws on research conducted with young people, as well as extensive legal and media analysis of sexting by young people. It contrasts these popular and legal discourses around sexting with the discourses of young people themselves, exploring the ways in which they understand and perceive sexting and how these perceptions converge with and diverge from dominant discourses. In this way, the article demonstrates the fundamental discord between such discourses, indicating the need to rethink legal responses to sexting between young people.

Resumen
The present work is related to such studies, the subject of which is the interaction of various institutional types of discourses. This article will focus on the biblical discourse, which, compared with the legal discourse, is considered by the author as a special type of interaction of believers based on legal norms. A special study of this issue is of undoubted scientific interest, because addressing this problem is important not only for the study of biblical discourse, which, unfortunately, is currently understudied. The fact is that many issues have not yet received proper coverage, for example, there is not enough information about what place a particular discourse occupies among other discourses, what specific features it possesses. Addressing specifically biblical and legal discourses is predetermined by the existence of an ontological connection between them. The study shows that the discourses’ points of contact are legal norms, which are an obvious significant structural component of interaction. The author primarily focuses on the structure of the legal norm and its functioning in the communicative process. Analyzing the biblical material, the author of the article comes to the conclusion that the legal norm: has a clear internal structure; is a convincing way of conveying necessary information; acts as a strategic tool that is used to express a communicative goal related to the correction of human behavior; in biblical communication, it is used by God as a means of influencing the interlocutor. The material for the study was the Book of Leviticus – a kind of legislative collection of rules, which served as the basis for the legal interaction of man and God. The results of the study are important for the understanding of the essence of biblical communication, for obtaining an objective idea of the process of biblical communication.

Resumen
The article examines means for constructing identities in legal informal discourse on Internet memes corpus. The aim of our research is to establish the regularities in the ways of identity constructions through the categorical oppositions and the stylistic means. The background of the research is the socio-constructionist and critical discourse-analysis approaches. We applied a methodology that integrates two approaches: a critical discourse analysis, as well as methods of humour analysis developed within the framework of a semantic approach to humour based on scripts (Script-based Semantic Theory of Humour (SSTH)). This involved identifying the subject positions based on linguistic and contextual analysis; examination of universal ways of how identities are expressed in informal legal discourse. The focus of our analysis was on the stylistic means that implement a certain way of professional identity construction. Our analysis indicated that identities appear fragmentary and are constructed with the means of different discourses; the central one is the professional legal, which is compared or contrasted to everyday discourse, informal, advertising and even “mom’s” discourse. The list of linguistic resources varies from legal terminology and neutral vocabulary to colloquial and thieves’ and mothers’ slang and invective vocabulary. The study expands the field of knowledge about the ways, stylistic and linguistic means of constructing professional identity through various possibilities of discursive subjects positioning.

Resumen
The paper considers legal media discourse as a discursive format that arose as a result of the interaction of legal discourse and media discourse. The research is aimed at defining the boundaries, structure and categories of legal media discourse. The material of the research are texts of legal media discourse including analytical articles on legal issues, regulatory legal acts, news materials and other genres implemented within the boundaries of the discursive format under study. The research applies methods of scientific description (systematization and interpretation), discursive analysis, as well as the simulation method. The paper provides an overview of research in the field of legal discourse and media discourse, which helps to get closer to defining the boundaries of the format under study, which represents a promising direction for further research. As a result of the systematization of the theoretical and practical material, the boundaries and structure of legal media discourse are determined. It is established that the boundaries of legal media discourse, which is a hybrid discursive formation, lie within the intersection of legal discourse with media discourse. The resulting discursive space has a field structure (core, periphery) and represents a discourse format that concretizes two types of discourse (legal discourse and media discourse) and is represented in turn by different genres. The article gives the description of the categories of legal media discourse, which is based on the model proposed by V. I. Karasik. The paper reveals typical participants of communication, their possible presuppositions, sphere of functioning, chronotope, goals and strategies, genre organization. The author also discusses the issue of implementing the expressive function in legal media discourse through the use of colloquial and obscene lexemes.

Resumen
Discursive attribution of texts functioning in a popular science law-related journal is analyzed. The agents and target recipients of interacting discourses and models of their interaction are characterized. Means of secondary categorization and conceptualization used by the agents of the popular legal discourse to adapt legal terms for non-specialists are described. Function is determined as a classifying criterion for the different discourse and text types forming the communicative space of the journal. The author comes to the conclusion that all institutional discourses and their “hybrids” represented in a popular science law-related journal construe a certain reality where great significance is given to legal values and principles.

This article analyzes the abbreviations and acronyms characteristic of the legal language, the role of abbreviations in replenishing the vocabulary, their cognitive-derivational and social essence in legal vocabulary, linguistic and historical factors, as well as the influence of the Latin language on their appearance. At present, the acronym vocabulary is becoming an integral part of the vocabulary of modern terminology, since the modern stage of the development of science and technology requires more concise communication tools for nomination, and most of the new terms are cumbersome and inconvenient to use

Resumen
Introduction. The activity of professional groups in the media environment has generated hybrid professional discourses that retain the typological features of the corresponding institutional discourses, while modified method and channel of communication has led to significant transformations in the structure of discourse and development of characteristic features peculiar to the media discourse. Aim and objectives. The study aims to determine the status and typological features of legal discourse produced and consumed within media. The objectives of the research include the correlation of the parameters of institutional discourse and media discourse, the role of each of them and the impact on the structure of hybrid discourse. Material and methods. The data include 300 texts of various styles and genres, constituting the content of professional legal groups on the social network Instagram: such as Internet memes; narratives representing the description of cases of professional practice. Results and discussion. In this study, the variety of legal discourse produced and consumed within the media is defined as an informal legal discourse on the basis that its core consists of the discourse-forming categories of institutional legal discourse. The sphere of functioning of the informal legal discourse is mass communication, which entails changes in the conceptual organization of discourse and the parameters of communication. The texts of the informal legal discourse acquire the characteristics of a “media text”, in which the verbal and media components are closely interrelated and combined with each other on the basis of a variety of principles. A specific way of communication determines a number of characteristics that bring legal informal discourse closer to everyday and humorous discourse and causes changes in stylistic and linguistic parameters. Conclusion. The analysis revealed the relationship between the parameters of the institutional legal discourse and the media discourse. The media environment is a fundamental condition that determines such parameters of the description of discourses as a method of communication and a mode. These parameters influenced changes in the structure of the institutional legal discourse at the communicative level and led to significant shifts in the communicative model due to the expansion of the concept of addressee. The media environment is a decisive factor in expanding the capabilities of a text that develops the characteristics of a “media text”. The specific way of communication has caused a number of characteristics that bring the legal informal discourse closer to the ordinary and humorous discourse and causes a change in the language norm.

Resumen
Based on participation observations and interviews with petitioners and petition officials in Chinese courts, this article analyzes how the petitioning discourse is organized and how it influences the dispute resolution process. It finds that the discourses between the petitioners and the petition officials are mismatched. The petitioners fight to frame their disputes in legal terms, while the petition officials use a “channeling discourse” to divert the petitioners to legal or extralegal institutions. The two types of discourse barely confront each other; nor are the substantive issues seriously debated. Since being channeled into other institutions does not resolve their disputes, petitioners start calling their petitioning experiences as injurious, blaming officials, and making new claims. Disputes are thus reproduced. The research sheds light on the petitioners’ legal consciousness and the operation of the petition system in China, and explores the contextual reasons why the phenomenon of mismatched discourses occurs in China.

Resumen
The article studies the way transformed traditional forms of popularization of legal knowledge in Russia impact the popular legal discourse. The form of popularization is perceived by the author as a permanent communicative model used by popularizers to increase legal awareness of non-specialists. Traditional forms of science popularization are subject to modification due to the emergence of new channels and means of communication. To interact with the target recipient, popularizers use a hybrid popular legal discourse, which enables them to disseminate legal knowledge in a comprehensible (adapted) form and maintain a steady interest of the community in legal issues. Depending on the communication channel used by the popularizer to convey the message to the audience, the author distinguishes a distant, distant-virtualized, monovirtual, contact-virtualized and contact types of popular legal discourse. Attention is drawn to the chronotope and participants of the types of discourse in question, as well as to the interdiscursive interaction in genre varieties of Russian popular legal discourse. Adapting to the changed conditions of communication, the polycode and hybridization potential of the popular legal discourse has reached a new level. In addition to informing the audience and shaping the public ideology, modern popular legal discourse also performs a recreational function. Entertainment is becoming an integral component of the texts of modern popular discourse, which makes it possible to gain and hold the attention of the public in a highly competitive environment.

Resumen
This research deals with the translation of legal discourse into English and addresses the related problems. As legal translation is becoming increasingly important in the present global world, legal discourse appears to be one of the most challenging areas in translation practice. Hence, the studies in the field of translation in general and institutional-legal interlingual communication, in particular, appear to be of immense topicality. The research objective is to identify the main strategies relevant for legal discourse translation. As a result of the translation techniques analysis, the following effective strategies of legal discourse translation into English have been considered: terminological construction, the strategy of "conscious omissions," and the strategy of "conscious simplifications". Their effectiveness in solving many problems of legal translation into English has been proved, taking into account the dynamics of the legal discourse development, as well as linguistic and cultural factors. The expediency of using the suggested approaches and principles as a linguistic guide is substantiated.
