The monograph is a comprehensive study of the current practice of resolving cases on determining the place of residence of children, the procedure for communicating with them separately living parents and other relatives; restriction and deprivation of parental rights; on the departure of children outside the Russian Federation and return within the framework of the Convention on Civil Aspects of International Child Abduction of 1980, the Convention on Jurisdiction, Applicable Law, Recognition and Enforcement and Cooperation in relation to Parental Responsibility and Measures for the Protection of children of 1996.The relations that develop between the child and parents, the child and the court, parents and the court, as well as parents as parties to the process are analyzed. The central place is occupied by the study of the content of the concept of the best interests of the child as a guarantee of the protection of his rights and the vector of development of the current legislation. The cases of abuse of parental rights and improper performance (or non-performance) of parental duties, illustrated by current judicial practice, are considered. The analysis is presented: measures of family legal responsibility, including restriction and deprivation of parental rights in connection with non-execution of a court decision on the upbringing of a child; features of the application of principle 6 of the Declaration of the Rights of the Child in resolving disputes about the place of residence of children; the possibility of taking interim measures in disputes between parents about upbringing; the ratio of legal and psychological categories in child-parent relations in order to apply special knowledge; the procedure for conducting forensic examinations in these categories of cases. Finally, the possibilities of out-of-court settlement of some family disputes, including through mediation, are investigated. For a wide range of readers interested in the rights of the child. It will be useful for students, postgraduates and teachers of law schools.

Person identification at passport control, at borders, in police investigations, and in criminal trials relies critically on the identity verification of people via image-to-image or person-to-image comparison. While this task is known as ‘facial image comparison’ in forensic settings, it has been studied as ‘unfamiliar face matching’ in cognitive science. This book brings together expertise from practitioners, and academics in psychology and law, to draw together what is currently known about these tasks. It explains the problem of identity impostors and how within-person variability and between-person similarity, due to factors such as image quality, lighting direction, and view, affect identification. A framework to develop a cognitive theory of face matching is offered. The face-matching abilities of untrained lay observers, facial reviewers, facial examiners, and super-recognizers are analysed and contrasted. Individual differences between observers, learning and training for face recognition and face matching, and personnel selection are reviewed. The admissibility criteria of evidence from face matching in legal settings are considered, focusing on aspects such as the requirement of relevance, the prohibition on evidence of opinion, and reliability. Key concepts relevant to automatic face recognition algorithms at airports and in police investigations are explained, such as deep convolutional neural networks, biometrics, and human–computer interaction. Finally, new security threats in the form of hyper-realistic mask disguises are considered, including the impact these have on person identification in applied and laboratory settings.

This chapter examines how forensic science and technology are reshaping crime investigation, prosecution, and the administration of criminal justice. It highlights the profound effect of new scientific techniques, data collection devices, and mathematical analysis on the traditional criminal justice system. These blur procedural boundaries that have hitherto been central, while automating and procedurally compressing the entire criminal justice process. Technological innovation has also resulted in mass surveillance and eroded ‘double jeopardy’ protections due to scientific advances that enable the revisiting of conclusions reached long ago. These innovations point towards a system of ‘automatic justice’ that minimizes human agency and undercut traditional due process safeguards that have hitherto been central to the criminal justice model. To rebalance the relationship between state and citizen in a system of automatic criminal justice, we may need to accept the limitations of the existing criminal procedure framework and deploy privacy and data protection law.

In this chapter, Blanshard examines one of the peculiarities of deliberative practice in the Athenian democratic governmental system, namely the tendency for decision-making to occur within the supportive presence of a network of peers. No major life decision, whether it related to the marriage of children, the sale of property, or the arrangements of funerals, was taken without wide consultation among friends and family. This means that when individuals were forced into situations of decision-making without the presence of their support networks, those decisions became, at the least, unsettling and potentially traumatic. One of the few occasions where we find such isolated decision-making is the Athenian lawcourt. The process of jury-sortition, combined with randomized seating allocation within the lawcourt, meant that the Athenian juror when he sat to deliberate was uniquely alone. Analysis of forensic rhetoric reveals how orators played up this sense of isolation and confusion.

This chapter approaches the work of the French sociologist, Pierre Bourdieu, from the point of view of embodied, extended, and distributed cognition. The concepts that form Bourdieu’s central dyad, habitus and field, are remarkably consonant with externalist views. Habitus is a form of knowledge that is not only embodied but fundamentally environment-dependent, and field is a distributed network of cognitively active positions that serves not only as a repository of social knowledge, but also as an external template for individual schemes of perception and action. The aim of this chapter’s comparative analysis is not to merely show that Bourdieu’s concepts are compatible with cognitive and epistemological externalism. They further demonstrate that the resources of Bourdieu’s theoretical framework can prove particularly useful for developing externalist accounts of culture and society—two areas that are significantly underexplored within mainstream debates in analytic philosophy.

Bioarchaeology and forensic anthropology offer unique perspectives on studies of mass violence and present opportunities to interpret human skeletal remains in a broader cultural context. Massacres and other forms of large-scale violence have been documented in many different ancient and modern contexts. Moving the analysis from the victims to the broader political and cultural context necessitates using social theories about the nature of mass violence. Massacres can be seen as a process, that is, as the unfolding of nonrandom patterns or chains of events that precede the events and continue long after. Mass violence has a cultural logic of its own that is shaped by social and historical dynamics. Massacres can have varying aims, including subjugation or total eradication of a group based on status, ethnicity, or religion. The goal of this edited volume is to present case studies that integrate the evidence from human remains within the broader cultural and historical contexts through the utilization of social theory to provide a framework for interpretation. This volume highlights case studies of massacres across time and space that stress innovative theoretical models that help make sense of this unique form of violence. The primary focus will be on how massacres are used as a strategy of violence across time and cultural/geopolitical landscapes.

Bolder economic policy could have addressed the persistent bouts of deflation in post-bubble Japan, claims this book. Despite warnings from economists, intense political pressure, and unconventional policy options to address this problem, Japan's central bank, the Bank of Japan (BOJ), resisted taking the bold actions that this book claims would have significantly helped. With Prime Minister Abe Shinzō's return to power, Japan finally shifted course at the start of 2013 with the launch of Abenomics—an economic agenda to reflate the economy—and Abe's appointment of new leadership at the BOJ. The BOJ's resistance to experimenting with bolder policy stemmed from entrenched policy ideas that were hostile to activist monetary policy. The book explains how these policy ideas evolved over the course of the BOJ's long history and gained dominance because of the closed nature of the broader policy network. The explanatory power of policy ideas and networks suggests a basic inadequacy in the dominant framework for analysis of the politics of monetary policy derived from the literature on central bank independence. This approach privileges the interaction between political principals and their supposed agents, central bankers; but this book shows clearly that central bankers' views, shaped by ideas and institutions, can be decisive in determining monetary policy. Through a combination of institutional analysis, quantitative empirical tests, in-depth case studies, and structured comparison of Japan with other countries, the book shows that, ultimately, the decision to adopt aggressive monetary policy depends largely on the bankers' established policy ideas and policy network.

What is at stake for how the Internet continues to evolve is the preservation of its integrity as a single network. In practice, its governance is neither centralized nor unitary; it is piecemeal and fragmented, with authoritative decision-making coming from different sources simultaneously: governments, businesses, international organizations, technical and academic experts, and civil society. Historically, the conditions for their interaction were rarely defined beyond basic technical coordination, due at first to the academic freedom granted to the researchers developing the network and, later on, to the sheer impossibility of controlling mushrooming Internet initiatives. Today, the search for global norms and rules for the Internet continues, be it for cybersecurity or artificial intelligence, amid processes fostering the supremacy of national approaches or the vitality of a pluralist environment with various stakeholders represented. This book provides an incisive analysis of the emergence and evolution of global Internet governance, unpacking the complexity of more than 300 governance arrangements, influential debates, and political negotiations over four decades. Highly accessible, this book breaks new ground through a wide empirical exploration and a new conceptual approach to governance enactment in global issue domains. A tripartite framework is employed for revealing power dynamics, relying on: (a) an extensive database of mechanisms of governance for the Internet at the global and regional level; (b) an in-depth analysis of the evolution of actors and priorities over time; and (c) a key set of dominant practices observed in the Internet governance communities. It explains continuity and change in Internet-related negotiations, opening up new directions for thinking and acting in this field.

This book offers a comprehensive framework for understanding contemporary presidential communication: the ubiquitous presidency. Presidents harness new opportunities in the media environment to create a nearly constant and highly visible presence in political and nonpolitical arenas. They do this by trying to achieve longstanding presidential goals, namely visibility, adaptation, and control. However, in an environment where accessibility, personalization, and pluralism are omnipresent considerations, the strategies presidents use to achieve their goals are very different from what we once knew. Using this novel framework, the book undertakes one of the most expansive analyses of presidential communication to date. This book provides an analysis of the global monetary system and the necessary reforms that it should undergo to play an active role in the twenty-first century. As its title indicates, its basic diagnosis is that it is an ad hoc framework rather than a coherent system—a ‘non-system’—which evolved after the breakdown of the original Bretton Woods arrangement in the early 1970s. The book places a special focus on the asymmetries that emerging and developing countries face within the current system, and therefore on the development dimensions of the global monetary system and of global monetary reform. The book proposes a comprehensive yet evolutionary reform of the system that includes: (i) provision of international liquidity through a system that mixes the multi-currency arrangement with a more active use of the IMF’s Special Drawing Rights (SDRs), the only true global currency that has been created; (ii) stronger mechanisms of macroeconomic policy cooperation, including greater cooperation in exchange rate management, and freedom to manage capital flows as a complement to counter-cyclical macroeconomic policy and other instruments of financial regulation; (iii) additional automatic balance-of-payments financing facilities, and the complementary use of swap and regional arrangements; (iv) a multilateral sovereign debt workout mechanism; and (v) major reforms of the system’s governance, based on a more representative apex organization, more equitable participation of emerging and developing countries in decision-making, and a network of global, regional, inter-regional, and sub-regional organizations.

A commodity chain refers to “a network of labor and production processes whose end result is a finished commodity.” The attention given to this concept has quickly translated into an expanding body of global chains literature. Research into global commodity chains (GCC), and later global value chains (GVC), is an endeavor to explain the social and organizational structure of the global economy and its dynamics by examining the commodity chains of a specific product of service. The GCC approach first emerged in the mid-1980s from world-system research and was reformulated in the early 1990s by development scholars. The development-oriented GCC approach turned the focus of GCC analysis to actor-centered processes in the global economy. One of the initial criticisms facing the GCC approach was its exclusive focus on internal conditions and organizational linkages, lacking systemic attention to the effect of domestic institutions and internal capacity on economic development. Other critics pointed to the narrow scope of GCC research. With the huge expansion in global chains literature in the past decade—not only in volume but also in depth and scope—efforts have been made to elaborate the global chains framework and to render it industry neutral, as partly reflected in the adoption of the term “global value chains.” Three key research themes surround these recent evolutions of global chains literature: GVC governance, “upgrading,” and the social construction of global value chains. Existing literature, however, still has theoretical and methodological gaps to redress.

The purpose of the monography is to elaborate the concept of the development of inter-regional investment cooperation by identifying the trends and features of its impact on the economic growth potential of the macro-region. The monography consists of the introduction, three chapters, conclusion and applications, as well as a list of references. The first chapter substantiates theoretical approaches to the essence, conditions and factors of regional development and the content of interregional investment cooperation in the current socio-economic conditions, analyzes the features of institutional design and the mechanisms for regulating regional cooperation for economic growth and development purposes, taking into account the Russian and foreign experience on the example of the European Union. The second chapter, basing on the economic analysis, identifies the trends in the development of the regions of the Central Federal District of the Russian Federation in terms of emerging macro-regions. A model has been proposed to assess the extent of the region’s economy’s involvement in inter-regional relations, which would allow to determine the dependence of variables such as interregional exchange, investment and gross regional product. Using mathematical modeling tools, the impact of these factors on the growth of the gross regional product of the Central Federal District of Russia, as well as its two regions — Moscow and Belgorod region — was evaluated. The third chapter identifies the prospects for the development of interregional investment cooperation in the Central Black Earth macro-region of the Central Federal District of the Russian Federation. The concept of developing inter-regional investment cooperation in the macro-region within the framework of the creation of a network of territories ahead of socioeconomic development (PSEDA) has been developed. The mechanism of inter-regional investment cooperation in the framework of the creation and development of the territories ahead of socio-economic development (PSEDA) has been adapted in order to form the points of economic growth in the macro-region. The main text of the monography is laid out on 234 pages and is illustrated with 21 drawings and 40 tables. The monography contains 4 applications. The references list includes 144 units.
