Resumen
This article offers a normative framework for affirmative action. It argues that affirmative action is not about diversity, but correcting historical injustice. The theory’s presumption is that racial groups would perform equally if not for history, because talent and hard work do not vary by race. The article explores the implications of that premise in answering the most provocative criticisms of affirmative action. Should white students pay for historical wrongs? Should African immigrants benefit from affirmative action? Are Asian Americans unfairly disadvantaged? The article proposes proportional representation as a limiting principle of affirmative action, because preferential treatment beyond proportionality contradicts the theory’s presumption of equal performance. The article proceeds to argue that some groups, like Asian Americans, rebut the presumption by fairly outperforming others and should not be penalized. Finally, the article argues that groups should not be classified on race per se, rather on a shared experience of injustice.

Abstract Mediation is mandatory for all separating and divorcing parents in Norway with children under 16 years. The participation of children is voluntary. Living arrangement preferences presented by children attending child-inclusive family mediation in Norway (n = 346, aged 4–18 years) have been examined. 47.1 per cent of children gave a living arrangement preference, and older children were more likely to express a preference for living primarily with the mother compared to an equal time-sharing arrangement. Children very often gave reasoned explanations for their wishes. Children’s utilisation of the potential in their participation supports future inclusion of children in mediation processes. The best interests of the child needs to be examined on an individual basis as children present various preferences that is not in line with a presumption of fixed time-sharing following parental break-up.

All else being equal, can an objective-seeming character of moral experience support a presumption in favor of some form of moral objectivism? Don Loeb (2007) has argued that even if we grant that moral experience appears to present us with a realm of objective moral facts—something he denies we have reason to do in the first place—the objective purport of moral experience cannot by itself provide even prima facie support for moral objectivism. In what follows, I contend against Loeb that granting the objective purport of ordinary moral experience is sufficient to shift a presumptive case in favor of moral objectivism, and this by constituting non-explanatory, relational confirmation that incrementally raises the prima facie probability that moral facts exist. More specifically, I appeal to a modest confirmational principle shared by Likelihoodists and Bayesians—namely, the Weak Law of Likelihood—in an effort to show that (i) at a minimum, granting the objective purport of moral experience establishes a middling scrutable probability for a sufficient but not necessary condition of moral objectivism being true, and that (ii) this moderate probability in turn constitutes evidence that makes it prima facie more probable than not that at least some form of moral objectivism is true.

The paper analyses provisions of Convention on the Civil Aspects of International Child Abduction with regard to a principle of the best interests of the child. The jurisprudence of the European Court of Human Rights on the best interests of the child dictates they should be interpreted broadly and cannot be identified by the application of the legal presumption. There is therefore a potential conflict between this reading and a narrow interpretation of this notion by the Hague convention according to which the best interest of the child in the case of international abduction is to return to the state of habitual residence. To secure the best interests of the child while applying Hague convention it is necessary to take into consideration respective international standards.

The molecular machines that mediate cell fusion are unknown. Previously, we identified a multispanning transmembrane protein, Prm1 (pheromone-regulated membrane protein 1), that acts during yeast mating (Heiman, M.G., and P. Walter. 2000. J. Cell Biol. 151:719–730). Without Prm1, a substantial fraction of mating pairs arrest with their plasma membranes tightly apposed yet unfused. In this study, we show that lack of the Golgi-resident protease Kex2 strongly enhances the cell fusion defect of Prm1-deficient mating pairs and causes a mild fusion defect in otherwise wild-type mating pairs. Lack of the Kex1 protease but not the Ste13 protease results in similar defects. Δkex2 and Δkex1 fusion defects were suppressed by osmotic support, a trait shared with mutants defective in cell wall remodeling. In contrast, other cell wall mutants do not enhance the Δprm1 fusion defect. Electron microscopy of Δkex2-derived mating pairs revealed novel extracellular blebs at presumptive sites of fusion. Kex2 and Kex1 may promote cell fusion by proteolytically processing substrates that act in parallel to Prm1 as an alternative fusion machine, as cell wall components, or both.

Cajal bodies (CBs) are subnuclear domains implicated in small nuclear ribonucleoprotein (snRNP) biogenesis. In most cell types, CBs coincide with nuclear gems, which contain the survival of motor neurons (SMN) complex, an essential snRNP assembly factor. Here, we analyze the exchange kinetics of multiple components of CBs and gems in living cells using photobleaching microscopy. We demonstrate differences in dissociation kinetics of CB constituents and relate them to their functions. Coilin and SMN complex members exhibit relatively long CB residence times, whereas components of snRNPs, small nucleolar RNPs, and factors shared with the nucleolus have significantly shorter residence times. Comparison of the dissociation kinetics of these shared proteins from either the nucleolus or the CB suggests the existence of compartment-specific retention mechanisms. The dynamic properties of several CB components do not depend on their interaction with coilin because their dissociation kinetics are unaltered in residual nuclear bodies of coilin knockout cells. Photobleaching and fluorescence resonance energy transfer experiments demonstrate that coilin and SMN can interact within CBs, but their interaction is not the major determinant of their residence times. These results suggest that CBs and gems are kinetically independent structures.

Proponents of giving the president the authority to use a line-item veto argue that the institutional change is needed to limit special-interest legislation and restrain spending. Opponents respond that it would grant too much added power to the president, thereby upsetting the delicate balance wisely crafted by the founding fathers. This article focuses on the presumption, evidently shared by both sides in the debate, that adoption of item-veto authority will have significant consequences in terms of budget outcomes and the distribution of power. Curiously, there presently exists little empirical support for the presumption that item-veto authority is important. Most studies comparing states with various types of veto authority have failed to detect significant effects associated with item veto. Additional tests of our own are consistent with these results. After reviewing the empirical evidence, we reconsider the alleged effects of itemveto authority by seating the popular depiction in an explicit model of the budgetary process. Formal modeling exposes logical inconsistencies contained in popular veto discourse. Further, the model makes clear that the predicted consequences of item veto, commonly projected as ubiquitous, in fact arise only in select settings.

This study examines the extent to which memory CD4+ T cells share immunosurveillance strategies with CD8+ resident memory T cells (TRM). After acute viral infection, memory CD4+ T cells predominantly used residence to survey nonlymphoid tissues, albeit not as stringently as observed for CD8+ T cells. In contrast, memory CD4+ T cells were more likely to be resident within lymphoid organs than CD8+ T cells. Migration properties of memory-phenotype CD4+ T cells in non-SPF parabionts were similar, generalizing these results to diverse infections and conditions. CD4+ and CD8+ TRM shared overlapping transcriptional signatures and location-specific features, such as granzyme B expression in the small intestine, revealing tissue-specific and migration property–specific, in addition to lineage-specific, differentiation programs. Functionally, mucosal CD4+ TRM reactivation locally triggered both chemokine expression and broad immune cell activation. Thus, residence provides a dominant mechanism for regionalizing CD4+ T cell immunity, and location enforces shared transcriptional, phenotypic, and functional properties with CD8+ T cells.

Designing the crossroads capacity is a prerequisite for achieving a high level of service with the same sustainability in stochastic traffic flow. Also, modeling of crossroad capacity can influence on balancing (symmetry) of traffic flow. Loss of priority in a left turn and optimal dimensioning of shared-short line is one of the permanent problems at intersections. A shared–short lane for taking a left turn from a priority direction at unsignalized intersections with a homogenous traffic flow and heterogeneous demands is a two-phase queueing system requiring a first in–first out (FIFO) service discipline and single-server service facility. The first phase (short lane) of the system is the queueing system M(pλ)/M(μ)/1/∞, whereas the second phase (shared lane) is a system with a binomial distribution service. In this research, we explicitly derive the probability of the state of a queueing system with a short lane of a finite capacity for taking a left turn and shared lane of infinite capacity. The presented formulas are under the presumption that the system is Markovian, i.e., the vehicle arrivals in both the minor and major streams are distributed according to the Poisson law, and that the service of the vehicles is exponentially distributed. Complex recursive operations in the two-phase queueing system are explained and solved in manuscript.

Information on the spatial and temporal distribution of protected marine species is critical for the development of conservation strategies. We examined a 12-year dataset describing the postnesting residence areas of 81 adult female loggerhead turtles (Caretta caretta) on the West Florida Shelf (WFS) in the northeastern Gulf of Mexico. The aggregation of loggerheads on the WFS represents at least four US recovery units for this protected species. We identified several seasonally persistent residence areas that were shared by multiple loggerheads on the WFS. The majority (69%) of individuals remained within a discrete residence area throughout the tracking period. We placed our results within the context of a related fishery management concern — loggerhead bycatch within the bottom longline component of the Gulf commercial reef-fish fishery. We characterized loggerhead residence areas and compared that information with fishing activity. Our results provide information on the distribution of WFS loggerhead residence areas and the extent to which residence areas overlap with areas of high fishing effort. Loggerheads were present year-round on portions of the WFS, within or near to areas with high fishing effort. Interactions among loggerheads and fishing activities could be reduced by conservation management strategies that consider these spatial and seasonal patterns of occurrence.

The ideal type of political organization is the nation-state, which leads to a presumption of state legitimacy when the state represents a community, based on ethnic origin or shared political values, that claims a right to persist. A nation-state tends to produce forced migration for three reasons: it contains more than one nation; the populace disagrees about the structure of the state or economy; or the state implodes due to the lack of resources. This paper elaborates a theory of refugee production and policy formation based on the dynamics of the nation-state. It concludes by addressing international refugee policy and practice in light of this theory and political changes following the end of the cold war.

The institution of separation legislative provisions of those EU member states that have chosen a separation legal regulation model, according to which the direct dependence of divorce on separation is recognized. It means that the spouse who wishes to dissolve the marriage must be in a state of separation issued by competent authority decision for some time (formal separation). Such EU member states as Denmark, Ireland, Italy have chosen the defined model for legal regulation of separation. Based on this study, the characteristic features of this model for legal regulation of separation are highlighted, namely: the main purpose of the separation institute in the legislation of these states is to provide spouses with time to decide on the future for their marriage: either divorce or reconciliation; a separate residence regime may be established by a decision of the competent authority (court, prosecutor, public administration) by mutual agreement or at the request of one of the spouses, despite the objections of the other; the existence of a clear list of grounds in the legislation to establish separation on the application of one of the spouses; the existence of any consequences of the individual residence regime is linked to the determination of the fault of one or both spouses in the establishment of a separate residence regime on one or another basis; separation would result in the termination of the marital property regime, the termination of the marriage contract, except for the provisions re- lating to the separate residence regime, and the termination of the paternity presumption. Although this model for legal regulation of separation is still relevant, the trend toward the simplification of legal regulation of divorce proceed- ings, has led to the complete rejection of separation as one of the prerequisites for divorce (in the event of mutual consent of the spouses to the termination of marriage) or reduction of spouse's stay in separation.

The aim of this article is to discuss the problems of submitting process letters to courts and public administration bodies via a postal operator as well as to indicate essential problems caused by unjustified differentiation of standards concerning the compliance with time-limits when the subject has limited or excluded opportunity to lodge a pleading a letter in person. Only in criminal proceedings and proceedings in cases of offences the participants have full freedom to choose a postal operator and to benefit from the presumption of lodging of a submitting a letter in the date of sending. In administrative proceedings, administrative court proceedings and tax proceedings, to be sure that legal deadline will be met, one should submit a letter to a court or a public administration body via a postal operator providing universal postal services. The article drew attention to a lack of consistency and consequence of the legislator relating to the regulation of submitting letters depending on the nature of proceedings and place of residence.

I am a US citizen working as an anthropologist (research and teaching) in Taipei. I live and work in Taiwan primarily because it allows me to work on local/globalizing and global/localizing popular culture simultaneously from the ethnographic inside and outside. On the one hand I have become an active member of the interpretive and creative communities I study, yet on the other, my foreigner status is irreducible and I am constantly reminded of the differences between my perspectives and those of my informants. For most anthropologists, those we represent and those to whom we represent them are different, and to be ethical we have to acknowledge their differences. But now the groups of my informants, students, colleagues and readers all overlap to varying degrees. In this paper, I will discuss the problems of addressing a public of informant-interlocutors – how to construct a “we” that can engage with shared problematics while recognizing the different positionalities of “I” and “you.” Trying to create such a “we” has forced me to challenge disciplinary boundaries, and to ponder what the lived experiences of globalization in the post-industrial non-West mean for the politics of both ethnography and critical theory.

Between April 2002 and April 2005, 210 estuarine dolphin groups were sighted, with 58 animals individually identified. Fifteen dolphins were photo-identified just once, while only two animals were sighted in 15 different months. Some individuals showed long-term residence (more than 3 y). Residence rates showed heterogeneity in the dolphin's permanence of the estuary, with 60% of the individuals with low numbers (<10) and only 7% showing high values for residence (maximum=45.9). Continued resightings of some dolphins support the regular use of the study area by the animals, despite some individuals that, after a long time without resightings were registered again. Individual range analysis showed that dolphins shared the same common area, the Caravelas River Estuary. A marked fluctuation in the number of photo-identified dolphins was observed in the study area, revealed by the high number of individuals with just a few resightings. The majority of the dolphins (60%) present a yearly residence pattern, as observed in other areas, suggesting that a few individuals show high fidelity for the area, while many other dolphins move constantly between different areas for unknown reasons.

AbstractData from 16-year-old Finnish twin pairs were used to estimate familial effects on religiosity and the modification of those effects by sex and residential region. The sample of 2265 twin boys and 2521 twin girls formed 779 monozygotic and 1614 dizygotic pairs, 785 of the same sex and 829 of opposite sex. We compared religiosity scores of twins living in more rural and traditional northern Finland with those living in the more urban and secular southern region. Girls had higher religiosity scores than did boys, and twins living in northern Finland had higher religiosity scores than those resident in southern Finland. Correlations for monozygotic twins were slightly higher than those for dizygotic twins, and covariance modeling found modest heritability of religiosity [11% (95% CI 0–24) for girls; 22% (95% CI 6–38) for boys], and substantial shared environmental effects [60% (95% CI 49–69) and 45% (95% CI 31–57)] among girls and boys, respectively. The correlation between shared environmental effects in boys and girls was estimated to be 0.84 (95% CI 0.73–0.99). In analyses distinguishing region of residence, girls living in southern Finland were found to have significantly higher unshared environmental effects than girls in northern Finland, while boys living in the urban south appeared to have lower shared environmental effects, and higher additive genetic effects, than boys living in the rural north.

Purpose – The aim of this paper is to identify the university student’s preferences for some important attributes of residence hall design. The study also attempts to highlight the differences and similarities in student’s preferences. Design/methodology/approach – The survey was distributed among students who were living in residence halls of a public university in Malaysia. A total of 752 students were recruited as participants. Data were collected using a self-administrated questionnaire. Students were asked to indicate their preferences rating a 4-point scale. The survey included questions concerning students’ preferences for residing in traditional and suite-style residence halls, single room and double room as well as rooms in which each student’s area is marked clearly. Collected data were analysed using PASW Statistics 17. Findings – The results indicated that, in total, students highly preferred residing in suite-style to traditional residence halls. Staying in a single room with shared bathroom was also preferred to double-sharing room. The results of study also indicated that living in a room in which each student ' s area is marked clearly is of great interest. The study proved significant differences in the students’ preferences based on their gender, nationality and study level. Practical implications – The outcome of this study can enhance the awareness of residence hall organizers and architects with regard to some of students’ priorities. Originality/value – The results give an important insight into student’s preferences towards their residence hall. The study provides statistic evidence unfavourably of traditional residence halls among the students of new generation. It also provides an insight into students ' greater needs and requirements for privacy.

Obstetric Fistula is a medical condition that involves an opening or perforation between the vagina and the bladder or the vagina and the rectum. It is a serious, life threatening and often debilitating medical condition that affects thousands of women in developing countries.The study consists of 270 obstetric fistula patients having all required information who were taking treatment at Jimma University Specialized Hospital in south west Ethiopia from January, 2011 to January ,2017. The log-rank and generalized wilcoxon test were used to explore the association between the recovery time and different independent categorical covariates. Then using different baseline distribution parametric models were employed to have an appropriate model for the recovery time/status of the patients based on Akaike information criteria (AIC) of the model. Result of Both log-rank and generalized wilcoxon test showed that there were significant differences among obstetric fistula patients in survival experience of weight , marital status, Residence, Incontinence, Antenatal care, mode of delivery, status of urethra and types of fistula of patients at 5% level of significance. Based on AIC log-normal gamma shared frailty model is an appropriate model and there is heterogeneity between patients with zone. The final model showed that marital status, Residence, Incontinence, Antenatal care, status of urethra and types of fistula were the determinants of recovery status of the patients at 5% level of significance. In Conclusion, the result showed that married women, rural residence, incontinence of urine more than 3 months, hadn’t antenatal care and completely damaged urethra were prolonged time recovery time of patients whereas having recto-vaginal-fistula shorten recovery status than vesico-vaginal fistula group of patients.

The increase in shared residential arrangements is driven by the belief that it is in the best interest of the child. The maintenance of contact between child and parents can mitigate negative consequences of separation. However, selection mechanisms may account for a positive relationship between shared residential arrangements and child outcomes. This study examines the association between children’s residential arrangements and their school engagement, focusing on the parent–child relationship as a mediator and selection mechanisms. Structural equation models are performed on a sample of 973 secondary school pupils with separated parents from the Leuven Adolescents and Families Study (LAFS; 2008-2011). The results suggest that more parental time is related with a better parent–child relationship, and this leads indirectly to higher school engagement. However, shared residence may also have negative consequences for children and is certainly not the only residential arrangement in which children have a good relationship with both parents.

Background: In order to meet policy drivers on death in usual place of residence, it is key to understand how shared decision-making can be facilitated in practice. An integrated care pathway was implemented in primary care in the North East of England to facilitate death in usual place of residence. Aim: To understand how, for whom and in which circumstances death in usual place of residence is facilitated. Design: A mixed method realist evaluation was employed. Local primary care practice death audit data were analysed to identify outcomes using a mixed effects logistic regression model. Focus groups and interviews with staff of the integrated care pathway and bereaved relatives were analysed to identify the related contexts and mechanisms. Setting/participants: Death audit data of 4182 patients were readily available from 14 general practitioner practices. Three focus groups were conducted with primary and secondary care staff, voluntary sector organisations and care home representatives. Interviews with bereaved relatives were carried out in participants’ homes ( n = 5). Results: A mixed effects logistic regression model indicated a significant effect of year on death in usual place of residence when compared to a model without year using an analysis of deviance ( p = 0.016). Qualitative analysis suggested that this outcome was achieved when a triad of ‘experts’ (comprising patient, family members/family carers/formal carers and healthcare professionals) used open communication strategies. Conclusion: An empirically supported theory of how, for whom and in which circumstances death in usual place of residence happens is provided, which has important implications for both policy and practice.

ObjectiveDisparities in treatment outcomes for traumatic injury are an important concern for care providers and policy makers. Factors that may influence these disparities include differences in risk exposure based on neighbourhood of residence and differences in quality of care between hospitals in different areas. This study examines geographical disparities within a single region: the Detroit metropolitan area.DesignData on all trauma admissions between 2006 and 2014 were obtained from the Michigan State Inpatient Database. Admissions were grouped by patient neighbourhood of residence and admitting hospital. Generalised linear mixed modelling procedures were used to determine the extent of shared variance based on these two levels of categorisation on three outcomes. Patients with trauma due to common mechanisms (falls, firearms and motor vehicle traffic) were examined as additional subgroups.Setting66 hospitals admitting patients for traumatic injury in the Detroit metropolitan area during the period from 2006 to 2014.Participants404 675 adult patients admitted for treatment of traumatic injury.Outcome measuresIn-hospital mortality, length of stay and hospital charges.ResultsIntraclass correlation coefficients indicated that there was substantial shared variance in outcomes based on hospital, but not based on neighbourhood of residence. Among all injury types, hospital-level differences accounted for 12.5% of variance in mortality risk, 28.5% of variance in length of stay and 32.2% of variance in hospital charges. Adjusting the results for patient age, injury severity, mechanism and comorbidities did not result in significant reduction in the estimated variance at the hospital level.ConclusionsBased on these data, geographical disparities in trauma treatment outcomes were more strongly attributable to differences in access to quality hospital care than to risk factors in the neighbourhood environment. Transfer of high-risk cases to hospitals with greater institutional experience in the relevant area may help address mortality disparities in particular.

East Lisbon is being exposed to large-scale urban regeneration processes, where luxury residential projects and mixed-use spatial developments are already underway. Thus, it is a living laboratory for “smart”, “creative” and “green” projects, as well as related urban public space interventions. Braço de Prata is an urban space overlooked by developers, being surrounded by obsolete industrial buildings. Concerning the recent interest in international investments in brownfield regeneration and greenfield developments, it represents an attractive urban terrain as a post-industrial working-class neighbourhood, where “smart” and “green” suggest transforming space so that both new and old residents can live and work together and share public space regardless of analysis on their environmental recognitions. The aim of this paper is to present an empirical evaluation model that examines the possible impacts of environmental negligence through the reorganisation of the physical and social fabric. The analyses focus on dwellers’ moral understanding of their changing environment as site-specific domains to address the unique conditions that affect transiently defined presumptions about the collective needs. Taking an evaluative approach in the Braço de Prata case, this paper demonstrates the specific socio-ecological implications of urban inequality in post-industrial neighbourhoods that could be threatened by new decisions, both through urban planning approaches and instruments.

While CD4 Th1 cells are required for resistance to intramacrophage infections, adoptive transfer of Th1 cells is insufficient to protect against Salmonella infection. Using an epitope-tagged vaccine strain of Salmonella, we found that effective protection correlated with expanded Salmonella-specific memory CD4 T cells in circulation and nonlymphoid tissues. However, naive mice that previously shared a blood supply with vaccinated partners lacked T cell memory with characteristics of tissue residence and did not acquire robust protective immunity. Using a YFP–IFN-γ reporter system, we identified Th1 cells in the liver of immunized mice that displayed markers of tissue residence, including P2X7, ARTC2, LFA-1, and CD101. Adoptive transfer of liver memory cells after ARTC2 blockade increased protection against highly virulent bacteria. Taken together, these data demonstrate that noncirculating memory Th1 cells are a vital component of immunity to Salmonella infection and should be the focus of vaccine strategies.

The fragments of the “Pseudonymous Greek Poets” constitute a collection of genuine and spurious quotations of renowned Greek poets – Homer, Hesiod, Aeschylus, etc. – on topics current in Hellenistic Jewish philosophy. The functions of these fragments are most often considered in terms used to characterize Hellenistic Jewish literature more broadly, i. e.: missionary literature, an apologetic defense of Judaism for a non-Jewish audience, an affirmation of Judaism for a Jewish audience, or a testament to the superiority of Judaism in the Hellenistic world. Each of these readings is guided by the presumption that Jews viewed the Hellenistic world as a foreign entity in need of some degree of “assimilation,” “resistance,” or “reconciliation,” and that Hellenistic Jewish literature reflects this process. This paper undermines this premise, demonstrating that the pseudonymous Greek fragments functioned instead to situate Hellenistic Jewish principles – as well as those who shared them – as part and parcel of broader Hellenistic trajectories.

Some recent archaeological landscape projects in Czechoslovakia have found a theoretical background within the concept of ’community areas‘. According to this concept prehistoric populations are approached as divided into communities. Each community is supposed to have shared a common territory within which most of its activities were concentrated. The community area consisted of several sub-areas (e.g. habitation areas, specific production areas, funerary areas, etc.) where activities different in function were performed (Neustupny 1986; 1991). The theory of community areas is not, however, limited to the identification of community areas themselves. It is rather a general approach, based on presumption and identification of patterns or structures underlying the archaeological record and reflecting structured human behaviour in the past. Using some concepts of the community area theory, this paper aims at analysing prehistoric habitation areas in the territory of Bohemia and articulating some general hypotheses concerning settlement processes and structures on various levels of complexity.

One goal of recent philosophy of mind has been to ‘naturalize’ intentionality by showing how a purely physical system could have states that represent or are about items (objects, properties, facts) in the world. The project is reductionist in spirit, the aim being to explain intentional relations—to say what they really are—and to do so in terms that do not themselves utilize intentional or semantic concepts. In this vein there are attempts to explain intentional relations in terms of causal relations, informational relations, teleological or functional relations, relations involving abstract similarity or isomorphism, and various combinations thereof. What makes these accounts naturalistic is the presumed objectivity and scientific respectability of the properties appelated to in the explanans. What makes them all reductive is their shared presumption that intentionality can be explained in terms that have a wider application to intentional systems as well as to systems that have no mental properties at all.

Purpose This paper challenges the value of consensus within the field of learning disability. In this commentary, the author argues that consensus threatens to silence multiple viewpoints, hides how power operates and stifles creativity. Design/methodology/approach The author focuses on two articles within this special issue to suggest that the consensus celebrated is more about a set of shared values, rather than a set of shared practices. This should make us question the depth of the field’s consensus. Findings The presumption that multiple paradigms can be “unified” actually hides how power operates to resolve disagreements among positive behaviour support, active support and human rights approaches. A similar erasure occurs in the language of “capable environments,” which the author argues obscures the role of individuals, relationships and organizational cultures in impacting quality of life. Research limitations/implications We need to create and build a new interdisciplinary field of challenging behaviour studies that is willing to embrace conflict and disagreement in research, policy and practice. Practical implications The author believes that this approach is more likely to empower people, including people with learning disabilities whose behaviour challenges, family members, and direct support workers because it is more likely to recognize their experiences and expertise. Originality/value A new multidisciplinary field of challenging behaviour studies may encourage more theoretical diversity that makes us challenge the value of consensus and embrace creativity.

Spaces are the backbone of intergenerational leisure interests and experiences. The objective of this research was to examine the spaces used in the practice of leisure shared by grandparents and grandchildren and their link with the geographical area of residence. A cross-sectional telematic survey was carried out in which 357 grandparents with grandchildren between 6 and 12 years of age living in the northern part of Spain participated, and a descriptive study and inferential analysis of the data were carried out. The results revealed that a descriptive and inferential analysis was performed. The preferred space for intergenerational leisure was the home, especially for cultural activities such as board games, watching television, and reading. Associations, municipal spaces (sports centers, cultural centers, playrooms), and educational centers are more frequently used in the inland populations. Residing in urban towns and coastal municipalities implies a greater preference for the use of private leisure spaces. Living in provinces with a wetter, rainy climate is related to more shared leisure practice at home. The possible exceptionality of the current situation, within the framework of COVID-19, which may have led to significant alterations in the grandparent–grandchildren relationship, is discussed, with the consequent need to continue this line of inquiry.

John Rea followed up his term as composer-in-residence in Mannheim with an immersion in the 1984 summer courses. Here the Canadian composer relates a series of anecdotes, which include his surprise at being recognized (or actually not recognized) as the composer of Pincer la musique aujourd’hui, and his subsequent attendance at a concert of Xenakis's music accompanied by Morton Feldman, who later shared a number of secrets with him. This leads the author to a reflection on the Darmstadt of his generation, and that of today.
