Daniel Bethlehem’s proposed principles grapple bravely with the familiar tension between law and power, between the aspirational and the real, between states’ words and irreconcilable acts. His principles “are proposed with the intention of stimulating a wider debate on these issues.” With that invitation in mind, I offer this thought: while Bethlehem posits a need for objectivity—by which he appears to mean neutral principles indifferent to power disparities—his proposed principles nonetheless substitute the opinio juris of the powerful for the practice of all, and they aim to bridge a division among states that he supposes merely to be a division among publicists.

Resumen
The solution of new tasks facing the leaders of public administration at the present stage of development of the Ukrainian state requires an increase in the efficiency of public administration and public administration as one of the priorities based on the principles of democracy, nation and human-centrism. The relevance of the topic of updating the principles of leadership development in public administration is closely related to updating management mechanisms in the information society, changing the traditional paradigm of management, characterized by stability, control, competition, homogeneity, egocentrism and heroism to a new one, which is characterized by fluidity, delegation of power, cooperation, heterogeneity, social relevance and modesty. The new management paradigm, which is partially being introduced into public administration and public administration, increasingly requires the introduction of modern leadership principles, which are manifested through the assertion of moral values in the personality of a leader, his behavior models and reforming organizational structures. According to the author, such signs of leadership as delegation of power and cooperation in public administration determine the development of leadership through its consideration in conjunction with the principle of command. The purpose of the article is to reveal the essence of the priority principles of leadership in public management activities, revealing the state of the study of this issue in domestic and foreign literature. The author of the article focuses on the definition – principle, which is analyzed as the basis for any theory or teaching, explanations or guidelines for action, a person’s inner conviction; basic rule of conduct; features in the creation of something, etc. The article reveals the priority principles of leadership as a prerequisite for the formation of a successful personality, successful leadership qualities. The system of principles of leadership development in public administration activities consists of an innovative principle of leadership development; the principle of independence for the development of new rules and regulations; the principle of subsidiarity to ensure the implementation of powers to the bodies of representative power; the principle of socially responsible leadership to ensure ethical relations between subordinates and the leader; the principle of justice, which is a special value measure for maintaining a balance between legal and moral values; the principle of professional and psychological readiness for public administration activities; methodological principle of information and analytical support.

The hydrodynamic principles common to many wave power converters are reviewed via two representative systems. The first involves one or more floating bodies, and the second water oscillating in a fixed enclosure. It is shown that the prevailing basis is impedance matching and resonance, for which the typical analysis can be illustrated for a single buoy and for an oscillating water column. We then examine the mechanics of a more recent design involving a compact array of small buoys that are not resonated. Its theoretical potential is compared with that of a large buoy of equal volume. A simple theory is also given for a two-dimensional array of small buoys in well-separated rows parallel to a coast. The effects of coastline on a land-based oscillating water column are examined analytically. Possible benefits of moderate to large column sizes are explored. Strategies for broadening the frequency bandwidth of high efficiency by controlling the power-takeoff system are discussed.

Constitutional adjudication in many legal systems crucially involves giving courts the power to override the decisions of other state institutions, even democratically elected legislatures. The task of delimiting the domain of judicial review is of the first importance. In this paper my aim is primarily critical. I want to take issue specifically with Ronald Dworkin’s well-known attempt to discharge this task through his use of the distinction between principle and policy. Courts, he claimed in Taking Rights Seriously, ought to decide on questions of principle and not policy and they are better suited for this purpose than legislatures. Despite the years that have passed since its original conception, Dworkin’s theory is very much alive and also relevant to contemporary constitutional theory. For, I believe it exemplifies a still common -perhaps also the predominant- way of conceiving of the role of courts and especially the practice of judicial review. It taps on the powerful intuition that it falls on judges to decide questions pertaining to the exercise and protection of individual right. Since my interest is pitched to questions of constitutional design, I will not challenge the explanatory adequacy of the principle/policy distinction itself from the point of view of moral theory, as many others have. Rather, I wish to explore whether this distinction adequately accounts for salient features of the division of labour between courts and legislatures. More specifically I will assess the extent to which employing this distinction satisfies three desiderata.

Abstract Recently, the word ’democracy’ has been featured prominently in the press, with calls to restore it, save it from ominous threats and expose challenges to its principles, all predicated on an assumed understanding of the concept. Many of the roots of today’s democracies reach back to the 18th century revolutions in the pre-U.S. American colonies and France, which continue to reinforce Euro-American values and ideologies of nation. The transfer of power remains a defining principle, shifting control from elites to the masses. How do the principles that inspired democratic revolutions relate to the ballot-box versions of democracy today? This article considers contemporary complexities of democracy as a concept, offering examples of how it is embodied through iconography, gestures of defiance and civil disobedience. Democratic values are explored in more formal choreography and in creative processes that establish associations with political agency.

The article deals with the issue of using a thermoacoustic engine as a low-power cogeneration source of energy for autonomous consumer power supply capable of operating on various types of fuel and wastes subject to combustion. The analysis of the world achievements in this field of energy has been carried out. A number of advantages make it very promising for developing energy sources capable of complex production of electrical and thermal energy with a greater efficiency than that of present day thermal power plants. The proposed scheme of a thermal power plant is based on the principle of a Stirling engine, but it uses the most efficient and promising thermoacoustic converter of heat into mechanical vibrations, which are then converted into electric current. The article contains a mathematical apparatus that explains the basic principles of the developed thermoacoustic engine. To determine the main parameters of the thermoacoustic engine, the methods of computer modeling in the DeltaEC environment have been used. A layout diagram of the laboratory sample of a thermal power plant has been proposed and the description of its design has been given. It has been proposed to use dry saturated steam as the working fluid, which makes it possible to increase the generated power of the thermoacoustic engine.

At the end of the 1940s, the United States and several West European states allied to defend themselves against invasion by the Soviet Union. Balance-ofpower theory predicts the recurrent formation of such balances among states. But it says little about the precise nature of the balance, the principles on which it will be constructed, or its institutional manifestations. The North Atlantic Treaty Organization (NATO) has been a peculiar mix. As a formal institution, NATO has through most of its history been distinctly nonmultilateral, with the United States commanding most decision-making power and responsibility. At the same time, NATO provided security to its member states in a way that strongly reflected multilateral principles. Within NATO, security was indivisible. It was based on a general organizing principle, the principle that the external boundaries of alliance territory were completely inviolable and that an attack on any border was an attack on all. Diffuse reciprocity was the norm. In the terms set out by John Ruggie, NATO has generally scored low as a multilateral organization but high as an institution of multilateralism.

The current direct trade rules and patterns cannot guarantee the interests of all parties directly related to the transaction, which is one of important reasons. Direct transaction space model of incentive compatible principles is proposed in this paper. How to guarantee the interests of grid, generators and big users during direct transaction is analyzed. For power generation companies, large users and grids, the change of interests are analyzed and marginal decision condition is studied. Based on the principle of incentive compatibility, direct transaction space model which not damage the interests of three transaction bodies is analyzed.

This paper takes two behavioural principles which have been suggested as explanatory models for human conversation, and tests them on a corpus of task-oriented dialogues (the HCRC Map Task Corpus). The principles chosen are Clark’s Collaborative Theory and Shadbolt’s Principle of Parsimony, which are both interested in notions of effort although they come from entirely different subfields of linguistics. The aim of the study is to compare the explanatory power of each of these principles when they are applied to real language data. Each of the principles was converted into a set of representative hypotheses about the types of behaviour which they would predict in dialogue. Then, a way of coding dialogue behaviour was developed, in order that the hypotheses could be tested on a suitably sized dataset. In particular, the coding system tried to distinguish between the levels of effort which participants used in their utterances. Finally, a series of statistical tests was undertaken to test the predictions of the hypotheses on the information generated by the coding system. The strongest support was found for the Principle of Parsimony and its associate Principle of Least Individual Effort, at the expense of the Collaborative Principle and the Principle of Least Collaborative Effort. There is certainly evidence that speakers try to minimise effort, but this seems to be occurring on an individual basis – which can be to the cost of the overall dialogue and task performance – rather than on a collaborative basis.

In different types of laser technological processes, accurate measurement of laser power is extremely important in terms of quality, repeatability, and validation of the process. In most cases, accurate laser power measurement is a difficult task, especially when working with high-power lasers or having to perform real-time measurements.The report analyses and systematizes the physical principles and methods on which existing laser measuring instruments are based. This research also aims to help researchers and technologists find and develop new approaches to solving this challenging measurement problem.

The rise of fascism, the advance of digital technology, and the erosion of the economic foundation of news media are disrupting journalism and mass communication (JMC) around the world. Combined with the increasingly globalized nature of journalism and media, these forces are posing extraordinary challenges to and opportunities for journalism and media education. This essay outlines 10 core principles to guide and reinvigorate international JMC education. We offer a concluding principle for JMC education as a foundation for the general education of college students.

With the development of power electronics,the technology of Switching Mode Power Supply(SMPS) is gradually perfected. However,there is no end to the demand for a high power and high performance power supply. Nowadays, Power Factor Correction (PFC) technique is widely researched. This paper mainly analyzes the fundamental configuration of the switching power supply. And we study the basic structure and the operating principles of ZVT-boost soft-switching PFC circuit and the implementing principle of soft switch. For the power requirements, the two-stage PFC circuit is used. The forward stage is a single-phase Boost Power Factor Correction circuit and the backward stage main circuit is a full-bridge converter with the phase-shifting control soft-switching technique. Finally the simulating analysis is performed to the designed system.

The article analyzes the objective and natural character of the origin of legal principles; the process of constitutionalization of the principles of Russian law and their implementation into the legitimate behavior of the participants of public relations. The authors substantiate that the content of constitutional principles is represented by three main elements: requirement, ideal, and knowledge. The most essential feature of constitutional principles is their ability for the legal expression of the most socially and politically significant values and ideals (legality, justice, humanism, freedom, equality, respect, trust) for an individual, society, and state. Regulatory features and normative significance of the principles of law are obtained as a result of constitutional formalization, and their embodiment insignificant rules of conduct of the state and the citizen contribute to the establishment of constitutional order. Special attention is paid to the content of some constitutional principles: the principle of respect and protection of human dignity; the principle of maintaining citizens’ trust in the law and the state; the principle of respect for the state power

The case of the French Revolution supports the proposition that principles of political legitimacy which shape state identities are linked to domestic social structures, and help determine the resources states mobilize in international competition. To the degree that they are shared across states, legitimacy principles also shape international society. The enactment of a deviant principle of legitimacy by a major power will have systemic consequences because it undermines the existing rules of the game; it may have transformative effects if the efficacy of the new principle is demonstrated in competition. Closer attention should be paid to the complex manner in which new principles interact with existing rules of international society.

Are the "general principles of law recognised by civilized nations" capable of adjusting to the progress and needs of the international community? This article argues that they are, and that international law needs, to a larger degree than what has been the case, to draw on principles of public law. Those principles of public law are not to supplant, but to supplement, those of private law. The article analyses four principles: the principle of legality; the principle requiring positive legal basis for state action; the principle that even the highest emanation of the executive power cannot escape judicial review; and the principle of protection of legitimate expectations. If one takes account of the needs of international law, there is no reason whatever why today we should accede to the orthodoxy that the intention behind the concept of general principles is only to authorise a court to apply the general principles of municipal jurisprudence, in particular of private law, in so far as they are applicable to relations of states – if for no other reason than the fact that international law no longer governs only relations of states.

This paper examines, enunciates, and makes explicit a set of market principles historically relied upon by the Federal Energy Regulatory Commission (FERC) to regulate wholesale electricity markets as required under the Federal Power Act (FPA). These identified competitive market principles are supported by policy and legal foundations that run through a myriad of FERC orders and court decisions. This paper seeks to make that history and those implicit market principles explicit by distilling and organizing Commission Orders and court decisions. It concludes that five market principles, each with multiple subprinciples, can be identified as elemental to how FERC understands and implements its statutory authority. Clear articulation of these foundational principles should help guide engaged entities as wholesale power markets continue to evolve. Market Principle 1 states that wholesale market revenues should predominantly flow from well-designed energy and ancillary services markets. Market structures generally are found to be preferable to non-market structures. Moreover, energy and ancillary services markets, in relationship to wholesale capacity markets, are better able to efficiently promote a least-cost resource. Market Principle 2 states that when altering market design, FERC and Independent System Operators (ISOs) should focus on only those services that are clearly needed, and ensure that any market design change does not unduly discriminate between resources. Market design changes focused on technology-neutral and well-defined granular services will help ensure that the design change does not lead to undue discrimination or preference that effectively favors certain resources. When such an impact still occurs, strong evidence showing that the rules are not unreasonable and arbitrary and that no non-unduly discriminatory and preferential alternative exists must support the change. Market Principle 3 states that interventions that distort transparent and accurate pricing should be minimized. Out-of-market interventions, in particular, have the potential to distort price signals and undermine competition. Market Principle 4 states that FERC’s just and reasonable standard strongly favors rate decreasing outcomes. Markets are premised on the economic presumption that competition reduces prices, in furtherance of the just and reasonable standard. Market Principle 5 states that FERC and ISOs should facilitate and not undermine state public policy preferences. FERC and ISOs are not well-situated to serve as decision-makers in determining which state public policy preferences should be given effect. State public policy preferences that do not run afoul of FERC’s authority under the FPA should thus be given full effect.

A foreign metal object will deteriorate the performance of wireless power transfer (WPT) systems and cause insecurity issues. Therefore, the influence principles and rules of foreign metal objects on soft-switching conditions of Class-E inverters and the performance of WPT systems are developed in this paper. The effects of different metal materials on coil parameters at different frequencies and positions are analyzed first, then the effects of foreign metal objects on soft-switching conditions of Class-E inverters and the power transfer capability of WPT systems are investigated. Principle analyses and simulation results demonstrate that there are significantly different effects on the soft-switching conditions and power transfer when a foreign metal object is placed near the transmitter coil or the receiver coil. In addition, the monotonicity of the variation in power transfer also depends on the position of the foreign metal object. Finally, a WPT experimental prototype with a Class-E inverter is implemented to verify the influence principles and rules of foreign metal objects. The experimental results are highly consistent with the principle analyses and simulation results.

When nonlinear load is powered by DC grid, harmonic currents and distortion power are produced. At first, the concept of the DC active power filter (DC-APF) is presented in this paper after the analysis of instantaneous power and power factor in the DC network. The DC-APF includes the parallel type, the series type and the series-parallel type, etc. The circuit topologies and the working principles of two kinds of DC-APF are proposed and analyzed: (1) the general type, which can compensate harmonic currents and reactive currents; (2) the correction type, which can track the DC voltage. The comprehensive simulation analysis of the double-bridge half-controlled DC-APF by means of MATLAB/SIMULINK and the experiment of the correction type prove the validity and the feasibility of these topologies and operating principles.

Prevailing analyses of INGO influence have focused on their advocacy role, claimed that they are motivated by values and assumed state monopoly over legitimate coercive power. As INGOs increasingly implement policy where state power is weak or non-existent, their commitment to their mission frequently causes action that violates their proper role. This article examines one case to probe how the INGOs community responds when the principles to which it is committed conflict and generates two findings. First, when principles conflict, they structure competing responses to a problem and who falls on which side reflects a kind of ‘bureaucratic politics’ of the transnational community. Second, principled actors have a hard time reasoning through trade-offs when values conflict. The same principled commitments that yield more success in advocacy roles may hinder success in policy implementation.

After all communication remains a bitter idea that one could communicate properly, and better, and more efficient, and lower overall costs. The idea that persists after any communication is that the communication was imperfect. Being imperfect, any communication is also a failure. The power of communication is the communication failure. The failure is to not express your-self perfect, or speak more or less than you should, or could not say everything, or being misunderstood. In essence, the failure and the primary means of communication to improve the communication would be expression, speech, discourse. Discourse can be verbal or non-verbal. In linguistic communication works the principle of general expression, the principle of strong effability (J. J. Katz). The range of expression through language we record influence of idea of ineffable: it is thought, content, feeling, feelings, expressiveness that cannot be expressed. Ineffable principle seems to be secondary. In fact, the natural state of the world is ineffability. Effability and Ineffability of communication are complementary principles. The power of communication is in communication failure. Perfection communication cancel communication, perfection does not allow self-reproduction of communication and therefore stimulate its implosion. Deficient communication process development support communication; communication failure is the communication power. Communication failure is a relatively late theoretical discovery of communication discipline. It follows that in a subsequent paper to investigate ”the principle of communication failure” that emerges from the research of several renowned experts in General Science Communication (C. R. Berger -1997; J. D. Peters; Noemi Marin - 2007).

Church growth is an important study in church history. The Bible has important principles in church growth, therefore these principles need to be analyzed so that they can contribute to the study of church growth. The Acts of the Apostles is a book that has a history and principles of church growth, therefore the author conducted research on church growth based on Acts 2: 1-47. The author uses a qualitative approach to literature study to find the principles of church growth based on Acts 2: 1-47. The results showed that there were three principles for the growth of the early church. The first principle based on the fourth verse is to depend on the Holy Spirit, the second principle based on verses 14-36, 42 is to preach the Word of God, the third principle based on verses 42-46 is to live in fellowship. For the growth of the church today the church must depend on the power of the Holy Spirit, teaching based on the word of God, and the church lives in fellowship.
