Vorspann Zwei Staaten, ein Problem. Nirgendwo im Europa der 1970er Jahre verübten linksextreme Terroristen so viele Anschläge und Morde wie in Italien und der Bundesrepublik. Beide Demokratien waren gezwungen, auf diese Herausforderung zu reagieren. Die Interaktion von Terrorismus, Staat und Gesellschaft prägte ein ganzes Jahrzehnt. Dabei fiel dem politisch-administrativen Handeln eine Schlüsselrolle zu. Für welche Gegenmaßnahmen entschieden sich Regierung und Parlament? Erwies sich der demokratische Rechtsstaat als stark und gefestigt und zugleich als flexibel und integrativ genug, um die terroristische Gefahr zu bewältigen, ohne selbst Schaden zu nehmen? Ein Ländervergleich verspricht neue Erkenntnisse für beide nationalen Beispiele.

AbstractIn this article, the author discusses the historical development of the concept of the Rechtsstaat in both Germany and elsewhere in continental Europe and North America, and seeks to argue that the term, for reasons empirical and ideological, has become excessively vague and, therefore, almost meaningless as a historically descriptive word and form of legal polity. The article urges a return to a rigorously historical understanding of the Rechtsstaat in order to restore centrality to the role of political authority and state power in the broad sweep of German life and, by extension, throughout continental Europe, and in order to maintain distinctions among western legal ways and traditions, in this case the important difference between the continental, civil law notion of the Rechtsstaat and the Anglo-American, common law theory of the rule of law. The argument proceeds along two major tracks. First, the author explores the eighteenth and nineteenth-century origins of the Rechtsstaat idea and its powerfully state-centered identity amidst countervailing liberal and democratic currents, and how such statism has persisted in German history and intellectual life up through the contemporary era. Historical, legal, and philosophical writings on the Rechtsstaat, both within and beyond German borders, constitute the focus of the analysis. The argument's second principal line of exposition is a consideration of the influence of the Rechtsstaat concept on the west's study of the history of Russian law and legal development, especially in the late imperial era. In delineating the course of western academics' interpretation of Russia's recent modernizing past—particularly in contrast to the writings of pre-revolutionary Russians—the author discusses the gradual merging of Rechtsstaat principles with indigenous Russian legal values and European intellectual borrowings, the eventual, post-1945 global triumph of Anglo-American expectations for modern, developed legal life, and finally the assimilation of the Rechtsstaat idea to the now globally broadcast standards and values of the rule of law model.

Resumen
In contrast to most existing literature, the author claims that there were palpable ‘rudiments’ of authoritarian socialist Rechtsstaat in some communist countries of East Central Europe in the late 1980s. The first part of the article examines the existing terminology with regard to the functioning of law in communist dictatorships and authoritarian regimes in general. By using the example of communist countries such as Poland and in particular Czechoslovakia, the author strives to show not only how rule by law was an increasingly important ruling instrument in state socialism but also how that gradually changed the nature of the dictatorial regimes. He argues that the late communist leaderships in these countries haphazardly set out towards an authoritarian socialist Rechtsstaat in an effort to safe their grip on power by strengthening the socialist normative state. They never arrived at the envisioned optimal stage in this respect, yet they opened a fateful path inside the dictatorships towards the legalist and negotiated revolutions of 1989.

Will the welfare state survive European Integration? The paper seeks to put this currently intense debate into constitutional perspectives. It starts with a reconstruction of the débat fondateur in post-war Germany on the new Basic Law, which was focused on alleged or real tensions of welfarism with Rechtsstaatlichkeit, the commitment to rule of law. This is the background for the discussion in Section II on legal categories, which Fritz Scharpf has characterised as a decoupling of economic integration from the various welfare traditions of Member States. The third section analyses the ECJ’s recent labour law jurisprudence with its interpretation of the supremacy of European freedoms and its rigid interpretation of pertinent secondary legislation. These controversial moves are bound to provoke fierce opposition on the part of the protagonists of “Social Europe.”

A critical observer would not deny that the practice of European Union (‘EU’) policy making in the field of criminal law in the past decade since the implementation of the Tampere Programme has been mainly repressive and prosecution-oriented.1 The idea of introducing a set of common (minimum) rules, guaranteeing the rights of defence at a EU-wide level, has not been accorded the same attention as the introduction of instruments aimed at improving the effectiveness of crime-fighting. What does this mean for the future of EU criminal policy? Will the EU succeed in the coming years in developing an area where freedom, security and justice are truly balanced? According to several authors, to date the EU has evolved in the opposite direction. As one observer put it:[I]f Procedural Criminal Law arises from the application of Constitutional Law, or indeed if it may be described as “a seismograph of the constitutional system of a State”, then as a consequence the Procedural Criminal Law of the European Union shows the extent of the Democratic Rule of Law, of the existence of a true “Rechtsstaat”, within an integrated Europe. This situation may be qualified as lamentable, as the main plank of the EU's criminal justice policy relates to the simplification and the speeding up of police and judicial cooperation—articles 30 and 31 of the Treaty of the EU—but without at the same time setting an acceptable standard for fundamental rights throughout a united Europe.2

The legal predicament of today in Europe and beyond takes the form of a devaluation of the meaning of legality, constitutionality and, of the rule of law. What we are dealing with is yet another crisis of both the tradition of the Rechtsstaat in continental setting and, more broadly, of liberal legality. While this disruption within the sphere of the law seems to mirror the reshuffling in established politics that took place over the last twenty years, it traces back to central jurisprudential questions that have made the substance of crucial debates during the interwar and have fashioned both the field of constitutional theory of the continent and our jurisprudential apparatus for approaching the nexus between law and politics. In this article I argue that the apparent uchronia that the current status of the law opens in relation to past theoretical questions that were seeking to ground legality, is neither a simple by-product of a Zeigeist oversaturated by appeals to procedural democracy or for returns to sovereign power, nor a mere regression to past juridico-political settings. It is a historical development that has been dormant for the past decades, yet has slowly undermined legal thought and praxis. Revisiting, as a matter of historical and jurisprudential inquiry, the context and the content of this original opposition between liberal legality and its enemy, is a way of understanding what constructs our own contemporary situation.

Resumen
Constitutional law and international law operate in simultaneous conjunction and reciprocal tension. Both fields seem to have overcome the great challenges of destruction and neglect in the course of the 20th century. Both after World War I and World War II the world experienced new waves of constitution making. In both cases the current German constitutions (the Weimar Constitution of 1919 and the Grundgesetz of 1949) were influential. Characteristic of constitution-making in this century, is the final victory of liberal constitutions based on the rule of law, the Rechtsstaat, fundamental rights, meaningful control of public powers and the establishment of constitutional courts. Following the destruction of World War II, the notion of the Sozialstaat emerged strongly in Germany. In contrast to the Constitution of the United States of America, the principle of the responsibility of the state for social justice has emerged in almost all new constitutions, including Russia, Poland, South Africa, Spain, Italy and Portugal. Where courts are given the mandate to interpret bills of rights, fundamental rights have been developed into foundation stones of the legal system. The presence in a Bill of Rights of restrictive clauses, is important for its analysis. Generally restrictive clauses in new constitutions try to limit the possibilities of restriction. The importance of constitutional rules establishing and legitimizing the political organs, must not be overlooked. Of particular importance is the degree of control over the head of state, a positive attitude among political actors towards the constitution and the protection of the interests of minorities in a democratic system. In the field of Public International Law much of Kant's ideal of an international confederation of peace has been realized. Since 1990 the United Nation's Security Council has shown the potential of becoming a directorate for the community ofnations. International law has also been instrumental in the worldwide recognition of human rights. Especially in Europe, Convention Law has had a strong impact. Furthermore, global and regional systems of regulation have tended to alter the legal attitude towards state sovereignty. It may be that the South African constitutional approach in terms of which international law is subject to constitutional and other national law, is not in line with international tendencies.

AbstractAfter 1990, the rupture of the politico-administrative system and transformation of the German Democratic Republic (GDR) was essentially shaped by the process of German unification and the GDR’s integration into the ‘old’ Federal Republic. Thus, basic constitutional and institutional issues, such as legal rule (Rechtsstaat)-based administration, inclusion in the European Union, were (‘exogenously’) pre-determined by the GDR’s accession to the ‘old’ Federal Republic. The chapter highlights East Germany’s politico-administrative transformation after 1990 by addressing the organisational and personnel dimensions of the remoulding and rebuilding of the administrative structures at the new Länder and local levels. Finally, notwithstanding the particularities of the ‘East German case’, it raises question whether there are lessons which other countries facing transition or transformation can draw from East Germany’s experience.
