Resumen
This book is the fruitful result of the extensive research conducted by the Research Group Regional Integration, Globalization and International Law by its members and colleagues from the Faculty of Law of Recife. The scholars have dedicated their research to develop a comprehensive study on relevant topics of International Law, in particular from the perspective of regional arrangements and globalization. As the Research Group has three fields of research, the papers have been divided into three parts accordingly. In Part 1, the articles address topics with respect to regional integration, focusing on the European Union and the MERCOSUR agreements. In Part 2, the papers deal with matters derived from the phenomenon of globalization, which demand international disciplines, such as the environment, consumer relations, cooperation and movement of goods and persons. Finally, in Part 3, the articles concentrate on the current and relevant discussions about international governance of several topics, such as foreign investment, trade, space exploitation, intelectual property, contracts, commerce and arbitration. That being said, this collective work is essential for professionals and scholars from the legal and related fields to deepen their knowledge on debates dominating the study of International Law and its diversities.

Resumen
This chapter synopsizes principal conclusions presented in this book. It stresses that mega-regional agreements risk further augmenting the fragmentation of international economic law and undermining the WTO negotiating forum. Regarding regulatory cooperation, it questions whether non-binding initiatives as those envisioned under CETA and TTIP will succeed and argues that efforts to reduce the vagueness of investment disciplines and thereby to protect domestic policy spaces are questionable. It also stresses that the controversial division of competences between the EU and its Member States greatly impedes their capability to act in international relations. It submits furthermore that citizens are increasingly anxious that they may not be able to democratically influence the process of international economic governance, which makes them feel progressively estranged also from European integration. This chapter concludes that international trade and investment agreements will, for a considerable time, not be discussed, negotiated, and concluded, in the same manner again.

India’s attempt to join the process of regional integration was marked by ambivalence. India did bypass its own region to seek integration in the adjacent one, ignoring SAARC to seek membership in some of the ASEAN led institutions. Operating by consensus through non-binding agreements, ASEAN-centered regionalism suited India’s needs for recognition and protected it against the negative repercussions of regional tensions while preventing the rise of potential regional hegemonys. Through its participation in a regional security architecture led by ASEAN rules, India established a normative buffer while being able to influence decisions. However, ASEAN’s centrality (i.e.; consensus based and a unanimous position reflecting common strategic vision) is gradually being eroded by US-China proxy struggle for influence, eroding the foundation of India’s relations with ASEAN, as it may draw New Delhi into the zero-sum game situation it has so far tried to avoid.

This chapter reinvestigates the history and early decisions of the European Union's Court of Justice (ECJ) to explore how context shapes international judicial lawmaking. It does so by comparing the ECJ with its Andean counterpart — the Andean Tribunal of Justice (ATJ). The two courts have nearly identical designs; they were both tasked with interpreting very similar framework agreements; and they were created to help further ambitious regional integration projects. Although there are important differences between the two judicial bodies, the many legal and structural parallels allows us to examine how the political context shapes the behavior of similarly designed institutions with similar legal and political mandates. The focus here is on the strikingly more modest judicial lawmaking of the ATJ as compared to the ECJ.

The Region of the Americas has prioritized the achievement of health equity—“the absence of avoidable or remediable differences among groups of people, whether these groups are defined socially, economically, demographically or geographically” (WHO)—both through regional agreements, such as the Sustainable Health Agenda for the Americas (2017), and by reporting progress toward the 2030 Agenda for Sustainable Development (the Sustainable Development Goals) (2015). Public sector policy is the principal initial lever through which both national and local governments institute and finance actions toward accelerating the achievement of equity in health. This study assessed 32 national health plans to report on whether and how countries in the Region are integrating the achievement of health equity into strategic lines of action in the health sector. It provides a snapshot of approaches and advances, allowing for knowledge sharing among countries on options for attention to equity in health policy. It will also facilitate future monitoring of trends in the integration of health equity aims and approaches in policies. The study found that stated overall commitments to health equity are common, as are commitments toward the disaggregation of data and monitoring of inequalities, while other elements of health equity like, for example, the identification of populations in situations of vulnerability, receive less attention. While further study is needed on the implementation and impacts of approaches in specific programmatic actions, the study provides useful insights to inform efforts for a stronger framework for health equity action toward the Region’s goals for 2030.
