This thesis aims to describe and analyze the politicians who belong the right-wing political conservative traditions in Turkey by the mediation of their understanding and mentality. In this framework, the study primarily intends to investigate and analyze their perceptions of political and ideological imaginations. Turkish right seems to have a quite heterogeneous structure. While the recognition of the heterogeneity embodied around the political-institutional structuring is crucial to understand the Turkish right-conservatism, focusing merely on the heterogeneity and differences is inadequate to understand the right-conservative tradition. This study aims to analyze the aforesaid diversity and heterogeneity in the axes of politics and ideology. In spite of its heterogeneous qualifications, there are some attributions which made the Turkish right-wing conservative tradition homogeneous on certain economic, social and cultural issues. In this context, the study aims to analyze and understand the differentiations and affinities among the politicians who belong to the mainstream right-wing conservative political parties by focusing on the politicians discourses.

This thesis is an attempt to analyse the narrative structure of the Turkish satiric comedies that were produced in the 1980s. It focuses on the relation between the narrative structure of the satiric comedies and the socio-political atmosphere of the period. It argues that the satiric comedies aimed to criticize the new right policies and the social transformation in the 1980s through the opposition between the &ldquo
honourable&rdquo
hero on the one hand, and the &ldquo
swindler&rdquo
figure(s) or the &ldquo
degenerated order&rdquo
on the other. The narrative tools and stereotypes were used to represent the decline of such social values as solidarity, collectivism and philanthropy and rise of new ones like individualism, competitiveness and self-reliance. The study also analyzes the transformation of satiric comedies themselves throughout the decade, focusing on the change in the construction of oppositions and conflicts, and the emergence of nostalgia and romanticism as part of their critical discourse.

In this thesis we empirically examine whether the Turkish stock market is driven by rational bubbles over the period between March 1990 and February 2012. The bubble periods are estimated using a recently developed right-tailed unit root test, the generalized sup augmented Dickey-Fuller test of Phillips, Shi and Yu (2011a). Applying their bubble detection and location strategies to weekly price dividend ratio series, we find strong evidence for the existence of rational bubbles in the Turkish stock market benchmark indices as well as sector indices. Our located bubble periods may give early warning signals of the subsequent Turkish financial crisis.

The main objective of this study is to analyze how labor&rsquo
s protests against the privatization in Turkey, are reconstructed in news. So, news discourse on labor protests against privatization of SEKA and TÜ
PRAS investigated in five newspapers of Turkey. During analysis, on which reconciliations meaning in the news are constructed was probed by both identifying the linguistic and narrative aspects of the news. Therefore discourse analyses will be applied to study how and on which level a pro-privatization ideology production is realized in the labor protest against privatization news. So, construction of a hegemonic ideology in Turkey by joining various discourse elements, and if there are any conflicts between parties in this construction was investigated.

The main objective of this thesis is to examine the specific place of the Freedom Party (Hü
rriyet Partisi) in Turkish political history. Founded by a group of Democratic Party (Demokrat Parti) members who were expelled from the party in December 1956, the Freedom Party (1956-1958) is crucial for a proper understanding of evolution of the idea and practice of democracy in Turkey. Although mostly neglected by students of Turkish politics and labeled as an insignificant political party, this thesis argues that the Freedom Party is critical for understanding the 1950s and socioeconomic and legal-constitutional developments of the following decade. The thesis also pays a considerable attention to the Forum journal, which began to be published in 1954 by a group of liberal intellectuals and which guided the Freedom Party in ideological and political terms. It is the main argument of this thesis that the Freedom Party and Forum journal introduced a new understanding of politics and this understanding had profound effects in the following decades. The ideological transformation of the Republican People&rsquo
s Party (Cumhuriyet Halk Partisi) after the second half of the 1950s and the role of HP in this process is another topic of the thesis.

This thesis analyses linguistic policies in Bulgaria, during the Ottoman, monarchical, communist and post-communist periods and its effects on the Turkish minority in Bulgaria. The linguistic policies in Bulgaria did not follow consistent policies
on the contrary, it followed different policies in different periods. The aim of this thesis is to analyse how the Turkish minority experiences and perceives linguistic rights in the post-communist period, such as study of and in Turkish language, Turkish minority media, use of minority personal names, naming of topographical places and the status of Turkish language in official and administrative institutions. For this purpose, in-depth interviews were carried out in ISiklar (Samuil) municipality in Bulgaria, where Turks constitute the absolute majority of the population. As a result of the analyses of the experiences of the Turkish minority, it was observed that (Turkish) linguistic rights and language were experienced by the Turkish minority in terms of ethnolinguistic identity. It is concluded that symbolic power and diglossia relationships between Turkish and Bulgarian languages affected the ways of perception of (Turkish) linguistic rights by the Turkish minority in Bulgaria.

The main concern of this thesis is to analyze the transformation of domestic human rights discourse by looking at the shifting representations of the idea of human rights. The representation of the idea of human rights in &lsquo
Turkey Human Rights Movement Conferences&rsquo
in different political contexts during the period 1998-2010 is evaluated with reference to three areas of literature on the idea of human rights and with a social constructionist perspective which begins with the proposition that ideas and practices concerning human rights are created by people in particular historical, social, and economic circumstances. The different conceptualizations of legitimation of the idea of human rights, the shifting representations of the idea of human rights as civil and political rights and economic, social and cultural rights and the varying constructions of domestic human rights language amongst local and universal claims in respect of human rights within different political contexts is explored. In this framework, the research design of the study is envisioned to evaluate these issues in the context of &lsquo
Turkey Human Rights Movement Conference&rsquo
texts. The final reports of eleven conferences held in the period 1998-2010 are analyzed by the method of &lsquo

This study examines the market reaction to rights offering announcements in Turkey. Even though the topic is extensively studied in the finance literature, there is still research going on for emerging markets. The first part of this study measures market reaction to rights offering announcements for six different information arrival dates. The results are significantly negative except for the case of the announcement of the rights offering period. Additionally, the sample is divided into two sub-periods as before and after the 2001 crisis. The results show that there is a significant difference in market reaction and this difference is attributed to the change in economic policy after the 2001 crisis. The second part of the study examines the determinants of this market reaction and the findings suggest that bonus issues are positively related and there is also evidence that firms time their equity issues. The third part analyzes the long term performance of equity issuing firms in two subgroups as financial and non-financial firms. The results provide evidence of a negative performance and this finding is consistent with the results of previous studies.

This is a study of the Turkish discussion on minority rights. The minority issue in Turkey was placed on the Turkish agenda in connection with intensified negotiations with the European Union on Turkish membership. The unusual and complex circumstances regarding the minority issue in Turkey makes it interesting and relevant to study this topic. The particular focus of this study is on the Kurdish minority and on the alternative discussion regarding the minority issue pursued within civil society groups and the academic sphere. The aim is to contribute to the understanding of the debate on minority rights within these groups. Interviews and collection of literature were made during a field study in Turkey in 2006. A result of this field study was the observation that there are forces working for a change in the notion of Turkish citizenship, and that the minority concept is controversial in Turkey for a number of reasons. Another observation was that the tension between assimilation and cultural identity is an important aspect of the discussion on minorities in Turkey. The Turkish debate has been contrasted to the debate on multiculturalism within political theory. This debate on multiculturalism is about how to deal with culturally diverse societies. There is one main position in favour of multiculturalism and one against. The ideas put forward in the Turkish discussion have been compared with this debate and it has been found that the Turkish discussion differs from this debate in some respects.

This dissertation investigates how collective identity groups frame their rights claims in the public sphere by exploring what types of framing processes specific groups of activists adopt. My empirical focus is on how certain social movements in Turkey has framed their rights claims in the restrictive nature of the public sphere. What types of frames characterize these movements? This research explores three empirical case studies from Turkey - looking at an Islamic, a women’s rights and an LGBT organization. The main empirical finding of the dissertation is all three organizations endorse a liberal/universalistic frame to be accepted in the Turkish public sphere. The thesis of this dissertation is based on the analysis of the implications, consequences, and tensions that come out of this finding for democratic theory, theorizing Turkey, and social movements. In my analysis, I highlight a paradox in making rights-claims in Turkey. Collective identity groups demand group rights, but they frame these demands in terms of universal human rights language. The reason for the emergence of such paradox – I argue- is because groups want to fit in by adopting the universal language of rights used by the state in its Constitution and laws. Rights-based language could be necessary for certain groups as it is located “within the accepted discursive field resonating with the values of a secular society” (Barras 2009). Using macroframes, such as ‘human rights’, enable groups to appeal to international organizations, as well. This ‘postnational’ approach to rights-claiming can be part of the groups’ mandate to appeal to universal human rights beyond the borders of state sovereignty (Soysal 1998). The implication of this analysis is that social groups’ acts of citizenship conform to dominant frameworks of claims-making. This, in turn, limits their ways of claims-making. For instance, they do not make multicultural claims or challenge the universal citizenship of the liberal state. While each civil society organization under study challenges the secular, the patriachal and the homophobic nature of Turkish citizenship, they conform to the definition of Turkish citizenship which is liberal, universal and individualistic. The dissertation uses the qualitative case study method based on in-depth interviews with the members of the groups.

This essay investigates the role of non-governmental organizations in Turkey that work with minority rights. The purpose of this study is to get a better understanding on how domestic NGOs understand and prioritize human rights and how different social structures are restricting NGOs from engaging in human rights of the Kurdish minority. To answer this question this study utilizes a qualitative content analyses of the published research on human rights and NGOs. The analysis has been conducted from a postcolonial perspective. The finding has shown that even if Turkish human right defenders are restricted on how they can work with human rights violations in the society there still is an engagement in trying to work with these social problems. This essay concludes that Kurds have been restricted from working with human rights by means of the Turkish anti-terror law, which may have negatively affected the visibility of Kurdish activist, but not stopped them from engaging in social issues. However, there is still a need for development in the Turkish NGO regime, but the westerniza- tion project may not be the answer for Turkish human right development. This essay argues that the human rights education projects in Turkey should be conducted by domestic NGOs own understanding of human rights and only then there will be potential for real human rights development.

This dissertation is about the political rights in the Turkish Constitutional system. It critically analyses the Turkish Constitution and the case-law of the Constitutional Court concerning the political rights. In this analysis, I will use a liberal framework which is based on the constitutional principles of political neutrality and the rule of law. These liberal principles provide the necessary setting in which the political rights are protected. It is widely believed that the official ideology of Turkish Constitution has much in common with liberal ideas, and indeed it aimed at establishing a liberal democracy. My study refutes this argument. The main argument of this thesis, on the contrary, is that the official ideology of the Turkish Constitution, namely Kemalism, is not compatible with the liberal principles of political neutrality and the rule of law. As such Kemalism, together with the strong state tradition in Turkish political culture, constitutes the most serious obstacle to the protection of liberal political rights. The dissertation consists of two parts. While Part I sets out the theoretical framework of political rights. Part II tries to analyse the Turkish Constitution in the light both of this theoretical background and of Kemalist principles. A particular chapter in the second part is devoted to the critical evaluation of the decisions given by the Turkish Constitutional Court. It is argued that the Court's approach to political rights is determined by the official ideology of the Constitution. In other words, it is an ideology-based, not a rights-based, approach. This study concludes that the Turkish Constitutional system has to undergo some institutional and structural changes, and radical paradigm shifts in order to remove the obstacles to the implementation of political rights. The Court in particular must adopt the rights-based approach to political rights. At the heart of all these changes and paradigm shifts, I argue, lies the self-awareness and authenticity which may be achieved through a journey to selfhood.

This research explores the extent of the shift in the Turkish state’s discourse towards the Kurds’ language rights and the sources of resistance to their recognition under the successive AKP governments between 2003 and 2015. Examining this issue, I explore 1) the true nature of the Kurds’ language-related rights in lights of the relevant key points in the political theories of language rights; 2) the extent of the shift in the AKP’s Kurdish policy towards the Kurds’ language rights; 3) the sources of resistance to the Kurds’ language rights in the state discourse in view of the competing rationales behind language rights from both the state’s and minority groups’ perspectives; 4) whether the AKP’s Kurdish policy aims to contain the Kurds’ language rights or accord it greater recognition. The thesis concludes that the Turkish state discourse towards the Kurds’ language rights under the successive AKP governments between 2003-2015 primarily aimed to contain potentially far-reaching consequences of the Kurds’ language rights.

The main concern of this thesis is the dissolution of political parties by the Turkish Constitution Court and the response of the European Court of Human Rights. This study will analyse and compare the approaches to restrictions of fundamental rights under the European Convention on Human Rights by both national courts and the Strasbourg Court. The protection of human rights has to be balanced by accommodations in favour of the reasonable needs of the State to perform its duties for the common good. Ensuring that State does not take improper advantage of such accommodations requires a measure of international control. National restrictions, which are necessary in a democratic society, are allowed subject to the supervision of the Court of Human Rights. Political parties are a form of association essential to the proper functioning of democracy, and restrictions on freedom of association should be construed strictly. Only the most compelling reasons can justify dissolution of political parties. This thesis aims to identify the democratic values set out in the case law of the Strasbourg organs, and to explore the cases concerning the dissolution of political parties in the light of those values. The approach of the national courts will be contrasted with that of the Strasbourg court in those cases, which have resulted in applications under the European Convention. The thesis draws a distinction between an ideology-based paradigm and a rights-based paradigm in such cases. The national court has adopted an ideology-based approach, whereas the Strasbourg court has adopted a rights-based approach. However, in the Refah Partisi case, the Strasbourg court appears to have adopted an ideology-based approach. This was unfortunate as this resulted in a decision that is in conflict with the approach it had adopted in earlier cases those previous cases had contributed significantly to the development of democratic values in Turkey.

This study asks how national power capacity and state structures are reconfigured when faced simultaneously with the power diffusion impact of political globalization---defined as a consensus of ideas and subsequent pressure on states for further democratization and liberalization---and the power maximization demands of internal and external security dilemmas. Hypothesizing a resulting bifurcation of such state structures, this study identifies and explores the transformation dynamics of states being pressured by these two forces through an in-depth analysis of the Turkish case. First, the roots of the two pressures are explored from the late Ottoman and early Republican eras, and a pendulum period is observed, in which the incompatibility of the two drives becomes accepted. As the inevitability of the transformation from more authoritarian to more liberal regimes is realized, a resulting gradual development and institutionalization of a dual state structure into hard and soft agendas and, eventually, realms is shown. Within such a structure, a compromised governance system emerges, in which both a form of democracy and democratization is maintained for legitimacy purposes, and a strong power-holding mechanism, unaccountable to the public, is preserved as an ultimate guard to maintain control over the transformation process. An analysis of changes in the Turkish constitutions is used to reveal traceable reflections of the gradual expansion and consolidation of the hard realm. The actual workings of a dual state structure, revealing the realms' actors, their domestic and external allies, their positions, arguments and rhetoric, is provided by focusing on the clash in the Turkish case over the issue of minority rights in relation with the country's application process for European Union membership. The major aim of this study is to evaluate the role of Turkish non-governmental organizations (NGOs) in the consolidation of democracy in Turkey regarding the characteristics defined by the classical pluralist theories, starting with the ideas of Alexis de Tocqueville, and by contemporary pluralist approaches to civil society. To that end, characteristics of two examples, iHD and KiH-YÇ
V will be examined using three dimensions: effectiveness, enhancing solidarity and responsibility, and the dimension of inner democracy. As the methodology of the case study, in-depth interview techniques were adapted for capturing the qualities of the organizations in a detailed way. At that level, in-depth interviews from each organization were conducted with members having different positions. In addition to this, all written documents obtained from the organizations were scanned and the relevant ones have been examined for the sake of the study. Since the aim of the study is to understand what part Turkish NGOs play in the consolidation of democracy in Turkey considering the assumptions of classical and contemporary pluralist school in their analysis of voluntary associations and interest groups, this study espoused an associational concept of democracy as the method of work, which is a contemporary concept that underlines the democratic role of free and voluntary associations. In this context, this study tries to discuss the following questions: To what extent are Turkish NGOs independent from the state? To what extent can they have leverage on governmental policies? Do they mitigate conflict through overlapping interests? Do they enhance social trust, tolerance, compromise and a sense of solidarity in society and within their organization? To what extent are they democratic, pluralist and horizontally structured inside their organization and to what extent they are democratic regarding their decision making process? Are they open and inclusive enough in their membership recruitment techniques?

Despite the developments in the international arena to ensure and protect human rights, evidence from around the world showcase examples of organized and systematic violations of human rights in the form of war crimes, genocides, and crimes against humanity. Turkey is one of the countries that has shown decline in the last ten years when it comes to respect for human rights. Aftermath of the Coup d’etat from 2016, involvement in Syrian civil war, and Kurdish question raised concern within the international community regarding human rights. Consequently, this research aims to provide a deeper understanding of how Turkish government treats the civilian population in these three cases in order to assess if there is a risk of Turkish government committing crimes against humanity. Furthermore, in order to get a more objective view of the happenings, this paper will also examine Turkish actions through the lenses of Realism. A qualitative research with an abductive approach with case study design was conducted. Analytical framework, that presents 10 risk factors for committing atrocities and crimes against humanity, developed by Dieng and Welsh was utilized to make sense of gathered data. Realism, with focus on national interest and security, was used to examine Turkish actions. Findings suggest that all 10 risk factors are presented in each case through different indicators. Journalists, lawyers, professors, refugees, and Kurds face systematic threat of mostly arbitrary detentions and imprisonments. Furthermore, findings show that Turkish actions can be explained through national interest expressed through security and unitary national identity.

acquis communataire&rdquo
, which requires her to adjust her administrative structures to European standards in a variety of policy spheres, including the social policy and social dialogue. Within this context, this thesis aims to analyze the approaches of the Turkish trade union confederations towards the practices of social dialogue at the European level, as well as their experiences of social dialogue mechanisms in Turkey through the data gathered from in depth interviews with the officials of the three trade union confederations, TURK-IS, DISK, HAK-IS, and some of their member unions. While all Turkish trade union confederations find social dialogue mechanisms fairly operational at the EU level, in relation to Turkey they all agree that such mechanisms are far from meeting their expectations. Beyond this common point the conceptualizations of social dialogue, interpretations over its structure, functions, and features, as well as the evaluations accounting for its underdevelopment in the Turkish context, show considerable variation across the three confederations.

This study is an exploration of the European Union acquis adoption in the Turkish National Police. The research employed the Diffusion of Innovations, Democratic Policing, and historical background check theoretical frameworks to study the decision-making of the TNP regarding reforms after 2003 as a qualitative case study which triangulated the methodology with less-dominant survey and several other analyzing methods. The data were collected from several sources including semi-structured interviews, archival records, documentary evidences and the European Commission Regular Reports on Turkey. The research interest was about the decision mechanisms of the TNP towards reforms and the rise of democratic policing in Turkey. During the study, internationally recognized human rights standards were given attention. As the data suggested, the police forces are shaped according to their ruling governments and societies. It is impossible to find a totally democratic police in a violent society and a totally violent police in a democratic society. The study findings suggested that reforming police agencies should not be a significant problem for determined governments. Human rights violations should not be directly related with the police in any country. The data suggested that democratic policing applications find common application when the democracy gets powerful and police brutality increases when authoritarian governments stays in power. Democratic policing on the other hand is an excellent tool to improve notion of democracy and to provide legitimacy to governments. However, democratic policing is not a tool to bring the democracy, but a support mechanism for it.

The overarching goal of this thesis was to compare the mother-child relationship and child behaviour across cultures. The three articles in this thesis were part of a multi-method investigation comparing England (an individualistic culture) and Turkey (a collectivistic culture). Accounts from two children and their mothers were obtained from 218 two-parent families in total. Mothers completed questionnaires, children were interviewed using the Berkeley Puppet Interview, and observations recorded during various play tasks. The study was unique as it recorded the perspectives of mothers and young children aged from 4 to 8 in each family across cultures. Results showed that English mothers used more positive methods of discipline with their older children, and reported less conflict with both of their children compared to Turkish mothers. In contrast, English children reported more anger and hostility from their mothers than did their Turkish peers (Paper 1). Cultural differences in maternal values partially explained these differences in positive discipline and anger and hostility (Paper 1). Using structural equation modelling, partial cross-cultural measurement invariance for parenting and child adjustment was revealed (Paper 2), and a stronger association between parenting and child adjustment was found for the English versus Turkish families (Paper 2). Finally, multi-level modelling yielded significant prediction of children's adjustment from both family-wide and child-specific aspects of parenting (Paper 3). The implications of the findings include appreciating different perspectives of parenting when conducting cross-cultural research (Paper 1); the culturally distinct meanings of both parent and child adjustment should be considered when interpreting their association (Paper 2); and that differential parenting within families can also have distinct cultural meaning (Paper 3). Future research would benefit from exploring within-and between-cultural differences in parent-child relationships further, across multiple countries, over time and in larger samples.

The aim of this essay is to analyze the political interests of the United States Government in Turkey, from 1997 to spring 2007, using a qualitative method. I will also analyze any strategic changes during this period, by using theories of realism, particularly Structure Realism and Rational Choice. Using the Rational Actor Model (RAM), I will analyze how nation states such as the United States act in the political arena in Turkey. How can the US Government legitimize the support to Turkey and at the same time criticize there democratic deficit and their view on human rights. Turkey has been an American Military Ally, via NATO since 1952 and its demographic situation has changed since the Cold War. Turkey is located at the crossroads of the Eastern Islamic and Western Christian worlds, which complicates the situation. In addition 99% of the Turkish population is Muslim and only 1% is Christian, which has affected the development of relationships during the past decade, especially dramatic after September 11, 2001 when the United States focused on threats from Islamic Fundamentalist Groups. The RAM treats governments as unitary rational actors in the broader strategic environment when they calculate and prefer one political alternative to another. The RAM can be used to determine whether and how political actors, in this case the US Government work towards a maximized goal. Hierarchical position in structural realism is also interesting - the bandwagon alternative - which means that states jumps on either the strongest bandwagon or the actor that can guarantee the security of other states. In conclusion from a RAM perspective the analyze shows that the political interests of the US government had changed from a economic-strategic interest before September 11, 2001 to a more security-strategic interest after September 11, 2001. The US Government by using Turkey as military allied had focused on there national goals in Euro Asia trying to guarantee both Turkeys and US economy strategic security during this period. Especially buy controlling the oil and gas from the Caspian Sea. Turkey has also got the leading role and the mission of guaranteeing the peace and democratic development to secure an area of different cultures and religions in there neighbourhood.

Although governments try to create strict policies and regulations to prevent abuses, use of excessive force is still a problem for almost every country including Turkey. This study is intended to help Turkish National Police administrators to understand and prevent police use of excessive force. Studies on police brutality categorize three factors that explain why police officers use excessive force; these are individual, situational and organizational. In addition to brutality theories, job satisfaction literature is examined in this study to understand the use of excessive force. Job satisfaction is found to be related with burnout, turnover, stress, commitment, and performance. The impact of officers' attitude toward the criminal justice system and/or laws has not been tested widely. Police officers attitudes toward human rights laws are examined in this study to measure its impact on attitude toward use of excessive force. A secondary data collected in Turkey are analyzed by structural equation modeling which provides confirmatory factor analysis, path analysis, and causal relationships between variables. It is found that police officers' attitude toward human rights laws is a significant predictor of their attitudes toward use of excessive force. Job satisfaction and education level are the other significant variables affecting attitude toward use of excessive force. Based on the analyses of findings, educational and policy implications are posed for Turkish police administrators to better understand and prevent police use of excessive force.

This study focuses on the Muslim Turkish minority in Greece and the development of its educational rights. It starts with the 1923 Lausanne Treaty that established the minorityhood of the Muslim ummah for the former Ottoman territory and explores various aspects of Minority education between then and the end of the 2000s. While doing so, it treats these rights as individual rights with a collective aspect; some of the individual rights of minorities can only be enjoyed together with others. Also, it draws a direct correlation between the Minority's education and its rights. That is, in the case that the education level of the Minority was high, there was less discrimination against members of the Minority, since they had the linguistic skills, educational background and self-confidence to fight against violations of their rights by the host country, Greece. Also, it emphasizes the involvement of external actors in the development of Minority education in Western Thrace. Concerning the development of Minority education, this study argues that minorities' rights are not only ‘given' by host states but also ‘claimed' by members of minorities through various struggles at the local, national and international level. Also, as well as the Minority and the Greek state, various external agents, such as Turkey and the European Union, are also involved in the struggle between the Minority and the Greek state over the former's education. The impact of these agents on the survival of the Minority's educational rights was immense, particularly from the 1980s onwards. It was primarily the inclusion of these external actors that pushed Greece to change its discriminatory policy against the Minority in 1991. This study demonstrates that a number of the individual rights emanating from the Minority's Greek citizenship have only been recognized since 1991. Nonetheless, I conclude that in spite of some improvements, the Minority's difficulties in the realm of rights with collective aspects, such as education of Minority students in a bilingual environment, persist.

Abstract

This study will shed light on the meaning of article 301 of the Turkish Penal Code and its

inconformity with fundamental principles of the European Union and fundamental human

rights. The trial of Nobel Prize winner, Mr Orhan Pamuk and the killing of Mr Hrant Dink in

January 2007 have both put focus on the notorious article 301 of the Turkish Penal Code.

The purpose of the study is to answer the main question; In what way does article 301 of the

Turkish Penal Code infringe the freedom of expression outlined in article 10 of the European

Convention on Human Rights and what should the European Union do about it?

The conclusion is that article 301 of the Turkish Penal Code infringes the right to freedom of

expression stated in article 10 of the European Convention on Human Rights. It does

undermine the essence of the right by invoking a wide range of self-censorship, by its

ambiguous language and by the way it is applied. The restrictions are interpreted broadly and

leave nothing but an arbitrary article left to apply for the courts. The European Union holds

the power to influence Turkey and can therefore enforce an abolition of article 301 of the

Turkish Penal Code. Time will tell if Turkey will fully safeguard freedom of expression as it

is stated in article 10 of the European Convention of Human Rights and in the praxis of the

European Court of Human rights and the European Court of Justice.

The purpose of this paper has been to describe the change of governance in Turkey from 2005 until 2018. The method that has been applied is a comparative study as well as a case study where a theory of democracy was used to describe and compare the changes of governance in Turkey between 2005 and 2018. Robert Dahls theory of democracy was used for this paper to determine the change in governance between the relevant years. The analysis of each institution for each year was than compared to finally determine any change in governance. The study showed that the governance of Turkey has taken further backsliding steps of democracy compared to the situation in 2005. The changes consist of a centralization and increase of power within the presidency and further limitations within some rights and freedoms. The possibility for citizens to engage in politics in different ways, to express the opinions whether good or bad, to search for alternative information and to have the right to vote in free and fair elections have all worsened in 2018 compared to 2005.

Dotée des caractéristiques essentielles d'un État moderne et laïque, le pays dispose de structures formellement démocratiques, mais sa démocratie se révèle fragile: ses politiques tant internes qu'externes sont décidées par un Conseil national de sécurité composé pour l'essentiel de militaires. En outre, l'armée qui a pris le pouvoir à maintes reprises a donné au régime une dimension autoritaire. Cela non seulement en vertu des principes fondateurs de la République (tradition centralisatrice de l'État turc), mais aussi de la priorité que l'institution militaire accorde à la sécurité, à l'unité et à l'identité nationales. En effet, les mesures d'exception (état d'urgence, cours de sûreté de l'État, loi anti-terroriste) ont contribué aux violations des droits de l'homme, d'où l'opposition entre le droit conventionnel et le droit national. De plus, le système judiciaire et administratif instauré par les militaires en 1982 n'est pas conçu dans l'intérêt des justiciables. Certes, l'accès à la modernité n'a pu se faire que sous la contrainte et le contrôle de l'armée, mais le régime en Turquie peut-il continuer à s'appuyer sur les«piliers de l'ordre» que sont l'armée, la police et la justice ? L’État semble cependant se réorganiser progressivement pour permettre au pouvoir politique d'assurer un contrôleur les forces de sécurité et pour donner une meilleure indépendance à la justice. Le processus mis en route et les critères imposés pour l'adhésion à l'UE devraient contribuer à mettre en œuvre les réformes institutionnelles capables d'harmoniser la démocratie à l'État de droit, à l'image des pays européens. En effet, les changements récents sont liés à l'agenda européen. Le gouvernement turc semble être déterminé et ambitieux dans sa vocation européenne. Les progrès réalisés pour intégrer l'UE lui sont un moteur de propulsion devant servir au pays et à sa population.
The issue of the accession of Turkey to the European Union is one of the most controversial topics as regards to human rights. The sensitive issues such as the kurdish problem and the conflict with Cyprus are the main cause of the most restrictions of the rights and freedoms and complaints lodged against the Turkish State before the European court of Human Rights. Turkey has the essential characteristics of a modern and secular state, but its democracy prove to be fragile. Thus, the powerful role of the army in many areas of political life can be explained by the malfunctioning of the democracy, giving to the régime an authoritative aspect. The Turkish army is seen as the guardian of the unity, security and identity of the nation. Indeed, the access to modernity is due to the control of the army, but the régime in Turkey needs to undertake major policy reforms to converge with European Union policies. The judicial and administrative system set by the army in 1982 does not sufficiently protect the justiciable. The exceptional measures such as state of emergency, security state courts, anti-terrorist law contributed to the violation of human rights and emphasized the contradiction between conventional law and national law. Turkey has made progress towards modifying its legal system in order to give more independence and impartiality. The accession partnership will certainly enable Turkey to review its Constitution and relevant legislation in providing basic freedoms, the rule of law and respect of human rights in conformity with the European Union's own standards. Turkey's inclusion in the enlargement process has not only increased European Union leverage over Turkish politics, but revitalized Turkey's European vocation.
