Résumé :
Various movements through history have appealed to Scripture for authority. These have been called supersessionist, messianist, and/or zionist, but they continue to appeal to Scripture even after they attain power and thus repress others. Power corrupts, and when this happened in ancient Israel Prophets arose to critique and denounce it. In addition Scripture as canon, both Jewish and Christian, included Wisdom thinking, making it a thoroughly dialogical compendium that questioned abuse of power. The teachings of Jesus are themselves largely prophetic critique of abuses of power. Beyond Scripture prophetic critique can be effected by empathy for the position of “the other” and loving the enemy, thus engaging in the monotheizing process by refusing to demonize those who differ but learning from them.

Abstract Orders and conflicts of jurisdictions. The procedure of appeal against an abuse of ecclesiastical power, processual lever, political object. The procedure of appeal as abuse was profoundly reformed by King François I, in the great ordinance signed at Villers-Cotterêts in August 1539. The concept underlying this reform set it up as a political lever in the fight against ecclesiastical jurisdictions, in a Gallican perspective. From the 16th to the 18th century, jurists thus turned a simple procedure into a real political tool in the service of their ideas.

Résumé :
For many women, the abuse of power in the form of physical and emotional battering by their so-called ‘partners’ is a fact of life. Individual women feel the pain, the humiliation, the fear and the anger. But the debate about how legally we should respond to a woman who finally kills her abuser is significant beyond the individual. Whatever the predicament of women such as Sara Thornton, or Kiranjit Ahluwalia, sentenced to life imprisonment and forced to scale seemingly impossible obstacles in the appeal process, the exponential rise in literature on this subject is quite disproportionate to the number and increase (if any) in such cases. The real significance of the ‘self-defence for battered women’ movement lies less in these concrete examples and more in its metaphorical role as witness to the social reality of the abuse of women.

Résumé :
Under the Teacher Status Act, the teacher appeal review system is a special legal system that can function very importantly as a pre-trial remedy for teachers' educational activities and illegal infringement of rights and interests. In order for the Faculty Appeal Review Committee to fulfill its legal and institutional functions, it is natural that teachers must have high reliability and utilization of the system. However, if teachers are not aware of the necessity of such a system, and they become distrustful, there will be no purpose for the system to exist. Therefore, in order to enhance the necessity and function of the teacher appeal review system, the general reason for existence of the system, the benefits of claims in administrative trials, administrative litigation, and constitutional complaints were reviewed, and the hearing, scope, and deliberation laws of the teacher appeal review committee were briefly reviewed. In particular, the expansion of the subjectivity of the teacher appeal is very consistent with the purpose of the existence of the teacher appeal system, the protection of teachers' educational activities, and the protection of teaching rights. Next, the Teachers' Appeal Review Committee plans to expand the scope of the claimed profits. Given that the disposition, which is the subject of administrative disputes, is expanding to general dispositions and that the subject is gradually expanding, it is necessary to expand the eligibility of claimants and claim profits to aspects of economic interests, not just power alone and power factual actions. The third is the expansion of the legal principles for hearing. In other words, it is a plan to expand the legal principles for reviewing discretionary power at the Faculty Appeal Review Committee. If the scope of the recognition of discretion is expanded beyond the logic of simple discretionary rights and the law on the deviation and abuse of discretionary power can be applied, the purpose of the existence of the teacher appeal review system can be greatly improved. In other words, I think that it will be a very useful and convenient relief system for teachers even if the target of teacher appeal is expanded.

Résumé :
This paper deals with emotional arguments which are frequently used as a tool for manipulation, especially in political rhetoric. It is believed that every conflict and every violent act is preceded by a specific type of rhetoric contributing to hatefulness and intolerance. This paper will discuss different arguments (i.e. appeal to emotions) which can influence the spread of hate speech, verbal abuse and, in some extreme cases, even physical conflict and violence. Political figures frequently use such arguments to manipulate the audience and consequently preserve or gain political power for themselves. Arguments such as appeal to fear (argumentum ad metum), appeal to anger (argumentum ad iram), appeal to indignation (argumentum ad indignationem) and appeal to threat (argumentum ad baculum) will be discussed and analyzed in the examples of political rhetoric. By recognizing emotional arguments used as manipulation and differentiating emotions as legitimate arguments, the audience might reveal manipulators, unmask manipulation and hopefully, in some instances, prevent violence and intolerance in society.

Résumé :
The establishment of the material standard in the appeal for abuse of power has witnessed development at the legislative level. In the original text of the law of June 1, 1972 relating to the Administrative Court, the legislator adopted an organic standard to determine the jurisdiction of judge abuse power. However, the Administrative Court did not adhere to the organic standard and adopted a material standard to determine its jurisdiction. The 1996 revision aligned itself with the judicial jurisprudence of the Administrative Court and established a material standard for determining jurisdiction in the appeal for abuse of power. At the same time, Law No. 38 of 1996, dated June 3, 1996, assigned jurisdictional blocks to both the judicial judge and the administrative judge. The activation of the material standard has clearly appeared in disputes of public establishments, decisions related to the organization of the legislative authority, the organization of the judicial authority and decisions issued by bodies not specified by law. Regarding full litigation, both the Administrative Court and the Conflict of Jurisdiction Council prevailed over the material standard in public establishment disputes, and the judge did not abide by the bloc of jurisdiction that the legislator assigned to the judicial judge, whether with regard to the relationship between public establishments and their clients or with regard to disputes that arise between them and others. In addition, the Administrative Court prevailed over the material standard in lawsuits related to real estate, whether those related to seizure or those related to private property of the administration. The study reached results, the most important of which is the lack of consistency and harmony between the requirements of the law of June 1, 1972, as amended, and Law No. 38 of 1996 with regard to standards of jurisdiction and abandoning the technique of blocks of jurisdiction.

Résumé :
Abstract There has been much debate in biblical scholarship over the alleged “rape” of Bathsheba by David as described in 2 Samuel 11–12. Scholars such as Bailey and Nichol claim that Bathsheba was a consenting partner, while others, including Davidson and Brueggemann, suggest she was a victim of David’s abuse of power. This analysis will explore 2 Samuel 11–12 with a special focus on the themes of power, honor, and shame that emerge in the pericope. These themes are also central to the overall narrative of Samuel. Using literary analysis, I highlight Bathsheba’s isolation and powerlessness as she is “taken” to King David by royal attendants after he has spied her bathing. Bathsheba’s lack of resistance is often compared to the rape of Tamar, which subsequently occurs in the vicinity of the palace in 2 Samuel 13. While Tamar objects to Amnon’s sexual advances in the narrative, Bathsheba does not voice an objection. It is primarily on the basis of her silence that scholars suggest she was a consensual partner. However, there are many differences between Tamar and Bathsheba. Tamar was a daughter of the king and could appeal to relatives in the palace to rescue her from rape. Bathsheba was alone with no one to rescue her. Her silence should not suggest complicity. This is reinforced by the prophetic condemnation by Nathan delivered to King David regarding his abuse of power. While not initially directly accusing the king, the prophet presents a judicial parable to trap the king into condemning himself. Yet, if King David is not corrupted by his power, why does the prophet Nathan need to use a rhetorical strategy to confront him? Convicted and guilty, David repents. The repentance for abuses of power and sexual sin by national leaders is emphasized and modeled by King David. This also provides a model of repentance for the pentecostal community for comparable abuses against victims of power and sexual sin.

Résumé :
Introduction. The right of the accused to a defense in criminal proceedings is a prerequisite for the effective administration of justice, since it minimizes possible errors in the final decision in a case, which may result in the conviction of innocent persons, which contradicts the purpose of criminal proceedings and undermines citizens confidence in the judicial system. The purpose of the article is to identify systemic problems that impede the effective implementation of the right to defense at the stage of appeal, as well as to suggest ways to resolve them. Main results. The authors come to the conclusion that the structural and logical elements of ensuring the right of the accused to a defense at the stage of appeal proceedings in a criminal case are: subjects defending the accused; duties of a defense lawyer to exercise the right of the accused to defense at the stage of appeal proceedings in the case; subjects who, in accordance with the requirements of the criminal procedure law, are obliged to ensure the right of the accused to defense; the duties of the courts of first and appellate instances imposed on them by the criminal procedure law, corresponding to the rights of the accused, his defense lawyer and legal representative and forming in their totality a system of interim measures necessary for the realization of the accuseds right to defense; the powers of the accused, his defense counsel and legal representative, through which the constitutional right to defense is exercised; guarantees of the accuseds right to defense. The only ground for limiting the right to defense is abuse of the right by the defense. The fact of abuse of the right can only be established by the court, the abuse of the right cannot be evidenced exclusively by the external expression of the actions of participants in the process. The question of the presence or absence of abuse of the right to defense should be decided by the court on the basis of the totality of factual circumstances and procedural features of each individual situation. The system of powers that make up the content of the defendants right to defense at the stage of appeal proceedings in the case consists of two interrelated elements, including powers exercised at the stage of filing an appeal and before the start of the court session of the court of appeal, as well as the powers that the defense side has directly in consideration of a criminal case in a court session of the court of appeal. Conclusion. Thus, the effective provision of the right to defense at the stage of appeal proceedings requires a change in approaches on the part of legislator and law enforcement officers.

Résumé :
Judicial forums are the means to achieve the most pivotal goal of maintaining check and balance according to the theory of separation of powers. The judiciary has the power to supervise the legislative and executive branches of the government. The judgments by the courts/appellate forums are vital as they prevent attempts by the competition authorities to abuse their powers when prosecuting wrongdoers and force the competition authorities to conduct more rigorous investigations to prevent legal challenges. In Pakistan certain challenges need to be addressed in order to strengthen the implementation of competition law. There is a need to establish a jurisprudence of competition law. The judgments of courts/appellate forums can set useful precedents. However, the dysfunctional status of the appeal court since the establishment of the Competition Commission of Pakistan (CCP), judges’ lack of experience in the area of competition law and certain other aspects need to be focused on in order to firm up competition law in Pakistan. This article intends to review the different forums of appeal available in Pakistan competition regime, eligibility criteria for filing an appeal, procedures of appellate forums, rules governing the procedure and powers of appellate forums. It aims to discuss the importance of judicial protection, the enforcement challenges of Pakistan competition jurisdiction and the suggestions for improvement.

Résumé :
Over the last two decades male victims of domestic abuse have received much media and political attention. A polarised debate emerged. At one pole there are those campaigning for the rights of ‘battered’ men to be acknowledged, believing gender to be irrelevant in the aetiology of domestic abuse. At the other pole there are feminists, maintaining that gender is relevant, as domestic abuse is an expression of patriarchy and therefore overwhelmingly perpetrated by men against women. Through a consideration of both male victims’ and female perpetrators’ accounts this research considers the relevance of gender and power, in abusive relationships, where it is the man who is the victim. With a view to establishing whether there is domestic violence without ‘male power’, the thesis asks: In what ways are abused men’s and female perpetrators’ accounts shaped by gender? And what is the relationship between masculinity/femininity and abuse for abused men and female perpetrators? Adopting the Free Association Narrative Interview method (FANI) I interviewed ten men presenting as victims and ten women presenting as perpetrators, accessed via support services and probation referral centres. Both psycho-discursive and psychosocial analysis was carried out on the interview data. Psycho-discursive analysis revealed how the men re-configured what would otherwise be emasculating disclosures of victimisation, as self-sacrificing heroism. The women’s accounts were constrained by the limited ways that women’s aggression is spoken about. Placing their perpetration firmly within the context of their own victimisation, they ‘struggled’ to recount their experiences in ways that did not contravene expectations of womanhood. Psychosocial analysis allowed for the exploration of individuals’ defences, revealing closely guarded fears, anxieties, insecurities, motivations, and desires. Underscoring men’s accounts of self-sacrifice and heroism and women’s constrained accounts of aggression were guarded vulnerabilities. However, such complexity was lost in the gender specific ways that male victims and female perpetrators positioned themselves within the ‘story’ of domestic abuse. Ultimately, the patterned configurations of power illuminated cannot adequately be explained by the concept of patriarchy, but instead the multiple ways that gender is intersected with other structural hierarchies, as well as individual biography, to create context specific configurations of power. It is argued that policymakers, service providers, academics and academic commentators alike must transcend the polarised debate. Only through an understanding no longer founded on oversimplifications, can we embrace the complexity of abusive relationships and in turn establish support that appropriately meets the needs of the male victims and the female perpetrators. This does not mean abandoning analyses of the role of gender and power in domestic abuse, but recognising the complex ways in which they present themselves in both the enactment of violence and in its telling in the aftermath of conflict.

Styczen, Myriam. « L'acte faisant grief ». Electronic Thesis or Diss., Université Paris-Panthéon-Assas, 2025. http://www.theses.fr/2025ASSA0005.

The term used by the administrative judge is a common term for an act that may be appealed. Yet the statutory and legislative provisions governing access to the court do not provide for such a concept. The doctrinal discourse is, moreover, heterogeneous and contingent. The choice was therefore made to propose a definition, based on an analysis that is both historical and positivist. The act causing damage is an act capable of producing sufficient effects, that is to say serious and immediate, justifying the opening of proceedings against it. It pursues a resolutely objective aim of regulating access to the court and delimiting the office of administrative judge. But the developments in administrative litigation reveal a renewed usefulness of such a notion, yet resolutely classical. The rule of prior decision, an intangible axiom of administrative litigation, is now called into question by the admission of appeals against acts which are not decisive on the ground that they cause harm. The grievance is the real admissibility test. The highlighting of the contentious utility of the grievance is accompanied by the understanding it allows of the legal and normative phenomenon. The act causing the injury shows that the unilateral administrative action is not in any way reduced to an administrative decision. Considering that the act causing injury, when it has effects, the judge invites to renew the approaches of normativity, inseparable from the notion of obligation. The opening of the appeal against non-decision-making acts would reveal a new pretorian conception of normativity, more realistic and based on the effective modification of rules of law or behaviour

Presto, Sylvia. « The impact of power of attorney abuse on the elderly| A case study ». Thesis, New Jersey City University, 2015. http://pqdtopen.proquest.com/#viewpdf?dispub=3730744.

Texte intégral
Résumé :

Durable power of attorney has been recognized as a powerful legal document that is used to financially exploit the elderly across the United States. The existing research indicated elder financial abuse undermines the economic security of the financially exploited older adult.

Despite the findings, however, a recent review of the existing literature showed a lack of research that computed how much elder financial abuse was attributed to durable power of attorney abuse. Studies, such as the one published by the MetLife Market Institute, reported that $2.9B was stolen from the elderly nationwide in 2010. If the durable power of attorney is used to financially exploit the elderly, then the question becomes: How much money is stolen from the elderly by the misuse of a durable power of attorney? The existing research that quantified elder financial abuse did not delineate and show how much was attributed to durable power of attorney abuse. That is the missing link.

Adult Protective Services is a nationwide government agency that receives and investigates reports of suspected elder abuse, physical and financial. The elder financial abuse cases include those in which a durable power of attorney was used to gain access to the older adults’ money.

This dissertation was the first attempt to calculate in dollars how much money was taken from older persons in Bergen County, New Jersey through the misuse of a durable power of attorney, with a sole focus on durable power of attorney abuse apart from the other ways in which senior citizens are financially exploited. This researcher examined an open-source document prepared by Bergen County Adult Protective Services and estimated in dollars how much money was taken from the elderly in Bergen County, New Jersey over a specific period of time.

This researcher examined civil security, the human security paradigm, and national security. The focus was on the economic component of the human security paradigm and through a narrow lens, the study results demonstrated that durable power of attorney abuse is a critical threat to the economic security of the nation’s older population and poses a potential threat to our nation’s security.

The most significant result was that the data compiled in this study seemed to indicate that between January 1, 2010, and December 31, 2013, the majority of the elder financial abuse cases reported to and investigated by Bergen County Adult Protective Services were committed by a means other than the misuse of a durable power of attorney. When it was used, however, it resulted in the older persons having their monthly social security income stolen on a regular basis, or in other cases hundreds of thousands of dollars were taken over time.

Résumé :
Violence against women (VAW) in Scotland has only recently emerged onto the national policy agenda, despite (or perhaps because of) three decades of work on the issue by feminist activists and organisations. Government responses to VAW increasingly involve calls for ‘joined-up working’ and public sector-voluntary sector partnerships, and the proliferation of these multi-agency bodies to address complex social problems such as child abuse and VAW underscores the need for enquiry regarding the processes and products of these bodies. What makes multi-agency partnerships work? Can they bring new, expert voices to the policy table? Can they nurture collaboration and broad ownership of policy implementation? This case study looks at the Scottish Partnership on Domestic Abuse. Set up in 1998 to define a national strategy for addressing domestic violence, the partnership officially ended its work in November 2000 with the presentation of the National Strategy on Domestic Abuse to the Scottish Parliament. The research focuses on the establishment of the Partnership in the context of an increasingly minimalist, differentiated system of governance and locates the Partnership at the intersection of devolution and 30 years of feminist activity on VAW. How new voices came to the table, Partnership processes for agenda setting and decision making, and the naming and framing of policy problems throughout the life of the Partnership – all emerged as important themes. Analysis reveals substantial increases in access to decision makers and policy networks and significant influence of the VAW sector on the national policy agenda. Less clear is the effectiveness of the Partnership in supporting innovation across resistant institutions such as the court system and the NHS, although these areas require longer-term study.

Résumé :
AbstractThe digital world has a strong tendency to let everything in its realm appear as resources. This includes digital public discourse and its main creators, humans. In the digital realm, humans constitute the economic end and at the same time provide the means to fulfill that end. A good example is the case of online public discourse. It exemplifies a range of challenges from user abuse to amassment of power, difficulties in regulation, and algorithmic decision-making. At its root lies the untamed perception of humans as economic and information resources. In this way, digital technology provides us with a mirror that shows a side of what we are as humans. It also provides a starting point to discuss such questions as who would we like to be – including digitally, which purpose should we pursue, and how can we live the digital good life?

Résumé :
In addressing the causes of unlawful actions committed by high-ranking officials in the 1940s and 1960s, Soviet authorities often attributed them to the lingering influence of pre-revolutionary capitalist mentalities among certain managers. This explanation lost credibility over time, as by the 1970s and 1980s, the leadership consisted largely of individuals born and fully socialized within the Soviet Union, supposedly free from the flaws of other, non-communist societies. In this module, Viktor Krupyna uses unpublished archival materials and available source collections to examine the widespread abuse of power by Soviet officials in the Ukrainian SSR in 1945-1991, its causes, scope, and consequences.

Résumé :
For over a decade, a number of scholars and scientific papers emphasized the continual decline of trust in public institutions, mainly in the democracies of “the West”. Some associated the observed phenomenon with the rise of social media and digital environments, while others attributed it to the rise of economic and political power of less democratic regimes of “the East”, such as China and Russia. In times of crisis, trust in government institutions could be of crucial importance for the appropriateness of the institutional response to the problems facing the nation. Across the EU, it is obvious that citizens of certain member states express higher trust in government and state institutions than others. This division has been even more apparent during the COVID-19 pandemic, especially when vaccination rates of particular EU countries are compared. In Croatia, the Government’s main message concerning COVID- 19 vaccination was modeled to appeal to the receivers’ empathy towards others. However, emotional appeal is just one of the possible courses of action. Theories of rational choices and exchange theories emphasize other, often ulterior motives, such as selfishness and revenge, as equally effective purposes to undertake certain actions. In this paper, we have examined four different types of messages, based on selfishness, revenge, honesty and empathy, and their power to persuade research subjects to get vaccinated. Message reception results are compared to other socio-demographic and behavioral factors to define which message type would be most appealing to different demographic groups.

Résumé :
In his recently released book, scholar Mark R. Thompson underscores how the “people power” narrative gradually lost credibility in the Philippines, as evidenced by the opposition’s resounding defeat in the 2022 elections. This outcome demonstrated the diminishing appeal of this discourse among the majority of Filipinos. Given Thompson’s assessment of Duterte’s election and his populist legacy as the latest iteration of a cyclical pattern in Philippine politics, his book represents a valuable contribution to the literature on populism.

Texte intégral
Résumé :
The abuse of criminal justice as a tool for repression is a hallmark of authoritarian regimes, with Russia serving as a compelling case study. This paper explores the evolution of criminal justice abuse in Russia, focusing on key mechanisms such as selective law enforcement, the erosion of judicial independence, and the strategic use of ambiguous legal provisions. High-profile cases, including those of Sergei Magnitsky and Alexei Navalny, highlight the regime's deliberate use of the judiciary to silence dissent, instill fear, and consolidate state power. The discussion extends to broader societal impacts, such as the fragmentation of civil society, suppression of independent media, and marginalization of minority groups. By leveraging criminal justice systems as instruments of control, the Kremlin has institutionalized authoritarian governance, leaving profound consequences for societal cohesion and human rights.

Résumé :
Changes in brand ownership resulting from cross-border mergers and acquisitions impact competition and consumer welfare. Foreign acquisitions of local brands often lead to an increase in cost or a decline in appeal for the acquired brand, with limited gains in efficiencies. However, the accompanying rise in market power has translated into higher profits for the majority of brand-acquiring firms. Pro-competitive policies in the United States and European Union that required divestitures in the beer industry as a condition for merger approval led to significant consumer savings. Similar policies in South America would have reduced consumer prices by 18%.

Texte intégral
Résumé :
The concept of impeachment has its origins in the history of political and legal thought as a constitutional mechanism to remove public officials for serious violations of the law or abuse of power. Originating from England, it has influenced the constitutions of the United States and the countries of Latin America. In addition to concrete grounds for impeachment, constitutions also allow for impeachment based on abstract grounds, designed for cases where no specific offence can be proven, but the abuse of power is so obvious that the people must be guaranteed the right to recall their elected leader. In Latin America, military coups have been replaced by so-called “soft coups”, which abuse various legal instruments. The abstract nature of the grounds for impeachment contributes to the potential misuse of this mechanism as a tool of lawfare, as many cases demonstrate. During the past decade, Peru has experienced a series of impeachments, with three presidents facing removal from office due to political conflicts between the legislative and executive branches. These cases highlight the use of impeachment as a tool of lawfare, undermining democratic stability and raising concerns about the transparency and impartiality of the process, as well as the erosion of democratic principles.

Texte intégral
Résumé :
This rapid review updates a previous report (Fraser and Martineau-Searle, 2018) with evidence from 2018 onwards. It finds an evidence base on online gender-based violence (OGBV) covering a wider range of countries than the previous report. Some key findings on the nature and prevalence of OGBV include: The most recent surveys show a prevalence of OGBV ranging from 16% to 58%; Men and boys also experience online abuse in high numbers, but it is less likely to be gender-based; Several studies from different countries identify Facebook as the top location for incidents of OGBV; Higher levels of online harassment and abuse are faced by people with intersecting inequality factors; According to victim-survivors, perpetrators are more likely to be unknown and acting alone, but large numbers are known to the victims. Perpetrators themselves report divergent, multifaceted and often over-lapping motivations for their actions; Analysis of underlying drivers of OGBV highlights an overarching theme of power and control, and heteronormative expectations around gender roles and sexual practice. Many authors recommend that OGBV be understood as part of a continuum of abuse where normalised behaviours, such as sexual harassment in public spaces, shade into behaviours widely recognized as criminal, such as physical assault. The societal impact of OGBV includes: Media freedom is compromised; Democracy being undermined; Economic losses resulting from lost productivity; A ‘climate of unsafety’ prevails. Evidence base: The number of surveys about self-reported experiences with online harassment has increased rapidly. The majority of the research found during the course of this rapid review came from international and domestic non-governmental organisations and think-tanks. Academic research studies were also found, including several literature reviews.

Résumé :
In the Islamist version of civilizational populism, the emotional backlash against the rise of secularism, multiculturalism, progressive ideas, and ‘wokeness,’ has been skillfully employed. While for the populists, populist far right and civilizational populists in the West, usually the Muslims are the civilizational other, we argue in this article, in the Islamist civilizational populism, the list of civilizational enemies of the Muslim way of life also includes feminists and LGBTQ+ rights advocates.Gender populism is a relatively new concept that refers to the use of gender symbolism, language, policy measures, and contestation of gender issues by populist actors. It involves the manipulation of gender roles, stereotypes, and traditional values to appeal to the masses and create divisions between “the people” and “the others.” This paper looks at the case study of gender populism in Turkey, where the Justice and Development Party (AKP) has been in power for over two decades. The AKP has used gender populism to redefine Turkish identity, promote conservative Islamism, and marginalize women and the LGBTQ+ community. The paper also discusses how gender populism has been used by the AKP to marginalize political opponents.

Résumé :
Labour abuse in the garment industry has been widely reported. This qualitative research explores the lived experiences in communities with bonded labour in Tamil Nadu, India. We conducted a qualitative expert-led analysis of 301 life stories of mostly women and girls. We also explore the differences and similarities between qualitative expert-led and participatory narrative analyses of life stories of people living near to and working in the spinning mills. Our findings show that the young female workforce, many of whom entered the workforce as children, are seen and treated as belonging – body, mind and soul – to others. Their stories confirm the need for a feminist approach to gender, race, caste and work that recognises the complexity of power. Oppression and domination have material, psychological and emotional forms that go far beyond the mill. Almost all the girls reported physical and psychological exhaustion from gendered unpaid domestic work, underpaid hazardous labour, little sleep, poor nutrition and being in unhealthy environments.

Texte intégral
Résumé :
Restrictive masculinity is a social construct that is tied to beliefs about how men behave and are expected to behave to be considered “real men”. By contrast, gender-equitable masculinities constitute a more flexible alternative that permits men to take on diverse roles and behaviors while not limiting womens agency. This publication conducted a thorough analysis of restrictive masculinities in Guyana, Suriname, and Trinidad and Tobago in 2022, utilizing both focus groups and online surveys. The research aimed to understand the attitudes of young men exploring seven themes related to gender and masculinities, including toughness, self-sufficiency, paid and unpaid work, money and education, hypersexuality, homophobia, power and control, and violence. To measure masculinity, the study develops a statistically validated scale composed of diverse attitude statements based on previous tools on this topic. It also explores how young mens attitudes about gender are associated with social norms and influence behavioral outcomes in areas such as sexual harassment, bullying, alcohol and drug abuse, depression and suicidal ideation. Finally, the publication offers policy recommendations and highlights best practices that can be employed to accelerate positive changes in the region.

Texte intégral
Résumé :
In this paper, we assess the implications of Elon Musk’s strategic control over Tesla, the pioneering company that has become central to the electric-vehicle transition. We document how, as Tesla’s CEO for 16 years, Musk has exercised strategic control to direct the transformation of the company from an uncertain startup to a global leader. Now that Tesla is profitable corporate predators (aka hedge-fund activists) may challenge Musk’s strategic control—a possibility of which the CEO is well aware. To retain his control over Tesla as a publicly listed company, Musk depends on holding a sufficient proportion of Tesla’s shares outstanding to possess the voting power to fend off predatory value extractors. In addition to accumulating Tesla shares by investing $291.2 million at early stages of the company’s evolution, Musk has relied upon massive stock-option grants from the Tesla board, under the guise of “compensation”, in 2009, 2012, and 2018, to boost his shareholding and, with it, his voting power. Hence the Delaware Court of Chancery’s decision in January 2024 to rescind Musk’s 2018 stock-option package—by far the largest ever granted to a corporate executive—poses a threat to Musk’s strategic control at Tesla. As the “Technoking” of Tesla strategizes to maintain his control over the company’s decision-making, anyone concerned with the role that Tesla will play in the evolving EV transition should be asking how CEO Musk might use, or abuse, his powerful position.
