Résumé :

U radu se daje prikaz uređenja pravila o međunarodnoj nadležnosti primjenjivima na potrošačke ugovore u hrvatskome međunarodnom privatnom pravu, počevši od Zakona o rješavanju sukoba zakona s propisima drugih zemalja u određenim odnosima (ZRSZ), preko uredaba Bruxelles I i Bruxelles I bis pa do najrecentnijeg Zakona o međunarodnom privatnom pravu (ZMPP). U ZRSZ-u nije postojala posebna odredba o međunarodnoj nadležnosti za potrošačke ugovore pa su ti ugovori bili podvrgnuti odredbama o općoj međunarodnoj nadležnosti i posebnoj međunarodnoj nadležnosti za ugovore. Ulaskom Republike Hrvatske u članstvo Europske unije hrvatski sudovi postali su obvezni primjenjivati Uredbu Bruxelles I kao izravno primjenjiv izvor pravila o međunarodnoj nadležnosti u građanskim i trgovačkim stvarima. Zahvaljujući Uredbi Bruxelles I, koja je u međuvremenu preinačena u Uredbu Bruxelles I bis, prvi su put potrošači na hrvatskom sudu dobili zaštitu u smislu povoljnijih postupovnih odredaba o međunarodnoj nadležnosti. Personalno polje primjene Uredbe Bruxelles I, kao i Uredbe Bruxelles I bis koja ju je zamijenila, uređeno je na način da se uredbe primjenjuju kada tuženik ima domicil u EU-u. Uredbom Bruxelles I bis položaj potrošača dodatno je ojačan proširenjem polja primjene odjeljka o potrošačkim ugovorima i na slučajeve kada tuženi trgovac ima domicil izvan EU-a. U siječnju 2019. godine na snagu je stupio ZMPP čije se odredbe o nadležnosti primjenjuju podredno, odnosno kada nije primjenjiva neka od uredaba europskoga međunarodnog privatnog prava. U članku 46., stavku 2. ZMPP-a hrvatski je zakonodavac proširio primjenu određenih odredaba Uredbe Bruxelles I bis i na situacije kada tuženik ima u smislu te uredbe domicil u državi koja nije članica EU-a. U radu će se analizirati opisani zakonodavni razvoj i njegov utjecaj na zaštitu potrošača u Hrvatskoj.

Les Gnawa sont une communauté confrérique issue de la présence subsaharienne au Maroc. Ils sont connus pour leur rituel nocturne de transes, la līla, mais aussi pour leur activité musicale incessante sur les places touristiques des villes marocaines. Cette thèse s’intéresse aux pratiques musicales des Gnawa à Bruxelles. En effet, la communauté des Marocains de Bruxelles (Maroxellois) est l’une des plus importantes de la capitale et les Gnawa en sont devenus l’une des voix audibles. Une quarantaine de musiciens sont actifs tant dans les rituels que dans les mariages, les salles de concert ou les parades.Cette thèse porte sur les mouvements des répertoires, des praticiens et praticiennes et de leurs instruments. Ces circulations ont une importance historique :d’une part, elles sont à l’origine de l’émergence de la pratique gnawa, née de la rencontre de plusieurs cultures d’Afrique subsaharienne portées par les esclaves au Maroc. D’autre part, elles sont constitutives de l’identité contemporaine des Gnawa à la fois dans leur processus d’initiation par la ǧōla et dans la construction de leur carrière professionnelle. La présence gnawa à Bruxelles soulève aussi la question des styles musicaux régionaux :au Maroc, chaque région possède un style « ancien », qui a petit à petit été remplacé par un style moderne globalisé. À Bruxelles, alors que le répertoire du luth guembri est souvent interprété dans sa version globalisée, le répertoire au tambour reste très attaché à son côté tangérois. S’appuyant sur des analyses du répertoire musico-chorégraphique, cette thèse examine comment et pourquoi les identités musicales régionales sont parfois mises en avant, parfois reléguées au second plan.Nourrie par un travail de terrain de plusieurs années mené à Bruxelles, au Maroc et dans d’autres lieux de la diaspora marocaine en Europe, cette recherche prend en compte des données de type historique, ethnomusicologique, anthropologique et sociologique. Les activités gnawa à Bruxelles sont envisagées à la fois dans une perspective transnationale, rattachées à des pratiques globalisées de par le monde mais aussi ancrées dans une localité bruxelloise spécifique qui leur fait prendre une trajectoire unique.

The Gnawa are a brotherhood community resulting from the sub-Saharan presence in Morocco. They are known for their nocturnal ritual of trances, the līla, but also for their public musical activity. This thesis focuses on the musical practices of the Gnawa in Brussels. Indeed, the community of Maroxellois is one of the most important in the capital and the Gnawa have become one of its audible voices.This thesis focuses on the movements of the repertoires, the practitioners and their instruments. These movements are, on the one hand, at the origin of the emergence of the Gnawa practice. On the other hand, they are constitutive of the contemporary identity of the Gnawa both in their process of initiation through ǧōla and in the construction of their professional career. In Morocco, each region has an "ancient" style, which has gradually been replaced by a modern globalized style. In Brussels, while the repertoire of the guembri lute is often performed in its globalized version, the drum repertoire remains very attached to its Tangier side. Based on musico-choreographic analyses, this thesis examines how and why regional musical identities are sometimes highlighted, sometimes relegated to the background.This research is based on several years of fieldwork and takes into account historical, ethnomusicological, anthropological and sociological data. Gnawa activities in Brussels are considered both from a transnational perspective, linked to globalized practices around the world, but also anchored in a specific Brussels locality that gives them a unique trajectory

Depuis une trentaine d’années, des Églises pentecôtistes portées par des communautés en migration ou issues de celles-ci ont fait leur apparition dans la capitale européenne. Leur implantation et leur succès grandissants vont de pair avec l’intensification des flux migratoires de ces trois dernières décennies en provenance d’Afrique sub-saharienne et d’Amérique Latine. Cette thèse entend explorer l’enchevêtrement entre l’expérience religieuse et le parcours migratoire des acteurs pentecôtistes euro-africains et euro-latinoaméricains à Bruxelles. Dans ces espaces, les convertis travaillent collectivement à réaliser la transformation encouragée par le scénario religieux qui consiste à appliquer le « plan parfait de Dieu » dans leur vie. Porteurs d’ambitions missionnaires, les fidèles donnent des contenus inédits à leur posture identitaire en redéfinissant la place qui leur est assignée dans le contexte de la Belgique postcoloniale. L’affiliation religieuse joue comme un marqueur de distinction, processus qui est particulièrement saillant dans le domaine de la sexualité et des rapports de genre entretenus à l’intérieur même des assemblées./During the past thirty years, Pentecostal churches, mostly composed by followers from Subsaharan Africa and Latin America, blossomed in Brussels. Their presence and growing success go hand in hand with the intensification of the migratory flows, the last three decades, from these two continents. This thesis investigates the relationship between the religious experience and the migratory route of the euro-African and euro-Latin-American Pentecostal actors in Brussels. In these meeting spaces, the converts work collectively to realise the transformation process encouraged by the religious scenario which consists in applying the perfect " plan of God " to their life. Carriers of missionary ambitions, the believers give new contents to their identity by redefining the place which is assigned to them in the context of post-colonial Belgium. The religious membership operates as a marker of distinction, a process which is particularly striking in the field of sexuality and gender relation maintained within the assemblies.

P. Nougé et R. Magritte en Belgique, G. Henein et R. Younane en Egyste C. Gauvreau et P. -E. Borduas au Québec, appartiennent à un surréalisme périphérique. Le regard qu'ils portent sur le mouvement mais aussi sur la modernité nous couvie en effet à percevoir un surréalisme différent qui n'est pas sans affinité avec les pensées de Derrida, Deleuze, Lyotard ou Peirce. En interrogeant avec pertinence les contradictions du mouvement, leurpoint de vue sur l'histoire, la mémoine, le merveilleux, fait émerger un nouveau rapport à la figure, à l'image, à l'abstraction. Les surréalistes francophones proposent proposent une vision du monde où l'indéterminé réorganise l'histoire, ses "complexes", ses symboles, son logocentrisme. Le mythe d'Orphée éclaire toutes ces questions en redéfinissant les frontières qui séparent la mémoire de l'imagination, le réel et le surréél et en donnant au féminin une place importante qui favorise le décentrement et l'occupation d'une marge créatice.

Résumé: À la suite de l’exposition de Paris 1925, le peintre René Guiette demande à LC de lui construire une maison avec atelier à Anvers. Ce bâtiment superbe existe encore, le seul témoignage de LC construit en Belgique! LC vient pour la première fois à Bruxelles en 1926 pour donner une conférence. Après une deuxième conférence en 1928 il reçoit une commande de Jean Canneel-Claes pour une maison, publiée par Le Corbusier en 1929 comme « Maison pour M. X à Bruxelles ». En 1930, il est présent à Bruxelles pour le congres CIAM. En 1933, LC participe au concours pour la Rive Gauche d’Anvers. En 1938 on lui demande de participer à l’ exposition de Liège en 1939, mais rien n’est construit. LC est présent à l’exposition Universelle de Bruxelles 1958 avec le pavillon exceptionnel pour Philips. Après l’expo, Le Poème Electronique est démoli. Résumé :

The Université Libre de Bruxelles/ Aero-Thermo-Mechanics Department (ULB/ATM) has developed a flow bench used to mimic the complete behaviour of an aircraft gas turbine engine lubrication system. This test bench has been improved to be fully instrumented and is really multi-purposes in order to test different lubrication devices in the supply circuit (pure oil) or in the scavenge part (two-phase flow) simulating real flight conditions (oil flow rate, oil temperature and pressure…). The paper will first present the characteristics of the lubrication test bench and its capabilities. In a second part, it will be presented the integration and the test results of two different types of sensors into the lubrication test bench. One sensor is based on measuring the change in frequency of a quartz crystal resonator. The other one is composed of two optical sensors, which are able to monitor different properties of the oil and also to detect particles in the oil.

Résumé :

In the frame of TOPAS (Tropospheric OPtical Absorption Spectroscopy), an EURO-TRAC subproject supported by the Belgian State - Prime Minister’s Service - Science Policy Office and the ”Fond National de la Recherche Scientique”, a long path (788 m) absorption system has been constructed on the urban site of the campus of the Université Libre de Bruxelles. It consists of a Xenon high pressure emission source connected to a 30 cm Cassegrain type telescope. A parabolic mirror placed at a distance of 394 m reflects the light back into a similar telescope connected to a high resolution Fourier Transform spectrometer BRUKER IFS120HR. The two telescopes are mounted on alignment devices and the external mirror is equipped with a driving system operated from the laboratory. This system has been in operation since October 1990. Absorption structures of O2, O3, NO2 and SO2 have been observed in the UV region (25000-45000 cm-1). The spectra are recorded at a dispersion of 8 cm-1.

Lubrication system of aero engines have to manage a two-phase flow of oil and air created in air-sealed bearing chambers. A part of this flow goes through scavenge pumps and a de-aerator before returning to the tank, the other part passes through a de-oiler before leaving the engine. The Aero-Thermo-Mechanics Department of Université Libre de Bruxelles is developing an original and integrated system to pump and separate a liquid-gas flow. This system helps to reduce the complexity and the oil consumption of aero-engine lubrication systems by replacing the de-oiler, the de-aerator and scavenge pumps. The prototype is composed of an axial part (blades and metallic foam) that performs the separation and a radial part that pressurize the liquid. De-oiling efficiency is measured with a radio-tracer measurement system. This paper presents the test results of four configurations (different radii, flow paths, size of the metallic foam). Droplet size measurements at the inlet and the outlet of the prototype are also presented. A physical interpretation has been developed and is presented.

Many applications need to extract a certain phase from a multiphase flow like in oil extraction, flow in nuclear power plants, aircraft lubrication systems, etc. The Aero-Thermo-Mechanics (ATM) Department of Universiteé Libre de Bruxelles (ULB) is developing an original system to extract the gas from a liquid-gas flow together with increasing the pressure of the liquid phase. This system will help to reduce the complexity and the oil consumption of aeroengine lubrication systems. This paper will summarise the results of a first air/oil prototype. It will also present the guidelines learned from this prototype and used to design a second version of the integrated pump and separator. A newly developed oil consumption measurement system will also be presented. Based on previous results, on litterature review and on an in-house theoretical model, the paper will explain theoretically how the separation efficiency is affected by the particle distribution at the inlet of the prototype, and by the key parameters identified in different studies. Finally the conclusions will present the lessons learned through the design and tests of these two prototypes and the future work will be presented.

The Aero-Thermo-Mechanics (ATM) Department of ULB (Universite´ Libre de Bruxelles) is developing an original system to pump and separate a two-phase flow. Many applications need to extract a certain phase of a multiphase flow: oil extraction, flow in nuclear pumps, flow in aircraft lubrication systems, pulp and paper processing, etc. The main objective of this study is to obtain a lightweight, compact and efficient system that can both extract the gas of a two-phase flow and increase the pressure of the liquid phase. Prototypes with different designs were first tested at ULB on a specific test bench using water and air. The current prototype is a kind of axial-centrifugal pump. The axial part is used to separate the two phases of the flow and to collect, in the centrifugal part, the liquid phase only. The test results of the water-air prototypes have allowed to identify the key design and working parameters for efficient separation and pumping. A theoretical model has also been developed to describe the behavior of these prototypes. After successful tests with water-air mixtures, the technology has been implemented for a hot oil-air mixture. The tests with oil-air mixtures are performed on the aeroengine lubrication system test bench that the ATM Department developed and continues developing for other projects. At the same time, the flow field in the pump and separator system is being studied with commercial CFD (Computational Fluid Dynamics) software packages. Several two-phase flow models are considered for this particular application.

The Aero-Thermo-Mechanics (ATM) department of Universite´ Libre de Bruxelles (ULB) develops a new system to simultaneously pump and separate a two-phase flow, in particular oil/air mixtures. Two-phase flows are encountered in many applications (oil extraction, flow in nuclear power plant pumps, pulp and paper processing) but the study is mainly focused on aeroengine lubrication systems. The main objective is to obtain a compact and efficient system that can both extract the gas of a two-phase flow and increase the pressure of the liquid phase. Particular care is given to the liquid flow rate lost at the gas outlet of the system. A large range of gas/liquid volume ratio has been studied, leading to different two-phase flow regimes at the inlet of the system (slug, churn or annular flow). After successful tests with water-air prototypes, which have allowed to identify the key design and working parameters, the technology has been implemented for a hot oil-air mixture. This paper presents the test results of the first oil/air prototype under real in-flight operating conditions. The tests with oil/air mixtures were performed on the aeroengine lubrication system test bench of the ATM department. The identification and implementation of appropriate two-phase flow rate measurement systems is an essential contribution to the project. Two attractive measurement systems have been considered: a Coriolis density meter for the volume fraction at the liquid outlet and radio-tracing elements for the measurement of the oil consumption at the air outlet. In parallel, the flow field in the pump and separator system has been studied with commercial CFD (Computational Fluid Dynamics) software packages. The choice of the two-phase flow model is highly dependent on the two-phase flow regime. But different regimes can simultaneously exist in the pump and separator system. So, the Eulerian two-phase flow model, the most complex and general model, seems to be the most appropriate. A coupling of this model with a dispersed phase model is under investigation to take all two-phase flow phenomena into account.
