Résumé :

Government Regulation Number 9 of 2022 is the second amendment to Government Regulation Number 51 of 2008 concerning Income Tax on Income from Construction Services Business. This change is a policy issued by the Government to assist the Construction Services sector in dealing with the impact of the covid-19 pandemic so that this business process can be maintained. In this new regulation there are changes to the final income tax rate, classification and scope of construction services. This study aims to evaluate the application of the final income tax on construction services based on Government Regulation Number 9 of 2022 on CV. CIDA in this case the imposition of final income tax rate, calculation, withholding, deposit and reporting of final income tax on Construction Services. The research method used is descriptive qualitative method. The results of the study show that the final income tax rate imposed on CV. CIDA according to business qualifications and applicable regulations, namely 1.75%. For calculation, withholding and final income tax deposit CV. CIDA complies with existing regulations. However, the final income tax reporting is not in accordance with the existing tax regulations.

Résumé :

The Control of Industrial Major Accident Hazards (CIMAH) regulations was introduced in 1996 to regulate workplaces with hazardous chemicals in their facilities. The Regulations provide a minimum standard to ensure precautionary measures related to major hazard risks are taken. Although the Regulations have been enforced for more than two decades in Malaysia, there have been limited efforts to review related information, trends and data since its inception. The study aimed to provide an overview of the position of CIMAH regulations after two decades of being enacted in Malaysia. Data were extracted from the published and unpublished reports and documentations by Department of Occupational Safety and Health of Malaysia (DOSH), as well as available publications from literary journals. Analysis of the contents revealed three categories of data: i) CIMAH regulations’ administrative governance changes; ii) major hazard industries–categorization and registration trends; and iii) CIMAH regulations’ punitive activities. The findings provide an overview of relevant trends and data related to CIMAH regulations in the past two decades, and may provide stakeholders such as policymakers, practitioners, and researchers a groundwork for improvement initiatives.

ABSTRACT Diverse organisms time their cellular activities to occur at distinct phases of Earth's solar day, not through the direct regulation of these processes by light and darkness but rather through the use of an internal biological (circadian) clock that is synchronized with the external cycle. Input pathways serve as mechanisms to transduce external cues to a circadian oscillator to maintain synchrony between this internal oscillation and the environment. The circadian input pathway in the cyanobacterium Synechococcus elongatus PCC 7942 requires the kinase CikA. A cikA null mutant exhibits a short circadian period, the inability to reset its clock in response to pulses of darkness, and a defect in cell division. Although CikA is copurified with the Kai proteins that constitute the circadian central oscillator, no direct interaction between CikA and either KaiA, KaiB, or KaiC has been demonstrated. Here, we identify four proteins that may help connect CikA with the oscillator. Phenotypic analyses of null and overexpression alleles demonstrate that these proteins are involved in at least one of the functions—circadian period regulation, phase resetting, and cell division—attributed to CikA. Predictions based on sequence similarity suggest that these proteins function through protein phosphorylation, iron-sulfur cluster biosynthesis, and redox regulation. Collectively, these results suggest a model for circadian input that incorporates proteins that link the circadian clock, metabolism, and cell division.

Résumé :

The regulation of index based agricultural insurance for small holder farmers in Cameroon are as a result of the risk they are exposed to like weather variability and related risks associated with their activities especially droughts, floods, pests and input costs and more importantly the limits of indemnity based agricultural insurance. Like any other poor and low income farmers with small land holdings their risk exposures can only be managed through good laws especially with the use of index insurance as a risk management tool. This article examines the CIMA Code as a regulatory instrument for agricultural insurance as far as small holder farmers are concerned. Book VII of the CIMA Code introduced microisurance in 2012 as a panacea to indemnity insurance which enabled the codification and development of index insurance by member states. The implementation of Index-based agricultural insurance faces considerable challenges that must be overcome to effectively service farmers in remote areas in a country like Cameroon. These challenges includes amongst others: regulatory insufficiency, limited historical rainfall and crop yield data, information on livestock mortality and limited infrastructures just to mention a few. It is recommended inter-alia that these aforementioned could be addressed through codification, infrastructural developments, inclusion of non-farming activities like banking and micro finance institutions amongst others.

Introduction: The Malaysian Control of Industrial Major Accident Hazard (CIMAH) Regulations introduced in 1996 resulted in the creation ‘Major Hazard Competent Person’ (MHCP) profession. However, after two decades of its establishment, there has been limited study conducted on this specific profession. The objectives of this study are to analyze 1) the trend of application and passing rates of MHCP registrations; and 2) the trend of Major Hazard Installations (MHI) registrations, and its relationship with the available supply of registered MHCP. Methods: The study used a document review approach, involving the extraction, examination, and interpretation of data from both published and unpublished documents by the Department of Occupational Safety and Health (DOSH), the regulatory body responsible for overseeing both MHCP and MHI registration status in Malaysia. The study looks into data from 1996 (beginning of 1996 CIMAH Regulation) to 2023, though the available data found and analyzed were from 1998 to 2021. Results: The study reveals a concerning lack of growth in the number of professionals being certified as MHCP, despite an increase in the number of MHIs over the past two decades. Potential causes of this shortage identified include a demanding certification process, limited availability of MHCP competency courses, and a lack of clear career paths and growth opportunities in the profession. Conclusion: The inadequate supply of MHCPs could potentially undermine their ability to provide sufficient coverage for MHIs, indirectly jeopardizing the quality of risk management in major hazard facilities. Therefore, there is merit in periodically reviewing the regulations and reforming the MHCP profession in response to changing trends.

ABSTRACT Recent studies have shown that expression of the Staphylococcus aureus lrgAB operon inhibits murein hydrolase activity and decreases sensitivity to penicillin-induced killing. It was proposed that the lrgAB gene products function in a manner analogous to an antiholin, inhibiting a putative holin from transporting murein hydrolases out of the cell. In the present study the cidAB operon was identified and characterized based on the similarity of the cidA and cidB gene products to the products of the lrgAB operon. Zymographic and quantitative analyses of murein hydrolase activity revealed that mutation of the cidA gene results in decreased extracellular murein hydrolase activity compared to that of S. aureus RN6390, the parental strain. Complementation of cidA expression restored the wild-type phenotype, indicating that expression of the cidAB operon has a positive influence on extracellular murein hydrolase activity. The cidA mutant also displayed a significant decrease in sensitivity to the killing effects of penicillin. However, complementation of the cidA defect did not restore penicillin sensitivity to wild-type levels. Reverse transcriptase PCR also revealed that cidAB is maximally expressed during early exponential growth, opposite of what was previously observed for lrgAB expression. Based on these results, we propose that the cidAB operon encodes the holin-like counterpart of the lrgAB operon and acts in a manner opposite from that of lrgAB by increasing extracellular murein hydrolase activity and increasing sensitivity to penicillin-induced killing.

Résumé :

A wide variety of bioactive peptides have been identified in the central nervous system and several peripheral tissues in the ascidian Ciona intestinalis type A (Ciona robusta). However, hemocyte endocrine peptides have yet to be explored. Here, we report a novel 14-amino-acid peptide, CiEMa, that is predominant in the granular hemocytes and unilocular refractile granulocytes of Ciona. RNA-seq and qRT-PCR revealed the high CiEma expression in the adult pharynx and stomach. Immunohistochemistry further revealed the highly concentrated CiEMa in the hemolymph of the pharynx and epithelial cells of the stomach, suggesting biological roles in the immune response. Notably, bacterial lipopolysaccharide stimulation of isolated hemocytes for 1–4 h resulted in 1.9- to 2.4-fold increased CiEMa secretion. Furthermore, CiEMa-stimulated pharynx exhibited mRNA upregulation of the growth factor (Fgf3/7/10/22), vanadium binding proteins (CiVanabin1 and CiVanabin3), and forkhead and homeobox transcription factors (Foxl2, Hox3, and Dbx) but not antimicrobial peptides (CrPap-a and CrMam-a) or immune-related genes (Tgfbtun3, Tnfa, and Il17-2). Collectively, these results suggest that CiEMa plays roles in signal transduction involving tissue development or repair in the immune response, rather than in the direct regulation of immune response genes. The present study identified a novel Ciona hemocyte peptide, CiEMa, which paves the way for research on the biological roles of hemocyte peptides in chordates.

Proteasome-mediated protein degradation is a key regulatory mechanism in a diversity of complex processes, including the control of cell cycle progression. The selection of substrates for degradation clearly depends on the specificity of ubiquitination mechanisms, but further regulation may occur within the proteasomal 19S cap complexes, which attach to the ends of the 20S proteolytic core and are thought to control entry of substrates into the core. We have characterized a gene from Saccharomyces cerevisiae that displays extensive sequence similarity to members of a family of ATPases that are components of the 19S complex, including human subunit p42 and S. cerevisiae SUG1/ CIM3 and CIM5 products. This gene, termed PCS1 (for proteasomal cap subunit), is identical to the recently described SUG2 gene (Russell, S.J., U.G. Sathyanarayana, and S.A. Johnston. 1996. J. Biol. Chem. 271:32810– 32817). We have shown that PCS1 function is essential for viability. A temperature-sensitive pcs1 strain arrests principally in the second cycle after transfer to the restrictive temperature, blocking as large-budded cells with a G2 content of unsegregated DNA. EM reveals that each arrested pcs1 cell has failed to duplicate its spindle pole body (SPB), which becomes enlarged as in other monopolar mutants. Additionally, we have shown localization of a functional Pcs1–green fluorescent protein fusion to the nucleus throughout the cell cycle. We hypothesize that Pcs1p plays a role in the degradation of certain potentially nuclear component(s) in a manner that specifically is required for SPB duplication.

La subrogation constitue un mécanisme juridique essentiel permettant à l'assureur, après indemnisation de l'assuré, de récupérer les sommes versées auprès du tiers responsable. Ce procédé est encadré par un ensemble de dispositions légales, jurisprudentielles, et des pratiques propres à chaque système juridique. Malgré cette importance dans les activités quotidiennes des assureurs, la subrogation analysée au prisme de son efficacité n’avait pas fait l’objet d’une étude approfondie, d’ensemble et comparée. Certes, les auteurs examinent parfois la subrogation en général ou de l’assureur en particulier, mais seulement à l’aune de ses conditions de mise en œuvre et de ses effets, sans jamais prendre le recul nécessaire pour interroger son efficacité globale. Cette absence d’étude s’expliquerait par la difficile réception de la notion même d’efficacité dans la sphère juridique. Néanmoins, cette crainte doit être surmontée. Cette étude interroge alors l’efficacité de la subrogation en droit français et dans les États membres de la Conférence Interafricaine des Marchés d’Assurances (CIMA), en analysant les textes, la jurisprudence et les pratiques de gestion des assureurs. Il ressort que si un cadre juridique solide a été établi dans les deux systèmes, l’efficacité du mécanisme reste limitée. En droit français, la subrogation est mieux encadrée, grâce à des textes juridiques précis et une jurisprudence abondante, surtout libérale. Dans les pays membres de la CIMA, bien que des progrès aient été réalisés, le cadre juridique et les pratiques des assureurs nécessitent encore des ajustements pour être véritablement efficaces. Cependant, dans les deux systèmes, les complexités liées à ces textes, la diversité des interprétations jurisprudentielles et les pratiques de gestion non uniformes des assureurs freinent l’aboutissement des recours subrogatoires. Il en résulte des propositions de réformes, tant théoriques que pratiques. Sur le plan théorique, il est recommandé de simplifier et d’harmoniser les règles régissant la subrogation, notamment dans les pays membres de la CIMA où le cadre législatif reste incomplet. Sur le plan pratique, il est suggéré d’améliorer les méthodes de gestion des recours subrogatoires, dans les deux systèmes étudiés, avec une meilleure coordination entre assureurs et la mise en place de procédures standardisées. Au demeurant, il échet d’adopter une vision optimiste de l’avenir des mécanismes de subrogation, en envisageant des améliorations qui rendraient ces dispositifs plus efficaces, équitables et adaptés aux réalités des différents systèmes juridiques
Subrogation, a key legal mechanism, allows the insurer, after compensating the insured, to recover the amounts paid from the liable third party. This process is governed by a set of legal provisions, jurisprudence, and practices unique to each legal system. Despite its importance in the daily operations of insurers, subrogation has not been thoroughly analyzed from the perspective of its overall effectiveness in a comprehensive and comparative manner. Although some scholars examine subrogation in general or in relation to the insurer, they typically focus on its conditions of implementation and its effects, without taking the necessary step back to assess its global effectiveness. This gap in the literature can be attributed to the legal community’s reluctance to embrace the very concept of effectiveness in law. However, this hesitation must be overcome. This study investigates the effectiveness of subrogation under French law and within the member states of the Inter-African Conference on Insurance Markets (CIMA) by analyzing legal texts, jurisprudence, and insurers' management practices. The findings indicate that while a solid legal framework exists in both systems, the mechanism’s effectiveness remains limited. In French law, subrogation is more rigorously regulated due to precise legal texts and a liberal, well-established body of jurisprudence. In the CIMA member states, although progress has been made, the legal framework and insurers’ practices still require adjustments to achieve genuine effectiveness. However, in both systems, the complexities of the legal texts, the diversity of jurisprudential interpretations, and insurers' inconsistent management practices hinder the success of subrogation claims. As a result, theoretical and practical reforms are proposed. From a theoretical standpoint, it is recommended to simplify and harmonize the rules governing subrogation, particularly in the CIMA member states, where the legislative framework remains incomplete. From a practical perspective, it is suggested that subrogation management practices be improved in both systems through better coordination among insurers and the implementation of standardized procedures. Ultimately, an optimistic outlook on the future of subrogation mechanisms is advocated, with improvements that would make these mechanisms more effective, equitable, and better suited to the realities of the different legal systems

I have decided to start this research because in this period the system of Franchising is having a great change and development especially in foreign countries as China, and small and medium company are having a huge change and improvement, thanks to this system that could give to them the possibility to expand their business. This thesis is important for understand the huge change that the system of franchising had in China and in Italy due to the improvement of the new legal regulation. With this thesis I want to describe the legal regulations of 2004 in Italy and in China by describing first the overview of Franchising and then by analyzing the franchising in Italy and in China. Those regulations helped the foreign industry to enter in Chinese market and gave them the possibility to expand their business in China. The conclusion of this thesis will describe the difficulties that could happens by entry into foreign market due to the cultural differences.

Résumé :

My thesis opens up analyzing the historical and international background of the industrial property law: from the first conventions that regulated the laws of the various countries in trademarks subjects to the international TRIPS agreement. The subject then shifts towards national Italian legislation, the national sources that trademarks regulation uses, introducing the concept of "trademark", its characteristics, all the registration and protection process. The second chapter analyzes the trademark discipline from the Chinese point of view, starting from the first law dated 1982 (and the 1993 revision), joining the WTO in 2001 up to the current 2014 trademark law, ending with the analysis of the trademark registration process, compared to the Italian one. The focus of the argument ends with the introduction of the problem related to counterfeiting, analysing the phenomena in all its features, both from the Italian penal code point of view and the Chinese criminal law, introducing cases and sentences that have dealt with trademark counterfeiting in the Italian-Chinese panorama.

The thesis, after a brief historical excursus of the Marriage Law, aims to analyse how the right of property within divorce cases has undergone various changes and over the years. The central part of the thesis is divided into two parts. The first part concerns the description of the regulations and laws regarding property in general and property in the context of marriage and divorce. The second part, on the other hand, concerns two judgments analysed and translated regarding the causes of divorce and its controversies."

Looking ahead, China's cosmetics industry will continue to be one of the fastest-growing and most attractive business sectors. The dissertation aims to present an overview of the cosmetics market in China and an explanation of the reasons international cosmetics companies should keep investing. An introduction explains the social and cultural perspectives that influence the market. A central chapter highlights the current status of the Chinese beauty market and its main regulations; particular attention is given to the latest developments and to the animal testing regulations introduced in China during the last couple of years. The thesis endeavors to indicate the regulations' impact on international companies entering the Chinese market. The final chapter analyzes why China should continue moving forward with the ban of animal testing, and the COVID-19 effects on the beauty market in China and worldwide. Based on the topics presented in the first part of the dissertation, a Chinese-English terminological record will analyze some of the industry-specific terms encountered during research to better understand the Chinese cosmetic regulations.

Cloud Computing ensures parallel computing and emerged as an efficient technology to meet the challenges of rapid growth of data that we experienced in this Internet age. Cloud computing is an emerging technology that offers subscription based services, and provide different models such as IaaS, PaaS and SaaS among other models to cater the needs of different user groups. The technology has enormous benefits but there are serious concerns and challenges related to lack of uniform standards or nonexistence of minimum benchmark for level of services offered across the industry to provide an effective, uniform and reliable service to the cloud users. As the cloud computing is gaining popularity, organizations and users are having problems to adopt the service ue to lack of minimum service level framework which can act as a benchmark in the selection of the cloud provider and provide quality of service according to the user’s expectations. The situation becomes more critical due to distributed nature of the service provider which can be offering service from any part of the world. Due to lack of minimum service level framework that will act as a benchmark to provide a uniform service across the industry there are serious concerns raised recently interms of security and data privacy breaches, authentication and authorization issues, lack of third party audit and identity management problems, integrity, confidentiality and variable data availability standards, no uniform incident response and monitoring standards, interoperability and lack of portability standards, identity management issues, lack of infrastructure protection services standards and weak governance and compliance standards are major cause of concerns for cloud users. Due to confusion and absence of universal agreed SLAs for a service model, different quality of services is being provided across the cloud industry. Currently there is no uniform performance model agreed by all stakeholders; which can provide performance criteria to measure, evaluate, and benchmark the level of services offered by various cloud providers in the industry. With the implementation of General Data Protection Regulation (GDPR) and demand from cloud users to have Green SLAs that provides better resource allocations mechanism, there will be serious implications for the cloud providers and its consumers due to lack of uniformity in SLAs and variable standards of service offered by various cloud providers. This research examines weaknesses in service level agreements offered by various cloud providers and impact due to absence of uniform agreed minimum service level framework on the adoption and usage of cloud service. The research is focused around higher education case study and proposes a conceptual model based on uniform minimum service model that acts as benchmark for the industry to ensure quality of service to the cloud users in the higher education institution and remove the barriers to the adoption of cloud technology. The proposed Minimum Service Level (MSL) framework, provides a set of minimum and uniform standards in the key concern areas raised by the participants of HE institution which are essential to the cloud users and provide a minimum quality benchmark that becomes a uniform standard across the industry. The proposed model produces a cloud computing implementation evaluation criteria which is an attempt to reduce the adoption barrier of the cloud technology and set minimum uniform standards followed by all the cloud providers regardless of their hosting location so that their performance can be measured, evaluated and compared across the industry to improve the overall QoS (Quality of Service) received by the cloud users, remove the adoption barriers and concerns of the cloud users and increase the competition across the cloud industry.
A computação em nuvem proporciona a computação paralela e emergiu como uma tecnologia eficiente para enfrentar os desafios do crescimento rápido de dados que vivemos na era da Internet. A computação em nuvem é uma tecnologia emergente que oferece serviços baseados em assinatura e oferece diferentes modelos como IaaS, PaaS e SaaS, entre outros modelos para atender as necessidades de diferentes grupos de utilizadores. A tecnologia tem enormes benefícios, mas subsistem sérias preocupações e desafios relacionados com a falta de normas uniformes ou inexistência de um referencial mínimo para o nível de serviços oferecidos, na indústria, para proporcionar uma oferta eficaz, uniforme e confiável para os utilizadores da nuvem. Como a computação em nuvem está a ganhar popularidade, tanto organizações como utilizadores estão enfrentando problemas para adotar o serviço devido à falta de enquadramento de nível de serviço mínimo que possa agir como um ponto de referência na seleção de provedor da nuvem e fornecer a qualidade dos serviços de acordo com as expectativas do utilizador. A situação torna-se mais crítica, devido à natureza distribuída do prestador de serviço, que pode ser oriundo de qualquer parte do mundo. Devido à falta de enquadramento de nível de serviço mínimo que irá agir como um benchmark para fornecer um serviço uniforme em toda a indústria, existem sérias preocupações levantadas recentemente em termos de violações de segurança e privacidade de dados, autenticação e autorização, falta de questões de auditoria de terceiros e problemas de gestão de identidade, integridade, confidencialidade e disponibilidade de dados, falta de uniformidade de normas, a não resposta a incidentes e o monitoramento de padrões, a interoperabilidade e a falta de padrões de portabilidade, questões relacionadas com a gestão de identidade, falta de padrões de serviços de proteção das infraestruturas e fraca governança e conformidade de padrões constituem outras importantes causas de preocupação para os utilizadores. Devido à confusão e ausência de SLAs acordados de modo universal para um modelo de serviço, diferente qualidade de serviços está a ser fornecida através da nuvem, pela indústria da computação em nuvem. Atualmente, não há desempenho uniforme nem um modelo acordado por todas as partes interessadas; que pode fornecer critérios de desempenho para medir, avaliar e comparar o nível de serviços oferecidos por diversos fornecedores de computação em nuvem na indústria. Com a implementação do Regulamento Geral de Protecção de Dados (RGPD) e a procura da nuvem com base no impacto ambiental (Green SLAs), são acrescentadas precupações adicionais e existem sérias implicações para os forncedores de computação em nuvem e para os seus consumidores, também devido à falta de uniformidade na multiplicidade de SLAs e padrões de serviço oferecidos. A presente pesquisa examina as fraquezas em acordos de nível de serviço oferecidos por fornecedores de computação em nuvem e estuda o impacto da ausência de um quadro de nível de serviço mínimo acordado sobre a adoção e o uso no contexto da computação em nuvem. A pesquisa está orientada para a adoção destes serviços para o caso do ensino superior e as instituições de ensino superior e propõe um modelo conceptualt com base em um modelo de serviço mínimo uniforme que funciona como referência para a indústria, para garantir a qualidade do serviço para os utilizadores da nuvem numa instituição de ensino superior de forma a eliminar as barreiras para a adoção da tecnologia de computação em nuvem. O nível de serviço mínimo proposto (MSL), fornece um conjunto mínimo de normas uniformes e na áreas das principais preocupações levantadas por responsáveis de instituições de ensino superior e que são essenciais, de modo a fornecer um referencial mínimo de qualidade, que se possa tornar um padrão uniforme em toda a indústria. O modelo proposto é uma tentativa de reduzir a barreira de adoção da tecnologia de computação em nuvem e definir normas mínimas seguidas por todos os fornecedores de computação em nuvem, independentemente do seu local de hospedagem para que os seus desempenhos possam ser medidos, avaliados e comparados em toda a indústria, para melhorar a qualidade de serviço (QoS) recebida pelos utilizadores e remova as barreiras de adoção e as preocupações dos utilizadores, bem como fomentar o aumento da concorrência em toda a indústria da computação em nuvem.

Résumé :

Inspired by the video-games industry that simulated the design and development of fictive cities (e.g. the SIM City series), CIM - City Information Modeling, aims to create a platform that allows architects, planners and other specialists to collaborate on the study and design of city-wide projects. Similar to BIM - Building Information Modeling, CIM utilizes 3D modeling that goes beyond the traditional know CAD - computer aided design, capabilities in order to incorporate data and information that are specific to a city. In this way the actual form of the city is linked to the infrastructure, to the public services, to the people's mobility and interactions through the urban space and other aspects that are attributed to the urban life. The chaotic development of the new residential areas in Romania has been usually attributed to different social, economic or political factors. To fully understand the current urban form of the Romanian cities we must also look into the influence of urban regulations on the current development and anticipate how they will evolve. The aim of the study is to use CIM as a scientific and educational tool of understanding how urban regulations impact the residential areas through time. The focus will be on what can we learn from the simulation of a certain Romanian residential area and how changing the urban regulation impacts not only the urban form but also other aspects concerning the quality of life. Thus, the simulations will allow the parallel study of different urban regulations in a controlled environment.

Warehouse fires represent a global challenge, inflicting economic losses, damaging reputational integrity, disrupting business operations, leading to job losses, and negatively impacting the environment. Despite strict fire regulations and codes of practice aimed at safeguarding warehouse facilities, the prevalence of catastrophic fires persists globally, including notable incidents in Sri Lanka. This persistence prompts an inquiry into the adequacy and appropriateness of current protective measures. This research addresses the urgent need to discern the root causes of warehouse fires and the consequent damages to devise effective preventative strategies. Through a combination of literature review and semi-structured interviews with ten experts, this study employs manual content analysis to explore underlying factors. Key findings indicate that failures often stem from the absence, inadequacy, or improper maintenance of fire detection and protection systems, the specific nature of storage configurations, the size of the facilities, and the combustible characteristics and volume of stored goods. The study proposes adhering to the Construction Industry Development Authority (CIDA) fire regulations, which mandate the provision and maintenance of active and passive fire protection measures. It further recommends the regular execution of fire risk assessments, the enforcement of stringent housekeeping protocols, the strategic separation of commodities based on their class and compatibility, and the isolation of battery re-charging operations from storage areas as critical steps to mitigate fire risks in warehouses. These insights guide warehouse owners, tenants, fire risk assessors, and other professionals who enhance fire safety in warehouse settings.

Abstract Regular inspection is important to verify the integrity of in-service pipeline in the petrochemical industry. Early detection of flaws is therefore essential to ensure the continued safe operation of pipeline. In generally, Conventional ultrasonic for thin-walled small-diameter pipes has limitations due to regulation requirements, efficiencies, lack of permanent results and repeatability. In many cases, the preferred method of inspection is radiographic testing, however there are many obvious shortcomings for radiographic detection. The aim of this work was to propose appropriate phased array ultrasonic scan plans that were able to achieve the following: reduce the inspection times, improve defect detectability and sizing, and reduce human intervention, which will reduce workforce radiation uptake. Ultrasonic simulation using CIVA and experimental verification for thin-walled small-diameter pipe with flaws that were carried out to determine the most appropriate phased array probe and its detection capabilities in this paper.

Labour subcontracting has become popular and has been extensively utilized in the building construction industry due to the potential for a reduction in initial cost for site mobilization. However, there are high risks involved in labour subcontracting due to inadequate and ambiguous subcontract agreements, which lead to disputes between parties. Thus, this paper aims to identify the deficiencies in large-scale contractors’ bespoke labour subcontract agreements in the Sri Lankan construction industry. Eight semi-structured interviews were carried out with main contractors (CS1 and CS2 as per the CIDA registrations) to identify the current practice of labour subcontracting and the terms/clauses included in their company-based labour subcontract agreement. The collected data was then subjected to a content analysis, and accordingly, deficiencies in the agreements were identified that fall into areas such as defects in the works, materials, tools and equipment, contract termination, discipline at the site, services provided by the main contractor, penalties, dispute management, health and safety, retention clause, quality of the works, rate of progress, laws and regulations, variations, insurance, and skill of the labour subcontractors.
