This chapter examines the cooperation between Serbia and the International Criminal tribunal for Former Yugoslavia (ICTY) though reconstruction of how the OTP obtained records of the Supreme Defence Council (SDC), a collective Commander-in-Chief of the Yugoslav Army (VJ: Vojska Jugoslavije) from 1992 to 2003. Recent experience in the former Yugoslavia, in particular with Serbia, shows that the leading political elites will rarely be open and will do everything possible to control and limit post-conflict narratives. This proposition will be illustrated by analysing the way the de facto and de jure powers of Slobodan Milošević as president of Serbia (1990-1998) and of the FRY (1998-2000) would have been revealed through the SDC collection of documents generated by the highest state bodies in charge of commanding the armed forces during the Croatian, BiH, and Kosovo indictment periods that were incompletely and grudgingly produced by Serbia to the ICTY for its use.

Chapter 7 inquires into the status and recognition of India’s new SC elite: the socioeconomic profile of SC politicians compared to other politicians, and their relationship to other elites and to their voters. SC politicians used to have significantly less formal education than other politicians, but that is no longer the case. However, SCs tend to be less wealthy than other politicians, less likely to have a criminal record, and seem to be perceived as less “glamorous.” Interview evidence indicates that while SC politicians still face some discrimination, factors like power, education, and money have served to reduce this caste bias. Further, voters generally seem to evaluate SC politicians similarly to other politicians; and voters who had lived in a reserved constituency for a long time were slightly more likely to evaluate SC politicians positively.

Every year thousands of people are kidnapped for ransom. Their families, friends, or employers are forced into a fiendishly complex and harrowing transaction with violent criminals to retrieve them. How do you agree a ‘fair’ price for a loved one—who may be tortured or killed as you deliberate? How do you securely deliver a sack of cash to the criminals’ lair? What compels kidnappers to uphold their end of the bargain after payment? Well-off individuals, profitable firms, and international NGOs operate surprisingly safely in areas of high and extreme kidnap risks. Many of them have bought kidnap insurance. Kidnaps among the insured are very rare—and almost all insured hostages are safely retrieved. This book examines the intricate governance system created by special risk insurers at Lloyd’s of London to guide and shape their customers’ interactions with the criminal underworld, rebel groups, and traditional elites. By encouraging local leaders to protect rather than hassle the insured, most abductions can be prevented. If a kidnap occurs, there are robust protocols to structure the negotiation and maintain ransom discipline. Experienced specialists facilitate payments and safely retrieve hostages. Kidnap insurance underpins trade, aid, and investment in many informally governed, crime-ridden, and rebel-held areas of the world. In terrorist kidnaps, however, international law prohibits commercial resolutions and well-meaning politicians have stepped into the breach. The outcomes have been massive ransom inflation, political concessions, torture, and gruesome murders. This book explains why private governance works and why public governance is bound to fail in the market for hostages.

Late nineteenth-century and fin-de-siècle writers first engaged with the case study genre in its psychiatric and psychoanalytic manifestations by means of satire, as recounted in Chapter 3. This chapter contrasts the interpretative powers of modern sexual publics and professional elites with the agency of the writer. It does so through enquiry into Panizza’s satirical and delusional negotiation of the boundaries between the two ‘cultures’ of art and science (pace C. P. Snow). Panizza’s first exposure to the case study genre was in the context of his training as a psychiatrist. More than a decade before Freud’s elaborations on the psychoanalytic case, Panizza made the human case study a central form in his literary oeuvre. Panizza anti-psychiatric dystopian work Psichopatia criminalis, represents the only persiflage of a medical case study compilation in European literature. Yet his engagement with the case study genre remains haunted by his own unruly psyche.

The early modern witch craze could never have taken place without crucial transformations in elite attitudes toward magic that opened the ears of judges to popular witch fears. The groundwork for these transformations was laid during the generations of social upheaval and papal schism that followed the Black Death, but the turning point came with demonological innovations in the early fifteenth century. These innovations coincided with a revolution in criminal justice that armed judges with powerful tools for extracting all manner of confessions at a time when they were increasingly disposed to lend credence to the accusations of the populace against suspected witches.

Created in 1993, the International Criminal Tribunal for the former Yugoslavia (ICTY) has operated longer than any war crimes tribunal in history. It thus offers a singularly important case study of how and why the local impact of an international criminal tribunal (ICT) evolves over time; the circumstances in which international justice can advance the normative, reparative, and other aims of transitional justice; and, more generally, the goals ICTs are either well-suited or unlikely to advance. The book explores the ICTY’s impact in Serbia, whose wartime leader plunged the former Yugoslavia into vicious ethnic conflict, and Bosnia-Herzegovina, which experienced searing atrocities culminating in the Srebrenica genocide, over the life of the Tribunal. It focuses on the Tribunal’s impact in three spheres: victims’ experience of justice; official, elite, and community discourses about wartime atrocities, as well as official gestures of acknowledgment; and domestic accountability processes, including the work of a hybrid court in Bosnia. While highlighting the perspectives of Bosnians and Serbians interviewed by the author, the book incorporates a rich body of interdisciplinary research to deepen their insights.

Chapter 5 analyses manifestations of history, that is, concrete historical legacies of power and knowledge in present-day Andaman society. The first section discusses the impact of hegemonic nationalist rhetoric—highlighting the role of bourgeois nationalist freedom fighters incarcerated in the Andamans—on the local sense and perception of history. The first section aims to show how politics of recognition influence the ways in which community actors constitute their present by narrating the subaltern past. The second section focuses on the manifestation of criminality as a crucial relation between the state and the population in the here and now. It shows that Andaman actors construct contemporary identities by referring to the criminal past of convicts deported to the islands; moreover, the institutionalization of criminality within the economic system of the Andaman divides the population into elite actors profiting from the black-market sector and subalterns whose participation in the same system brings them into continuous conflict with the law.

Every day, in courtrooms around the United States, thousands of criminal defendants are represented by public defenders--lawyers provided by the government for those who cannot afford private counsel. Though often taken for granted, the modern American public defender has a surprisingly contentious history--one that offers insights not only about the "carceral state," but also about the contours and compromises of twentieth-century liberalism. First gaining appeal amidst the Progressive Era fervor for court reform, the public defender idea was swiftly quashed by elite corporate lawyers who believed the legal profession should remain independent from the state. Public defenders took hold in some localities but not yet as a nationwide standard. By the 1960s, views had shifted. Gideon v. Wainwright enshrined the right to counsel into law and the legal profession mobilized to expand the ranks of public defenders nationwide. Yet within a few years, lawyers had already diagnosed a "crisis" of underfunded, overworked defenders providing inadequate representation--a crisis that persists today. This book shows how these conditions, often attributed to recent fiscal emergencies, have deep roots, and it chronicles the intertwined histories of constitutional doctrine, big philanthropy, professional in-fighting, and Cold War culture that made public defenders ubiquitous but embattled figures in American courtrooms.

All five contemporary practitioners of the death penalty in the Association of Southeast Asian Nations (ASEAN)—Indonesia, Malaysia, Thailand, Singapore, and Vietnam—have performed executions on a regular basis over the past few decades. Amnesty International currently classifies each of these nations as death penalty ‘retentionists’. However, notwithstanding a common willingness to execute, the number of death sentences passed by courts that are reduced to a term of imprisonment, or where the prisoner is released from custody altogether, through grants of clemency by the executive branch of government varies remarkably among these neighbouring political allies. This book uncovers the patterns which explain why some countries in the region award commutations and pardons far more often than do others in death penalty cases. Over the period under analysis, from 1991 to 2016, the regional outliers were Thailand (with more than 95 per cent of condemned prisoners receiving clemency after exhausting judicial appeals) and Singapore (with less than 1 per cent of condemned prisoners receiving clemency). Malaysia, Indonesia, and Vietnam fall at various points in between these two extremes. This is the first academic study anywhere in the world to compare executive clemency across national borders using empirical methodology, the latter being a systematic collection of clemency data in multiple jurisdictions using archival and ‘elite’ interview sources. Last Chance for Life: Clemency in Southeast Asian Death Penalty Cases will prove an authoritative resource for legal practitioners, criminal justice policymakers, scholars, and activists throughout the ASEAN region and around the world.
