AbstractRejecting the competing positions of Swadling and Chambers, this article argues that the law of presumed resulting trusts reflects a very old rule that, upon a voluntary transfer, the fate of the beneficial interest in the property depends on the intention of the transferor. The case law shows that the presumption is of an intention to create a trust for the transferor or provider of the purchase money. It makes no difference if, reflecting the historically important concept of “retention”, this is phrased in negative terms as a presumption that the intention of the transferor was not to pass the beneficial interest to the transferee.

ResumenEl presente artículo aborda la relación entre la intención comunicativa y la prosodia de las vocalizaciones producidas por infantes de entre 16 y 24 meses de edad. Los resultados muestran que (1) las vocalizaciones comunicativas y no comunicativas no se diferencian de forma significativa a partir de su contorno entonativo final (ascendente, descendente o suspensivo), (2) aunque sí a partir de su frecuencia fundamental, más alta en el caso de las vocalizaciones comunicativas; y que (3) las funciones comunicativas tempranas (declarativa, imperativa, expresiva, mímica, guía de acción y “relleno” conversacional) se diferencian por su contorno entonativo final y, también, más marcadamente, (4) por su frecuencia fundamental, más alta en los imperativos (y vocalizaciones expresivas) que en los declarativos.Palabras clave: intención comunicativa, función comunicativa, prosodia, adquisición del lenguajeAbstractThis paper deals with the relation between communicative intention and prosody in vocalizations uttered by infants 16 to 24 months-old. Results show that (1) communicative and non-communicative vocalizations are not significantly different based on pitch final contour (rising, falling and flat), (2) but show significantly different fundamental frequency values, which are higher in communicative vocalizations; and that (3) early communicative functions (declarative, imperative, emotive, mimic, action guide, and conversational “filling”) can be differentiated based on their final pitch contour and, more clearly, (4) on their fundamental frequency, which is overall higher in imperatives (and emotive vocalizations) than in declaratives.Keywords: communicative intention, communicative function, prosody, language acquisition

Résumé :

In her article, Patrycja Montusiewicz present the results of research on the phenomenon of correlation between the grammatical structure of a legal text and the linguistic message of its communicative intention. The study describe the grammatical categories of the verb: person and number. Montusiewicz, based on the examples excerpted from the source English version of the Universal Declaration of Human Rights and its translations into target languages German, Dutch and Polish target languages identifies the selection of an appropriate equivalent encoding the impersonality and impartiality of the analyzed declarative text. The results of the contrastive analysis has shown that the selection of specific grammatical markers depends on the internal specificity of a given language system and not on the formal, often matrix, similarity of the source and target language units.

Résumé :

Annulment and nullity of marriage are two institutions that function in two separate and independent legal systems. Despite some similarities, they cannot be used interchangeably. The differences between the annulment and declaring nullityof marriage follow mainly from the fact that the canonical marriage between baptized persons is a sacrament, a lifelong and indissoluble bond. For this reason, once validly contracted, it cannot be annulled or dissolved by divorce, but only bythe death of a spouse or a dispensation from an unconsummated marriage and the privilege of faith. In the case when marriage is contracted, despite the existence of impediments to marriage, the ecclesiastical tribunal, after completing the relevant proceedings, declares its nullity whereby this judgment is of a declarative nature. In the case of annulment of marriage, the legislator provided for some restriction as to the persons authorized to file a claim, and it also listed the situations in which, even though marriage was contracted in breach of law, its annulment is not possible. Therefore, convalidation by force of law is permissible. Such validation and such restrictions have not been provided by the ecclesiastical legislator, although the convalidation of marriage is possible as long as the matrimonial consent continues and some additional conditions have been satisfied. The judgment regarding the annulment of marriage is constitutive, although the effects of annulment have retroactive effects, whereby the legislator stated that for certain relationships, the rules of divorce shall be applicable. Both in the state and canonical orders, there are three groups of reasons that are the basis for annulment and declaration of nullity of marriage. These are impediments to marriage, defects to the declarations of intention of the spousesand defects to the mandate to contract marriage. The individual reasons have been briefly discussed to present the differences in their understanding under canon law and state law.

Abstract One might assume that the desire to help (here described as Want) is the essential driver of helping declarations and/or behaviors. However, even if desire to help (Want) is low, intention to help may still occur if the expectancy regarding the perceived effectiveness of helping is high. We tested these predictions in a set of three experimental studies. In all three, we measured the desire to help (Want) and the Expectancy that the aid would be impactful for the victim; in addition, we manipulated Expectancy in Study 3. In Studies 1 and 3, we measured the participants’ declaration to help while in Study 2, their helping behavior was examined. In all three studies, we used variations of the same story about a victim. The results supported our hypothesis. Thus, the studies help to tease apart the determinants of helping under conditions of lowered desire to do so, an issue of great importance in public policymaking.

Résumé :

The paper focuses on formal and practical problems in the field of environmental protection, which occur as a consequence of omissions of the legislative and executive authorities in Serbia. The text analyzes the positive legislation and compliance of domestic legal regulations with international declarations and conventions ratified by our country (from the Stockholm Declaration and the Council of Europe Convention on Civil Liability for Damage Caused by Dangerous Activities to the Environment to the Rio Declaration), as well as with European Directives (EU Directive on Industrial Emissions) and Regulations (Regulation No. 525/2013 on monitoring and reporting of greenhouse gas emissions and reporting on other information relevant to climate change). The candidacy for equal membership in the European family of nations obliges the Serbian Parliament and the Government to make additional efforts in the direction of harmonizing our law with the European one. The paper takes a de lege ferenda approach, so the author explains the need to amend a number of laws, such as the Law on Environmental Impact Assessment, the Law on Strategic Environmental Assessment, the Law on Fees for the Use of Public Goods and the Law on Budget system, as well as the enactment of the Law on Climate Change and the Serbian Civil Code as soon as possible (in which dilemmas that hinder the subjects of law in using the environmental lawsuit as an instrument of environmental protection should be resolved). An unacceptable deviation from one of the fundamental principles established by the Rio Declaration was pointed out, which brings with it a number of structural problems and the inability of both the Green Fund institutions and a number of organizations that focus on ecology. The consequences of the discrepancy between the intentions proclaimed by the Constitution of Serbia and the National Strategy of Serbia for the accession of Serbia and Montenegro to the European Union from 2005 on the one hand and the absence of adequate legislative and executive activities in environmental protection, on the other hand, are obvious in the reports of the European Commission and the European Environment Office, as well as in the health risk and increased mortality of a large number of citizens of Serbia and other European countries, due to harmful emissions that cause pollution of air, water and soil in our country. In addition to the proposals for changes in the formal framework in the field of environmental protection, the paper points out the need to use those mechanisms of civil protection, such as environmental lawsuits (established by the Law on Obligations 1978), which is, by its nature, actio popularis and in that sense accessible to the widest range of subjects. The defense of the standards established by the Kyoto Protocol and the Basel Convention would, through the extensive use of this procedural instrument, be placed not only in the hands of representatives of the legislature and the executive, but also, the judiciary (conditionally, of course, because courts can decide only initiate a civil action, but not on its own initiative).

Declarative process models support process flexibility, whose importance has been widely recognized, particularly for organizations that face frequent changes and variable stimuli from their environment. However, the currently dominant declarative approaches lack expressiveness for addressing the process context (namely, environment effects) and leading its execution towards a goal. This paper proposes a declarative model which addresses activities as well as states, external events, and goals. The model is based on the Generic Process Model (GPM), extended by a notion of activity, which includes a state change aspect and an intentional aspect. The achievement of the intention of an activity may depend on events in the environment and is hence not certain. The paper provides a formalization of the model and describes an execution mechanism. It emphasizes the usefulness of specifying the intentional aspect of activities, by using it as a basis for semantic validation of the model at design time and for a planning module that can guide execution at runtime. These are illustrated by an example from the medical domain.

Syftet är att ur ett kulturanalytiskt perspektiv beskriva och analysera Länsdelegationen i jämställdhet. Början av uppsatsen kan ses som ett bakgrundskapitel. Detta för att förstå uppkomsten av undersökningen. Där förklaras kort den svenska jämställdhetspolitiken, hur det strategiska arbetet sker genom jämställdhetsintegrering och Länsstyrelsens roll och arbete kring Länsdelegationen. Vidare behandlas hur delegationen arbetar med den avsiktsförklaring de tagit fram och hur de förhåller sig till den. Men också på hur delegaterna faktiskt ser på sitt deltagande, hur de arbetar med att införliva jämställdhetspolitiken i praktiken samt de svårigheter och möjligheter som kommer med arbetet i delegationen. Vidare diskuteras hur delegaterna ser på framtiden med sin medverkan och delegationens varande. Senare görs en kort jämförelse med hur förändringen gestaltat sig sedan delegationens start år 1997. Detta med hjälp av de två tidigare utvärderingarna från år 2000 och år 2006. I den avslutande diskussionen knyts uppsatsen ihop genom att besvara syftet med utvärderingen: att söka svar på hur delegationen arbetar och verkar med jämställdhetsarbetet. Till undersökningen valde jag att arbeta med två olika insamlingsmetoder, dels en webbenkät som gått ut till samtliga delegater i Länsdelegationen i jämställdhet, dels tre intervjuer med några av delegaterna. Jag har även studerat den avsiktsförklaring som togs fram för år 2014-2016 för att få kunskap om vad delegationen ska förhålla sig till. Jag har också använt två tidigare utvärderingar som gjorts av Länsdelegationen i jämställdhet samt den debattartikel som delegationen publicerade inför 2014 års nationella genusforskarkonferens, g14 som var förlagd till Umeå universitet. Slutsatserna i undersökningen är att Länsdelegationen främst verkar som en symbolisk faktor och många talar och skriver om att de vill bli en mer arbetande grupp och agera utåt och bidra till att Västerbotten ska bli ett jämställt län. Men det stannar av där, det blir tillsynes kanske inte mer än vackra ord i handlingsplanerna.

Face au développement de l’activisme, l’obligation d’information qui pèse sur l‘investisseur, lorsqu’il acquiert des titres de sociétés cotées, est appelée à ajouter un rôle central au-delà de celui qu’elle a dans le dialogue actionnarial et dans la prévention des prises de contrôle rampantes. Bien que cette obligation ait été considérablement renforcée, les alternatives de contournement dont elle fait l’objet invitent à s’interroger sur l’efficacité des déclarations qui la composent et sur celle de leurs sanctions. Une analyse de ces mécanismes montre que le développement des techniques de démembrement des titres de capitaux et l’usage des contrats financiers dérivés, couplés aux stratégies toujours plus inventives de la pratique, font toujours peser de réels risques de contournement. De plus, les sanctions traditionnelles de ces obligations sont difficiles à mettre en œuvre. Si la répression des abus de marché a été largement redynamisée depuis 2016, les infractions spécifiques aux obligations d’information de l’investisseur restent essentiellement désuètes. Enfin, le recours à la responsabilité civile demeure très délicat. La mise en place d’une obligation d’information de l’investisseur sur le marché, qui soit cohérente et complète, implique à la fois de combler les insuffisances dans les déclarations obligatoires de l’investisseur et à réfléchir aux moyens de garantir l’application effective des mécanismes de sanctions ainsi que ceux de la responsabilité pénale et civile<br>With the rise of shareholder activism, the investor duty of disclosure on the capital market is called to play a central role in addition to the one it already has in shareholder dialogue and the prevention of creeping takeovers. Although this obligation has been considerably strengthened, attempts to circumvent it call the effectiveness of both its declaration and sanction mechanisms into question. An analysis of these mechanisms shows that the development of the dismemberment of capital rights and the use of financial derivatives coupled with the increasingly inventive strategies of the practice weighs real risks of circumvention. Besides, the sanctions of these obligations are difficult to implement. While market abuse sanctions have largely been reinvigorated since 2016, specific offenses linked to the breaches of these obligations are essentially obsolete. Finally, civil liability mechanisms remain very difficult to implement. The establishment of a coherent and comprehensive information mechanism involves fillings gaps in the investor’s duty of disclosure and considering how to ensure the effective application of the sanctions as well as the criminal and civil liability mechanisms

L'étude porte sur le fondement du lien de filiation et l'équilibrage de ses composantes multiples, dont la vérité génétique et la vérité socio-affective.<p>Elle analyse la place croissante de l'autonomie de la volonté dans la conception de l'enfant, la création, le maintien et les effets du lien, ainsi que la prise en considération marquée de la parenté d'intention, détachée de la réalité génétique.<p>Cet examen est fait tant pour la procréation dite naturelle que pour la procréation médicalement assistée, avec, en particulier, une étude de la réception par le droit du désir d'enfant chez les personnes célibataires ou en couple homosexuel.<p>La parenté est également étudiée au plan de son évolution vers une reconnaissance de l'autonomie de la fonction parentale sous la forme de la parentalité, détachée de la filiation.<p>Le rôle du droit et la transformation de sa fonction sont analysés en parallèle.<p>Enfin, les conclusions développées au sujet de l'engagement parental volontaire sont confrontées aux principes généraux de dignité humaine et d'intérêt supérieur de l'enfant, ainsi qu'aux droits au respect de la vie familiale et à la connaissance des origines.<p><br>Doctorat en droit<br>info:eu-repo/semantics/nonPublished

It was found that variables of demographic have significant correlation with whether the taxpayer has on-line business income tax declaration adoption experience or not. The taxpayer is female, owns personal computer, owns personal internet account, operate mode needs computer and high frequency computer user who has large proportion to adopt on-line declaration. Different demographic variables are significant at before-adopting Cognitive, the taxpayer is female, has on-line business income tax declaration experience, daily computer user has higher Comparative Advantage Cognition. The taxpayer’s age during 30 to 39, bachelor educational background, has on-line business income tax declaration experience, owns personal internet account user has higher Innovation Compatibility Cognition. Demographic variables also differ with after-adopting Evaluation, the attributes are female, has business income tax declaration experience, owns personal internet account and daily computer user who has higher evaluation to Outcomes Observation. The attributes are female, has on-line business income tax declaration experience and daily computer user who has higher evaluation to Perceived Risk. The last study indicates demographic variables are significant at Diffusion Effect which includes Positive Diffusion and Diffusive Channel.

Fire Traceability Declaration Management System is one of the best system to conform fire building safety information and meet the Fire Services Act. Therefore, the purpose of this study is to understand the users’ satisfaction and reused intention of this system and make some suggestions. Exploring the results and problems derived from the introduction of Fire Traceability Declaration Management System is also the main purpose of this study. This study focuses on the mutual influence of platform users on product service, use awareness, and use behavior of the system. This research was conducting by a method of questionnaire and using SPSS statistical software to conduct descriptive statistics analysis, factor analysis, reliability analysis, and cross analysis. On the other hand, there are 200 companies surveyed in this study. The main result shows service innovation, cost/price, and service quality have positive influence on platform use behavior. However, service innovation, cost/price, and service quality are also have positive influence in terms of cognitive ease of use and awareness. The relationship between system services and reused Intention is partially mediated by using cognitive.

Governments are trying to provide all kinds of services for taxing. Along with the rapid growth of internet and the innovation of information technology, the on-line services being the tendency. Via web-based taxing filing system, everyone can access to government administrative services anytime and anywhere. This study adopts the technology acceptance model which (Davis,1989) proposed. To discuss the relationships among external variables (Setting System Quality and Computer Self-efficacy), perceived usefulness, perceived ease of use, attitude and behavioral intention., and the Intention of Applying Online Local Tax Declaration System. Relevant data were collected from January 2019 to March 2019 through literature review and questionnaire survey. All 250 questionnaires were handed out and 223 valid feedbacks were received, the effective rate was 89%. Descriptive statistical analysis, factor analysis, reliability and validity analysis, and regression analysis are applied to examine the hypothesis. Based on the statistical software SPSS statistical analysis to verify whether the assumptions of this study are established or not and further interpretation of the findings. This research is summarily concluded as follows: 1.The systems quality of” Intention of Applying Online Local Tax Declaration System” has significant impact on perceived usefulness and perceived ease of use. 2.The computer self-efficacy has significant impact on perceived usefulness and perceived ease of use. 3.The perceived ease of use has significant impact on perceived usefulness. 4.The perceived ease of use and perceived usefulness has significant impact on behavioral intention to use. 5.The perceived usefulness and attitude toward use has significant impact on behavior intention.

In recent years, we have seen a growing wave of integration of new IoT (Internet of Things) technologies into society. The massive integration of these technologies has led to the emergence of several critical issues which have consequently created new challenges, for which no obvious answers have yet been found. One of the main challenges has to do with the security and privacy of information processed by IoT devices present in our daily life. At present there are no guarantees from the manufacturers of such IoT devices, which are connected on our networks, as regards the collection and sending of personal information, nor an expected behavior. Thus, in this work, we developed and tested a solution that aims to increase the privacy and security of information in Networks of IoT devices, from the perspective of controlling the communication of smart devices on the network. To include one tool capable of analyzing packets sent by IoT devices and another capable of defining and allowing the application of network traffic control rules to the packets in question. These tools were indispensable for investigation of the two central aspects of this dissertation, which are investigating how the declarations of communication intentions of the IoT devices specified by the manufacturers are used, in order to facilitate control of communication by consumers and enable them to detect violations of those intentions, and how to give users/consumers control over IoT communication, so that they can define what they do and do not want their devices to communicate.<br>Nos últimos anos, assistimos a uma onda de crescimento da integração de novas tecnologias IoT (Internet Of Things) na sociedade. A integração massiva destas tecnologias levou ao aparecimento de vários aspetos críticos que, consequentemente, criou novos desafios, para os quais ainda não foram dadas respostas óbvias. Um dos principais desafios diz respeito à segurança e privacidade da informação dos dispositivos IoT presentes no nosso dia-a-dia. Atualmente, não existem quaisquer garantias por parte dos fabricantes destes equipamentos IoT, que estão conectados nas nossas redes, relativamente à recolha e envio de informação pessoal realizada pelos mesmos, bem como um comportamento expectável. Assim, neste trabalho, desenvolvemos e testamos uma solução que cujo objetivo é aumentar a privacidade e segurança da informação em redes de dispositivos IoT, na perspetiva do controlo da comunicação dos dispositivos inteligentes na rede. Para incluir-se uma ferramenta capaz de efetuar análise dos pacotes enviados pelos dispositivos IoT e uma outra capaz de definir e permitir a aplicação de regras de controlo de tráfego de rede aos pacotes mencionados. Estas ferramentas foram indispensáveis para a investigação dos dois aspetos centrais desta dissertação, que são a investigação de como as declarações de intenções de comunicação dos dispositivos IoT especificados pelos fabricantes são utilizadas, para facilitarem o controlo de comunicação destes pelos consumidores e permitir-lhes detetar violações dessas intenções e como atribuir ao utilizador/consumidor controlo sobre a comunicação IoT, para que este possa explicitar o pretende e não pretende que os seus dispositivos comuniquem.

AbstractIn many industries, traditional automation systems (operating technology) such as PLCs are being replaced with modern, networked ICT-based systems as part of a drive towards the Industrial Internet of Things (IIoT). The intention behind this is to use more cost-effective, open platforms that also integrate better with an organisation’s information technology (IT) systems. In order to deal with heterogeneity in these systems, middleware platforms such as EdgeX Foundry, IoTivity, FI-WARE for Internet of Things (IoT) systems are under development that provide integration and try to overcome interoperability issues between devices of different standards. In this paper, we consider the EdgeX Foundry IIoT middleware platform as a transformation engine between field devices and enterprise applications. We also consider security as a critical element in this and discuss how to prevent or mitigate the possibility of several security risks. Here we address secure data access control by introducing a declarative policy layer implementable using Ciphertext-Policy Attribute-Based Encryption (CP-ABE). Finally, we tackle the interoperability challenge at the application layer by connecting EdgeX with DIME, a model-driven/low-code application development platform that provides methods and techniques for systematic integration based on layered Domain-Specific Languages (DSL). Here, EdgeX services are accessed through a Native DSL, and the application logic is designed in the DIME Language DSL, lifting middleware development/configuration to a DSL abstraction level. Through the use of DSLs, this approach covers the integration space domain by domain, technology by technology, and is thus highly generalizable and reusable. We validate our approach with an example IIoT use case in smart manufacturing.

Résumé :

Current parametric CAD systems are based on solving equality type of constraints between geometric objects and parameters. This includes algebraic equations constraining the values of variables, and geometric constraints, constraining the positions of geometric objects. However, to truly represent design intent, next-generation CAD systems must also allow users to input other types of constraints such as inequality constraints. Inequality constraints are expressed as inequality expressions on variables or as geometric constraints that force geometric objects to be on specific sides or have specific orientations with respect to other objects. To solve problems involving constraints, we use a graph-based constraint solving algorithm that can be used in CAD/CAM/CAE applications. This graph-based constraint solving algorithm, called the Modified Frontier Algorithm with Solution Selection (MFASS), has been implemented at Michigan Technological University to solve equality based constraints in a CAD/CAM/CAE testbed application. The objective of this research was to investigate whether the Frontier Algorithm can be extended to solve geometry positioning problems involving systems of equality and inequality based declarations in which the inequality based declaration are used as solution selectors to choose from multiple solutions inherently arising from these systems. It is hypothesized that these systems can be decomposed by the Frontier Algorithm in a manner similar to purely equality-based constraint systems however they require tracking and iterating through solutions and in many cases may require backtracking through the solution sequence. This capitalizes on the strength of the Frontier Algorithm which solves only one small subsystem at a time with resulting short processing times compared to alternative algorithms. In this research we generate a new algorithm/DR planner for handling inequality constraints, both theoretically and through implementation in a testbed to demonstrate the working of the algorithm.

Commercial feature-based design systems are based on describing the design model in some form of sequential representation of primitive shapes and operations called features. In these systems, the overall design process, the behavior of building blocks and the characteristics of the final model, are governed by the construction sequence. These systems do not check for the conformity of the final shape with the actual design intent of features, and allow their design and engineering intent to be altered during the design process. The research work presented here describes a new design methodology and feature representation for facilitating a design environment that is independent of any construction order or constraint-based dependencies and provides a mechanism for maintaining design and engineering intent of the design features. The methodology works by dynamically evaluating the features using a planning algorithm such that the validity of each feature is maintained. These are intended to serve as a generic template that can be used to design and develop specific design features and CAD software systems.

Lacking proper geometric design capability is one of the main factors that are impeding MEMS development. MEMS developers are suffering the cumbersome and unintuitive traditional design methodology in which the design of a new product begins with figuring out its fabrication mask layouts. As the kernel of new MEMS design methodology, a new model for MEMS devices is highly required to implement structured design strategies. This paper focuses on developing a feature model for MEMS geometric design, which enables designers to create fabrication-ready 3D models of MEMS devices in an intuitive manner. This feature model not only represents the geometric information of the devices but also provides the high level engineering means to describe the design intent, and hence, it can be used to facilitate the decision making process in design and the modification of models in subsequent stages. The separation of design and fabrication allows designers to concentrate on creative design activity without thinking of the tedious fabrication issues. The features specified according to common fabrication process aim to systematically map design intents to fabrication data. A generalized framework for MEMS feature model is presented in which the features are manipulated and managed in a declarative manner.

We study the design of data publishing mechanisms that allow a collection of autonomous distributed datasources to collaborate to support queries. A common mechanism for data publishing is via views: functions that expose derived data to users, usually specified as declarative queries. Our autonomy assumption is that the views must be on individual sources, but with the intention of supporting integrated queries. In deciding what data to expose to users, two considerations must be balanced. The views must be sufficiently expressive to support queries that users want to ask -- the utility of the publishing mechanism. But there may also be some expressiveness restriction. Here we consider two restrictions, a minimal information requirement, saying that the views should reveal as little as possible while supporting the utility query, and a non-disclosure requirement, formalizing the need to prevent external users from computing information that data owners do not want revealed. We investigate the problem of designing views that satisfy both an expressiveness and an inexpressiveness requirement, for views in a restricted declarative language (conjunctive queries), and for arbitrary views.

People, mostly and directly affected from the state's decision about taxation. State, in order to realize public services, while using its taxation authority depending to its power of sovereignty, intervenes in the economy in different ways. While using taxation authority, state is subject to various limitations. The most important limitation about taxation is the necessity of obeying the laws.  The basic principles about taxation are indicated on the Universal Declaration of Human Rights and Constitutions. Nowadays, nearly in every country, advanced tax payer rights, public pressure and the ruling parties’ intent about remaining in power or the opposition parties' intent about coming in power also determines the limits of taxation.  Proceedings of the independent judicial bodies are very important about the limitation of taxation. Because independent judicial bodies can control the power of sovereignty of the state about taxation. In the judging process, they judge the tax rules and tax applications' harmony to the basic principles of taxation. If there are no fair limits about taxation in a country, this means that there is no democracy in that country.

In this 2021 Nulungu Reconciliation lecture, Dr Robert Isaacs AM OAM will explore the meaning of reconciliation and the lessons of his personal journey in two worlds. As part of the Stolen Generation, and born at the dawn of the formal Aboriginal Rights Movement, this lecture outlines the changing social attitudes through the eyes of the lived experience and the evolving national policy framework that has sought to manage, then heal, the wounds that divided a nation. Aspirations of self-determination, assimilation and reconciliation are investigated to unpack the intent versus the outcome, and why the deep challenges not only still exist, but in some locations the divide is growing. The Kimberley is an Aboriginal rights location of global relevance with Noonkanbah at the beating heart. The Kimberley now has 93 percent of the land determined through Native Title yet the Kimberley is home to extreme disadvantage, abuse and hopelessness. Our government agencies are working “nine-to-five” but our youth, by their own declaration, are committing suicide out of official government hours. The theme of the Kimberley underpins this lecture. This is the journey of a man that was of two worlds but now walks with the story of five - the child of the Bibilmum Noongar language group and the boy that was stolen. The man that became a policy leader and the father of a Yawuru-Bibilmum-Noongar family and the proud great-grandson that finally saw the recognition of the courageous act of saving fifty shipwrecked survivors in 1876.
