The monograph is devoted to the problem of studying the transformation of social institutions in Russian society. The current state of society is characterized by dynamic processes developing in it. How do artist archives survive and stay authentic in radically changed contexts? The volume addresses the challenge of continuity, sustainability, and institutionalization of archives established by Eastern European artists. At its center stands the 40th anniversary of the Artpool Art Research Center founded in 1979 in Budapest as an underground institution based on György Galántai's »Active Archive« concept. Ten internationally renowned scholars propose contemporary interpretations of this concept and frame artist archives not as mere sources of art history but as models of self-historicization. The contributions give knowledgeable insights into the transition of Cold War art networks and institutional landscapes.

Chapter 4 traces the origins of international landscape law, particularly in the soft law instruments adopted under the auspices of UNESCO and the Council of Europe. This first phase of international landscape law retains a strong conceptual dependency upon aesthetics and nature, which slowly began to change towards a more people-centred approach in the early 1990s. This is evident in the developments made in protected areas designation and other environmental regimes, such as the Convention on Biological Diversity, which began to include intangible heritage, relationships between people and place, and local knowledge in the consideration of landscape and land use management.

This book explores the various avenues—institutional, substantive, and procedural—for the protection of landscape in international law. Since the inclusion of ‘cultural landscapes’ within the scope of the UNESCO World Heritage Convention in 1992, landscape has gained increasing importance at the international level. ‘Cultural landscapes’ were intended to give recognition to the intangible and associative values attached to certain landscapes, to sustainable agricultural practices, and to ‘people and communities’—essentially the human dimension of landscape. This shift came full circle with the adoption of the European Landscape Convention (ELC) in 2000. The European Landscape Convention conceives of landscape above all as a people’s landscape and accordingly, provides for the active participation of the public in the formulation of plans and polices. It not only focuses on outstanding landscapes, but also on the everyday and degraded landscapes where most people live and work. This brings ‘landscape’ back to its early etymological origins—when it corresponded to a close up, human perspective—and has a number of implications for human rights, democracy, and spatial justice. How does international law, which deals for the most part with universality, deal with something so region-specific and particular as landscape? What is the legal conception of landscape and what are the various roles played by international law in its protection? This book assesses the institutional framework for landscape protection, analyses the interplay between landscape and human rights, and links the etymology and theory of landscape with its articulation in law.

Chapter 6 discusses the origins and implications of the European Landscape Convention (ELC), the first international instrument solely dedicated to the protection, management and planning of landscape, adopted by the Council of Europe in 2000. It assesses the radical definition and concept of landscape espoused by the ELC as well as its institutional framework, before moving on to problematizing the ELC from a legal perspective. It argues that despite the Convention’s lack of legal bite, it has nevertheless been paradigm-changing for its societal influence and impact on landscape discourse more broadly. The chapter concludes by offering some observations on current proposals for a global landscape convention inspired by the ELC.

Institutions are norms that undergird organizations and are reflected in laws and practices. Scholars point towards the ‘stickiness’ of institutions as stubbornly persisting on the historical landscape. As institutions tend to persist, the related political, administrative, and social processes persist as well. Therefore, it is puzzling when perpetuating institutions change paths. This book unravels one such puzzle by examining the process of institutional change through the lenses of transformation in the ‘information regime’ in India by tracing the passage of the Right to Information (RTI) Act, 2005. Historically, in India, the norm of secrecy was entrenched within the state, perpetuating since colonial times. Yet, in 2005, the RTI Act was enacted heralding an institutional shift from the norm of ‘secrecy’ to the new norm of ‘openness’. What explains this institutional change? Based on new historical evidence overlooked in the mainstream literature, this book shows that the RTI Act was path-dependent on ideas of openness that emerged within the state since Independence. It argues that an endogenous policy discourse on enacting legislation on access to information had begun since Independence; it incrementally evolved and reached a ‘tipping point’ and, after surviving many political challenges, resulted in institutional change. Initially these ideas emerged gradually and incrementally as part of opposition politics, but eventually became part of mainstream politics. The book presents an alternate perspective to the mainstream narrative explaining the evolution of the RTI Act and makes theoretical contribution to the literature on institutional change.
