AbstractHumanitarian actors sometimes have to decide whether to render assistance in situations that put them at risk of liability for aiding and abetting under international criminal law. This is the problem of the virtuous accomplice—the idea that knowingly contributing to the wrongdoing of others might, exceptionally, be the right thing to do. This article explains why the problem arises and clarifies its scope, before turning to criminal law in England and Wales and Germany to assess potential solutions. It argues that the best approach is to accept a defence of necessity—of justified complicity—and shows that such an argument works in international criminal law.

The article is devoted to the examination of the formation of new vectors for international relations development within the global format of cooperation. The establishment and unification of BRICS in the international legal sphere through a wide range of common interests and views of its members towards issues facing the modern world reflect objective tendencies of world development to the formation of amultipolar international relations system and determination of particular large country actors of broad integration and having many dimensions. The authors reveal particular characteristics of the international-legal status of BRICS, which make it possible to have an effective impact on challenges facing the modern world. The legal BRICS status differs crucially from traditional legal approaches to international organizations. Acting as a special subject of world politics, creating more trusted interaction conditions, BRICS focuses its attention on the alternative world order principles within the new model of global relations. Such a format of multilateral cooperation, as well as more trusted and additional mechanisms of international interaction, gives the members an opportunity to demonstrate their geopolitical and geoeconomic world significance, and in addition their demanded humanitarian role, which, as the analysis of the mentioned actor demonstrates, is aimed at forming its own interaction model. The logic of the BRICS agenda extension to the level of an important global management system element demonstrates the goal in the field of action and, accordingly, intensive progress of humanitarian imperatives. For these humanitarian imperatives, the issues of international peacekeeping, security, protection, encouraging human rights and providing stable development are an objective necessity, especially for active demonstration of the members’ viewpoints on the international scene. For understanding the process of the alignment of international security humanitarian imperatives it is necessary to study the existing objective needs in conjunction with each country, member of BRICS.

AbstractThe traditional distinction between military and law enforcement operations is increasingly difficult to uphold. This gives rise to a number of difficult and complicated challenges in regard to the handling of detainees. Legal ambiguity may lead to operational uncertainty, which may hamper the efficiency of a given United Nations (UN)-mandated international military operation. It is in the interest of no one, not least the detained individual. The author argues that the Copenhagen Process on the Handling of Detainees in UN-mandated international military operations is a necessity to ensure the full protection of any individual detained during an UN-mandated international military operation and thereby ensuring the efficiency of the efforts of the international community to bring stability and peace to States and regions in dire need. On the key legal question concerning the relationship between international humanitarian law and human rights law, it is necessary to conduct a thorough analysis of the relevant provisions of both bodies of international law in context. When this is done, most of the claimedincongruities between the two bodies of law disappear – and thereby also the basis for the sometime heateddiscussions between the advocates of one or the other body of law.

In reassessing the evolution of the post-1945 human rights movement, the paper identifies three “waves” or genres of human rights, generally representing the divisions between the Western and non-Western nations on the subject. A number of serious problems are raised, such as “double standards” maintained by some countries concerning human rights. This is followed by an evaluation of the possible clash between two perspectives: (a) the Third World's advocacy of such collective economic rights as a developing nation's right to sustained development (with its attendant demand that the West has to pay for its past colonization); and (b) the West's obstinancy regarding the individuals' rights to be asserted against their governments. In the age of intensified complex interdependence, a growing feature is the interpenetration of the economies of nations. That by necessity makes the migrant workers an “interface” between rich and poor economies. As economic interdependence deepens, both labor-importing and labor-sending countries have common stakes in the protection of the migrant workers.

The paper questions the extraterritorial nature of foreign private law applied by the national law enforcement body in the regulation of cross-border private law relations. In view of the use of common terms “exterritorial” and “extraterritorial” in the framework of international public and private law regulation, it seems necessary to study the extraterritorial effect of foreign private law provisions through the prism of the substantive characteristics of extraterritoriality, formulated in the context of public international law. To this end, the author refers to the definition of extraterritorial jurisdiction as an international legal category and raises the question of how appropriate it is to admit, within the framework of a single definition, “extraterritorial” both the presence and absence of the manifestation of the sovereign will of the state on the territory of which any of the types of jurisdiction of a foreign state is exercised. Taking into account that the manifestation of the extraterritorial jurisdiction of one state in relation to another is realized in the absence of the latter’s sanction for its implementation, the author debates the admissibility of designation as extraterritorial foreign private law, the admissibility and limits of application of which are sanctioned by the national state.

AbstractThis article examines the initially cooperative but increasingly tense relationship between the International Criminal Court (ICC) and Africa. It assesses the various legal and political reasons for the mounting criticisms of the ICC by African governments, especially within the African Union (AU), following the indictment of incumbent Sudanese President Omar Hassan Al Bashir. The author situates the ICC within broader African efforts to establish more peaceful societies through the continent-wide AU. He submits that the ICC, by prosecuting architects of serious international crimes in Africa's numerous conflicts, could contribute significantly to the continent's fledgling peace and security architecture which aims to prevent, manage and resolve conflicts and to anticipate and avert crimes against humanity. On the other hand, the author suggests that the ICC also has much to gain from Africa, especially in these early years when it is seeking to become a functional court of law with global legitimacy. By undertaking independent, fair and credible prosecutions without alienating States Parties, the world criminal court is more likely to fulfill its mandate and to win over powerful hold outs, such as the United States, China, and India. This will help it co-opt the support necessary for its universal reach and future success. However, he cautions that given Africa's sensitive historical experience with foreign interventions, including the slave trade and colonialism, the international criminal justice regime anchored on the ICC may be undermined, or perhaps even falter, if it is perceived as having a biased, politicized or insensitive application to a single region of the world.

Preemption comes in many forms and what we think of it depends on the circumstances. One state may not strike another merely because the second might someday develop an ability and desire to attack it. Yet few would criticize a strike in the midst of an ongoing war against a second state’s program to develop new types of weapons. Between these two examples lie countless fact patterns.In the end, each use offeree must find legitimacy in the facts and circumstances that the state believes have made it necessary. Each should be judged not on abstract concepts, but on the particular events that gave rise to it. While nations must not use preemption as a pretext for aggression, to be for or against preemption in the abstract is a mistake. The use of force preemptively is sometimes lawful and sometimes not.

This thesis examines the role of necessity, as a defence to State responsibility, in international law. Necessity provides a State with a defence to the responsibility that would otherwise arise from its breach of an international obligation where the only way that State can safeguard an essential interest from a grave and imminent peril is to breach an obligation owed to a less imperilled State. It is a defence that has generated a considerable body of jurisprudence in recent years and yet it continues to be plagued by a perception that States have abused it in the past and by fears that States will abuse it in the future - 'necessity', declared the German Chancellor on the eve of World War I, 'knows no law'. This thesis contends that this perception is flawed and these fears are unfounded. The main claim of this thesis is that necessity operates as a safety valve within the law of State responsibility that mediates between the binding quality of international obligations and the harsh consequences that may follow from requiring compliance with those obligations at all costs. This safety valve promotes the reasonable application of international law and it recognises that international law must sometimes bend so that it does not break. The thesis bears out this claim by contending that necessity has a stronger pedigree than is commonly appreciated and that it is solidly grounded in, and its contours are constrained by, customary international law. It charts those contours by first examining the scope of the obligations to which necessity may provide a defence, which includes examining how necessity relates to fields of law that contain their own safety valves regulating emergency situations. It then proceeds to examine the conditions that a State must satisfy in order to establish necessity and it finally examines the consequences of necessity, including for the stability of international law. The thesis concludes that any suggestion that 'necessity knows no law' has no place in international law today.

More than fifty investor-state arbitration claims have been filed by foreign investors against the Republic of Argentina due to the country's adoption of measures to mitigate the consequences of a severe financial crisis that struck the country in the early 2000s. Argentina invoked the Non-Precluded Measures (NPM) clause in the U.S.-Argentina Bilateral Investment Treaty (BIT) and the necessity defence in customary international law as its defense in these arbitrations. As a result of taking divergent approaches to interpreting the NPM clause in the U.S.-Argentina BIT, the tribunals reached inconsistent decisions on Argentina’s liability for damages incurred by foreign investors, which intensified the legitimacy crisis in the investment arbitration regime. Consequently, the tribunals’ approaches to interpreting the nexus requirement of the treaty NPM clause (the "necessary for" term) caused a fierce academic debate among scholars. This thesis studies the issues related to the inconsistent interpretation of treaty NPM clauses and the customary necessity defense in the investment arbitration regime. It presents a detailed examination of the necessity defense in customary international law and treaty NPM clauses through the lens of regime theory. By applying relevant concepts of regime theory, such as regime formation, regime attributes, regime consequences and regime dynamics, this work explores the origins and evolution of the necessity doctrine, and provides a comparative analysis of the attributes, structural elements and the consequences of invoking the customary necessity defense and treaty NPM clauses. This thesis analyses the interpretative issues in the Argentine cases, and based on the dynamics of developments in the practice of states, it arrives at concrete proposals that will contribute to the coherent practice of investment arbitration tribunals in interpreting treaty NPM clauses. By applying the concept of interaction of regimes, this thesis provides a comparative analysis of tests suggested by scholars for interpreting Article XI of the U.S.-Argentina BIT. It examines whether the interpretative testsmargin of appreciation, proportionality and less restrictive meansused by dispute settlement bodies in other specialized treaty regimes have the potential to serve as an optimal standard for interpreting Article XI. This work explains the contents of these tests and inquires as to the advantages and criticisms related to their application in the investment arbitration regime. This thesis further advances the argument that the interpretation of treaty NPM clauses (Article XI of the U.S.-Argentina BIT) should be performed with strict adherence to the general rules of interpretation as established under Article 31 of the Vienna Convention on the Law of Treaties (VCLT). Specifically, it argues that in cases when tribunals fail to define the meaning of a treaty provision under Article 31 (1) and (2) of VCLT, they should not look for guidance from other specialized treaty regimes, but rather, must have recourse to general international law, specifically, customary rules of international law. As a methodology for performing this interpretation, this thesis proposes to apply a systemic integration approach through operationalizing Article 31(3)(c) of VCLT. Furthermore, this thesis advances the argument that the interpretation of the only means requirement of the customary necessity defense (Article 25 of Articles on the Responsibility of States) does not accurately reflect the contemporary customary rules on necessity. Thus, by applying the concept of regime dynamics, it proposes to reconceptualise the interpretation of the only means requirement through incorporating the elements of a more progressive version, which is found in the international trade regime. Unlike the scholars who rejected the application of the customary necessity elements, and proposed the direct importation of the LRM test from the international trade regime to interpret Article XI, this thesis proposes a different approach to taking advantage of the WTO jurisprudence. Specifically, it argues that WTO jurisprudence can be incorporated into the investment regime indirectly by serving as a source from which we can identify the development of state practice in examining the "only means" nature of state measures adopted in emergency (necessity) circumstances. It is contended that such state practice represents a more progressive and practical approach to interpreting the only means requirement of customary necessity defense, and thus, should be incorporated into the interpretation practice of investment arbitral tribunals.

Since 2002, the United States has been conducting drone strikes as an integral part of its war on terror against al Qaeda. This paper discusses the evolution of that practice and considers the legal implications of the targeted killing of alleged members of al Qaeda and its affiliate organizations in non-battlefield situations. It argues that the U.S. is negatively influencing international law at a time when the law is unsettled with regard to non-battlefield targeting of members of armed opposition groups. Further, some of the strikes conducted by the U.S. violate the principles of distinction, proportionality and military necessity. The paper suggests that the U.S. should alter its course of actions, support a more restrained view of the boundaries of targeted killing, and limit any targeted killings to high-level members of terrorist organizations.

Aircraft leasing is a method of fleet acquisition. It was known to none at the outset of the air traffic era; as a result, international air law treaties were not formulated upon the concept that realized the practices as such. The moment international aircraft leasing materialized, many regimes of international air law became unsuited to the situation.
On the one hand, public international air law treaties have faced the problems ranging from safety oversight responsibilities and aircraft accident investigation to airport charges and criminal jurisdiction.
On the other hand, private international air law treaties have faced the problems ranging from applicability of the 1952 Rome Convention and preferential rights under the 1948 Geneva Convention to aircraft engine leasing and the idiosyncrasy of leasing transactions.
This study is not aimed at scrutinizing leasing transactions but at examining the aforementioned difficulties, especially the issues of public international air law.

New methods of conflict and coercion can prompt tectonic shifts in the international system, reconfiguring power, institutions, and norms of state behavior. Cyberattacks, coercive acts that disrupt or destroy the digital infrastructure on which states increasingly rely, have the potential to be such a tool — but only if put into practice. This study examines which forces in the international system might restrain state use of cyberattacks, even when they are militarily advantageous. To do so I place this novel technology in the context of existing international regimes, employing an analogical approach that identifies the salient aspects of cyberattacks, and compares them to prior weapons and tactics that share those attributes. Specifically, this study considers three possible restraints on state behavior: rationalist deterrence, the jus ad bellum regime governing the resort to force, and incompatibility with the jus in bello canon of law defining just conduct in war. First, I demonstrate that cyberattacks frustrate conventional deterrence models, and invite, instead, a novel form of proto-competition I call ‘structural deterrence.’ Recognizing that states have not yet grounded their sweeping claims about the acceptability of cyberattacks in any formal analysis, I consider evidence from other prohibited uses of force or types of weaponry to defining whether cyberattacks are ‘legal’ in peacetime or ‘usable’ in wartime. Whereas previous studies of cyberattacks have focused primarily on policy guidance for a single state or limited analysis of the letter of international law, this study explicitly relates international law to state decision-making and precedent. It draws together previously disparate literature across strategic studies, international law, and diplomatic history to offer conclusions applicable beyond any single technology, and of increasing importance as states’ dependence on technology grows.

In just three decades of human exploration and utilization of outer space, an unwanted legacy of thousands of artificial space debris has been left behind.
The purpose of this thesis is to analyse the appropriate technical aspects of the artificial space debris issue and to explore the legal ramifications of the question.
The first chapter is devoted to the technical aspects and covers topics such as the origins and location of artificial space debris, the hazards they constitute, the anticipated damage that might be caused by such debris and the likelihood of its occurrence.
In the second chapter, the legal aspects are explored by first looking at space law generally. A brief historical perspective of space law as well as the role of the United Nations in the making of space law is offered. Space law as it relates to the space debris issue is then analysed by first trying to define terms such as "space object", "component parts" and "space debris". Particular emphasis is then placed on issues like jurisdiction and control over space debris, international responsibility for space debris, their identification and, finally, liability for damage caused by space debris.

When states use force extraterritorially, they invariably claim a right of self-defence. They also accept that its exercise is conditioned by the customary international law requirements of necessity and proportionality. To date, these requirements have received little attention. They are notorious for being normatively indeterminate and operationally complex. As a breach of either requirement transforms lawful acts of self-defence into unlawful uses of force, increased determinacy regarding their scope and substance is crucial to how international law constrains military force. This thesis addresses this fact. It examines the conceptual meaning, content and practical application of necessity and proportionality as they relate to the right of self-defence following the adoption of the UN Charter. It provides a coherent and up-to-date description of the lex lata and an analytical framework to guide its operation and appraisal. It does this by undertaking the first comprehensive review of relevant jurisprudence, academic commentary and state practice from 1945 to date. Although the operation of necessity and proportionality is highly contextual, the result is a more determinate elaboration of international law that bridges theory and practice. This greater normative clarity strengthens the law's potential to exert a pull towards compliance. Necessity determines whether defensive force may be used to respond to an armed attack, and where it must be directed. Proportionality governs how much total force is permissible. This thesis contends that the two requirements are conceptually distinct and must be applied in the foregoing order to avoid an insufficient 'catch-all' description of (il)legality. It also argues that necessity and proportionality must apply on an ongoing basis, throughout the duration of an armed conflict prompted by self-defence. This ensures that the purposes of self-defence are met, and nothing more, and that defensive force is not unduly disruptive to third party interests and international peace and security.

Of all the standard criticisms of Marxism, the claim that it is wedded to a mechanical and deterministic account of history is among the most pervasive. It is also among the least defensible. This chapter argues that Marxism affords an especially strong set of analytical tools for explaining the contingencies of international law. Romanticising the concept of contingency as illuminative of aporia or ruptures—moments of radical uncertainty utterly at odds with the broader social contexts in which they register—risks relegating the events under scrutiny to the status of mutually unrelated accidents, to be lauded or lambasted in isolation or loose association. By contrast, a Marxist analysis of international law, one that is alive to the co-constitutive relations between class power and juridical authority, provides an explanatory framework within which contingencies may be comprehended. My argument proceeds in two stages. I first revisit some of the ways in which Marx engaged directly with questions of law and rights. I then draw upon Nicos Poulantzas’ theory of the state to propose a new Marxist approach to international law. My contention is that the question of law under capitalism is closely related to the question of contingency under capitalism, that the Marxist tradition’s responses to both questions are considerably more nuanced than they have generally been made out to be, and that being a ‘Marxist’ requires commitment not to the view that all contingency is illusory but simply to the view that contingency (like agency) is socially conditioned.

This chapter assesses the relationship between international law and municipal law. Though international law deals primarily with inter-State relations, and municipal law addresses relationships between individuals or between individuals and the State, there are many overlapping issues on which both international and national regulation are necessary, such as the environment, trade, and human rights. Though the international legal order asserts its primacy over municipal legislation, it leaves to domestic constitutions the question of how international legal rules should be applied or enforced in municipal orders. Two conflicting doctrines define the relationship between international and municipal legal orders: dualism and monism. Dualism is usually understood as emphasizing the autonomy and distinct nature of municipal legal orders, in which the State is sovereign and supreme. Meanwhile, theories of monism conceive the relationship between international and municipal legal orders as more coherent and in fact unified, their validity deriving from one common source.

In the post-global economic and financial crisis, Europe is suffering from significantly low levels of investment. This applies both to national level in the individual Member States and to those with a supranational scope. For this reason, the EC tried to stimulate the development of any investment initiative through the Juncker Plan, which is based on three pillars: the European Fund for Strategic Investments, the European Investment Advisory Center and the European Investment Projects Portal, and third, improving the business environment by removing regulatory barriers to investment at national and European level. Policies in this direction will continue and build on over the period 2021-2027 through the InvestEU program, which aims to continue to support increased investment, innovation and job creation in Europe. The process of implementation of each such initiative directly affects the individual legal and natural persons as investors who enter different bond relations, which have both national and international dimension. The development of new investment products and instruments would be unthinkable without the Bank’s involvement as a major creditor in the implementation of investment projects. This fact shows that it is necessary to examine the legal guarantees for the protection of creditors in these relationships in case of possible threat the debtor to damage the creditor in case of unfavourable development of the respective investment initiative. This paper will justify the significance and the peculiarities of Paul’s claim as a means of protecting creditors in the context of a developing EU investment environment and its legal framework. This method of preventing the decline of the asset and / or the increase of the liability of the debtor’s property is characterized by extreme persistence over time as a legal institution that originated in the Roman era and has survived to the present without losing its significance.

Kyrgyzstan since the collapse of Soviet Union went to the transition path and while it is argued that it succeeded at some points, levels or degree. It is certainly that major obstacles to the successful transition are not overcome. First of all it was necessary to get out of Russian dominated economy since it was itself declining. Kyrgyzstan was the first former Soviet republics left Russian ruble zone and accepted its own currency, som in 1993. Moreover, it is also the first former Soviet republics entered to World Trade Organization (WTO) in 1998. Second, finding new trade partners and external markets was a challenge. Kyrgyz governments wanted to go outside for two reasons: trading with outsiders at time of economic downturn in CIS was rise profitable and trading with outsiders would be a manifestation of their independence and sovereignty. It is obvious that since the independence Kyrgyzstan still serves as supply of raw material such as Kyrgyzstan’s primary budget income is still composed from natural resources (gold export). The Kyrgyz Republic is also classified as a low-income country with high debt vulnerability, due to these characteristics it is eligible to receive a significant level of grant from international financial organization, like World Bank. In this paper, Kyrgyzstan’s relations with the International Financial Organizations will divide three stages: Romantic years in 1990s, Debate on Heavily Indebted Poor Countries (HIPC) Initiative in 2000s, and the last one, after HIPC and Revolution in 2010.

This review looks at the extent to which LGBT rights are provided for under law in a range of Small Island Developing States (SIDS), and the record on implementation/enforcement, as well as approaches to promote LGBT rights and inclusion. SIDS covered are those in the Caribbean, Pacific, and Atlantic-Indian Ocean-South China Sea (AIS) regions. The review draws on a mixture of grey literature (largely from international development agencies/NGOs), academic literature, and media reports. While the information on the legal situation of LGBT people in SIDS was readily available, there was far less evidence on approaches/programmes to promote LGBT rights/inclusion in these countries. However, the review did find a number of reports with recommendations for international development cooperation generally on LGBT issues. Denial of LGBT rights and discrimination against LGBT people is found to varying extents in all parts of the world. It is important that LGBT people have protection in law, in particular the right to have same-sex sexual relations; protection from discrimination on the grounds of sexual orientation; and the right to gender identity/expression. Such rights are also provided for under international human rights conventions such as the Universal Declaration of Human Rights, while the Sustainable Development Goals are based on the principle of ‘leave no one behind'.
