Resumo: Este artigo discute a evolução do pensamento kantiano a partir do conceito de coisa-em-si. A divisão da realidade entre fenômeno e noumeno marca claramente uma preocupação posterior nos discípulos e seguidores deste autor. O modo como os ditos conceitos evoluíram, de maneira diferente é tema principal na reelaboração constitutiva do Criticismo. Dois pontos são ressaltados no debate: a visão dos pós-kantianos e Neokantianos, especialmente Liebmann e Cohen, seguidores tardios que julgaram ser necessária uma adaptação à filosofia kantiana. Em todo caso, é possível perceber a pouca fidelidade de ambos ao pensamento do autor. A filosofia crítica deixa de ser o parâmetro de sua própria interpretação para entrar num projeto puramente evolutivo a respeito da ética, da metafísica e da história.Abstract: This article discusses the evolution of Kantian thought from the notion of the thing-in-itself. The division of reality between phenomenon and noumenon clearly became a concern for Kant’s disciples and followers. The ways these concepts develop is the central theme of the constitutive reworking of Criticism. Two points are emphasized in the debate: the vision of the post-Kantians and that of the neo-Kantians, especially Liebmann and Cohen, later followers who felt it necessary to adapt Kantian philosophy to new challenges. In any case, both tendencies show little fidelity to the author’s thought. Critical philosophy ceases to be the parameter of its own interpretation to enter into a purely evolutionary project about ethics, metaphysics and history.

RESUMOO artigo científico visa esclarecer a fundamentação kantiana da doutrina da incorporação do Bill of Rights. A Suprema Corte dos Estados Unidos estendeu o Bill of Rights aos Estados. Neste trabalho pretendemos demonstrar a fundamentação kantiana na doutrina da incorporação do Bill of Rights, abordando a corrente filosófica do utilitarismo e do contratualismo. Em primeiro lugar, examinaremos o precedente da Suprema Corte dos Estados Unidos Gideon v. Wainwright (1963) e em seguida analisaremos filosoficamente o precedente. Em relação aos procedimentos metodológicos esta pesquisa caracteriza-se como qualitativa e descritiva, uma revisão de literaturas por meio de livros, revistas especializadas e periódicos.Palavras-Chave: Bill of Rights; Doutrina da Incorporação; Utilitarismo; Contratualismo; Imperativo categórico kantiano. ABSTRACTThe scientific article aims to clarify the Kantian foundation of the doctrine of incorporation of the Bill of Rights. The United States Supreme Court has extended the Bill of Rights to the states. In this paper we intend to demonstrate the Kantian grounding in the doctrine of incorporation of the Bill of Rights, addressing the philosophical current of utilitarianism and contractualism. First, we will examine the precedent of the United States Supreme Court Gideon v. Wainwright and then we will philosophically analyze the precedent. Regarding the methodological procedures this research is characterized as qualitative and descriptive, literature review through books.Keywords: Bill of rights; Doctrine of Incorporation; Utilitarianism; Contractualism; Kantian categorical imperative.

Faticidade e sociocentrismo são dois conceitos fundamentais com os quais toda teoria moral se vê confrontada. O artigo enquadra o significado deles na deontologia clássica kantiana e no paradigma pós-kantiano da ética do discurso. A discussão dos problemas implicados nesses conceitos leva o autor a defender um paradigma do Realismo Normativo que faz justiça ao conteúdo crítico desses conceitos e às intuições morais contidas neles.Abstract: ´Facticity´ and ´socio-centrism´ denote major structural features of theories of morality. The paper explicates their core-meaning and tries to demonstrate how these notions are instantiated in classical Kantian deontology and the post-Kantian paradigms of discourse-ethics. A justification is attempted for abandoning these theories in favour of a possible successor paradigm of Normative Realism which does better justice to the critical content of these concepts and the morally loaded intuitions contained therein.

Este artículo sostiene que hay problemas importantes en la tradición kantiana, en la medida en que existe una tendencia persistente a atribuir valor intrínseco basado en la existencia de capacidades cognitivamente relevantes. Además, se argumenta que después de un análisis de la obra de Kant, la exclusión de seres moralmente relevantes es una inclinación prevalente de la tradición. El trabajo de Rawls es utilizado para mostrar cómo, del racismo, el proyecto kantiano pasa al capacitismo. En la conclusión, se demuestra que incluso una versión más contemporánea y abierta de la tradición kantiana, como la defendida por Korsgaard, sigue vinculada a los mismos problemas que las formulaciones anteriores de la tradición. In this paper, there are important problems in the Kantian tradition that are argued, insofar as there is a persistent tendency to attribute intrinsic value based on the existence of cognitively distinct capacities. Furthermore, it is argued that after an analysis of the work of Kant the exclusion of morally relevant beings is a prevalent inclination of the tradition. The work of Rawls is used to show how from racism, the project moves on to ableism. In the conclusions, is showed that even a more contemporary and open version of the Kantian tradition, such as the one defended by Korsgaard, is still bound to the same problems as the previous formulations of the tradition.

Neste artigo, busca-se reproduzir o primeiro argumento de David Cummiskey em Kantian Consequantialism e, em seguida, realizar uma avaliação crítica dele. Tal avaliação é realizada através de duas objeções que recorrem à epistemologia kantiana: a primeira objeção demonstra que o imperativo fornecido pelo autor recorre à empiria; a segunda explicita a condição contida no pressuposto do imperativo. Esta segunda objeção bifurca-se em dois argumentos: o primeiro é contra as intuições morais, e o segundo figura como um contraexemplo hipotético. Nesse sentido, exemplos e experimentos mentais são utilizados ao longo do texto como argumentos complementares. Conclui-se que a tentativa de um consequencialismo kantiano está em fundamental oposição com sua epistemologia e, portanto, deve ser rejeitada.

This essay explores the development of Georg Simmel's interpretation of Immanuel Kant's philosophy in the context of neo-Kantianism and its preoccupation with the question of unity in modern diversity. It argues that the neo-Kantian movement can be divided into two periods: in the first, unity was addressed with regard to Kant's epistemology; in the second period, the main issue was the overall coherence of Kantian teaching. Simmel, who belonged to the younger generation of neo-Kantians, absorbed the conclusions of the previous generation that purged Kantian epistemology from its metaphysical foundations related to the noumenal world. Yet he did not share the views of his peers who considered Kant to be the philosopher of cultural plurality. On the contrary, he argued that Kant's system is thoroughly intellectualistic, and that ethics, aesthetics and religion within it are subordinated to logic. At the same time, his own philosophy presupposed cultural plurality akin to that of other neo-Kantians. In other words, Simmel abandoned Kant in order to develop his own version of neo-Kantianism.

The aim of the study is articulated in the title. The author is reconstructing Kantian philosophy and pedagogic, the thesis of postmodernism and post-modern pedagogic and indicates the relationships and differences of those two systems. Both Kant and the Baden-based neo-Kantians enabled the emancipation of the humanities. The Kantian model of pedagogy was the basis for pedagogic directions, belonging to the meta-theory of humanistic education and critical pedagogy, especially the postmodern one. There are clear links with Kantian ideas of pedagogy, the way to capture the role of dignity, knowledge and freedom in the morality of a human being. There are also significant differences: Kant did not include to his pedagogy social, political and pluralistic questions, which are so important in postmodern pedagogy.

In this paper I argue, with many leading commentators, that Kant is a conceptualist. I support this conclusion, argued for independently by Hannah Ginsborg and John McDowell, by appeal to the analyticity of Kant’s apperception principle in the transcendental deduction. I argue that the apperception principle, if taken as an analytic proposition, implies that any mental representation that figures into discursive cognition is the product of a priori synthesis. I further argue that making a priori synthesis a condition for the possibility of any mental representation is sufficient to make mental representation conceptual in the relevant sense. This, I argue, strongly suggests that Kant is a conceptualist.

There is little doubt that Salomon Maimon was both highly respected by, and highly influential upon, his contemporaries; indeed, Kant himself referred to Maimon as the best of his critics. The appraisal and reformulation of the Kantian project detailed in Maimon’s Essay on Transcendental Philosophy played a significant role in determining the criteria of success for post-Kantian philosophy, and was thus crucial to the early development of German Idealism. Key aspects of Maimon’s transcendental philosophy remain, however, relatively obscure. In particular, it remains unclear to what degree Maimon’s skepticism is internal to the Kantian framework, and how this skepticism is related to Maimon’s so-called dogmatic rationalism. The central aim of this project is to present Maimon’s as a distinct form of post-Kantian skepticism: one which poses significant problems for Kant’s theoretical project and which motivates a reformulation of the critical framework. In Kant’s eyes, pre-Kantian forms of skepticism are insufficiently critical insofar as they involve a commitment to transcendental realism. By contrast, I argue that Maimon’s skepticism does not involve a commitment to transcendental realism and that it strikes at the heart of Kant’s critical project insofar as it constitutes what I term ‘critical’ as opposed to merely ‘empirical’ skepticism. I further argue that Maimon’s rationalism provides the materials for a response to this form of skepticism. This thesis contributes to contemporary debates in the history of philosophy concerning the nature of Maimon’s coalition system and its relation to German Idealism, but also provides an alternative perspective on contemporary problems in the philosophy of perception concerning, in particular, the possibility of non-conceptual intentional content.

Christine Korsgaard has attempted to defend a distinct approach to metaethics – Neo-Kantian Constructivism. Not only does she present a positive case for her own view, she also attacks existing metaethical positions and even the disctinctions that metaethics has traditionally relied on. This thesis is a sustained examination of this position. I consider whether Korsgaard can legitimately claim to be offering a metaethical position at all, providing her with some defence against the scepticism of some metaethicists. I also examine her attacks on traditional metaethical positions (in particular moral realism and expressivism). I argue that her attack on moral realism can be avoided if the realism on offer takes a particular form. In the case of expressivism I claim that Korsgaard’s attack, though not fully developed in her work, motivates an examination of contemporary hybrid-expressivist theories. I argue that these are, as of yet, no advance over their non-hybrid cousins. Finally I examine Korsgaard’s own position, attempting to make it clearer by combining her claims with a framework developed by Crispin Wright for judgement-dependent qualities. This gives Korsgaard her best chance of a distinctive metaethical position. Ultimately, though, the Neo-Kantian approach to morality fails.

The aim of this thesis is to locate Nietzsche’s thoughts on epistemology within the Kantian tradition of Transcendental Idealism. Through a critical involvement with both Kant’s Critique of Pure Reason and Schopenhauer’s The World as Will and Representation, the Study will draw attention to the level of Nietzsche’s involvement with key issues in Kantian epistemology. In doing so it will put forward a reading of Nietzsche’s early ‘error theory’, Which rejects the idea that Nietzsche endorses a metaphysical correspondence theory of truth. It will instead be argued that in the early error theory Nietzsche is critiquing the discursivity of our understanding. The study will finish with a consideration of Nietzsche’s attempted rejection of the concept of the thing-in-itself through an epistemology of perspectivism. It will be argued that this rejection, much like Schopenhauer’s rejection of Kant’s inference to the thing-in-itself, ultimately fails and that Nietzsche’s perspectivism itself presupposes the ability to refer to, and make use of, the concept of reality in itself.

This thesis explores the role of the concept of equality in John Rawls' theory of justice. Rawls argues that the Kantian idea of the moral equality of persons translates into a primary principle of equal basic liberties, followed by a principle of fair equality of opportunity that addresses the moral arbitrariness of social and natural contingencies. Furthermore, the "difference principle" specifies that social and economic inequalities are only justified if they benefit the worst-off group. Libertarian critics such as Robert Nozick argue that Rawls' "difference principle" is inconsistent with a Kantian respect for the moral equality of persons as ends in themselves. Communitarians such as Michael Sandel and Charles Taylor argue that Rawls' egalitarian commitments are not supportable via a Kantian conception of the moral subject of justice as an autonomous pre-social self. This thesis defends Rawls' theory of justice against these challenges.

There are certain elements of Kant's moral philosophy that I believe no moral theory can afford to ignore. On the other hand, there are others which Kant's theory evidently would be better off without. I will be developing an account of human virtue by defending and exploiting some of Kant's most fertile and sustainable ideas, while arguing against other theses of his, a few of which have come to be regarded as definitive of Kantian Ethics.I begin by showing that we can plausibly interpret Kant's texts on "the good will" and "actions from duty" as presupposing that an agent's moral goodness consists in her aptitude for lawful conduct, that is, her aptitude for living in accord with practical principles valid for all possible agents. I build my basic account of virtue by showing that this aptitude inheres in the possession of certain traits. The cornerstone of virtue, I argue, is the moral commitment: the stable, non-instrumental aim of living lawfully. For, when this commitment prevails in determining an agent's actions, lawful conduct necessarily ensues--which cannot be said of any other commitment or aim. I identify four additional elements of virtue by searching for traits that a perfectly morally committed agent might possess, and which together would guarantee that her moral commitment prevails. These are: moral understanding, strength of will, empirical understanding, and empirical power. And I suggest that when an agent violates a moral requirement, this is always saliently attributable to a lack of one or more of the five proposed elements of virtue.I supplement the basic account of virtue by arguing that the morally committed human agent is rationally required to adopt four further, general aims: the efficient pursuit of her own happiness, the happiness of other agents and non-agents, her own moral perfection, and that of other similarly committed agents. This part of my view differs significantly from Kant's, so I will be largely concerned with critiquing the relevant arguments of his. But the result is still very much a Kantian account, and one that warrants serious consideration in contemporary debates about virtue.

The right of peoples to "self-determination” is influenced by varying motives in different times and geographies in its implementation, and is rarely operated according to its foundational ethic and legal bases dating back to the Kantian concept of free will and the international laws codified after the World War II. Particularly, political economy has always played an important but usually covered role in the application of this principle to national or international disputes. This paper aims to explain the dominance of political economy in international decision making processes about the people making a claim for their own state, and to highlight the changing nature of political economy supporting sometimes the sovereign states and sometimes the sub-state level ethnic groups. In this context, the theoretical development and the application of “self-determination” principle is assessed relatively by historical comparison method. Field research for the study comprises archival research of primary and secondary resources. This paper concludes that the political economy has usually greater influence on the application of “self-determination” to the national and international disputes than its ethic and legal content, and that the paradoxical content of this principle contributes to the redistribution of lands usually in compliance with the interests of great powers.

Background: Clear allergen communication in food business operators (FBOs) has been shown to have a positive impact on customers’ perceptions of businesses (Barnett et al., 2013). However, the precise size and nature of this effect is not known: there is a paucity of quantitative evidence in this area, particularly in the form of randomised controlled trials (RCTs). The Food Standards Agency (FSA), in collaboration with Kantar’s Behavioural Practice, conducted a feasibility trial to investigate whether a randomised cluster trial – involving the proactive communication of allergen information at the point of sale in FBOs – is feasible in the United Kingdom (UK). Objectives: The trial sought to establish: ease of recruitments of businesses into trials; customer response rates for in-store outcome surveys; fidelity of intervention delivery by FBO staff; sensitivity of outcome survey measures to change; and appropriateness of the chosen analytical approach. Method: Following a recruitment phase – in which one of fourteen multinational FBOs was successfully recruited – the execution of the feasibility trial involved a quasi-randomised matched-pairs clustered experiment. Each of the FBO’s ten participating branches underwent pair-wise matching, with similarity of branches judged according to four criteria: Food Hygiene Rating Scheme (FHRS) score, average weekly footfall, number of staff and customer satisfaction rating. The allocation ratio for this trial was 1:1: one branch in each pair was assigned to the treatment group by a representative from the FBO, while the other continued to operate in accordance with their standard operating procedure. As a business-based feasibility trial, customers at participating branches throughout the fieldwork period were automatically enrolled in the trial. The trial was single-blind: customers at treatment branches were not aware that they were receiving an intervention. All customers who visited participating branches throughout the fieldwork period were asked to complete a short in-store survey on a tablet affixed in branches. This survey contained four outcome measures which operationalised customers’: perceptions of food safety in the FBO; trust in the FBO; self-reported confidence to ask for allergen information in future visits; and overall satisfaction with their visit. Results: Fieldwork was conducted from the 3 – 20 March 2020, with cessation occurring prematurely due to the closure of outlets following the proliferation of COVID-19. n=177 participants took part in the trial across the ten branches; however, response rates (which ranged between 0.1 - 0.8%) were likely also adversely affected by COVID-19. Intervention fidelity was an issue in this study: while compliance with delivery of the intervention was relatively high in treatment branches (78.9%), erroneous delivery in control branches was also common (46.2%). Survey data were analysed using random-intercept multilevel linear regression models (due to the nesting of customers within branches). Despite the trial’s modest sample size, there was some evidence to suggest that the intervention had a positive effect for those suffering from allergies/intolerances for the ‘trust’ (β = 1.288, p<0.01) and ‘satisfaction’ (β = 0.945, p<0.01) outcome variables. Due to singularity within the fitted linear models, hierarchical Bayes models were used to corroborate the size of these interactions. Conclusions: The results of this trial suggest that a fully powered clustered RCT would likely be feasible in the UK. In this case, the primary challenge in the execution of the trial was the recruitment of FBOs: despite high levels of initial interest from four chains, only one took part. However, it is likely that the proliferation of COVID-19 adversely impacted chain participation – two other FBOs withdrew during branch eligibility assessment and selection, citing COVID-19 as a barrier. COVID-19 also likely lowered the on-site survey response rate: a significant negative Pearson correlation was observed between daily survey completions and COVID-19 cases in the UK, highlighting a likely relationship between the two. Limitations: The trial was quasi-random: selection of branches, pair matching and allocation to treatment/control groups were not systematically conducted. These processes were undertaken by a representative from the FBO’s Safety and Quality Assurance team (with oversight from Kantar representatives on pair matching), as a result of the chain’s internal operational restrictions.
