This chapter examines issues of governance arising from partnerships used as private investment funds. A limited partnership has two categories of partner: general partners and limited partners. The chapter first considers the role and duties of general partners and limited partners before discussing the English law vs Delaware law on limited partnerships, focusing on the advantages and disadvantages of Delaware law. It then looks at the UK legal reform on limited partnership and how the limited partnership agreement can be used to address the governance challenge presented by private investment funds. It also explains the duties of partners with respect to the governance challenge, taking into account the fiduciary duty in Delaware partnerships, the fiduciary duty of the board of directors under Delaware law, the Delaware Court of Chancery’s ruling in USA Cafes, and developments following USA Cafes.

Ecological policy and politics in the United States and most other countries has turned on the almost inevitable conflicts between ecological and economic goals. US policy recognized this in defining policy as a process of minimizing negatives: of limiting ecological harm while also controlling for pollution and other effects of growth. Instead, policy choices should be built on a green growth strategy—of maximizing the opportunities for positive relationships. This goal is supported by evidence. Ecological policies in the United States have had limited adverse effects on economic growth and competitiveness; at the same time, strategies built on such concepts as clean energy and green infrastructure define options for positive-sum solutions. Evidence of both ecological and social costs of unguided economic growth, as well as the realities of American politics, makes a compelling case for a green growth framing.

This book explains the legal framework within which partnerships, limited partnerships, and limited liability partnerships (LLPs) operate in England and Wales. In relation to partnerships, it deals first with the characteristics and essential elements for a partnership to exist; the distinction between partners, creditors, and employees; and the interaction between partnerships and public regulation. The book then deals with the two major consequences of a partnership, the liability of partners to third parties for actions taken by their fellow partners and the duties and liability of each partner to the other partners. It then identifies and explores the assets which have become partnership property. The issues relating to dissolution follow, setting out how a partnership may be dissolved (in full or in part) and the procedures to effect that. The impact of the insolvency of the firm and/or bankruptcy of the partners is covered. The rapid rise of the use of limited partnerships is explained together with the modifications to partnership law and the creation of private fund limited partnerships. In relation to LLPs, after setting out the background to the legislation and explaining its structure, it examines the requirements for the creation of LLPs, how they are incorporated, and the consequences of their incorporation as separate legal entities. It then explores what membership of an LLP entails, including the interrelation of membership with employment and worker status, and the relations between members and the LLP and between the members themselves. It then looks at the default provisions, the role of the LLP Agreement, and the extent to which contractual doctrines such as repudiation and frustration apply to that agreement. Finally, the book looks at decision-making within an LLP, termination of a member’s membership, and insolvency and dissolution of the LLP itself.

In addition to explaining established principles it explores the unresolved issues in partnership law, including fixed share partnerships and whether partners can be workers, dissolution by acceptance of repudiatory breach, abandonment and mutuality, liability for equitable wrongs, the authority of a partner winding up a partnership, and the availability of equitable or common law remedies for breaches of the partnership agreement. The new edition includes a greatly expanded analysis of limited liability partnerships signifying the growth in importance of this type of entity and the development of a distinct area of law. LLP law is still evolving and combines both corporate and partnership elements which creates legal and practical difficulties. The book considers and provides answers to these problems. It analyses for example, the question as to whether a person can be both a member and an employee of an LLP. Limited partnerships are also considered in detail in response to their recent revival as investment vehicles and recent developments on access to information and derivative actions by limited partners.

The estimated incidence of Chlamydia trachomatis infection is over 100 million cases globally and almost 1 million in the United States. Infection with C. trachomatis tends to be asymptomatic and of long duration. If a pregnant woman has active infection during delivery, the infant may acquire the infection, which can result in conjunctivitis or pneumonia. The most effective method of controlling perinatal C. trachomatis infection is the screening and treatment of pregnant women. Identification of infected mothers offers the opportunity to provide treatment for their sexual partners to help prevent reinfection and Chlamydia-associated morbidity in them, in addition to preventing morbidity during pregnancy and perinatal infection. Further research on prevention, especially in resource-limited settings, is most important. The implementation of prenatal screening and treatment is feasible now and will greatly reduce morbidity in pregnant women, their sexual partners, and their infants.

Competitive advantage can be sustained only for a limited period, so firms must innovate their business model – through replication or through renewal. Replication means firms scale up and improve their existing business model over time, for example, McDonald’s and IKEA. Renewal involves firms bringing in a brand new, very different business model, for example, DSM, which has reinvented itself several times, and the temping agency Randstad. Chapter 2 also identifies several levers of business model innovation, the main one being new technology. Complementary levers include new managerial practices, new organizational forms, and co-creation with new partners.

The interaction between HIV and mental illness is complex. For many individuals, the psychiatric condition is a preexisting one, predisposing to HIV infection through behavioral factors and risk environment. The risk factors for HIV are well established and involve blood/bodily fluid contact with infected individuals: unprotected sexual behaviors, needle sharing, multiple sexual partners, and fetal/natal exposure. Individuals with preexisting psychiatric illness often engage in risky behaviors with little thought or fear of consequences. This relates to increased emotional immaturity and impulsivity, poor contact with reality, denial and disinhibition, cognitive dysfunction, active thoughts of self-harm, and victimization or impaired judgment. Barriers to treatment, such as distrust of authority, poor communication skills, limited access, lack of motivation, and unstructured lifestyle, result in poor overall health care and delayed diagnosis of all health issues. Diagnosis of mental health issues is frequently challenging, and adherence to treatment is frequently impacted by these same factors.

Abstract: This chapter describes models and approaches of field instruction used by the UMSSW/TAC. The chapter presents an overview of field instruction models and essential student skills; it discusses the use of traditional field instruction, use of specific student groups (e.g., Community-Based Initiative MSW students, Semester in Detroit undergraduate students), and VISTA volunteers. The chapter outlines the migration of field instruction from UMSSW/TAC staff to community governance organizations. The chapter summarizes the experience of efforts to coordinate multiple courses within the SSW and across institutional partner programs (e.g., Urban Planning and Public Policy). The limits and challenges of field instruction approaches are reviewed; benefits to community residents and the Good Neighborhoods Initiative are discussed. Lessons learned are generated from Foundation, Community Partners, Supervisors, and Students. The chapter ends with thoughts about field instruction as a strategy for community development.

The transatlantic slave trade peaked in the third quarter of the eighteenth century, when more than 80,000 slaves annually were being shipped from Africa for the Americas. This overshadowed the older-established trade in slaves northwards from West Africa across the Sahara Desert to the Muslim world, which was probably under 10,000 annually. Despite the long history of commerce, direct European involvement in Africa remained limited. In contrast to the Americas, European colonial occupation of African territory was minimal before the later nineteenth century. Some African states maintained diplomatic relations with their trading partners across the Atlantic. The operation of the Atlantic trade had the effect of linking up different parts of Africa with each other, as well as with Europe and the Americas. The autonomous (or northern-oriented) character of the West African historical process might seem to be self-evidently illustrated by one of the major developments of this period, a series of jihads, or ‘Islamic Revolutions’, in which Muslim clerics seized power from existing ruling groups.

Degrees of Difference: Reflections of Women of Color on Graduate School uses personal narrative supported by scholarly research to identify the struggles faced by women of color in graduate school and the methods deployed by women to mitigate the academic and emotional struggles they face. Contributors represent a diverse group of women from different ethnic, racial, and national origin backgrounds in fields ranging from the humanities to sciences. The essays engage common themes that recur in many women of color’s narratives: racial microaggressions, alienation, disillusionment, a lack of departmental and institutional support, imposter syndrome, a lack of self-care, and limited support from family and partners. The authors then discuss the specific steps taken to resist the roadblocks that stop many women of color from completing their degrees. Focusing on self-care, the creation of supportive communities, finding like-minded mentors, and strategies on resisting racism and unsupportive faculty and graduate students, the contrubtors offer solutions and possible avenues to support other women of color’s success in academia.

African countries have diversified both their exports and trade partners over the last decade, African agricultural trade still suffers from structural problems as well as exogenous shocks. Against this backdrop, the 2021 Africa Agriculture Trade Monitor (AATM) analyzes continental and regional trends in African agricultural trade flows and policies. The report finds that many African countries continue to enjoy the most success in global markets with cash crops and niche products. At the intra-African level, countries are becoming more interconnected in trade of key commodities, but there remain many potential but unexploited trade relationships. The report examines the livestock sector in detail, finding that despite its important role in Africa, the sector is concentrated in low value- added products that are informally traded. The report also examines trade integration in the Arab Maghreb Union (AMU), which remains limited due to factors including tariffs, nontariff measures, poor transport infrastructure, and weak institutions. Finally, the report discusses the implications of two major events affecting African trade in 2020 and 2021: the COVID-19 pandemic and the implementation of the African Continental Free Trade Area (AfCFTA).

By directly challenging existing accounts of post-World War II relations among the United States of America, the United Kingdom, Australia, and New Zealand, this book is a significant contribution to transnational and diplomatic history. At its heart, the book examines why strategic cooperation among these closely allied Western powers in the Asia-Pacific region was limited during the early Cold War. The book probes the difficulties of security cooperation as the leadership of these four states balanced intramural competition with the need to develop a common strategy against the Soviet Union and the new communist power, the People's Republic of China. It exposes contention and disorganization among non-communist allies in the early phase of containment strategy in Asia-Pacific. In particular, it notes the significance of economic, racial, and cultural elements to planning for regional security and highlights how these domestic matters resulted in international disorganization. The book shows that, amidst these contentious relations, the antipodean powers Australia and New Zealand occupied an important role in the region and successfully utilized quadrilateral diplomacy to advance their own national interests, such as the crafting of the 1951 ANZUS collective security treaty. As fractious as were allied relations in the early days of NATO, the book demonstrates that the post-World War II Asia-Pacific was as contentious, and that Britain and the commonwealth nations were necessary partners in the development of early global Cold War strategy.

This book chronologically details the lives and professional experiences of Jewish professional figures, demonstrating the obstacles they faced and the status they achieved. The book begins by detailing the influx of Jews into medical schools after 1914 and the problems these Jewish medical students faced. Finding employment was problematic. Afraid of antisemitic claims that Jews were flooding the market, the leaders of Anglo-Jewry even tried in the 1930s to dissuade young Jews from becoming doctors and lawyers. In this context, the book also considers the position of refugee doctors before and during the Second World War. The establishment of the National Health Service in 1948 resulted in fundamental changes, particularly in the way in which consultants were selected, and this permitted Jewish doctors to enter specialties from which they had previously been excluded. The book summarizes the careers of many prominent Jewish doctors. The experience of Jews in the legal profession, both as solicitors and barristers, is examined in similar detail. The persistence of an anti-Jewish bias in the inter-war period limited opportunities for Jews and dissuaded them from entering the law. After the war, major changes in the economy and legal system allowed Jewish law firms to expand rapidly, challenging the dominance of the City law firms in the commercial world. Many of these firms consequently began to admit Jewish partners for the first time. From the late 1960s, Jews were also promoted in increasing numbers to position on the High Court Bench. As well as giving a detailed picture of these mainstream developments the book also looks at the careers of Jewish communist, socialist, and maverick lawyers.

These ripple effects most notably impact the unemployed worker’s family, including a spouse or partner and/or children. For couples and families, we explore the financial or economic stressors and strain brought about by job loss; the direct, crossover, and relationship quality effects of stress and reduced mental health among unemployed workers and their spouses; protective resources for coping with job loss, such as social support and family resilience; and the social roles and identity of the unemployed worker. For children, we focus on mental health, child development, and educational/human capital attainment. We then offer suggestions for future research on families facing unemployment.

Empathy is widely recognized to have multiple facets, both affective and cognitive. This chapter reviews evidence regarding the effect on social relationships of two of these facets: compassion and perspective-taking. The focus is on three domains: smooth social functioning/relationship quality, social support, and responses to partner transgression. Evidence indicates that perspective-taking is consistently related to measures of relationship quality, including global relationship satisfaction and interpersonal hostility. In contrast, compassion displays weaker and less consistent associations. A similar pattern is found for social support; perspective-taking has a consistent beneficial effect on the provision of various types of relationship support; the effects of compassion are weaker. A different pattern emerges for reactions to partner transgression. By far the strongest predictor of forgiveness is experiencing compassion for the transgressor. Finally, the limited evidence from studies examining these issues cross-culturally suggests that these patterns hold in non-American samples as well.

James Tenney focuses on the “reconciliation” of two musical worlds: formal and aesthetic ideas inspired by John Cage, and harmonic possibilities suggested by Harry Partch. Using the computer as a compositional partner, Tenney examines notions of intentionality (the Cagean part) and the formative gestalt ideas of Meta + Hodos. He correlates new developments in harmony with the design of new tuning systems and considers one of the new directions taken by some composers after 1910 involving the expansion of the pitch resources beyond a tuning system tempered by twelve-tone music. He argues that such expansions did not—and could not—solve the problem that had arisen with the “exhaustion” of tonality. According to Tenney, the real problem with the 12-set is not the relatively small number of pitches it makes available, but the fact that a very large tolerance range has to be assumed even for it to be regarded as a “fair approximation” of the basic intervals of the 5-limit—and even greater ranges are involved with those of the 7- and 11-limits.

This chapter explores how service members with injuries that damage sexual and reproductive functioning may experience the psychosocial implications of impaired fertility. It addresses a general overview of infertility and then describes the experience within the military context. Infertility can be an invisible, secondary wound that is not felt until one considers procreation and that may last for many years. Further, infertility is an injury that affects not only the service member but also his or her partner. Many ethical considerations and barriers, including limited insurance coverage and accessibility for treatment, make it difficult to access technologies for reproduction. Fertility preservation and sperm harvesting should be considered as options by service members before deployment. While advances in technologies can help injured service members to procreate, the challenges and emotional fallout are significant and need to be addressed in treatment, counseling, and public policy.

Aggression and coercive behaviors in the form of physical assaults, psychological aggression, and sexual coercion—often referred to as intimate partner violence (IPV)—are highly prevalent in couples during early adulthood (ages 18 through 29 years). Although such IPV has long been recognized as a major public health problem, the existing intervention programs have shown limited effects. Since the late 1990s researchers have sought to identify more nuanced developmental pathways and interactional processes of IPV in young couples in order to better inform prevention and intervention efforts. This chapter first discusses characteristics of IPV in early adulthood and then outlines key assumptions of the dynamic developmental systems model, an extension of coercion theory, as a framework for understanding the development of IPV. It then provides relevant empirical findings from the Oregon Youth Study–Couples Study. We also discuss clinical implications of the findings from our work.

How can international organizations (IOs) like the United Nations (UN) and their implementing partners be held accountable if their actions and policies violate fundamental human rights? Political scientists and legal scholars have shed a much-needed light on the limits of traditional accountability when it comes to complex global governance. However, conventional studies on IO accountability fail to systematically analyze a related, puzzling empirical trend: human rights violations that occur in the context of global governance do not go unnoticed altogether; they are investigated and sanctioned by independent third parties. This book puts forward the concept of pluralist accountability, whereby third parties hold IOs and their implementing partners accountable for human rights violations. We can expect pluralist accountability to evolve if a competitive environment stimulates third parties to enact accountability and if the implementing actors are vulnerable to human rights demands. Based on a comprehensive study of UN-mandated operations in Afghanistan, Bosnia, and Kosovo, the European Union Troika’s austerity policy, and global public–private health partnerships in India, this book demonstrates how competition and human rights vulnerability shape the evolution of pluralist accountability in response to diverse human rights violations, such as human trafficking, the violation of the rights of detainees, economic rights, and the right to consent in clinical trials. While highlighting the importance of studying alternative accountability mechanisms, this book also argues that pluralist accountability should not be regarded as a panacea for IOs’ legitimacy problems, as it is often less legalized and might cause multiple accountability disorder.

This chapter analyzes how Italian clientelist liberalism has shaped policy outcomes in fiscal policy, labor-market policy, and financial regulation since the early 1990s. Unlike France and Germany, where national liberal traditions were successfully synthesized with the postwar political-economic order, in Italy a weakly embedded liberalism became increasingly dominated and undermined by clientelistic imperatives. Like its German counterpart, Italian liberalism has traditionally viewed groups as the fundamental components of the social and economic order. Unlike those in Germany, however, these groups have acted and been seen as acting as impediments to adjustments rather than partners with the state. The result has been a zero-sum conception of political reform, a conflation of notions of the limits of state power with the vested interests of powerful groups, and a deep distrust of the state. In fiscal policy, labor-market policy, and financial regulation, these political dysfunctions have frustrated reforms and undermined effective adjustment.

This chapter describes the process of progressive decentring of two partners taking part in a dialogue. Phenomenological unfolding is the taking of a third-person perspective on one’s own experiences. The hermeneutic moment consists in position-taking and perspective-taking with respect to one’s own experiences and their meanings. It requires the capacity to distance oneself from one’s own habits in interpreting and understanding the ‘facts’ of one’s own life, and to make of these very habits the object for reflection and for understanding. The psychodynamic moment consists in positing both phenomenological unfolding and hermeneutic analysis in a larger historical context, according great importance to the role of life events, of tradition and prejudice in the development of any form of habitus in interpreting one’s experiences, and of limit-situations in jeopardizing one’s defensive ‘housings’ and showing their vulnerability. This means acknowledging and accepting contingency as the necessity of one’s own story.

Throughout the history of philosophy, relations to oneself have been modeled on intersubjective relations, as the “internalization” of possible relations with others. Plato describes thought itself as a kind of internal dialogue, and Kant grounds normativity on “self-legislation” and the possibility of obligations to oneself. The conscience is pictured as an “internalized other.” This chapter argues for “self-other asymmetries” governing speech and interlocution which limit the sense in which a person can be her own interlocutor, or treat either a part of herself or a temporal stage of herself as such a conversational partner (Korsgaard, Dummett). The chapter revisits the related claims of Anscombe and Cavell that “believing someone” does not have a first-person reflexive form, and develops the idea of the two forms of agency expressed in speech.

Patients with gynaecological cancer encounter, everyday, various problems in their family lives, jobs, and finances, in addition to the direct effects of the cancer itself. They also face problems concerning a loss of femininity, such as those related to the menopause, their reproductive function, and sexual activity that is brought about by the effects of the disease and its management. Hence, problems are not only limited to the biological aspect of cancer, but also to its impact on psychosocial aspects, thereby increasing the level of stress in these patients. Hence, when considering the problems of patients with gynaecological cancer, its psychosocial impact, and its effect on day-to-day living should be addressed in addition to the physical aspect of the disease. Otherwise, treatment will be inadequate. Chapter 10 addresses this. Recognition of the importance of solving these psychosocial problems, which can be distressing to many patients with gynaecological cancer, and the early identification along with appropriate intervention for these problems, would aid in improving the quality-of-life of these sufferers. Furthermore, the biopsychosocial impact of the cancer extends to close family members who care for the patient, particularly the spouse/ partner, and thus increases their risk of psychosomatic disease besides malignancy. Cancer support services should include the family care-givers. Two vignettes illustrate the complex biopsychosocial issues associated with gynaecological cancer, and one depicts issues after bereavement.

One-time routine screening of all adults and adolescents as well as annual screening of high-risk individuals and all pregnant women are recommended without the need for pretest counseling or written consent. HIV is a reportable disease to the Centers for Disease Control and Prevention in all 50 states and the District of Columbia. Partner notification remains a key component of HIV prevention. Health care providers may be obligated to assist in notification or HIV disclosure in select instances. HIV stigma and discrimination remain problematic in many areas of the United States and globally, but laws have been progressively enacted to limit these problems and protect persons living with HIV disease. Confidentiality of HIV status and health-related issues is protected under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). Advance care planning is an important component of comprehensive care for adults living with HIV/AIDS.
