There is no agreed minimum standard with regard to what is considered safe, competent nursing care. Limited resources and organizational constraints make it challenging to develop a minimum standard. As part of their everyday practice, nurses have to ration nursing care and prioritize what care to postpone, leave out, and/or omit. In developed countries where public healthcare is tax-funded, a minimum level of healthcare is a patient right; however, what this entails in a given patient’s actual situation is unclear. Résumé :
This work introduces three models to measure information security compliance. These are the cardinality model, the second’s model, which is based on vector space, and the last model is based on the priority principle. Each of these models will be presented with definitions, basic operations, and examples. All three models are based on a new theory to understand information security called the Information Security Sets Theory (ISST). The ISST is based on four basic sets: external sets, local strategy sets, local standard sets, and local implementation sets. It should be noted that two sets are used to create local standard sets—local expansion and local creation. The major differences between the Zermelo Fraenkel set theory and the ISST are the elimination of using empty element and empty set. This assumption is based on “there is not empty security” measure and the is substituted to be and is defined as “minimum security (or system default security)”. The main objective of this article is to achieve new modeling system for information security compliance. The compliance measurement is defined in the first model as the cardinality between local strategy sets and the actual local implementation. The second model is looking at the security compliance as the angle between two sets, local implementation and local standard. The third model is based on the priority philosophy for local security standard.

This chapter analyses the prominent role of due diligence in international investment law. It points out that due diligence was relevant in this field as an element of customary law norms requiring compliance with an international minimum standard for the treatment of aliens and prohibiting denial of justice, before modern day investment treaties were concluded. The chapter’s analysis reveals that due diligence underlies host states’ obligation to provide full protection and security and fair and equitable treatment. It underlines that also investors carry a responsibility of due diligence throughout the whole period of their investment and that an investor’s negligence can lead to loss of protection under investment treaties. The chapter argues that due diligence has emerged as a balancing paradigm between protection of foreign investors and regulatory freedom of host states.

Résumé :
While CORBA has been very successful in the domain of enterprise computing, its adoption for mobile devices is obstructed by a central problem: the limited resources of such devices. If standard-compliant CORBA-based applications are to be executed on mobile devices, storage requirements, for example, represent a major bottleneck. But for all that, several research groups have made an effort over the past few years to establish the CORBA standard in the domain of mobile devices. The existing approaches can be divided into three categories:1. approaches that are restricted in the sense that they use an implementation of the IIOP protocol only,2. approaches that build on the minimum CORBA specification, and3. approaches that rely on other ways to reduce the memory footprint of a CORBA implementation. In the following sections of this chapter, these approaches will be discussed in detail.

Résumé :
Electronic documentation of medication data is one of the biggest challenges associated with digital clinical documentation. Despite its importance, it has not been consistently implemented in German university hospitals. In this paper we describe the approach of the German Medical Informatics Initiative (MII) towards the modelling of a medication core dataset using FHIR® profiles and standard-compliant terminologies. The FHIR profiles for Medication and MedicationStatement were adapted to the core dataset of the MIl. The terminologies to be used were selected based on the criteria of the ISO-standard for the Identification of Medicinal Products (IDMP). For a first use case with a minimal medication dataset, the entries in the medication chapter of the German Procedure Classification (OPS codes) were analyzed and mapped to IDMP-compliant medication terminology. OPS data are available at all German hospitals as they are mandatory for reimbursement purposes. Reimbursement-relevant encounter data containing OPS medication procedures were used to create a FHIR representation based on the FHIR profiles MedicationStatement and Medication. This minimal solution includes – besides the details on patient and start-/end-dates – the active ingredients identified by the IDMP-compliant codes and – if specified in the OPS code – the route of administration and the range of the amount of substance administered to the patient, using the appropriate unit of measurement code. With FHIR, the medication data can be represented in the data integration centers of the MII to provide a standardized format for data analysis across the MII sites.

Under current Center for Medicare and Medicaid Services (CMS) regulations, hospitals are responsible for establishing policies and procedures that differentiate anesthesia from analgesia/sedation. They are also responsible for determining the qualifications for practitioners who administer sedation based on nationally recognized guidelines. CMS regulations require the anesthesia service in CMS-certified hospitals to develop hospital policies and procedures governing the provision of all categories of anesthesia services, including specifying the minimum qualifications for practitioners permitted to provide procedural sedation. Additional regulatory bodies such as state survey agencies, which may include departments of health and accrediting organizations, follow CMS interpretive guidelines to determine a facility’s compliance with the Medicare Conditions of Participation. State laws, health department requirements, professional boards, accrediting organization standards, and facility bylaws and policy may exceed CMS requirements.

Résumé :
This concluding chapter reviews the key findings and arguments of this book regarding private regulation. It also looks at other suggestions to reform and improve private regulation which are not canvassed extensively in this book. An important one is to reform the buyer–supplier contract to make the contract “work both ways” — that is, level the playing field so suppliers and workers can sue for buyer compliance. A second concerns institutionalizing unemployment insurance for supply chain workers. Meanwhile, a third suggestion is that global buyers reform their sourcing to source only from countries with good labor standards, or at a minimum, clearly indicate to those country's governments that they will stop sourcing if labor laws are not enforced. Ultimately, private regulation is not a panacea, and researchers have pointed to other steps that could improve working conditions in supply chains. For one thing, national governments need to do a better job enforcing existing labor laws; indeed, it was governments' failure to do so that gave rise to private regulation. Another step is regionalization — harmonizing national labor standards within regional trade blocs through arrangements similar to those employed by the European Union. Moreover, labor standards could be improved if the International Labour Organization (ILO) could be more forceful with its members with respect to adhering to ILO conventions.

Mental health practitioners are obligated to follow their profession’s code of ethics and to operate based on its values in their professional roles. As this chapter explains, this includes both enforceable standards and aspirational values. This chapter explains how to be guided by these aspirational values while ensuring compliance with ethics requirements. Guidance is provided on how to separate minimal requirements for ethical practice from optional aspirations that are encouraged in living out the profession’s values. Specifically, how fees are set and collected, options for payment that take client financial hardship into consideration, and decisions about working with insurance are each addressed. Commonly occurring challenges are described and specific recommendations are provided for proactively addressing each of them to achieve the goal of having a financially successful private practice while ensuring that those in financial need may access needed mental health services.

Résumé :
Introduction: Ensuring scientific reproducibility and compliance with documentation guidelines of funding bodies and journals is a topic of greatly increasing importance in biomedical research. Failure to comply, or unawareness of documentation standards can have adverse effects on the translation of research into patient treatments, as well as economic implications. In the context of the German Research Foundation-funded collaborative research center (CRC) 1002, an IT-infrastructure sub-project was designed. Its goal has been to establish standardized metadata documentation and information exchange benefitting the participating research groups with minimal additional documentation efforts. Methods: Implementation of the self-developed menoci-based research data platform (RDP) was driven by close communication and collaboration with researchers as early adopters and experts. Requirements analysis and concept development involved in person observation of experimental procedures, interviews and collaboration with researchers and experts, as well as the investigation of available and applicable metadata standards and tools. The Drupal-based RDP features distinct modules for the different documented data and workflow types, and both the development and the types of collected metadata were continuously reviewed and evaluated with the early adopters. Results: The menoci-based RDP allows for standardized documentation, sharing and cross-referencing of different data types, workflows, and scientific publications. Different modules have been implemented for specific data types and workflows, allowing for the enrichment of entries with specific metadata and linking to further relevant entries in different modules. Discussion: Taking the workflows and datasets of the frequently involved experimental service projects as a starting point for (meta-)data types to overcome irreproducibility of research data, results in increased benefits for researchers with minimized efforts. While the menoci-based RDP with its data models and metadata schema was originally developed in a cardiological context, it has been implemented and extended to other consortia at GÃűttingen Campus and beyond in different life science research areas.
