This article compares the conceptual and linguistic similarities between the curse formula of the Azatiwada inscription and the curse formula in 2 Kings 21.7, 13. The linguistic similarities between the two texts have been pointed out many times, but the difference in agency has not been explored. The grammatical similarity between the two accentuates the difference between Azatiwada’s claim of ownership and Yahweh’s claim of ownership. This article will also explore the subtle theological distinctions implicit in the two curse formulas.

Résumé :
In recent years, Danish museums have experienced ideological, political and structural changes. Simultaneously, a wave of name changes has swept over the field. From a branding perspective, the change and choice of new name can be understood as an attempt to stand out from the group of museums. Conversely, from an institutional perspective, the name change can be perceived as a way to claim membership of the transformed museum landscape. This paper presents a study of ten public museums that have all recently changed their names. Findings suggest that name change is employed as a means to claim category, territory but also distinctiveness. Further, the study reveals different practices regarding the use of the term “museum”, with practical implications for a museum name change as a way to communicate a balance between fitting in and standing out.

Résumé :
ObjectiveTo determine whether there was an increase in payments for neurologist-prescribed drugs, we performed a retrospective analysis of prescription claims in the Medicare Part D Prescriber Public Use Files from 2013 to 2017.MethodsWe included claims prescribed by providers with the taxonomy “neurology” and included drugs present in all 5 years. Drugs were designated in 2013 as generic (GEN), brand name only (BNO), and brand name prescribed even though a generic equivalent is available (BNGE). To observe payment trends, the percentage change in the per claim payment was compared between drug classes.ResultsWe included 520 drugs, of which 322 were GEN, 61 were BNO, and 137 were BNGE, representing 90,716,536 claims and generating payments of $26,654,750,720. While the number of claims from 2013 to 2017 increased only 7.6%, the total payment increased 50.4%. Adjusted for inflation, claim payments for GEN drug increased 0.6%, compared to significant increases in BNO and BNGE drugs of 42.4% and 45.0% (ptrend < 0.001). The percentage of overall GEN claims increased from 81.9% to 88.0%, BNO increased from 4.9% to 6.2%, and BNGE decreased from 13.3% to 5.8%. Neuroimmunology/multiple sclerosis drugs represented >50% of the total payments despite being only 4.3% of claims.ConclusionsPayments for neurologist-prescribed brand name, but not generic, drugs in Medicare Part D increased consistently and well above inflation from 2013 to 2017. Unless the overall trend stabilizes or is reversed or high cost-to-claim drugs are addressed, this trend will place an increasing burden on the neurologic Medicare budget.

The late 19th/early 20th century heralded a period in neurology when there was claim and counter claim about the founders of new reflex movements of the great toe. The cutaneous plantar reflex is undoubtedly one of the most important signs in clinical neurology, and there have been several methods described of eliciting this sign, each with its own eponymous name. This article reviews the background to these claims and the contribution of the various authors, to the discovery, clinical relevance and ease of eliciting reflex movements of the great toe.

Résumé :
The authors report the results of a laboratory experiment examining the effects of the meaningfulness of brand names on recall of advertising. The findings indicate that a brand name explicitly conveying a product benefit (e.g., PicturePerfect televisions) leads to higher recall of an advertised benefit claim consistent in meaning with the brand name compared with a nonsuggestive brand name (e.g., Emporium televisions). Conversely, a suggestive brand name leads to lower recall of a subsequently advertised benefit claim unrelated in product meaning (e.g., superior sound) compared with a nonsuggestive brand name. The authors discuss implications of these findings for marketers with respect to advertising strategies and the optimal use of meaningful brand names in building and managing brand equity.

Résumé :
Motor Vehicle Insurance claims form a substantial component of Non life insurance claims and it is also growing with increasing number of vehicles on roads. It is also desirable to have an idea of what will be the likely claim amount for the coming future (Monthly, Quarterly, Yearly) based on past claim data. If one looks at the claim amount one can make out that there will be few large claims compared to large number of average and below average claims. Thus the distributions of claims do not follow a Symmetric pattern which makes it difficult using normal Statistical analysis. The methodology followed to analyze such data is known as Extreme value Analysis. Extreme value analysis is a general name which covers (i) Generalised Extreme Value (GEV) (ii) Generalised Pareto Distribution (GPD). Basically these techniques can deal with non symmetric shape of the distribution which is close to reality. Normally one fits a generalised Extreme Value distribution (GEV)/Generalised Pareto Distribution (GPD) and using parameters of fitted distribution future, forecast of likely losses can be predicted. Second method of analyzing such data is using methodology of simulation. Here we fit a Poisson distribution for arrival of claims and weibull/pareto/Lognormal for claim amount. Using Monte Carlo Simulation one combines both the distributions for future prediction of claim amount. This paper shows a comparison of the above techniques on motor vehicle claims data.

This paper considers a by-claim risk model with constant interest rate in which the main claim and by-claim random vectors form a sequence of independent and identically distributed random pairs with each pair obeying some certain dependence or arbitrary dependence structure. Under the assumption of heavy-tailed claims, we derive some asymptotic formulas for ultimate ruin probability. Some simulation studies are also performed to check the accuracy of the obtained theoretical results via the crude Monte Carlo method.

Résumé :
As consumers walk through the grocery store they encounter a vast range of products. In this setting information printed on food packages play a role in consumer decision making. One way of influencing consumer behaviour is by using package panels where detailed communication claims can be placed. This study investigates the effect of package communication claims on propensity to switch brand through quantitative research design. Variations among consumer of private label brands versus consumers of name brands are also investigated. Results show that package communication claims have an effect on consumer propensity to switch brand, however there are differences depending on type of claims. Environmental packaging claims have a negative effect on propensity to switch while nutritional claims do not have a significant effect. Production process claims and product origin claims both have a positive effect on consumer propensity to switch and is thus more favourable for brands to use. Furthermore, package communication claims have a larger positive effect on propensity to switch among consumers of private label brands than among consumers of name brands. Since there is a lack of research in the area of package communication this thesis contribute by proving that packages have an effect on consumer behaviour and argues for further research in this area.

Résumé :
Comparative advertising is widely used in the U.S and much remains to be learnt about when comparative advertising is used with the two forms of verbal claim; factual and evaluative claim. An experimental design with the 2 forms of verbal content (factual vs evaluative) and the two forms of comparative advertisements (direct vs indirect) were examined to identify the form of verbal content and comparison that would be most persuasive. In measuring the persuasiveness, attitude towards the brand and purchase intention were included as dependable variables. Results show that there was no significant difference between the two types of verbal content and the two types of comparisons which indicate that any forms of verbal content under any form of comparative advertisements is equally persuasive.

Résumé :
When several parties are involved in a construction project are conflicts inevitable, and when one party feel that another party are not following their work according to the agreed contract, can they issue a claim. Claim management and causes of claims has been addressed by previous research, but there is lack of attention to study claim management specifically in EPC-projects. The purpose of this thesis is to shed some light on claim management and identify cause of change claims, specifically in the context of EPC-projects. A case study was conducted within an organisation that executes complex plant EPC-projects, where several parties are involved. This thesis has applied tools of root cause analysis in order to identify the causes of change claims, and conducted focus groups and semi-structured interviews to better understand problems associated with claim management and how the relationship between two parties affects claims. The thesis concludes that the most common root causes to sub-contractor change claims are related to design where not enough information for design input has been provided, or related to installation where sub-contractors issue change claims in order to fix conflicts caused by themselves. Other major root causes are related to insufficient instructions provided by the principal organisation or requests of changes by one party. The thesis also concludes that claims during plant installation are avoided since more time is required for settling an official claim. Poor documentation is a major reason why the settlement of official claims requires more time. Further does this thesis conclude that the relationship between two parties does not affect claims, and in contrast might the relationship benefit from claims if causes are treated properly.

A esta técnica é dado o nome de OCD, isto é, The One-Year Claim Development.
This report will arrive at a conclusion by explaining to the reader the basic reasoning behind splitting large claims as well as the most common methods for BI reserving. It is assumed that the reader has fundamental understanding of the insurance industry, motor insurance and BI, and the reserving process. It is necessary to explain the practices used by Portugal and other Liberty International countries to form an opinion of those practices by applying them to Portugal's claim information. Furthermore, the question of whether to split large claims or not will be thoroughly evaluated. Finally, there will be an aggregate suggestion as to the best splitting practice and reserving methodology specific for Liberty Seguros Portugal. To do this, several shocked scenarios will be simulated. Additional large claims will be introduced to the total incurred claims triangle and large claim count triangles. The one-year claim development (OCD) will then be compared using different reserving methodologies, the Chain Ladder Method, Cape Cod Method, and Benktander Method. The one-year claim development is measured by the change in the aggregate reserve ultimate between 2014 and 2015 (excluding the 2015 cohort for which no aggregate reserve ultimate was available in 2014). The standard deviation of each method's one-year uncertainty will be calculated by computing the OCD of each method under the three shocked scenarios. The technique that yields the lowest average of standard deviations, called the one-year sensitivity measure by the author, will be selected as the best approach for handling large claims.

Brock, Penohole. « Politics of reparations : unravelling the power relations in the Herero/Nama genocide reparations claims ». Master's thesis, Faculty of Humanities, 2019. http://hdl.handle.net/11427/31354.

Texte intégral
Résumé :
The Herero/Nama Genocide (1904-1908) under German colonialism in Namibia is the first genocide of the twentieth century and has stirred debates around reparations for historical injustices. Reparative Justice has evolved into a victim-centric pillar of justice, in which perpetrators are legally and morally obligated to pay reparations in its several forms to its victims, including material and symbolic reparations. This thesis is a case study of reparations claims for historical injustices, specifically colonial genocide and explores such claims as a political process. Firstly, defining victims of genocide is a political process in which colonial atrocities have been blanketed by a lawless cover, previously ignoring the rights of the former colonised. The acknowledgement of genocide victims is a not only a necessary step to claiming reparations, but is part of Reparative Justice in which the perpetrator recognises its victims, offers a formal apology and make amends to the victims’ satisfaction. The acknowledgement of the Herero and Nama as victims of genocide has taken over a century for the German government to admit. Secondly, reparations claims is a political process in which requests are demanded and/or negotiated between perpetrator and victim. Germany’s previous foreign policy avoided terms such as 'genocide’ and 'reparations’, which has been a form of colonial amnesia. Namibian actors cannot easily forget the weight of the genocide and have had to negotiate and demand overdue justice in the face of colonial amnesia. Victim groups often do not speak with one voice, as noted in the Herero group, which is divided into general two camps: the Riruako group and the Maherero group. Under Paramount Chief Riruako, and his successor Rukoro, the Ovaherero Traditional Authority (OTA) have made several reparations claims to Germany over the last three decades. The Namibian government has previously played an unsupportive role, due to Germany’s annual development aid, which has undermined the position of the Riruako group. However, Riruako’s Motion on the Ovaherero Genocide in 2006, was unanimously passed and requested that the Namibian government facilitates negotiations between Germany and representatives of the affected communities. The two governments have since entered formal negotiations on how to address the past, however this has been resented by the OTA and some reparations organisations, who argue that the Namibian government have taken the lead on negotiations, rather than facilitate them. Those participating in government negotiations are the Maherero group, and those who have refused to join is the Riruako group, who have lodged a lawsuit in 2017 against the German government for reparations. In 2015, the German government admitted that its shared history with Namibia involved genocide. However, this acknowledgement has transferred limited power to the Namibian actors who continue to be undermined as 'equal’ counterparts to the German government. The German government continue to negotiate on their terms of redress, and have claimed state immunity towards the lawsuit. Therefore, there are small traces of colonial amnesia in Germany’s conduct despite its recent change in foreign policy.

Résumé :
AbstractAquaponics is a technology that is part of the broader integrated agri-aquaculture systems discipline which seeks to combine animal and plant culture technologies to confer advantages and conserve nutrients and other biological and economic resources. It emerged in the USA in the early 1970s and has recently seen a resurgence, especially in Europe. Whilst aquaponics broadly combines recirculating fish culture with hydroponic plant production, the application of the term aquaponic is broad and many technologies claim use of the name. Combining fish culture with aquatic-based, terrestrial plant culture via aquaponics may be better defined via its nutrient resource sharing credentials. Aquaponics applies several principles including, but not limited to, efficient water use, efficient nutrient use, lowered or negated environmental impact and the application of biological and ecological approaches to agricultural fish and plant production. Water sources are important so that the nutrients required for fish and plant production are available and balanced, and system water chemistry is paramount to optimised fish and plant production. Systems may be configured in several ways, including those that are fully recirculating and those that are decoupled. Aquaponics importantly seeks to apply methods that provide technical, biological, chemical, environmental and economic advantages.

Résumé :
This chapter takes up the position of the infamous “angry black woman” by avoiding righteous, revisionist, or reactionary arguments about black women and anger and instead considering black women’s anger as critical posture. The argument neither begins nor ends with the stereotype, but with the supposition that representational discourse has been largely unable to account for anger as an aspect of black female subjectivity. The case is therefore made that anger is inherently bound up with the notion of claim for black women, and accounting for this interaction requires an interrogation into the most intimate of black female spaces. The chapter ultimately turns to a discussion of reality television, Claudia Rankine’s discussion of Serena Williams, and a brief analysis of Toni Morrison’s Sula.

Résumé :
This book concludes by considering the slogan that the democratic state acts in the name of citizens, arguing that there is a downside of this “naming.” It critiques this claim in relation to the negative space of injustice and the sanguine potential of democratic citizenship. It also examines the upside of living under a democratic state that credibly acts on citizens' behalf, along with the preliminary ingredients for an account of democratic patriotism. Finally, it discusses the idea of pride in the actions of one's country/representatives and compares it with two approaches to patriotism: the first treats the attitude as crudely associative and the second identifies patriotism as an attitude not directed at one's state or fellow citizens but as a pro-attitude toward a set of abstract principles.

Résumé :
This book explores three interlocking problems of the ethics of democracy, with the objective of solving them simultaneously: ethics of participation, ethics of belief, and ethics of delegation. Ordinary political morality holds that the denizens of a representative democracy—the electors and the elected—can bear responsibility for their shared terms of interaction. Because the citizens' primary mode of political agency is mediated, they are vulnerable to the charge of participating in the wrongdoing of another. The book considers the special agency relationship between citizens and representatives, the conditions under which injustice is committed in our name as citizens, and how we can void that relationship. Its central claim is that complicity is the professional hazard of democratic citizenship. This introduction provides an overview of the link between the liabilities of citizenship and the demands of citizenship, compares microdemocratic theory with macrodemocratic theory, and previews the chapters that follow.
