This article compares the conceptual and linguistic similarities between the curse formula of the Azatiwada inscription and the curse formula in 2 Kings 21.7, 13. The linguistic similarities between the two texts have been pointed out many times, but the difference in agency has not been explored. The grammatical similarity between the two accentuates the difference between Azatiwada’s claim of ownership and Yahweh’s claim of ownership. This article will also explore the subtle theological distinctions implicit in the two curse formulas.

In recent years, Danish museums have experienced ideological, political and structural changes. Simultaneously, a wave of name changes has swept over the field. From a branding perspective, the change and choice of new name can be understood as an attempt to stand out from the group of museums. Conversely, from an institutional perspective, the name change can be perceived as a way to claim membership of the transformed museum landscape. This paper presents a study of ten public museums that have all recently changed their names. Findings suggest that name change is employed as a means to claim category, territory but also distinctiveness. Further, the study reveals different practices regarding the use of the term “museum”, with practical implications for a museum name change as a way to communicate a balance between fitting in and standing out.

ObjectiveTo determine whether there was an increase in payments for neurologist-prescribed drugs, we performed a retrospective analysis of prescription claims in the Medicare Part D Prescriber Public Use Files from 2013 to 2017.MethodsWe included claims prescribed by providers with the taxonomy “neurology” and included drugs present in all 5 years. Drugs were designated in 2013 as generic (GEN), brand name only (BNO), and brand name prescribed even though a generic equivalent is available (BNGE). To observe payment trends, the percentage change in the per claim payment was compared between drug classes.ResultsWe included 520 drugs, of which 322 were GEN, 61 were BNO, and 137 were BNGE, representing 90,716,536 claims and generating payments of $26,654,750,720. While the number of claims from 2013 to 2017 increased only 7.6%, the total payment increased 50.4%. Adjusted for inflation, claim payments for GEN drug increased 0.6%, compared to significant increases in BNO and BNGE drugs of 42.4% and 45.0% (ptrend < 0.001). The percentage of overall GEN claims increased from 81.9% to 88.0%, BNO increased from 4.9% to 6.2%, and BNGE decreased from 13.3% to 5.8%. Neuroimmunology/multiple sclerosis drugs represented >50% of the total payments despite being only 4.3% of claims.ConclusionsPayments for neurologist-prescribed brand name, but not generic, drugs in Medicare Part D increased consistently and well above inflation from 2013 to 2017. Unless the overall trend stabilizes or is reversed or high cost-to-claim drugs are addressed, this trend will place an increasing burden on the neurologic Medicare budget.

The cutaneous plantar reflex is undoubtedly one of the most important signs in clinical neurology, and there have been several methods described of eliciting this sign, each with its own eponymous name. This article reviews the background to these claims and the contribution of the various authors, to the discovery, clinical relevance and ease of eliciting reflex movements of the great toe.

The authors report the results of a laboratory experiment examining the effects of the meaningfulness of brand names on recall of advertising. The findings indicate that a brand name explicitly conveying a product benefit (e.g., PicturePerfect televisions) leads to higher recall of an advertised benefit claim consistent in meaning with the brand name compared with a nonsuggestive brand name (e.g., Emporium televisions). Conversely, a suggestive brand name leads to lower recall of a subsequently advertised benefit claim unrelated in product meaning (e.g., superior sound) compared with a nonsuggestive brand name. The authors discuss implications of these findings for marketers with respect to advertising strategies and the optimal use of meaningful brand names in building and managing brand equity.

Motor Vehicle Insurance claims form a substantial component of Non life insurance claims and it is also growing with increasing number of vehicles on roads. It is also desirable to have an idea of what will be the likely claim amount for the coming future (Monthly, Quarterly, Yearly) based on past claim data. If one looks at the claim amount one can make out that there will be few large claims compared to large number of average and below average claims. Thus the distributions of claims do not follow a Symmetric pattern which makes it difficult using normal Statistical analysis. The methodology followed to analyze such data is known as Extreme value Analysis. Extreme value analysis is a general name which covers (i) Generalised Extreme Value (GEV) (ii) Generalised Pareto Distribution (GPD). Basically these techniques can deal with non symmetric shape of the distribution which is close to reality. Normally one fits a generalised Extreme Value distribution (GEV)/Generalised Pareto Distribution (GPD) and using parameters of fitted distribution future, forecast of likely losses can be predicted. Second method of analyzing such data is using methodology of simulation. Here we fit a Poisson distribution for arrival of claims and weibull/pareto/Lognormal for claim amount. Using Monte Carlo Simulation one combines both the distributions for future prediction of claim amount. This paper shows a comparison of the above techniques on motor vehicle claims data.

This paper considers a by-claim risk model with constant interest rate in which the main claim and by-claim random vectors form a sequence of independent and identically distributed random pairs with each pair obeying some certain dependence or arbitrary dependence structure. Under the assumption of heavy-tailed claims, we derive some asymptotic formulas for ultimate ruin probability. Some simulation studies are also performed to check the accuracy of the obtained theoretical results via the crude Monte Carlo method.

The birth story of Solomon is unique in the ancient Israelite historiography from the monarchic period. Though the birth name of the newborn child was “Solomon,” he received an additional name “Yedidyah.” The purpose of this name should be understood within three contexts: the immediate passage in 2 Samuel 12; the wider story regarding Solomon’s rise to power in 1 King 1–2; and comparable ancient Near Eastern texts that recount the claims of usurpers outside the royal line to a throne. The latter attempted to legitimize their kingship by introducing themselves as beloved or chosen by patron deities, occasionally taking a new throne-name to reflect their status vis-à-vis the god or gods. This historical and literary phenomenon is clearly reflected from Mesopotamian, Anatolian, Persian, and Egyptian writings of different periods. The discussion here reveals that in ancient Israel and in the surrounding cultures, both Semitic and non-Semitic, the method of self-legitimation by usurpers was to claim that they had divine legitimization.

Mining claim disputes in Québec generally arise either when more than one staker carries out simultaneous stakings on the ground or when one or more stakers, while disputing the validity of a claim already recorded, under The Mining Act, stake the same piece of ground. Applications for record that give rise to a dispute are referred to the Minister of Energy and Resources. He may in turn refer the case to the Mining Judge. If he chooses not to do so, an appeal of his decision, by the party whose claims are refused or cancelled, lies with the Mining Judge. Decisions of the Mining Judge may be appealed to the Court of Appeal. Provisions of The Mining Act relating to the method ot staking are compulsory and entail, for instance, that block staking is illegal and that staking must be done personally. If the staker of a recorded claim has not staked his claim according to the Act and has declared in his notice of staking that he followed the Act, then the claim was recorded under misrepresentation and may be cancelled. However, a limitation exists in favour of a third-party holder in good faith when the claim has been recorded in his name for a year. Under the doctrine of substantial compliance, the staker may depart from the staking provisions of the Act in varying degree according to circumstances requirements. Applications of the doctrine to various situations of fact include non substantial discrepancies as to the area of the claim or the location of posts. Disputes may also relate to forfeiture and the re-opening of the land to staking. One may also dispute his own claims in order to prevent others from eventually disputing them if the claims had not been initially well staked. In the adjudicating process, it is important for the staker to be present at the hearing lest the other party be favoured. Disputes have provided for a better understanding of the Act's staking provisions. However, some drawbacks of the system would warrant changes to the Act for purposes of efficacy.

When the Supreme Court in PLIVA v. Mensing determined that certain state tort law failure-to-warn claims against generic drug companies were pre-empted by federal drug regulations, the pronouncement was met with substantial criticism. In light of the Court's decision two years earlier in Wyeth v. Levine, where the Court allowed a similar claim against a brand-name drug manufacturer to proceed, many complained the resulting Levine-Mensing dichotomy created an arbitrary distinction between brand-name and generic drugs, allowing an injured patient's ability to recover to hinge solely on the happenstance of whether the individual had taken the brand-name or generic version. But, although Mensing cut back significantly on the ability of plaintiffs to make state law failure-to-warn claims against generic drug manufacturers, the case did not completely prohibit such claims. Instead, the Court banned only failure-to-warn claims premised on an argument that the generic drug company needed to change its label in order to meet state tort law duties. If plaintiffs can advance other theories independent of a formal label change, such as a failure to adequately warn a physician about a recent change to the drug's label, then they may still be able to proceed against generic drug manufacturers.

This article considers Derrida's reading of Walter Benjamin's ‘Critique of Violence’ in ‘Force of Law’ with particular reference to the claims Derrida makes in his controversial ‘Post-Scriptum’. The article focuses in particular on Derrida's claim – a claim situated within the context of a discourse on the ‘final solution’ – that the ‘Critique of Violence’ is too Heideggerian. This claim is explored in the article mainly through reading Heidegger's ‘Anaximander's Saying’ with the purpose of showing some affinities between his and Benjamin's notions of justice and also with respect to the importance both thinkers bestow on the purity of the name. Particular attention is paid to the notion of ‘divine violence’ and its ‘complicity’ with the ‘worst’ also in relation to the questions of the witness and the animal in Benjamin and Heidegger. The article insists on the importance of the theme of the singular witness in the thinking of justice and divine violence and opens up possible avenues for exploring Derrida's relation to Benjamin.

Health claims on food labels are used by food manufacturers to inform consumers about the health effects of a product, and such claims can have notable effects on consumer preferences. According to regulatory definitions, health claims can be either worded or presented as images, but it is not clear under which conditions an image on a food label should be considered a health claim. This question has important practical implications, as the use of health claims is strictly regulated. The objective of this study was to determine how commonly images of the heart are used on food labels, and to investigate consumers’ perceptions of products labelled with heart images, using different degrees of health relationships. Both a food supply study (N = 10,573 foods) and experiments with consumers (N = 1000) were performed in Slovenia. The use of heart imagery on food products was very common (9%). The consumer study was conducted using a web panel. Structure of the study population was comparable with Slovenian adult population (18–65 years), according to gender and age. The questionnaire was split into conjoint analysis with constructed elements, a choice-based task with real-life elements and a consumers’ association task. The experiments showed that a heart image as part of the brand name itself—without an additional (worded) health claim—did not cause most consumers to relate it to health. However, consumers tended to strongly relate an image of the heart as part of a brand with health benefits, where the image was accompanied by a worded health claim or if the heart image was designed specifically to imply health benefits. We can conclude that the use of heart images was very common on food products, but references to health were less common. Without a health-related context, heart images could not be considered as a health claim.

Some call it Addis Ababa. Others call it Finfinnee. That is the capital city of the Federal Democratic Republic of Ethiopia. “What’s in a name?” In fact, the name is at the centre of the row over the federal capital. Those who opt to refer the capital as Finfinnee claim that the capital belongs to the Oromo. Those that stick to the official name, Addis Ababa, reject the language of ownership. But this is not merely a fight over history. It is a constitutional politics that has gripped the federation. The debate over the Ethiopian capital brings to fore the question about the place of capital cities in multi-ethnic federations. Using the Ethiopian capital as a case study, this article investigates how capital cities can manage the tension between the accommodation of diverse communities and the indigeneity argument that is often used as a basis to claim ownership. The article argues that the mediation of tensions can be best addressed through the framework of intergovernmental cooperation.

Shī'ī scholars from Jabal 'Āmil, the hill-country which lies inland from Ṣaydā and Ṣūr in southern Lebanon, claim that theirs is the oldest of all Shī'ī communities. They attribute its foundation to Abū Dharr, a Companion of the Prophet and one of the first supporters of the claims of 'Alī to be his successor. He is said to have gone from Madīna to Damascus, and to have been exiled from there to the country districts of Bilād al-Shām, or Syria in the broader geographical sense. There is a mosque associated with his name in the village of Mays al-Jabal.

Human resource management (HRM) is an important source of competitive advantage. However, recent reports document that HRM, and in particular employee training, is less likely to occur in small firms. One possible remedy of special interest to small retailers is trade name franchise membership. Trade name franchises, or buying groups, claim to offer small firms advantages not otherwise realizable, including bulk buying discounts, brand name recognition and workforce training. We report results from our study of over 300 small and medium-sized hardware stores, which tested the effects of employee training and trade name franchise membership, on small firm performance. Trade name franchisees achieve higher mean performance; however, the contribution to performance made by franchisees’ training does not appear to be significantly better than that of independent stores.

The author provides a legislative history of the False Claims Act and discusses the potential impacts of the April 1993 amendments to the False Claims Act on the health care industry. The False Claims Act allows any private citizen with knowledge that a false claim had been submitted to the government for payment to bring a civil action in the name of the government to recover any damages suffered by the government. As an incentive, the person is entitled to a “bounty” plus costs. False claims in the health industry take three principal forms: nondelivery of services, delivery of unnecessary services, misrepresentation of services, charges, or costs. The author emphasizes that no specific intent to defraud is required. Items billed by a hospital in deliberate ignorance or reckless disregard for the truth or falsity of a bill are the only proof necessary.

This would help to create awareness about DPLs amongst healthcare providers thus encouraging the improvement of healthcare system.Methods: This cross sectional observational study was carried out at Department of Pharmacology, Medical College Baroda. DPLs were collected & critically analysed for consistency, accuracy, validity of the provided information as per WHO guidelines.Results: Out of total 616 DPLs collected, 371 satisfied the inclusion criteria. None of the DPL was fulfilling all criteria according to WHO guidelines. Most of DPLs were having information regarding; generic name / INN (98.39%), brand name (100%), amount of active ingredient per dosage (94.07%), approved therapeutic uses (84.91%), dosage form (91.37%) and name & address of manufacturers (91.91%). Of all the DPLs, information provided for safety parameters like; name of active ingredient known to cause problem (11.59%), dosage regimen (32.88%), side effects & drug reaction (14.56%), major drug interactions (14.02%) and precautions, contraindications and warning (14.29%) seemed to be grossly neglected. Total of 431 claims were evaluated, of which the most common type of claim was efficacy (55.45%). Relevant references to claims were present in (48.74%) DPLs. Total 203 references were evaluated from 371 DPLs, of which maximum reference were from journal article (74.38%).Conclusions: From this study, it was concluded that pharmaceutical companies didn’t follow the WHO guidelines for ethical drug promotion, thus failing to fulfil the rational promotion of drugs. Given the present findings physicians should be cautious about drawing conclusions regarding medicine based on DPLs provided by pharmaceutical companies.

AbstractThis article draws out the political implications of some of the avatars of ancient skepticism in modern fiction. It relies on Martha Nussbaum’s claim that fiction can provide some of the best lessons in moral philosophy to refute her claim that ancient skepticism was a bad influence on morals. It surveys references to skepticism from Shakespeare through such diverse writers as Isabel de Charrière, Herman Melville, Mark Twain, Anatole France, and Albert Camus down to recent writers such as Orhan Pamuk and Michel Houellebecq. The most substantial treatment is of Naguib Mahfouz’s Cairo Trilogy, which is interpreted in two ways: one, as an example of isosthenia or equipollence in arguments on both sides of questions about gender in the Islamic world, and two, as the biography of a person who claims to be a self-conscious skeptic. Skepticism emerges as a multi-faceted concept in modern literature, but there are definite references back to the ancient skeptics, including mention of the name Pyrrhonism and knowledge of the writings of Sextus Empiricus. The political implications militate against dogmatic claims to truth and knowledge of a one-dimensional justice.

The problem with the origin of the name of Tuman Monastery near Golubac has so far been addressed by several authors who have proposed several different solutions. This paper is an attempt to point out other aspects that should be examined using the available historical and linguistic material, which the previous researchers did not take into account. There were interpretations and etymological explanations proposed earlier, the assumptions about the name of the monastery based on the words from the ancient Greek or Latin and according to the same name of one Armenian monastery etc. Paying due respect to the preserved traditions of the foundation and the name of this monastery, we believe that in the discussion of its name it was necessary to refer to the possible Slavic origin of the name - especially in the light of the numerous existing parallels in the toponyms of the regions inhabited mainly by the Slavic people, as well as its Pre-Indo-European, or perhaps Asiatic, i.e. Mongolian-Tatar background. It is not known when the Tuman monastery got its present name. The first mention of the monastery in the village of Tuman near Golubac dates from the second half of the 16th century. A few Serbian authors claim that in Armenia there was/is a monastery of the same name, according to which the monastery of Tuman near Golubac was named. However, the existence of this monastery is not certain. It remains to be examined whether the toponym of St. Tuman, recorded in the areas of today?s Turkey which had been inhabited by the Arme?nians until the beginning of the 20th century, has any connection with the name of Tuman monastery near Golubac.

In a recent publication the name Solimonadaceae Losey et al. 2013 has been proposed as a replacement name for the family name Sinobacteraceae Zhou et al. 2008. This course of action contravenes the current Code governing the nomenclature of prokaryotes, making Solimonadaceae Losey et al. 2013 an illegitimate name that neither has claim to priority nor can be used as a correct name. In this paper, I attempt to clarify the ideas of equality underlying section 15 claims for benefits such as welfare and health care; I use the name ‘economic rights claims’ for these types of claims. I adopt Joseph Raz’s division of equality claims into rhetorical egalitarian claims, which are based in a failure to equally respect a universal claim (and typically take a form such as, ‘All Fs have a right to G’), and strict egalitarian claims, which are based on an actually existing unequal distribution of resources (and take the form, ‘All Fs who do not have G have a right to G if some Fs have G’). I show how the dignity-based approach to equality stemming from Law v. Canada is an example of a rhetorical egalitarian claim. With this groundwork set, I turn my attention to the economic rights claims. I survey three reasons for thinking that an unequal distribution of some benefit might, even absent any failure to respect or recognize the dignity of those at the losing end, be thought of as wrong or unjust. The first two reasons - an appeal to an idea of sufficiency, and the fear that some stigma might be associated with the inequality - I reject in favour of the third, which is that in a situation in which all the participants have some equal claim to a benefit, a fair procedure will result in their benefiting equally. Following John Rawls, I suggest that our society, as a cooperative venture for mutual advantage, creates in its members at least a prima facie equal claim to share in the society’s benefits. The economic rights claims, then, are claims that this prima facie equal claim has not been respected. But the benefits being claimed for, as benefits created by the society, are not benefits automatically due to everyone just in virtue of their humanity, instead they are due to the worst-off once the best off have come to be able to benefit from them. Thus they take a strict egalitarian form - once some members of our society benefit in a certain way, then the equality of all members as contributors to the cooperative venture for mutual advantage implies that the other members of our society gain a claim to that benefit. The fact that these economic rights claims are strict egalitarian claims means they cannot be grounded in arguments about dignity, as dignity-based claims are rhetorical egalitarian claims for benefits due to all in virtue of their universal human dignity. I conclude by returning to Law to highlight a passage which I believe provides a grounding for a recognition of economic rights in line with my argument; I also make some brief comments on the need for a stricter division of labour between section 15 and section 1 in the context of economic rights claims and on the effect of this argument on Canadian federal law more generally.

Why will the death penalty live on, even beyond its end? How should we understand this claim? And what are the implications of the death penalty's survival for any attempt to continue Derrida's on-going efforts to deconstruct sovereignty in the name of what he often calls ‘the unconditional’? I suggest that the survivability of the death penalty is a crucial element in Derrida's attempt to articulate a different abolitionism, an abolitionism that has parted ways with all certainty concerning the death penalty's ‘end’.

AbstractDespite their high frequency in present-day language, German proper name compounds have received little attention in the linguistic literature. It has been assumed that this pattern is rather recent, and possibly a loan from English. Focusing on the period between 1600 and 1900, the paper provides evidence against this claim. More specifically, I argue that the development of proper name compounds can only be properly described if proper name compounds that are names themselves (e. g., Martin-Luther-Universität ‘Martin Luther University’) are strictly distinguished from those that are common nouns (e. g., Nilfahrt ‘Nile ride’). It is shown that both types develop differently, and in particular that common noun compounds undergo a functional extension in this period. In this connection the paper also discusses the idea of proper name compounds as competitors of the genitive and it compares proper name compounds and alternative constructions with respect to the concept of the “Nominalklammer” (nominal frame).

Postmodemism's censure of metanarratives expresses a moral claim and moral concern about those who have spawned injustice in the name of Truth. Ironically, while this censure is an indictment against the historic failures of the Christian church, it is also a corroboration of Christian theology. On postmodernism, a moral claim must be understood either instrumentally (emotivism or prescriptivism) or ideally (subjectivism or intersubjectivism), and neither is adequate. Rather, the moral claim requires moral realism. Moral realism, however, is best explained by theism. While sharing many of postmodemism's moral concerns, theism—especially Christian theism—can best enable and satisfy these concerns, whereas postmodernism can only frustrate them. Thus, theism uniquely enables moral accountability, communication, and tolerance. Moreover, Christian theism, in virtue of the incarnation, crucifixion, and resurrection of Jesus, uniquely redeems moral concerns from futility and offers hope to those concerned for justice.

<p>This article discusses the thought of Abdulkarim Soroush on the relation between the truth claim of religious understanding and the emergence of religious authoritarianism. Truth claim can raise the tyranny of religion when there is an attempt at the ideologization of a religious understanding to political and power sphere. Some questions to be answered here include: why does religious truth claim emerge, and how does Soroush deconstruct religious truth claim? Why does Soroush reject the paradigm of religious ideologization, and how does he promote the democratization of the relation between religion and politics? This article reveals that religious truth claim emerge due to the absence of consciousness to distinguish between religious understanding which is temporal and profan and the very religion which is eternal and sacred. Attempts at ideologizing religion represent the lack of consciousness to distinguish between religion and politics, as this lack can degrade the divine value of religion to its worldly and human character. The ideologization of religion can result in tyranny in the name of religion, and accordingly give the monopoly of power to a certain religious understanding while rejecting others.</p>

In The Sources of Normativity, Christine Korsgaard affirms that Enlightenment morality is true: humanity is valuable. To many of us few claims seem more obvious. Yet Enlightenment thinkers such as Kant do not limit themselves to affirming that humanity is valuable. They appeal to reason in an effort to establish it. They try to show that, in some sense, we are rationally compelled to recognize the value of humanity. Korsgaard joins in this effort. She champions the claim that unless we take humanity to be valuable, we condemn ourselves to complete practical skepticism, i.e., to the view that we have no reason to do anything at all.Korsgaard discusses two arguments that, she believes, support this claim. The first she attributes directly to Kant in a series of influential papers on his ethics. The second argument, which she calls a ‘fancy new model’ of the first, she constructs under her own name in The Sources of Normativity. I will defend the view that neither of these arguments succeeds. In doing so, I will not be trying to show that we are mistaken in believing humanity to be valuable.

It was Joseph François Félix Babinski who became known worldwide for the sign that bears his name. In order to help Joseph in establishing his career, brother Henri gave up his aspirations and abandoned engineering. Clovis Vincent, ‘father’ of French neurosurgery and pupil of Joseph, stated: “Joseph Babinski lived for science, and Henri lived for his brother; without Henri Babinski, Joseph would not have accomplished that much”. However, Henri’s name became famous in all Paris for a cookbook Gastronomie Pratique written under the pseudonym of ‘Ali-Bab.’ Throughout Joseph’s career his surname remained distorted despite his own efforts to spell and pronounce it correctly. Several people can claim the name Babinski, but in neurology and neurosurgery there is only one, Joseph.

Augmented and virtual reality technology (e-REAL) reproduces a variety of different emergent situations, � enabling learners to interact with multimedia scenarios and practice using Name-Claim-Aim in a virtual environment. Subsequently, learners rapidly cycle between deliberate practice and directed feedback within a high-fidelity simulation scenario until mastery is achieved.So far, the early findings show that visualization, if linked in interactive ways to the learners, allows for the better use of the neural processes and for better learning and meaningful behavior change.Non-invasive technologies to monitor patterns of neural activity during the program delivery will be introduced.</p>
