In this essay I argue that Anthony Trollope's The Warden (1855) anticipates and problematizes Trollope's oft-cited representativeness of the Victorian period generally, and Victorian liberalism in particular. As JŸrgen Habermas has shown, Victorian liberalism should be construed less in terms of its promotion of pluralism than in terms of an"ambivalence" as to its practical implications. Correspondingly, The Warden offers a performative exemplification of Victorian liberalism that is instructive precisely because it paradoxically refuses definitively to represent it. The instruction I would draw from this paradox relates to the moral "pinch" that Septimus Harding, the novel's protagonist,feels as a result of his aspiration to "be right" as opposed to being "proved" right. This paradox disrupts the reader's reflexive inclination to read Harding's emancipation in traditionally Romantic terms. Just as Harding was "awoken" from the self-induced oblivion of a hegemonic morality, so too the reader is awoken from the self-induced oblivion of the disciplinary conventions of Victorian literary experience that D. A. Miller and David Lloyd critique. Thus the novel can be said to embody Victorian liberalism precisely to the extent that it illuminates the question of such embodiment as open, as a practical problem confronting and animating Victorian society. Hence Trollope makes Harding's imaginary cello-playing the medium or 'embodiment' of his"awakening": the pursuit of "right being" is a matter of "testing" the boundaries of political action and aesthetic imagination alike.

Despite the Government of India’s official recognition of “third gender” in 2014, the right to gender self-determination remains contested. Over one million transgender women in the country face discrimination and continue to live on the fringes of society. Discrimination and stigma force them to resort to prostitution, begging on city streets, and performing at village festivals. While transgender women are venerated during religious rituals and festivals, they are excluded from employment and higher education. This article outlines the cultural and social conditions facing the trans community in India, as well as the illiberal attitudes of society toward it, through the prism of visual analysis.

In current struggles over cultural hegemony, conservative and right-wing populist dis- course is marked by an omni-presence of topics related to gender and sexuality. This article examines the ways in which diverse actors of what will be called the ‘right-wing populist complex’ use gender in order to catapult a variety of arguments into the public sphere with particular focus on actors in the Americas and Germany. Suggest- ing a first set of Right-Wing Populist Patterns of Gendering1, the article pursues the question how seemingly emancipatory arguments function in right-wing discourse, especially in performing a modernisation paradigm, while simultaneously, and in of- ten paradoxical ways, promoting a program of re-traditionalisation. Therefore, often, gender arguments—like the sexual freedom of ‘autochtonous’ women—are used to justify anti-immigration and racist politics. One’s own society can thus be depicted as supposedly already fully emancipated in contrast to the alleged ‘backward’ social order of immigrants. Through this ethno-sexist twist, the article argues that gender provides right-wing populist discourse a useful tool for affectively bridging seemingly paradoxical arguments and transferring diverse social hierarchies shaped by late neo- liberalism onto the gender hierarchy of a society. Since gender as a discursive element is foundational for right-wing discourse, an analytical, systematic and intersectional gender lens—or a critical gender theory—is crucial in right-wing populism research in order to grasp patterns of gendering and their entanglements with racialisation and racist structures.

Police in a democratic society is a service of the citizens. Its main tasks are the maintenance of public order and peace, the direct protection of human rights of citizens, the prevention of criminal acts and the fight against crime. As a service of the citizens, the police is obliged to respect human rights while performing the activities within its competence. The police have a dual role in securing human rights. On the one hand, it is obliged to protect human rights. On the other hand, when taking police powers, it should be extremely careful and not allow human rights to be endangered by exceed police powers.The powers of the Macedonian police in the performance of the activities under its competence are prescribed by the Law on Internal Affairs and the Law on Police. They are numerous. Among them are the use of firearms and other means of coercion. In addition, it has the right to examine citizens, the right to detention and deprivation of liberty. These and other powers of the police are always followed by a latent danger of being exceeded and thus, human rights to be harmed.The paper deal protection of human rights in cases of exceed police powers such as unlawful and unprofessional conduct, offensive and degrading behavior, harassment, excessive use of force with elements of torture, brutal behavior, bodily injuries, etc. In addition, the paper includes mechanisms for prevention of overstepping of police powers from the aspect of human rights protection.

Despite the fact that the Constitution explicitly protects the right to freedom of scientific research, this right features neither in the preamble to any legislation, nor in any reported case law. If the right to freedom of scientific research remains in obscurity, South Africa could slip into totalitarian control of the scientific enterprise, to the detriment not only of scientists, but also of society in general. The right to freedom of scientific research should play a more central role in policy-making. This is not only because it is an enumerated constitutional right, but also because it is important in its own right, as it serves purposes that are at the core of our constitutional value-system: promoting individual autonomy, facilitating the search for truth, and supporting democracy. The right to freedom of scientific research is unique in protecting not only the exchange of scientific thoughts and information, but also in particular the physical activities entailed by scientific research, such as performing experiments. The notion that government should somehow seek to regulate every new scientific development is erroneous, as freedom should be the default position in science-related policy, and should only be limited by regulation if, and to the extent that, it is constitutionally justified.

Humans require fundings in fulfilling their needs in life, such as primary, secondary, and tertiary necessities. Funds are used for some purposes such as venture development, working capital, investment, etc. In accordance to the function of bank which is to gather and distribute fundings to the society, banks may distribute such fundings in the form of loan. The granting of loan from banks as creditors is written in a loan agreement document. In fact, there will always be risk of non performing loan, which lead to the process of Cession, to shift the creditor’s right to claim debt payment, from Bank (as Assignor) to a new creditor (as Assignee). Repeated process in assigning right to claim receivables may cause loss to the Assignee, and the right of the Asignee has to be protected by the law. The method used in this study is the juridical normative method on a descriptive analytical nature. The study also uses statue approach and conceptual approach. The aims of this research is to have further review and analysis, about how Indonesian legal system regulates the settlement of credit, related with cession / assignment, which has been done more than once. The conclusion that can be drawn is: Cession is a legal action which causes a main legal consequences, that is shifted right to claim payment of debt, from first creditor to the new creditor. Debtor still have obligation to pay the debt, but now to the new creditor. In fact, cession is done because the first creditor consider several conditions in the debtor, that makes the debt potentially unpaid. The new creditor has to consider and understand the risks before signing cession agreement. Repeated cession has no clear regulation in Indonesia, but it’s commonly done by bankers and credit practicioners. This research sugests: government should issue regulation regarding the implementation of repeated cession, in order to protect the rights of the last Assignee. For bankers and credit practicioners, repeated cession should not be considered as recommended way to solve non-performing loans.

AbstractThe paper analyses the current Slovenian political and economic situation through interpretations of old socialist regime’s modernisation. Right after the Yugoslavian disintegration, namely in the beginning of transition, the Slovenian starting position was the best, compared to other Yugoslavian countries and among other transitional countries. Between 1990/1991 and 2008 Slovenia seemed to be a politically more or less stable and economically well performing country. But after 2008 a negative trend hit the whole society, causing political instabilities and economic stagnation, reflected in negative macroeconomic indicators (i.e. GDP, GDP p.c. FDIs, unemployment, government debt, etc.). Could such a situation be explained on the basis of a long lasting socialist regime? If these suppositions are to be confirming, why do other transitional countries, which were subjected to a tougher communist regime, seem to be performing better nowadays?

Chapter 2 explores how the shift to an unpredictable, urban wage economy left many families unable to care for or make use of “idiotic” relatives who might be only partly productive. Complicating matters, charity policies intended to prevent public dependency—scientific charity programs and efforts to separate diverse poorhouse residents into specialized institutions—increasingly selected pupils who had no home to which they could return. In response to this rapidly increasing and permanent population, asylum directors allied with proto-eugenicists such as Josephine Shaw Lowell to convince lawmakers to fund dedicated custodial asylums for “feeble-minded” people. In these institutions, inmates’ labors no longer led to discharge. Instead, perceived abilities determined every facet of life, from institutional conditions to inmates’ likelihood of dying shortly after arrival, and often in perverse ways. Despite being depicted by superintendents as unemployable in mainstream society, “feeble-minded” women who were institutionally productive were much less likely to be discharged and remained for decades, performing vast amounts of unpaid care work that defrayed much of the costs of these custodial asylums. Nonetheless, for some inmates, their toils offered some meaning and a small measure of control over their lives.

This chapter studies community engagement policies in the era of populism in Finland. Finland, although performing excellently in international comparisons of social cohesion, has seen the steepest decrease in the level of trust in the government among all the Organisation for Economic Co-operation and Development (OECD) countries during the past decade. At the same time, right-wing populist rhetoric has strengthened and the populist movement has established its support in the political spectrum. To transform Finnish democracy, participatory programmes have been created in order to reach out and engage different groups to join community development practices. These efforts stem both from the public authorities and the renewed Finnish Local Government Act of 2017, as well as from projects undertaken by civil society organisations (CSOs). Further, there is a long tradition of building civil society in Finland, which has often been based on the unique Finnish liberal adult education system. Yet growing inequality is currently deepening the polarisation in political participation. The chapter then explores the ways of countering the polarisation and populism by supporting the political capabilities of communities and nurturing deliberative discussion.

Chapter 3 of Performing Music Research explores the guiding principles on which ethical codes are based. These can be summarized as follows: people should not be harmed, nor their rights and dignity compromised, and research must be of scientific value and carried out with integrity. These issues must be considered and addressed in the earliest stages of research and in light of the potential benefits of the findings of the research to society. The chapter reflects on the philosophical underpinnings of ethical research and outlines the process whereby ethical approval is typically sought and obtained, with reference to a selection of codes of research ethics published by professional associations and regulatory bodies that guide and inform research activity.

The six eastern partners of the European Union (EU) (Armenia, Azerbaijan, Belarus, Georgia, Moldova, and Ukraine) are states with which the EU aims to establish value-based relations without offering membership perspective. The EU uses its economic strength and attraction as far as visa-free access to EU territory to persuade the six states to stay on the orbit of the EU. However, the EU has limited means of conditionality and it remains questionable what it can achieve with its socialisation. The six partners are in different position as far as their readiness to share western norms and values and follow them. Problems start when the expectations of the EU require major adjustments in the partner’s society, like the introduction of effective anti-corruption measures, guaranteeing judicial independence, providing for a vibrant civil society, fostering a pluralistic and independent media, and achieving good governance. Even the best performing partners face some difficulty in one area or other whereas declaratory human rights policy is not an issue for any as they all belong to various arrangements (Organization for Security and Cooperation in Europe (OSCE), Council of Europe, United Nations) that contain similar requirements. That is why norms and political reality are not congruent that will cause problems for the EU in the relationship for the future. It will continue to face hesitant implementation of human rights commitments by those that lag behind and push for EU membership by the best performing eastern partners.

« was seen (as he often still is) as characteristically ‘heavy’, boring and lacking in a sense of humour, or at least irony – in fact the kind of playwright he himself deplored in his own, rational theatre. Furthermore, he was a Marxist and thus his ideas were (and are) unlikely to be suited to the mainly bourgeois institution of British theatre and theatregoers. Since Brecht’s ideology has so often been a barrier to a full appreciation of his work in Britain, and consequently appears regularly in this book, it is worth briefly spelling out here the basis and implications of his political beliefs. Brecht’s commitment to the classic Marxist tradition of ‘dialectical materialism’ (the idea that the individual is created by socio-political and economic factors and is, therefore, able to change his circumstances and environment) provided a ‘legitimacy’ (in his view at least) for an interventionist form of theatre. Brecht’s ‘discovery’ of Marxism (in 1928/9) confirmed his already well-developed idea that theatre should have a social function. As he said, he ‘had written a whole pile of Marxist plays without knowing it’ (Völker, 1979, p. 110). His ‘epic theatre’ was based on the concept of the primary importance of production in social life and it was intended to demonstrate socialism as the constant revolutionising of the forces and relations within the processes of production. Brecht often spoke of his form of theatre as one designed to make a contribution to ‘the full unfettering of everybody’s productivity’ (Suvin, 1984, p.20). He would admit, however, that in order for epic theatre to work fully, the actors involved in the production needed to share a Marxist view of the world. Certainly many theatre critics and historians would agree that without a knowledge of Marxist philosophy and aesthetics, it is virtually impossible to grasp the full meaning of Brecht’s plays. For example, Marxist philosophy is fundamental to Brecht’s dramaturgical exploration of the relationship between the individual and society. As a playwright, he builds up a complex framework of social, political, economic, historical and personal factors, which determine the character as an individual ; his phrase for this is ‘statistical causality’. This approach to characterisation enables Brecht to demonstrate through his plays a wider range of possibilities for human behaviour than is the case with more ‘naturalistic’, psychologically-based drama. Brecht’s politics have, of course, been used frequently against him – as a reason for rejecting his artistic achievements, and as a ‘stick’ with which to beat him and expose the apparent hypocrisy in his personal behaviour. His detractors often draw attention to the fact that he never actually joined the Communist Party and that, after returning to East Berlin in 1949, he obtained an Austrian passport (1950), gave exclusive publishing rights to his writing to a West German publisher, and maintained a Swiss bank account. Equally notably, Brecht even refused to sign a binding contract with his own company, the Berliner Ensemble, until 1953, when he signed a form of ‘open’ agreement. Knowledge is the act of having a concept of something. It includes descriptions, assumptions, and theories. Knowledge Management is about making the right knowledge available to the right people. A Brazilian university made its own pathway to manage the knowledge generated inside the academia favoring the market needs, showing that an organization can learn and use its knowledge in businesses applications, creating competitive advantage, regarding innovation, for the productive sector. An understanding of the market and society's demands enabled the development of products, technologies, and services with high added-value in line with solutions to challenges faced by businesses. A Brazilian startup made the “interaction” between market and academia allowing interest increase of productive sector in performing projects in partnership with research and technology institutes. Both successful cases in this chapter ensure the importance of knowledge, project, and technology management processes conferring innovative technological and market advantages to small companies and big industries.

This chapter takes a dual focus/lens to applying and performing research methods in inclusive and special education in a tertiary/post-secondary setting with a group of students with dyslexia. It links the core ideas of United Nations Convention on the rights of persons with disabilities Article 24, Inclusive Education to describing the development and implementation of a co-constructed, collaborative project to identify success strategies for students with dyslexia, utilizing both student and teacher perspectives and experiences, and examines the fit of utilizing ethnographic approaches in this. As practitioner –researchers, authors provide a narrative case study of a project which was developed/co-constructed to respond to a set of identified needs for a group of students presenting with dyslexia. Authors then examine how the project practices link to research methodology, particularly ethnography, and produce both a set of strategies to work inclusively in the future with students with dyslexia and also construct a methodological approach within the lens of new ethnography. This serves to theories both the project work and guidelines for future use of ethnographic approaches for research in the field of inclusive and special education.

Deciding whether or not two images are of the same unfamiliar face is an important task in many professions. These decisions are a critical part of modern identity verification processes with direct—and often profound—consequences for individual rights and the security of society. As a result, the public expect the people entrusted with these decisions to perform accurately. But do they? Here we review 29 published tests comparing face matching accuracy in professional and novice groups. Twelve of these tests show no significant differences between professional and novice groups, suggesting that merely performing the task in daily work is not sufficient to improve accuracy. However, specialist groups of facial examiners and police super-recognizers consistently outperform novices. Staff selection, mentorship, deliberate practice, motivation, feedback and training may all contribute to enhancing the performance of individuals working in these groups, and future research is necessary to delineate their relative contributions.

The developed society depends on many critical infrastructure processes, such as power generation, water treatment, many types of manufacturing, and smart buildings. These processes need control and the automation industry has embraced the Internet to connect all these controls. However, the controlling devices thus opened to the world do not always have adequate safeguards to withstand malicious users. Many automation systems have default passwords or known and unknown backdoors. Also, often those systems are not updated to close security weaknesses found after original installation. The authors argue that while the industry is familiar with the notion of safety of equipment and processes, it has not focused enough on IT security. Several years ago the Shodan search engine showed how easy it is to find these control devices on the Internet. The authors followed this research line further by targeting one nation's IP address space with Shodan and found thousands of control systems, many of which represent models and versions with known vulnerabilities. Their first contribution is presenting these findings and analyzing their significance. Their study started in 2012 and the most recent results are from the end of 2015. To gain further knowledge, they have built a prototype scanner capable of finding industrial control systems. This lets the authors evaluate the possibility of performing routine scans to gauge the vulnerability of a nation. Their second contribution is to present a template for a national Internet scanning program. The authors discuss the technology, performance, and legality of such a program. Based on their findings and analysis they argue that nations should continuously monitor their own Internet address space for vulnerabilities. The authors' findings indicate that the current level of vulnerabilities is significant and unacceptable. Scanning a nation's critical infrastructure can be done in minutes, allowing them to keep a tight control of vulnerabilities. Yet, in addition, the authors need to extend current legislation and the rights of government officials to bring more security in national critical infrastructures; this discussion is their third contribution. The cyber-space has become a playing field for criminals, terrorists and nation states, all of which may have a motive to disrupt the daily life of a nation, and currently causing such disruptions is too easy.

The quality of life in the urban system is closely associated with environmental conditions. With the right use of design tools, it is possible to solve the environmental problems of youth through the impact of landscape design on human opinion. Such landscaping areas as territories of memorable historical places must be complied with the modern requirements of society to preserve historical memory. It is discussed in the article the issues of solving problems to improve the factors of the urban environment that have a positive impact on maintaining intergenerational ties. The relevance of the project "Living memory of the Great Victory: for the glory of life, unity and the future" is grounded on the beautification and landscape design of Armavir. It is described a new ecological landscape approach to the planting of greenery and improvement of memorial complexes, based on the creation of a natural, relatively sustainable ecosystem. It is described the concept of laying park sites, performing cognitive, patriotic, informational, and environmental functions. The proposed style of memorial park territories supports the general historical and local history orientation of the territory in the design and improvement of urban areas with minimal resources for planting red oaks, based on the independent cultivation of seedlings from acorns. Ecological and patriotic project is aimed at creating and maintaining a sustainable landscape structure.
