Abstract The multiple ongoing reform processes of investment law and investor-State dispute settlement (ISDS) opened the space to reconsider the default reliance on investment arbitration and to reimagine the role of dispute prevention and amicable settlement mechanisms in this space. Such mechanisms entail several benefits for States, including cost and time efficiency, more leverage and control in the course and outcome of disputes, and the restoration of trust in ISDS more broadly. Dispute prevention mechanisms and mediation have emerged as viable reform options, gaining growing support from States (including the EU and its Member States), investors, and international organizations (UNCITRAL, the World Bank Group, etc.) alike. While dispute prevention mechanisms take different shapes and forms in different countries, amicable settlement (including negotiations, conciliation and mediation) has been available in international investment treaties for decades, in the so-called “cooling-off” period. Nevertheless, it has not been effectively used in ISDS, due to a variety of factors, ranging from the preference for third-party adjudication, motivated by the desire of the competent authorities to avoid personal liability resulting from settlements with foreign investors, and/or a lack of capacities. The Western Balkans governments, navigating the ISDS reform process, while progressing on their path to EU accession, are a good case study for the challenges and opportunities of integrating dispute prevention and mediation into the State toolbox for investment dispute resolution. This chapter will address the regional and international, as well as legal and institutional frameworks for dispute prevention and mediation, the obstacles and challenges in the Western Balkans, and the emerging new structures and best practices, which establish a promising model for the region, with tailored solutions for each State. The chapter will offer perspectives for dispute prevention and mediation as staples of the investment protection frameworks in the Western Balkans on their path to the EU, and as future EU Member States.

AbstractIn the last chapter, the authors take stock of the challenges which are besetting the European Union’s (EU) internal and external borders from the perspective of contemporary events and crises, and evaluate them in the context of a changing international environment. They consider what can be learned from past experiences concerning the internal borders which in the last decades were lifted only to be reinstated again, and the hardening of the EU’s external borders in order to keep unwanted pressure from irregular immigration at bay while facing off hybrid security threats, terrorism and organized crime. The chapter analyzes the geopolitical shift from the perspective of the EU’s quest to protect internal policy progress, such as the greening of the economy, against political actors which challenge the principles of the rules-based international order. The chapter concludes by discussing the implications of the war in Ukraine on the European security architecture, and the prospect of a future enlargement to Ukraine, Moldova, and the candidate countries on the Balkan Peninsula.

AbstractThere is no doubt that, due to the global nature of modern ICT networks, international cooperation plays a key role in ensuring cybersecurity, including in the fight against cybercrime.This chapter describes initiatives taken within international organizations to ensure cybersecurity and the prevention of cybercrime. The presentation will start with the initiatives of the OECD and the Council of Europe. This is due not only to some kind of “Eurocentrism” but above all to the fact that these two organisations were the first to address cybersecurity and cybercrime issues. In addition, the Council of Europe Convention 185 on CyberCrime of November the 23rd, 2001, an international agreement concluded in the Council of Europe, is a milestone in the prevention of computer crime, remaining the only binding act of international law to combat it. Its importance is best demonstrated by the constantly growing number of signatories (and countries that model without signatures after the provisions, e.g. Pakistan) and the fact that international organisations, or recommend that their members accept (UN, G7/G8, European Union) or “copy” provisions, creating their own model legal acts (e.g. Commonwealth).

Former Soviet Union (FSU) SuperCourse is created in the frame of Supercourse project &amp;ndash; online library of lectures in public health, epidemiology and Internet &amp;ndash; www.pitt.edu/~super1. Education and information sharing is paramount to preventing all forms of diseases and conditions. The Supercourse Team asserts that the Internet provides a powerful and inexpensive tool for the improvement of health as well protection from disasters. To date, more than 500 public health workers from all 15 FSU countries have participated to integrate Internet-based education into prevention of all form of diseases and terrorism/bioterrorism. FSU Supercourse is collaboration of FSU scientists involved in prevention and the Internet for creation of Russian language library of lectures. The main topics of presentations include global health, information security, non-communicable diseases, infectious diseases, disaster medicine, disaster preparedness and mitigation. The training in the area of prevention and Internet-Prevention (I-Prevention) is the primary goal of the collaboration. We started development of FSU Supercourse at the beginning of 2000 as a part of Drs.Shubnikov and Troufanov&amp;rsquo;s fellowship at the University of Pittsburgh. The number of Internet users in Russia reached 2 million people in 2000. By the end of year 2006 the number of Internet users in Russia reached 21% of total population (about 30 million people). The fast growing of Internet users is big advantages for Internet based programs, but the number of Internet users in Russia still lower compare with European countries (more than 50%). Recently, we introduced a Russian language Supercourse web site at http://www.supercourse.pochta.ru/. More than 250 lectures translated into Russian language already available, including lecture by Dr.Noji on Public Health Disaster Consequences of Disasters. Creation and development of country or language specific libraries of lectures and development of scientific networks as FSU Supercourse, is a tool for education and improving global health including prevention of biological threats and pandemics. Our FSU Supercourse may become a backbone for other health and science projects in FSU countries.

Muslim immigrants present heterogeneous characteristics across EU countries implying the existence of diverse instances entailing radicalization cases and related risks which require modern policy capacities. EU Muslim immigrants, in particular youth, might be misled by radicalized messages deriving from current jihadist view of religious tenets. EU born immigrants (hence not belonging to first generation immigrants) are particularly exposed and vulnerable to the influence of vengeful purposes against Western societies. Some terrorist plots discovered in EU confirm this trend. Interestingly, effective actions carried out for counter-radicalization purposes are the chance for promoting equal opportunities, social integration and educational policies further than preventing terrorist organization proliferation. The identification of a common EU vision regarding terrorism-related matters borne by immigration and radicalization of Islam doctrine is the audacious commitment undertaken by relevant authorities in the course of recent years. The cultural power of the distorted and insane messages grounding on violent extremism and radicalization represents a strategic modus operandi for the proliferation of terrorist purposes. A comprehensive engagement for the development of policies and actions tailored for countering the misleading drift of religious tenets towards terrorism has to rely on an updated debate and open discussion among practitioners, academicians, policy-makers and lawenforcement actors.

The paper presents the European Union Directive 2018/1673 on combating money laundering through criminal law. The goal of this international document is the harmonization of criminal law in the European countries in order to form a unique strategy to combat money laundering. Since the current Law on Prevention of Money Laundering and Financing of Terrorism, as amended, is harmonized with the so-called The fifth directive of the European Union, we will first give an overview of the key features of the directives that preceded Directive 2018/1673 and then make a comparison of the international document in question with relevant provisions in the current Criminal Code of Serbia and the Law on Prevention of Money Laundering. It was established that the Serbian Criminal Code adopted the largest number of European recommendations.
