Testo completoBilateral fisheries agreements between the European Union (EU) and third countries have always been a feature of the Common Fisheries Policy (CFP). The 2002 reform of the CFP introduced the concept of partnership, to emphasize the EU’s intention to support the development of the national fisheries sector in its partner countries. Since 2004, they have been known as Fisheries partnership agreements (FPAs). Underpinning the partnership approach is the EU’s commitment to promote responsible and sustainable fisheries wherever European vessels fish throughout the world. Mainly signed with African countries (and also with States in the Pacific Ocean and Greenland), they are cooperation tools designed to build sustainable development in fisheries access agreements in order to enhance fisheries management. After few years of practice of the FPAs, and by the yardstick of their reform, within the reform of the CFP, it is time for evaluation. It should be assessed whether or not they fulfilled their objectives and if they indeed contributed to the implementation of more responsible behaviours in fishing activities in third countries

Testo completoEstablished in 2015, the Emotion Imbued Choice (EIC; Lerner et al., 2015) explains how emotions influence decision making. According to this model, incidental emotions (not related to the decision) associated with a high degree of certainty would trigger a heuristic information processing (Tiedens & Linton, 2001). In contrast, incidental emotions associated with a high level of uncertainty would trigger a deliberative information processing. This would explain the difference in performance on decision-making task.The influence of incidental emotions has been studied in one-shot decision and sequential decision making (i.e., sequence of decisions). While the EIC provides a clear and powerful framework for one-shot decision, its predictions are less explicit for sequential decision making. The particularity of this type of decision is that each decision is followed by a feedback (gain or loss) with an emotional cue (positive vs. negative). This integral source (related to the decision) of emotional influence can modify the subsequent decisions. Researchers have observed that the initiation of a heuristic processing leads participants to make more advantageous decisions than the initiation of a deliberative ones (Bagneux et al., 2012; Bagneux et al., 2013; Bollon & Bagneux, 2013). However, the impact of the processing of the emotional cue associated with feedbacks in obtaining this pattern of result has not yet been directly confirmed.Our objective was to identify how incidental emotions, based on their degree of certainty, modulate sequential decision making. Through a series of seven experiments, we have shown how incidental emotions interact with integral influence of feedbacks. Only the initiation of a heuristic processing leads participants to modulate their decisions according to the type of feedbacks received (positive vs. negative). These results concern both risky and ambiguous sequential decision making. The modulation of decision making has been highlighted, in a classic way, when inducing incidental negative emotions and, in a more original way, when inducing incidental positive emotions. The analysis of the results and the literature reveal difficulties in terms of the reliability of the measurement of the degree of certainty. A series of six other studies, in the general methodology of scale construction, investigated the origin of these difficulties. We have shown that these difficulties are the double consequence of an incomplete definition and an imperfect operationalization of the certainty appraisal dimension. From a theoretical level, we propose that all of our results support the need to extend the EIC to sequential decision making. From a methodological level, our results justify the interest of developing a new tool to measure the degree of certainty

Testo completoThis Ph. D analyses the way in which the concepts of health and autonomy are articulated in a given clinical practice, that of internal medicine in hospital care departments. It does so particularly in the context of medical decision-making and in the “travail du soin”, a phrase we may translate into English as “care endeavour”. The aim is to show how through its position in the hospital context, its field of application and the global and holistic approach it claims for, internal medicine pays particular attention to the clinical problems it faces and gives the possibility to grasp them in their different dimensions. Based on a work of reconstruction of the history of internal medicine and its theoretical referents from the analysis of its speeches, a conceptual analysis of the categories of autonomy, health and decision, and observations made in internal medicine department, this Ph. D focuses on a certain number of complex situations, that involve polypathological condition or comorbidities. They crystallise the difficulties linked to autonomy as a moral value and to the application, in the context of care and decision-making, of the "principle of autonomy". They also question the "functional autonomy" erected as a standard of care, and apprehended as the opposite of dependency. It appears that different senses of autonomy intertwine in the care given to the situations of polypathology and comorbidities and in the decisions that concern them : the concern for functional autonomy, the consideration for social autonomy and for an inclusion in a network of support and formal and informal care, as well as issues of self-determination and crucial life choices. Besides, these different senses of autonomy intertwine with health considerations. This situations lead us to consider different forms of health and autonomy, which take into account the various forms of dependency that allow a sick person to preserve what will be designated in this work as a certain “latitude of life”. The latter includes a certain “latitude” in the decisions made about them. At stake in this work is the attempt to adopt a positive concept of health – distinct from its conception as the absence of disease ; a concept that also allows to consider autonomy in various ways. This « health » must be something we can take care of, even in situations of long-term pathological condition. On the basis of the conceptions of health states and pathological states of Kurt Goldstein and Georges Canguilhem we examine in this Ph. D., we finally develop the idea of a form of health that is understood as a "certain latitude of life", a life latitude likely to remain despite the restrictions, deficits, dependencies induced by the disease and to be aroused, maintained and restored through care and support relationships

Testo completoThe end-of-life (EOL) decision-making process remains a particular event that confronts health care teams with their doubts and uncertainties. Indeed, for such a decision to made, there must be some doubt and uncertainty, otherwise, instead of being a conscious “decision”, it becomes a simple application of prior knowledge. EOL decisions are not simply a case of the decision-maker overcoming his or her indecisiveness. In this work, I examine the role of the doctor as an arbitrator in the conflict between the certain and the uncertain in EOL situations in the neonatal period. I have based my work on the analysis of the trajectories of six clinical observations drawn from my own experience, which illustrate, better than a long speech, the notion of the certain and the uncertain, and give these abstract concepts a concrete and practical meaning.To explore the notion of the uncertain during the decision-making process in EOL situations, is to accept to go against the dominant medical culture that values certainty, because uncertainty is negatively perceived amongst caregivers. However, doubt can have a beneficial effect on the decision-making process itself, and on the consequences of the decision taken, since it encourages discussion between caregivers and allows time for decision-making. Thus, he or she who doubts is not ignorant, but cautious in the Aristotelian sense, when trying to deliberate a choice by subjecting it to the criticism of others as part of a procedure of collegial reflection.In this work, I also show that doubt and uncertainty compel the decision-maker to confront his or her personal convictions, which constitutes ethical ethics, with his or her responsibility, which is teleological ethics. It is only in the tension between these two ethics that the caregiver can decide with peace of mind

Testo completoUpon his arrival in Paris, G. W. Leibniz met many scientists. Through discussions and debates with them, he acquired knowledge of mathematics. We have focused here on his work in arithmetic, which in 1672 is dominated to a large extent, by a branched Diophantine problem that requires a significant use of algebra to be solved. While some credible studies have been published on this problem we’ve aimed at trying to go further than a mere description of failed attempts at solving this problem, known as the “sixsquare problem”. We have sought to show that Leibniz engaged in depth with this subject. Based on mathematical studies published by the Berlin Academy of Sciences, we have conducted parallel research on numbers by Leibniz, stemming from these attempts. By studying the correspondences of scholars from the late 17th century, we have been able to illustrate advances in the resolution of the problem, and we have also used them to show the way Leibniz gradually came to neglect the problem as found new ways to work in arithmetic. As a result, this study proposes a reinterpretation of the way the six-square problem was constructed by its creator, Jacques Ozanam. We’ve also insisted on the fact that the resolution was closely linked to two elements, one mathematical, the other historical, which Leibniz did not master: algebraic squaring methods and the preparation of a book by Ozanam, Diophante. These two factors set Leibniz back, and sharpened his dedication to his goal as soon as he succeeded in finding, in the burdensome factorization and development theories he had developed for the six-square problem, some properties of the divisibility of numbers. Finally, we have endeavored to examine these works to portray Leibniz as an arithmetician who, in particular, wrote original texts on prime numbers and even on their repartition. Thus we show that the history of Leibniz’s arithmetical practice in Paris is closely linked to his own history as a mathematician, and that it bears witness to his ability to gain knowledge, and then to go further than the expertise of his time, thereby contributing to his own development as a researcher

Testo completo1. The freudian means of representation into thinking became a peculiar question, in 1925, when germans attempted to make a silent-movie on psychoanalysis. This project was regarded in quite differnet ways and freud replied immediately that psychoanalytical concepts were unable to be figures. Asking this first reply for consequences on cinsiderations of representability, we have extended this concept on clinical and cultural fields, looking for documents upon history of psychoanalysis and upon history of cinema ; then, we have more widely discussed about representation of pictures and psychical imagery. 2. Towards assessment of philological interest of psychoanalysis; clinical approaches of speech are asking ofr epistemology according to clinical approaches of theories too. Different stage directions for a typical observation - what kind of observation applied sciences could not include - are inquiring own freudian's concepts'representability. Furthermore, studying magical thinking leads us to conceive, considering its effects into transferance, a useful opposition between image's power and words'ability, and a necessary conflict between imaginary and imagination, according as representations and defacements are by turns results of speech, theory or litterature

Testo completoThe way musicians identify notes has always been a fascinating subject. In order to understand this competence of theirs, we have opted to interview professional and learner musicians so as to analyse the mental methods they use to fulfil this task. A detailed description of the faintest mental processes involved in so doing opens on a bewildering world which exposes an organisation of many low level actions as adapted to their functions as they are subtle. These fragments of thoughts - which we have called mental anchor points - can be described, are varied in their ways of surfacing and can engage in diverse mission types. When subjected to closer scrutiny, we can imagine that these highly specialised mechanisms fall within the sphere of general functional principles which seem to be active at every moment of our lives, for whichever operation we try to perform: calculating, taking part in sports activities, cooking or simply thinking. This is what the second part of this study first tries to show, before disclosing a strange system of issues concerning interactive relations between perceptions and representations. Many testimonies mention situations in which mental anchor points play a prominent part in our perceptive behaviour. The confrontation of these two universes, thanks to the use of what we have called mental reprojections, makes it possible for us to examine the machinery at stake in our cognitive constructions and to analyse the consequences they imply concerning our comprehension of the real world

Given a ring R with 2R=R, R^2 neq 0 and U is a Lie ideal of R. In this thesis, we give a characterization of prime ideals in the Lie ring U. Namely, we prove that if W is proper Lie ideal of U, then W is a prime ideal of U if and only if there exists a prime ideal P of R such that P cap U subseteq W and (W+P)/P=Z((U+P)/P).

Testo completoThe abuse of a dominante position, by the means of unjust pricing, consubstantiates a conduct of exploitation of the consumers, throught the use of excessive pricing. Nevertheless the immediate consequences of this conduct, other legal orders have refused to establish a condemnation. However, since the Treaty of Rome, the European Union, in line with the goals of antitrust law, it’s political and economic history, and the various notions of justice, implemented this type of abuse. As a result, this thesis proposes to define a set of elements and criteria for a better orientation, application and comprehension of excessive pricing, in accordance with the principles of legal certainty and presumption of innocence, based on several jurisprudenceand doctrine, both national and european.
