Religion law – the law of the state on religion – has been taught for generations in the law schools of continental Europe, though its introduction in those of the United Kingdom is relatively recent. The aim of this article is to show how culture influences church legislation and to identify possible dangers associated with it. The article illustrates examples of changes in Church law that take place under the influence of culture. The conclusions are as follows: canon law submits to culture and it is a possible threat because it loses its ecclesiastical and salvific character. The standard modern view of Locke portrays him as a simulacrum of John Stuart Mill or John Rawls. This chapter decisively shifts the terms in which Locke is understood away from this standard view. It shows that with Locke religious worship is neither private nor optional, and is a matter of duty rather than right primarily — a duty prescribed by natural law. Natural law led Locke to jurisdiction, and, more precisely, to two corresponding jurisdictions, the eccesiastical and civil. The different ends implied in these two jurisdictions and the different ways in which they were established made church and state free from each other's direction. Worship is not tolerated by the state, for the state has no jurisdiction over it; rather, it is free. Conversely the state is required to coerce religious or irreligious groups, whether Roman Catholics or atheists, who undermine the possibility of independent civil and ecclesiastical jurisdictions.

An important catalyst for the upsurge of interest in analysing earthly political communities came in 1510, when the French king Louis XII called a Council of the Church to Pisa. Like previous Councils, it encouraged debate about the location, representation, and exercise of power, but the Council at Pisa was especially notable because its defenders—including Jacques Almain and John Mair—leaned heavily on the concept of natural law in making their case against the Pope. By appealing to natural law they made clear that they saw their writings as relevant not only to the internal workings of the Church, but to all communities, temporal as well as ecclesiastical. Soon new arguments began to circulate in Europe in which the basis of political power was grounded in natural law rather than in any direct grant of power from God. These arguments helped to explain why political power was diffused among a number of independent communities rather than united in the Empire, and they could also be used to show how and why the Church was different from the state or temporal community. This chapter also considers alternative ideas about the relationship between Christianity and politics, including those developed by Thomas More, Niccolò Machiavelli, and Francesco Guicciardini.
