Objective. To investigate the association between assisted conceptions and preeclampsia (PEC), including assessment of severity of disease. Methods. In a prospective case control study, cases were selected from women with preeclampsia and controls from women without preeclampsia. Exposure was defined as assisted conception with intrauterine insemination or in vitro fertilization (IUI or IVF). We assessed the association between exposure and outcome, using Chi square or Fisher's exact tests. Stratified analyses and multivariable logistic regression were used to control for confounders. Results. Preeclampsia was associated with assisted conception after controlling for age and race (AOR 2.2, [1.03–4.72]). All women with preeclampsia who had assisted conceptions demonstrated severe disease and were more likely to have abnormal lab values: AST >45 (AOR = 6.01 [1.63–22.21] P=0.007), creatinine ≥1 (AOR 2.92 [0.82–10.4], P=0.09) or platelets <100 (AOR 5.74 [1.00–32.76] P=0.049), after adjusting for race, age, and multiple gestations. Conclusion. Assisted conceptions are associated with a more severe preeclamptic phenotype.

Based on Fligstein's (1990) work on ‘conceptions of control’ (broad managerial paradigms), this paper provides an analysis of the ways in which information technology (IT) artefacts shape and are shaped by institutional contexts. Specifically, we report on primary and secondary empirical data that spans a 44-year period pertaining to the uses made of the Amazon rainforest monitoring system (a set of satellite-based geographic information systems). This paper argues that: (1) the process of institutional change is conflictual, emergent and contested; (2) the design and use of IT artefacts tend to reflect the currently dominant conceptions of control; (3) that IT artefacts that emerge within a specific conception of control can be later reconfigured to serve the interests of other conceptions of control; (4) and finally, IT artefacts might unintentionally reinforce alternate conceptions of control and lead to institutional change.

Abstract (sommario):

The aim of this study was to investigate the effect of concept cartoons embedded within context-based learning approach on 8th grade students’ alternative conceptions of “chemical bonding”. Within a nonequivalent pretest-posttest control group design, the study was conducted with 45 8th grade students. To gather data, Chemical Bonding Concept Test (CBCT) with 16 multiple choice questions and clinical interviews with 5 open-ended questions was used to probe their conceptions. Clinical interview questions were prepared in parallel with the same alternative conceptions asked in the CBCT. At the end of the study, context-based approach was found effective at remedying alternative conceptions about chemical bonding. On the other hand, although concept cartoons are found powerful tools to remedy alternative conceptions about chemical bonding, they did not show an extraordinary effect. This suggests that we may need to use more than one intervention method to effectively remedy the alternative conceptions in chemical bonding. Statistical methods are extensively used in quality control. The method of the application of entropy conception for quality control is proposed. It is based on the use of statistical information about deviations in the operation of a complex system. In the context of this: the structure of the complex system control is considered; the conceptions of controllable and observable systems are introduced. The classification of adverse factor is given influencing upon the system. The example is presented, showing how the application of the proposed method permits to give the evaluation of sources of risks and quality reduction in the complex system.

Emergency contraceptive pills (ECP) are a safe and efficacious backup method of birth control. Despite widespread availability, ECP is underutilized by young women. While partner level of involvement has been shown to influence contraceptive behavior, there is a dearth of knowledge regarding any possible association between partner influence and ECP use. To better understand the reasons for the seemingly underuse of ECP, a grounded theory study was conducted to elucidate the relationship of couple dynamics and knowledge of, attitudes toward, and decision making regarding the use of ECP in coupled young adults. Consistent with contemporary constructivist grounded theory methods, several categories were identified including the meanings associated with ECP use. This article presents an elaboration of this particular finding. The meanings that participants ascribed to ECP use represented a continuum of value attributes regarding ethics, safety, efficacy, and responsibility.

Analysis of the concept of internal control system is an important subject that involves the analysis of the latest scientific results, and on its basis to perform an updated analysis of the concept of internal control system which meets the modern business conditions and tendencies. Such an assumption has been made upon exploring famous scientists’ concepts of internal control system, in which the basic values needed for internal control system: (honesty, trust, respect, openness, skills, courage, economy, initiative, etc.) were not included. Only a modern concept of internal control might ensure an effective internal control system.The main purpose of the authors was to explore control, the concepts and conceptions of control, internal control and the system of internal control, as well as to present their own idea of the concept of internal control system and to compile a structural scheme of their conception. The structural scheme may alleviate the process of compiling a new model of an effective internal control system. The structural scheme of the conception may also be used in compiling a model of internal control system in different branches of industry.

The period comprising the second half of the nineteenth and the early twentieth century in Belgium has been described as one of rapid societal transformation including industrialization, urbanization, and, also in some extent, secularization. This is the historical period in which first mortality and later fertility also declined, facilitated by socio-economic (structural) and cultural changes, and resulting in the first demographic transition. One of the characteristics of the secularization marking this period is considered to be the reduced compliance with religious rules concerning the timing of marriages and sexual intercourse (i.e., conceptions). Against this background, the purpose of this article is twofold. It first assesses the initial extent and evolution of church control in the rapidly developing port city of Antwerp, Flanders (Belgium), in the mid-nineteenth and early twentieth centuries. This will be studied through a so-called daily Lent and Advent marriage and conception index. By daily, we mean that we exactly measure the timing of Advent and Lent. We secondly try to explain the determinants of the occurrence of these marriages and conceptions through individual socio-economic, cultural, and life-course factors. We use data from the unique multisource COR* historical sample, containing individual information from population registers and civil registration records (1845–1913). We find clear signs of decreasing compliance with religious rules and therefore secularization but different patterns for marriages and conceptions. Even though compliance overall decreases for both events, rules are better complied with for marriages, and in particular, first marriages. Marriages are more influenced by social control than for sexual intercourse (i.e., conceptions). The influence of stronger compliance with marriage seasonality is observed through better adherence with first conceptions, although this is in much less extent for higher-order conceptions. The occurrence of these events, in particular marriages, is determined by a number of structural, cultural, and life-course factors. Noncompliances are found more in an urban setting, older women, and later historical periods, whereas compliance is found in high social class of men. For conceptions, relatively few (significant) effects are observed, although noncompliance for maternal literacy status and compliance for paternal social class is also found indicating gender differential effects.

Background: This study was to assess whether assisted conception acts as a predictor for insulin therapy in gestational diabetes (GDM) treatment. The secondary aim of this study was to analyse the type of interventions that aided control of blood glucose. The role of ART as a risk factor that increases the risk of insulin therapy in GDM remains elusive. Many studies have established the increased association of GDM with ART conceptions. Factors like advanced maternal age, polycystic ovarian syndrome or obesity that increase GDM risk also contribute to subfertility. Increased level of Hb A1C, elevated FBS values are considered as risk factors for antenatal insulin therapy in women with GDM. This study was to assess if assisted reproduction is an independent variable associated with insulin therapy.Methods: In this retrospective study, GDM was diagnosed by fasting blood sugar and 2 hours postprandial or 75 gms OGTT based on IADPSG criteria with FBS >90, 2hr >140. Among the 121 GDM mothers, 42 women were ART conceptions and 79 were spontaneous conceptions. The entire study population (121) was divided into 3 groups based on the treatment required. Diet and lifestyle modifications only, diet and life style modifications with OHA and OHA with or without insulin therapy. The demographic, clinical, biochemical data were compared between groups. Details were obtained from case notes and entered in an excel sheet and SSPS software was used for statistical analysis. Inclusion criteria was all GDM pregnancies in the study period (4 years; January 2014 to December 2017) for whom case notes were available. Exclusion criteria was women with diabetes prior to pregnancy, those who moved elsewhere for delivery and multiple gestations.Results: There was no difference in the insulin requirement between ART conception and spontaneous conceptions. Out of 121 women, 34 women (28%) required diet and life style management, 38 women required OHA (31%), 49 women required insulin (40%). 73% of women who were managed with diet were spontaneous conceptions. Preterm labor was the commonest complication encountered (17%). ART women had more number of perinatal complications, in all treatment groups.Conclusions: ART was not a predictor for insulin therapy in this study group. The largest group of intervention for GDM was with insulin, 40%. Perinatal complications were seen more in ART mothers with GDM compared with spontaneous conceptions. Spontaneous conceptions women had more percentage of management with diet and life style modifications.

This literature review study aimed to identify the conceptions of palliative care mentioned in Brazilian journals. The databases LILACS, SciELO and BDENF were used. In total, 47 articles were selected, published from 2000 to 2006. The conceptions found refer to the concept of palliative care, understood as integral care for individuals in terminal conditions, emphasizing the physical, psychosocial and spiritual aspects of the individual and the family; quality of life; care based on a humanistic approach and valuation of life; pain and symptom control; ethical issues about life and death; multidisciplinary approach; dying as a natural process; the priority of care over cure; communication, spirituality and mourning support. These conceptions are considered highly important in palliative care; however, there is a lack of services and centers to deliver these types of care.

Heightened risk taking in adolescence has long been attributed to valuation systems overwhelming the deployment of cognitive control. However, this explanation of why adolescents engage in risk taking is insufficient given increasing evidence that risk-taking behavior can be strategic and involve elevated cognitive control. We argue that applying the expected-value-of-control computational model to adolescent risk taking can clarify under what conditions control is elevated or diminished during risky decision-making. Through this lens, we review research examining when adolescent risk taking might be due to—rather than a failure of—effective cognitive control and suggest compelling ways to test such hypotheses. This effort can resolve when risk taking arises from an immaturity of the control system itself, as opposed to arising from differences in what adolescents value relative to adults. It can also identify promising avenues for channeling cognitive control toward adaptive outcomes in adolescence.

How do people make sense of the emotions, sensations, and cognitive abilities that make up mental life? Pioneering work on the dimensions of mind perception has been interpreted as evidence that people consider mental life to have two core components—experience (e.g., hunger, joy) and agency (e.g., planning, self-control) [Gray HM, et al. (2007) Science 315:619]. We argue that this conclusion is premature: The experience–agency framework may capture people’s understanding of the differences among different beings (e.g., dogs, humans, robots, God) but not how people parse mental life itself. Inspired by Gray et al.’s bottom-up approach, we conducted four large-scale studies designed to assess people’s conceptions of mental life more directly. This led to the discovery of an organization that differs strikingly from the experience–agency framework: Instead of a broad distinction between experience and agency, our studies consistently revealed three fundamental components of mental life—suites of capacities related to the body, the heart, and the mind—with each component encompassing related aspects of both experience and agency. This body–heart–mind framework distinguishes itself from Gray et al.’s experience–agency framework by its clear and importantly different implications for dehumanization, moral reasoning, and other important social phenomena.

Purpose The purpose of this paper is to analyze how “New Deal” regulatory initiatives, primarily the Securities Acts and the Securities and Exchange Commission (SEC), changed US auditors’ professional knowledge conception, culminating in the 1938 expansion of the Committee on Accounting Procedure (CAP), the first US body to set accounting principles. Design/methodology/approach The paper combines Halliday’s (1985) knowledge mandates with Hancher and Moran’s (1989) regulatory space to attain a theory-based understanding of auditors’ changing knowledge conceptions amid regulatory pressure. It draws on a range of primary and secondary sources to examine the period from 1929 to 1938. Findings Following the stock market crash, the newly created SEC aimed to engage auditors as a means to regulate companies’ accounting practices based on a set of codified principles. While entailing increased status, this new role conflicted with the auditors’ knowledge conception, which was based on professional judgment and personal integrity. Pressure from the SEC and academics eventually made auditors agree to a codification of their professional knowledge and create the CAP as a cooperative regulatory solution. Originality/value The paper explores the role of auditors’ knowledge conceptions in the emergence of today’s standard setting. It is suggested that auditors’ incomplete control of their professional knowledge made standard setting a form of co-regulation, located between the actors occupying the regulatory space of accounting.

This study aimed to investigate the effect of conceptual change text (CCT) in the REACT strategy for students' conceptions of solutions. A quasi-experimental method was used in the study. The study was carried out in the spring term of the 2012–2013 academic year with 61 freshmen students (aged 18–20 years) studying in the Elementary Education Department. To gather data, the solutions concept test (SCT) was used as a pretest (PrT) and posttest (PoT) and clinical interviews were used to increase the validity of the data obtained from SCT. In the experimental and control groups, the REACT strategy was used as the teaching strategy. In the experimental group, the REACT strategy was enriched with CCTs. Three CCTs were used for the experimental group. According to the findings, there was a significant difference between the experimental and control groups' PrT and PoT results. The REACT strategy was found to be successful at dealing with the alternative conceptions in solution chemistry. However, no significant difference was found between the groups' PoT results. On the other hand, qualitative analyses showed that the CCTs were slightly effective in remediation of alternative conceptions in solution chemistry. This suggests that we may need to use more than one intervention model to effectively remedy the alternative conceptions in solution chemistry. This study may be helpful for diagnosing alternative conceptions and guide researchers to remedy them. Hence, CCTs can be designed for other chemistry topics for implementation in schools.

Some commentators have argued that all particular altruistic acts are directly caused by or reinforced by an internal emotional state. Others argue that rewards obtained by one person might reinforce another person's altruistic act. Yet others argue that all altruistic acts are reinforced by social reciprocation. There are logical and empirical problems with all of these conceptions. The best explanation of altruistic acts is that – though they are themselves not reinforced (either immediately, or delayed, or conditionally, or internally) – they are, like self-controlled acts, part of a pattern of overt behavior that is either extrinsically reinforced or intrinsically reinforcing.

AbstractThis paper describes a multi-case study which linked conceptions and practices of assessment for learning to developing learner autonomy within UK primary mathematics classrooms. The project explored the use of assessment for learning in mathematics lessons with Year 5 (9–10 years old) children and their teachers. Four cases were studied in depth to understand how conceptions and practices impacted upon autonomy and control for teachers and learners. A typology of assessment for learning in mathematics is proposed, along with what this might mean for both teachers and learners in terms of the balance between control and autonomy. One case in particular, that of teacher Alex, is highlighted as it exemplified the expert teacher through the conceptions and use of assessment for learning, which led to the children becoming expert learners of mathematics. The class ethos was one of value for personal autonomy. Responsibility and control of learning was a shared endeavour within a community of learners. Community in this respect was broadened to include the environment and resources within the classroom and so demonstrated learners working within an expert classroom. This article was developed from a paper first presented at the ICME 13 conference (O’Shea, 2016).

Meerten B. ter Borg argued that canons function as a means of social control. The success of a canon follows not from the assent or agreement of the populace, but rather from the embedded quasi-personal relationship that produces a sense of belonging and identity. The objectified canon takes over this quasi-personal feature, which guarantees a canon’s sanctity. Calling scripture or law “canonical” thus transcendentalizes a text and allows it to retain a sacred quality that in turn effects social control through a shared sense of belonging. This thesis is confirmed and elaborated through a review of the conceptions of canon operative in the Catholic Church during the thirteenth, the sixteenth, and the late nineteenth and twentieth centuries. In all these periods, the Catholic Church modified its conception of the canonical nature of both its scriptures and its laws in order to strengthen corporate identity and to establish order and control within and without its perimeter.

Discourse concerning state control concept on natural resources in Article 33 clause (3) of the 1945 Constitution is very dynamic. Such dynamic can be seen on a variety of conceptions of state control rights on natural resources formulated in various acts in natural resources area. Lack of single concept on ‘state control right’ will impact to unfavorable situation where natural resources shall escape from conception of state control right and into control not by the state. The Constitutional Court as the Guardian and Interpreter of the Constitution has a significant role to ascertain that an act in natural resources area really adopt the principle of state control on natural resources in Indonesia. This article analyzes on dynamics of conception of state control on natural resources in various acts and the role of the Constitutional Court in guarding and interpreting acts in natural resources in order to be in accordance with Article 33 clause (3) of the 1945 Constitution. From the result of analysis a conclusion is achieved that there are many different concepts of state control on natural resources in various acts in natural resources area. The Constitutional Court indeed has made interpretation on state control right. In order to make the conception stronger it is necessary to have an act in natural resources area as instruction of Article 33 clause (5) of the 1945 Constitution that further provisions of Article 33 shall be regulated by an act. Moreover, DPR (The House of Representatives) and the Government have to make certain or definite the concept of state control right in every draft bill of natural resources area so that liberalism and capitalism stream will not erode the principle of state control right.

There are two principal philosophical conceptions of socialism, corresponding to two interpretations of the notion of a rational society. The first conception corresponds to an instrumental view of social rationality. Captured by the image of socialism as “one big workshop,” the instrumental view holds that social ownership of the means of production is rational because it promotes the optimal development of the productive forces. Social ownership is optimal because it eliminates the costs of coordination imposed by the conduct of economic activities in formally independent enterprises, and, more generally, overcomes fetters on development that result from the control of resources by individuals whose particular interests (in profit) imperfectly correspond to a general interest in productive advance.

Despite repeated announcements of the end of ideology and the demise of religion during the twentieth century, both play a crucial role in world politics today. This disjuncture between theoretical expectations and historical developments has its roots in conventional conceptions of ideology. While the latter grasp the representative nature of ideology as an expression of historical forces and political interests, they miss its constitutive role for modern politics. Based on an analysis of its historical origins and political implications, this article develops a new conception of ideology which accounts for the resilience and historical dynamics of ideological struggle. Like the sorcerer’s apprentice, I show, liberalism has called ideology into being but lost control of its own creation.

The purpose of this article is to describe the health-specific guiding ideas, planning and control mechanisms and objectives that explain the main thrust of thinking and action of the two currently most important policy conceptions. On the one hand, this is the conception of health policy as economic policy, and on the other hand the health sciences approach of health policy as health-based intervention policy. The differences between both concepts are not trivial and show fundamentally different ideas of the allocation and distribution of health goods and services. When choosing “for or against” the “right” health policy approach, these systemic differences must be adequately taken into account.

Lean Six Sigma is a management focused on quality and productive performance in operating systems. This article discusses the foundations of this methodology through of two different conceptions of management, Lean Manufacturing and Six Sigma. First of the article explain the DMAIC (define measure, analyze, improve and control) and their respective phases, after the Lean philosophy with the sipoc and value stream mapping techniques. The article aims to show integration of these two conception and their results. The methodology consisted in a theory was based on a literature search an exploratory research which consisted of three case studies in differences companies located in Sorocaba, São Paulo. The main purpose of the present study was to investigate the effect of case-based instruction on remedying 10th grade students' alternative conceptions related to gas concepts. 128 tenth grade students from two high schools participated in this study. In each school, one of the classes was randomly assigned as the experimental group and the other class, instructed by the same chemistry teacher, was assigned as the control group. The students in the experimental groups were instructed by case-based instruction based on conceptual change conditions while the control group students received traditionally designed chemistry instruction. As pre-tests, the science process skills test, the attitude and motivation towards chemistry and the gas concept test were applied to both groups of students. As a post-test, the gas concept test was administered to both groups of students to determine their alternative conceptions and understanding of gas concepts. One-way ANOVA was used to assess the effect of case-based instruction on students' understanding of gas concepts. The results revealed that case-based instruction was an effective method for overcoming students' alternative conceptions about the gas concepts.

This study investigated the effectiveness of a Team Building Through Physical Challenges (TBPC; Glover and Midura, 1992) program on the self-conceptions of physical education students in Grades 6 and 7. The treatment group was exposed to one TBPC activity every second week for 8 months, while the second group completed the regular physical education curriculum without any TBPC activities. Data were analyzed using 2 (treatment/control) x 2 (preintervention/postintervention) x 2 (male/female) repeated measures analysis. Results at postintervention revealed that both male and female students in the treatment group were significantly higher on perceptions of global self-worth, athletic competence, physical appearance, and social acceptance than the control group. Female students in the treatment group were also significantly higher on perceptions of scholastic competence and behavioral conduct than female students in the control group. Effect sizes indicated that meaningful as well as significant differences in self-conceptions were created by the TBPC program.

Currently, the performance and functionality of CNC system, which achieved gradually by the software instead of hardware, is becoming increasingly complex. However, very few researches on the reliability of CNC system software was presented. In this paper, the basic conceptions and important of CNC software reliability were discussed, and comparative analysis on the research status at domestic and abroad were studied from the view of theoretical research and engineering practice. Meanwhile, the paper collected field failure data on 30 CNC systems in six months, and reliability analysis was made based on the data.

Teacher conceptions of assessment influence their implementation of learning-focused assessment initiatives as advocated in many educational policy documents. This mixed-methods study investigated Chinese secondary school teachers’ conceptions of L2 assessment in the context of an exam-oriented educational system which emphasizes English grammar, vocabulary and reading comprehension skills. For the quantitative part of the study, survey data were collected to gauge the conceptions of assessment held by 66 senior secondary EFL teachers from six schools in Eastern China. For the qualitative part, case studies of two teachers from schools with different rankings were conducted. Quantitative results showed that the teacher participants as a group agreed most with the view that assessment is to help learning. However, there was a strong association between two factors, that is, the assessment as accurate for examination and teacher/school control factor, and the assessment as accurate for student development factor. The strong association indicated that it may be less likely for the group of teachers to adopt the formative assessment initiatives emphasizing student development as promoted in the English curriculum reform. Qualitative findings further revealed individual differences in the two case study teachers’ conceptions and practices of assessment as well as the interplay among meso-level (e.g., school factor), micro-level (e.g., student factor), and macro-level (e.g., sociocultural and policy contexts) factors in shaping the teachers’ different conceptions and practices of assessment. A situated approach has been proposed to enhance teachers’ assessment literacy.

Aim. This study investigated the associations among early pregnancy vitamin D concentrations, seasonality, and vitamin D metabolic gene variants and how these variables related alone and in interaction with the risk of gestational diabetes mellitus (GDM). Methods. Research participants were women from the Ma’anshan birth cohort study in China. The overall study included 3110 women to explore the association between early pregnancy vitamin D concentrations and the risk of GDM. In the current analysis, a nested case-control study of 274 GDM cases and 380 controls was conducted to investigate seven vitamin D metabolic gene variants and the risk of GDM. Vitamin D concentrations were measured by radioimmunoassay. Genotypes were determined by improved multiple ligase detection reaction. Interactions between genetic variants and vitamin D as predictors of the risk of GDM were evaluated by a pair-wise analysis under a multiplicative interaction model. Results. Vitamin D concentrations were not significantly associated with the risk of GDM (OR=0.79, 95% CI=0.55-1.13) after adjusting for seasonality. Fall-winter conceptions had a 37% decreased risk of GDM compared with spring-summer conceptions (OR=0.63, 95% CI=0.49-0.81), independent of vitamin D concentrations. Two VDR gene variants rs1544410 (OR=2.03, 95% CI=1.17-3.51 for CT versus CC) and rs731236 (OR=2.42, 95% CI=1.29-4.55 for GA versus AA) were significantly associated with the risk of GDM. No interactions among genetic variants and vitamin D concentrations were detected. Conclusion. Early pregnancy vitamin D insufficiency or deficiency was not significantly associated with the risk of GDM. The results of this study emphasize the importance of genetic variants in VDR and conception season as factors that affect the risk of GDM.

What should teachers do to ensure a student construct meaningful understanding in cell division and reproduction concepts? This research examined the effect of 5E learning cycle on 10th grade students’ understanding of cell division and reproduction concepts and their alternative conceptions on these concepts. Mixed methods research design was utilized for this aim. Eight classes with 228 students from two public high schools were selected conventionally. Experimental groups received learning cycle (LC) and control groups received conventional teaching (CT) throughout the 10 weeks. A three-tier diagnostic test was administered to both groups as pre and post-tests. After the treatment, 12 students were interviewed semi-structurally. The results revealed that learning cycle is superior to conventional teaching on promoting conceptual change along with increasing understanding. The present research recommends teachers utilize learning cycle to improve students’ understanding and remediate their alternative conceptions. Background: Research has identified enhancement of positive self-concept as an important outcome connected with participation in adventure-based activities in physical education (PE). Purpose: This study compared the effectiveness of Team Building Through Physical Challenges (TBPC) and Adventure Curriculum for Physical Education (ACPE) programs on the self-conceptions of middle school PE students. Both approaches include adventure-type tasks adapted for use in PE. Methodology/Approach: Participants consisted of 397 female ( n = 183) and male ( n = 214) students who were enrolled in Coeducational Grades 7 and 8 PE classes in three middle schools. Students in the treatment classes were exposed to either the TBPC condition or the ACPE condition during PE classes over 7 months, whereas students in the control group completed the regular PE curriculum that did not include activities from either approach. Findings/Conclusions: Results suggest that both approaches benefit the self-conceptions of children with each being particularly effective at changing those self-conceptions logically related to specific organizing themes. Specifically, ACPE was greater than TBPC, for global self-worth and perceived behavioral conduct. TBPC was greater than ACPE for perceived social approval. Implications: Incorporating either the TBPC or the ACPE program in middle school PE can benefit the self-conceptions of students.

Abstract This article analyzes Justice Anthony M. Kennedy’s commitment to protecting state sovereignty. In contrast to scholars who view Kennedy’s behavior as merely pragmatic or centrist, this article focuses on principles and tensions underlying his liberty-based approach to federalism. From his early career in Sacramento through three decades on the U.S. Supreme Court, Kennedy sought to restore a federalism he considered essential to personal and political liberty but increasingly “endangered.” His opinions extended beyond the constitutional text to protect traditional areas of state concern, state treasuries, and local political decision making against increasing federal control. However, Kennedy subordinated state sovereignty when it interfered with the federal government’s direct relationship to citizens, promoted economic protectionism, and violated his expansive conceptions of constitutional liberty and human dignity. The article concludes by situating Kennedy’s distinctive conception of federalism within the larger Rehnquist and Roberts Courts.

In this article we argue that traditional notions of state-local relations as a zero-sum game need recasting. Although some new state education reforms are exerting strong influences on the classroom, there are reasons to think that the reforms left not only considerable room for flexibility but also enhanced local activism. New conceptions of state-local relations must account for the ways in which states mobilize public and professional opinion, districts orchestrate state and local priorities around schools and classrooms, and local political entrepreneurs influence state policy. The result is often that the local effects of state policy are greater than those one would predict on the basis of state capacity, and localities often gain influence as a result of state policymaking rather than lose it.
