Depuis la suppression des actions possessoires, seule la procédure de référé de droit commun assure la protection possessoire visée à l’article 2278 du Code civil. Ce changement transforme profondément la nature du contentieux possessoire qui, de contentieux au fond du droit, devient un contentieux du provisoire. Cette étude s’attache à déterminer l’articulation peu évidente entre l’article 2278 et la procédure de référé, en s’intéressant d’abord à la façon dont se superposent les conditions de ces deux corps de règles puis aux conséquences que le régime du référé emporte sur la protection possessoire. Bien que le référé soit efficace en matière de protection possessoire, il présente certaines limites, liées à son caractère provisoire, qui n’existaient pas dans le cadre des anciennes actions possessoires. Ce constat nous interroge sur la nécessité de rétablir une action générale au fond destinée à assurer cette protection, en contradiction avec une jurisprudence de la Cour de cassation difficile à justifier.

Abstract (sommario):

Les Chantiers de la justice ont été lancés en octobre 2017. Cinq rapports ont été remis au gouvernement le 15 janvier 2018 partiellement repris par un « Projet de loi de programmation 2018-2022 et de réforme de la justice » déposé le 23 avril 2018 au Sénat en procédure accélérée. Le choix a été fait d’un seul texte législatif mêlant organisation judiciaire, procédure civile, procédure pénale et exécution des peines. Pour ce qui concerne les cours d’appel le projet prévoit d’expérimenter sur deux ressorts s’étendant à plusieurs cours une nouvelle forme d’organisation confiant des pouvoirs d’animation et de coordination à un premier président et un procureur général, et permettant la spécialisation de certaines cours dans des matières civiles à déterminer par décret. Pour ce qui concerne les juridictions de première instance, le projet prévoit le regroupement de l’ensemble des contentieux relevant du tribunal d’instance au TGI qui devient la seule juridiction compétente en première instance hors tribunaux de commerce et conseils de prud’hommes. Toutes les implantations de TGI sont maintenues avec un tribunal départemental « pilote » dans un département en comportant plusieurs et la possibilité de désigner par décret un TGI pour traiter de contentieux déterminés. De nombreuses dispositions civiles et pénales du projet participent d’une simplification du fonctionnement des juridictions, et donc de leur organisation. Un procès civil redessiné donne une place importante aux règlements amiables et pratique de nombreuses déjudiciarisations ainsi que des regroupements de contentieux de masse, allant jusqu’à des jugements sans audience. Au pénal, parmi des simplifications réclamées de longue date, l’application des peines et l’instruction sont cantonnées, mais l’essentiel du procès pénal est conservé alors que l’application des peines et l’instruction auraient pu être supprimées. Certes, la justice est une institution fragile, mais on a souvent le sentiment de rester au milieu du gué.

La réforme du droit de la famille a eu d’importantes incidences procédurales. Dans la foulée du courant de droit récent en faveur de la négociation, la médiation et le règlement des conflits dans l’intérêt premier des enfants, le juge se voit confier une nouvelle mission et se trouve doté de pouvoirs d’intervention élargis. L’auteur analyse l’impact judiciaire de la réforme en constatant le recul du caractère contradictoire et conflictuel des débats. Le contentieux familial échappe de plus en plus à la conception traditionnelle du procès civil et l’auteur conclut en se demandant si le juge est suffisamment outillé pour faire face à son rôle nouveau.

Abstract: This article challenges the claim that there is regulatory competition in the areas of contract law and civil litigation. It is frequently assumed that lawmakers reform their contract laws and dispute resolution mechanisms with the purpose of attracting 'users', i.e., parties to cross-border contracts who choose the contract law or the courts of a given legal system. I shall discuss this assumption and its plausibility in the first part of this article. In the second part, I will test the assumption by presenting the available empirical evidence on the choices of contract law and forum that businesses in Europe actually make. For a long time, such data have been largely absent from the debate. Moreover, I assemble evidence of lawmakers competing for the production of the most attractive legal regimes in the areas of contract law and civil litigation. I conclude that meaningful regulatory competition in the areas concerned cannot be predicted with confidence; nor is there evidence of its existence. Résumé: Cet article questionne l'affirmation selon laquelle il existerait une concurrence normative en matière de droit des contrats et de contentieux civil. Il est généralement tenu pour acquis que les organes producteurs de droit réforment le droit des contrats et les mécanismes de résolution des conflits en ayant en vue de les render attractifs pour les 'utilisateurs de droit', et plus spécifiquement, d'attirer les parties aux contrats internationaux qui sont en position de choisir le droit applicable à l'acte ainsi que la juridiction compétente en cas de conflit. Cette hypothèse sera analysée et son caractère plausible étudié, dans la première partie de l'article. Dans la seconde partie, l'hypothèse sera mise à l'épreuve au regard des résultats des études empiriques récentes sur les choix de loi et de forum par les professionnels en Europe. Longtemps, ce type de donnés a fait défaut au débat. Au surplus, seront étudiés des indices relatifs à l'existence éventuelle d'une compétition entre législateurs pour produire les régimes légaux les plus attractifs en matière de droit des contrats et de contentieux civil. Il faudra conclure en reconnaissant que, d'une part, il est difficile de prédire avec certitude qu'une réelle concurrence normative pourrait marquer les domaines étudiés et que, d'autre part, il n'y a, pour l'heure, pas de preuve de son existence.

Abstract: Alternative Litigation Funding (ALF) refers to any practice whereby an entity not party to a dispute provides capital to claimants or defendants or in any way bears whole or part of the dispute costs, in exchange for a share of the expected financial recovery. For a few years, the use of ALF has experienced some success in certain common law jurisdictions but has not yet emerged in most (European Union) civil law countries. Italy is one of those countries in which ALF has not yet emerged, although court costs have steadily increased in recent years, and practitioners’ claims for access to justice have multiplied. Against this background, after a comparative overview, this article aims to shed light on the current status and issues related to ALF in Italy. In doing so, some Italian legislation that might potentially involve this manner of funding will also be analysed, particularly with regard to the recent reforms of (civil and commercial) justice. Résumé: Le financement alternatif du contentieux (FAC) se réfère à toute pratique par laquelle une entité non partie à une dispute fournit des capitaux aux parties, ou encore assume tout ou partie des coûts liés au litige, en échange d’une part des gains attendus. Depuis plusieurs années, le FAC connaît un succès grandissant dans certains pays de common law. En revanche, la plupart des pays de droit civil de l’Union Européenne se sont pas encore ouverts à cette pratique. En Italie par exemple, le FAC n’a pas encore vu le jour bien que, au cours des dernières années, les frais de justice aient augmenté de facon constante et les plaintes des praticiens concernant l’accès à la justice se soient multipliées. L’objectif de cet article sera donc d’établir un état des lieux des questions liées à l’introduction du FAC en Italie. Après un rapide apercu comparatif, nous analyserons la législation italienne pouvant concerner cette forme de financement. Nous intéresserons ainsi en particulier aux récentes réformes de la justice civile et commerciale.

La « question macédonienne » a été, tout au long de la fin du XIXème siècle, une question critique, plus encore que d’autres, entre toutes celles que posait le démembrement de l’Empire ottoman. Avec une telle prémisse, l’auteur se penche sur la complexité de l’ « impasse macédoine » pendant le XXème siècle à cause, entre autres, de l’occupation hitlerienne des Balkans et le principe de l’intangibilité des frontières de 1945 ou encore le démembrement ultérieur de l’ancienne Yougoslavie en 1991. Enfin, la recherche d’une solution conciliatrice, pour le contentieux gréco-macédoine, entre les paramètres internationaux et l’identité étatique, est susceptible d’être utile afin de faire face à d’autres situations conflictuelles. En ce sens, si l’on conclut, comme il paraît raisonnable, à la faillite du raisonnement en termes de droits historiques, à la fragilité des critères religieux et linguistique, peut-on chercher le salut dans le recours, par voie d’emprunt au droit civil, ou, tout à la fois, à ce droit et au droit commercial, à la notion de droit au nom.

In many jurisdictions, courts and the related tort liability rules have failed to adequately address conflicts arising from healthcare delivery that has caused harm. The litigation model – the classic model used to deal with medical liability – must be, if not replaced, at least supplemented by another model, and alternative dispute resolution is best suited to this task. Because conflicts are resolved in a less adversarial environment than a courtroom and led by people with knowledge of both medicine and law, alternative dispute resolution promotes a congenial procedure, is faster and cheaper than traditional litigation and can provide more satisfactory outcomes for all parties. La thèse soutenue est celle d'une régression législative de la protection sociale des victimes d'accident du travail et de maladie professionnelle. La loi de 1985 édicte des présomptions légales qui ramènent le travailleur sur le terrain du contentieux. La logique de l'indemnisation automatique se trouve ainsi écartée, alors qu'elle constituait le point fort du compromis historique élaboré au Québec à partir de 1909, dans la foulée des pays industrialisés d'Europe occidentale. La Cour d'appel révèle en 1992 dans six arrêts rendus le même jour l'ampleur des limitations apportées par la loi de 1985 à la protection juridique des travailleurs. Le silence gardé par la doctrine sur ces arrêts de principe contraste avec la vigueur des critiques qui ont accueilli en 1996 une décision de la Cour suprême refusant, à juste titre, d'utiliser les chartes à l’encontre d'une protection sociale acquise au cours de l'histoire. Ces textes constitutionnels devraient être utilisés à meilleur escient, comme l'établissement de ponts entre le droit civil de la responsabilité individuelle et le droit social de l'indemnisation collective.

AbstractThis study examines the effects of civic consciousness and civil disobedience on individual attitudes toward, and participation in, contentious politics. Using the newly collected survey data on civic consciousness and civil disobedience in Taiwan in 2015, this study finds that both civic consciousness and civil disobedience are significantly associated with individual support for and engagement in contentious politics. Specifically, people with strong civic consciousness and civil disobedience are more likely to support the Sunflower Movement and take part in contentious political activities such as rallies, marches, and strikes. The findings imply that as the ideas of civic consciousness and civil disobedience prevail in a democracy, the public will be more likely to choose to use contentious political activities to express their opinions instead of institutional and legal approaches when the government is unable to respond to public needs in a timely manner.

La présente étude est consacrée à l’« organisation, fonctionnement et compétence du Tribunal de commerce ». Son contenu s’articule autour de l’analyse de la législation qui régit le Tribunal de commerce en République Démocratique du Congo. De cette réflexion, il s’est avérée que la loi du 03 juillet 2001 prévoit un régime juridique applicable à la juridiction précitée. La spécialité des règles qui régissent le Tribunal de commerce distingue cette instance juridictionnelle des Tribunaux de Paix et des Tribunaux de Grande Instance dans plusieurs matières, entre autres, la présence des juges consulaires dans la composition des chambres alors qu’ils ne sont pas magistrats. Vingt ans après son application en République Démocratique du Congo, la réalité est que le texte législatif en examen est imprécis et obsolète. L’imprécision réside dans le fait que le législateur prévoit des règles organiques, procédurales et de compétences qui sont identiques tant dans un contentieux pénal que dans un litige civil. L’obsoléité est manifestement palpable d’abord dans le silence du législateur sur plusieurs questions de droit que la législation supranationale renvoie au droit national, en suite dans le contenu de certains articles. Fort de ce constat, il est crucial de procéder à une réforme profonde de la loi du 03 juillet 2001 portant création, organisation et fonctionnement des Tribunaux de commerce afin de rendre précises ses règles organiques, procédurales et de compétences selon que nous sommes en matière pénale ou en matière civile. En outre, la réforme visera aussi à adapter le contenu de la loi précitée au cadre juridique actuel fortement influencé par le droit communautaire.

Abstract: Third-party litigation funding (TPLF) is a promising and fascinating practice that is receiving increasing attention. However, TPLF is still a novel institution, and hence there exists certain controversy as to what it actually stands for. In order to bring some clarity in this regard, a definition of TPLF will be provided. This definition will be used to compare TPLF with other ways of funding litigation disputes, to investigate its origins, and to examine its advantages and disadvantages. Nonetheless, the main purpose of this article is to shed light as to two supplementary issues. On the one hand, this article will show what is the current state of affairs of TPLF. For that purpose, a comparative analysis of several countries will be provided. This will show that TPLF is commonplace in common law countries such as Australia, though virtually non-existent in civil law countries. On the other hand, in order to determine the prospects for TPLF to expand into jurisdictions in which it has not developed so far, Spain will be taken as an example. This analysis will show that the possibilities for TPLF to grow in Spain are rather promising as TPLF may help overcome some of the challenges currently faced by the Spanish civil justice system. In addition, TPLF seems to be legally viable under Spanish law. Resumé: Third-Party Litigation Funding (TPLF) est une pratique prometteuse et fascinante, qui reçoit une attention croissante. Cependant, le TPLF est encore une institution novatrice, à ce titre il existe un certain nombre de controverses concernant ce qu'il représente. Afin d'apporter de la clarté à cet égard, une définition du TPLF sera fournie. Cette définition sera utilisée pour comparer le TPLF avec d'autres moyens de financement de litiges contentieux, pour rechercher ses origines et examiner ses avantages et inconvénients. Néanmoins, le but principal de cet article est de faire la lumière sur deux questions supplémentaires. Dans un premier temps, cet article montrera quelle est la situation actuelle du TPLF. Pour cela, une analyse comparative de plusieurs pays sera établie. Elle démontrera que le TPLF est monnaie courante dans les pays de common law comme l'Australie, et pratiquement inexistante dans les pays de droit civil. Dans un second temps, afin de déterminer les perspectives du TPLF de se développer dans les juridictions où il n'est que peu implanté, l'Espagne sera prise comme exemple. Cette analyse montrera que les possibilités pour le TPLF de se développer en Espagne sont prometteuses puisque le TPLF peut permettre de surmonter certaines difficultés rencontrées actuellement par son système de justice civile. En outre, TPLF semblent légalement viables en vertu du droit espagnol.

Le Cameroun, à l’instar de la plupart des pays qui ont adopté le système Torrens, a opté pour le régime foncier de l’immatriculation, qui se traduit par l’inscription des droits réels sur un Livre foncier. L’inscription de ces droits réels sur le livre foncier, n’intervient qu’à l’issue d’une procédure destinée à révéler tous les droits réels attachés à un immeuble. Lorsque, aucune opposition ne s’est manifestée lors de cette procédure, le titre foncier obtenu devient inattaquable, intangible et définitif. Cependant, à ces principes d’incontestabilité et d’irrévocabilité du titre foncier, le droit positif camerounais y a apporté deux tempéraments : en permettant à la personne lésée, par une immatriculation dolosive, ou consécutive à une faute de l’Administration, ou résultant de la fraude du bénéficiaire, d’intenter, soit une action personnelle en dommages intérêts devant le tribunal civil, soit, de solliciter le retrait administratif du titre foncier auprès de l’autorité administrative compétente, soit enfin, de demander son annulation juridictionnelle, devant le juge administratif. Cet aspect contentieux de l’immatriculation constitue l’originalité du droit camerounais, par rapport aux droits d’autres pays, qui ont adopté le système Torrens. Cette mise en cause du titre foncier devant le juge administratif, et l’éventualité de son annulation, démontrent que le titre foncier ne possède qu’une force probante relative. La réflexion menée actuellement par les pouvoirs publics camerounais tend à améliorer ce régime de l’immatriculation, en mettant l’accent sur les failles décelées : l’inefficacité de la publicité des avis des demandes d’immatriculation et l’ineffectivité des enquêtes sur le terrain.

L’évidence en contentieux administratif évoque immédiatement le rôle du juge des référés, souvent présenté comme le juge de l’évidence. La plupart des référés de droit commun sont enserrés dans une contrainte temporelle qui pousse le juge à procéder à un examen rapide mais efficace des dossiers qui lui sont soumis. Ce constat s’avère cependant quelque peu simpliste. Le juge des référés n’est pas le seul juge de l’évidence. En contentieux d’une façon générale, l’évidence est couramment employée sous les traits du manifeste. D’une part, comme en matière de référé, l’évidence est utilisée pour l’examen de la légalité. D’autre part, elle est également employée pour des raisons procédurales, que ce soit pour évaluer la recevabilité d’une requête ou pour justifier son rejet rapide. Le juge des référés n’est donc pas le seul juge de l’évidence. Mais, l’évidence ne parvient pas à expliquer l’ensemble des solutions dont elle est pourtant le fondement au point que, malgré sa présence indubitable, il est nécessaire de relativiser sa portée. En référé, certaines solutions s’éloignent de plus en plus de l’évidence pour tendre vers la recherche d’une certitude pour juger vite et bien dans des délais restreints. De même, le contentieux opère un mouvement similaire malgré l’absence d’urgence.

The path to the modern democratic model has been lengthy and contentious, culminating in the recognition of civil rights as guarantees of equal social opportunity and legal protection for all, irrespective of race, religion or other personal characteristics. Realising civil rights requires the active engagement of all societal members, including the youth, who are especially vital for the future. This article aims to elucidate the legal avenues for youth civic participation in Latvia, assess the current situation and provide insights into the historical evolution of civil rights. To achieve this, we examined the existing legal framework, analysed theoretical literature, gathered statistical data, drew conclusions and reviewed recent research on youth civic participation. While laws regulate the opportunities for youth in Latvia to engage in civic activities, they do not resolve participation issues. Data from the Saeima (the Parliament of Latvia) elections between 2002 and 2018 reveal a nearly 17% decline in voter turnout, with youth participation even lower. This reluctance to vote or run for office reflects a broader political distrust in society. Additionally, the lack of consistent civic education further undermines young people’s willingness to engage in civic activities. Keywords: civil rights; civic participation; democracy; engagement.

How can the shrinking of civic spaces be reversed? This article suggests an analytical approach to identify mechanisms that cause the shrinking of civic spaces in Mozambique, and presents a starting point for building strategies to react to this process. Based on interviews and participative observation in the field, it explores events and episodes where crucial issues or activists’ groupings were neutralised, and visits the theory of defiance in civil society, power and contentious politics to explain how the shrinking of civic spaces has been taking place in Mozambique in the past ten years. It is reasonable to state that activists need to cope with cultural and cognitive barriers in order to face the various expressions of state and market power in Mozambique. Civil society organizations need to work with their donors to create new forms of relationship together, where issues such as accountability, for example, do not put at risk civic spaces and projects that have made a positive difference to people’s lives. In addition, activists need to establish a joint lobbying focus for constructing a legal framework that facilitates the emergence of new civic spaces in urban and rural areas.

Abstract In 2015, Montenegro’s oppositional alliance Democratic Front (DF) launched ‘Freedom Calling’, a contentious campaign demanding regime change. Although presented as non-partisan, it did feature a party-stemming background. Thus, politics turned civil—meaning that the civil character was a disguise for a planned, creative party endeavour. Methodologically, the authors interpret the DF’s campaign, elaborating on process tracing and applying Tilly and Tarrow’s ‘contentious politics’ approach. They enquire into how the political-party background of the organizers influenced the unfolding of the contentious campaign, thereby addressing the role of parties as initiators of movements. This is especially pertinent in hybrid regimes with formally democratic institutions and persisting authoritarian practices. The Montenegrin case study of contentious (party) politics reveals that, while resources are available, the strong (ethno)political identity label of the party imposes constraints on the construction of a programmatic campaign.

The study expands on the current debate about post-socialist civil society and social movements, specifically in Croatia. Taking the strategic practices of the Croatian feminist movement in relation to the right to abortion in the last decade as the research unit, it employs the conception of post-socialist civil societies, focuses on the practices of civil society, and differentiates between contentious and compliant practices regardless of the form of organisation or engagement. The study examines whether the strategic practices of the Croatian feminist movement have changed in the last decade and, if so, which factors have played the most significant role. The study is based on a critical content analysis of interviews with the actors themselves and draws on their interpretations of the strategic practices. It finds that the Croatian feminist movement has, in the last decade, rethought the dominant compliant strategic practices inherent in the nonprofit sector and the organisations within it and has turned more towards contentious practices. The research described in the paper finds that there are three dominant factors behind the rethinking of the strategic practice: two external – the growing prominence of the conservative movement and the new expected abortion law – and one internal: a generational shift.

Previously, in the Code of Non-Contentious Procedure of 1945, the general part of this procedure had an internal division and contained only general provisions. De lege lata, in the Code of Civil Procedure of 1964, the general part of this procedure has no internal division and also contains provisions that are not general norms. These provisions should be transferred to the part of detailed non-contentious proceedings (art. 526 et seq. of the Code of Civil Procedure).

Si l’on prend tous les recours existants relatifs au contrôle de légalité, c'est-à-dire l'action directe en nullité en vertu de l'article 33 du Code de procédure civile, le mandamus, l'évocation, le quo warranto, l'habeas corpus et l'homologation, il y a certainement place à des regroupements. Il est important, pour tenter une certaine unification, de bien préciser les caractères de la question posée au juge. En d'autres termes, il est essentiel de circonscrire l'objet du litige. Ainsi, les recours pourraient être regroupés en deux blocs de classification : le contentieux visant la nullité de l'acte et un litige avec l'Administration, d'une part, et le contentieux de l'interprétation, d'autre part.

AbstractSince the publication fifty years ago of Robert N. Bellah's classic article “Civil Religion in America,” the concept of civil religion has provoked continuing debates among scholars who study religion and American culture. This essay is a contribution to these debates and an attempt to move beyond them. It considers American civil religion as theory and as practice, examining its meaning through an investigation of how it functioned at an important and too little studied point in its past. Arguing that civil religion is both a cultural and a political construct, it shows how at the close of World War I, a loosely linked network of civic, military, and patriotic groups came together to create a sacralized form of patriotic nationalism and incorporate it into the American civil religious tradition. Contending that the relationships between civil religion and more conventional forms of organized religion are often close and at times contentious, it examines how religious bodies of the time were instrumental in supporting this process and intractable in resisting it. Proposing that civil religion can come in a variety of sometimes competing versions, it discusses the conflicts over civil religious practices that ensued within American churches during the next decade, relying on reports from the time to describe how these conflicts divided church leaders, denominations, and congregations. Finally, working from the premise that civil religious beliefs, symbols, and rituals are invariably involved in the political process, it examines how they became increasingly used for partisan purposes over the course of the decade, raising issues about the relationship between church and state. In closing, it comments on the enduring character of civil religion, and speculates on its continuing importance for American religion and politics.

Western scholars dominating the field generally suggest that civil resistance struggles involve public contention with unjust states to expand political rights and civil liberties. We argue that this perspective is an example of Eurocentric universalism, which has three blind spots: it tends to ignore struggles seeking to subvert rather than join the liberal world system, as well as coloniality's effects on nonviolent action, and emerging subjugated knowledges. We propose going beyond these limitations by learning from social movements focusing on human dignity, material self-sufficiency, and local autonomy, especially in the Global South. Our essay examines two classic decolonizing thinkers (Gandhi and Fanon) and two contemporary decolonizing struggles (the Zapatistas in Mexico and the Abahlali in South Africa). Each emphasizes coloniality, constructive over contentious resistance, transformations in political subjectivity, and emancipatory visions that go beyond Western ideals. We call for further research on the many different stories of civil resistance across the worldwide coloniality line.

The subject. This essay describes the procedural treatment of non-contentious matters inItaly. After a brief historical recount on the evolution of the concept of ‘non-contentiousjurisdiction’, from Roman law to the law in force, the chapter emphasizes the extreme varietyof non-adverse proceedings governed by the Code of civil procedure and special statutesas well.The purpose of the article is to understand the ‘default rules’ of non-adverse proceedings(meaning the rules applicable insofar as the law does not ordain otherwise) provided by theCode of civil procedure. These rules outline a procedure in chambers that is simpler andless time-consuming than the ordinary one: for these reasons, the procedure in chambershas been increasingly adopted for the judicial treatment of a few contentious matters, withmixed results.Methodology. The methodological basis for the study: general scientific methods (analysis,synthesis, comparison, description); private and academic (comparative legal, interpretation,formal-legal).Results. It is difficult to foresee whether in the near future more attention will be devotedby Italian legislators to non-contentious jurisdiction so as to lay down rules that are uniformand consistent. In recent decades, Italian civil procedure has been re-written again andagain in the attempt to solve the most serious and enduring problem of the justice system,namely, the excessive length of proceedings.Conclusions. As far as non-contentious matters, in light of the notorious overload of Italiancourts the author believes that they could be handles more efficiently by administrativeauthorities.

Some specific areas of civil FP are discussed, including tort law reform, reliability of psychiatric evidence, contentious psychiatric disorders, and the many domains of civil FP. Conclusions: Civil FP is an important sub-specialty component of forensic psychiatry that requires greater emphasis in the training and continuing education of psychiatrists. A process of accrediting psychiatrists as having competency in advanced civil FP may be of value.

The starting point for the analysis is the unclear regulation of Art. 4582 of the Code of Civil Procedure which contains a catalogue of commercial matters that is supposed to determine the scope of application of the special contentious proceedings, and which also includes some non-contentious matters. The author takes a critical approach to the above regulation and tries to prove that the provisions on proceedings in commercial matters cannot be applied in non-contentious proceedings.

AbstractThis article shows how voluntary social work in late 19th/early 20th century Copenhagen emerged as the result of several creative re-interpretations of the cultural schemas of revivalist Protestantism as urban revivalists faced the social question. Informed by pragmatist cultural sociology, the concept of “collective soteriology” is introduced as a way of analyzing the Protestant reinterpretations in terms of doctrine, ideals of community, and recipes for action. It is shown how Lutheran revivalist ideas at the same time encouraged, constrained, and shaped the voluntary social action undertaken. The paper aims to uncover a sociologically neglected European tradition of civic action, to contribute to the sociology of Protestantism’s influence on civil society, and to develop a theoretical framework for analyzing the role of ideas in non-contentious collective action.

En France, les affaires dites du siècle et Commune de Grande-Synthe ont une place importante dans le contentieux climatique et s’inscrivent dans un mouvement international de recours portés par la société civile contre les États dans le but de demander la mise en œuvre de mesures concrètes pour diminuer les émissions de gaz à effet de serre (Urgenda, Klimaatzaat, etc.). L’étude est une analyse pluraliste d’un cas en se demandant dans quelle mesure les conceptions du pluralisme juridique – partant du postulat qu’il existe des normes juridiques extra-étatiques et plusieurs méthodes pour en connaître – sont pertinentes pour saisir pleinement les enjeux juridiques de ces types de contentieux. Par une méthode analytique, il s’agit d’abord d’observer éléments entrant dans le champ du pluralisme juridique : la reconnaissance par le juge d’ordres juridiques concurrents et de rapports internormatifs et le recours à une pluralité d’arguments. À partir de la prise en compte des limites à l’office du juge, la démarche sera davantage prospective, en s’appuyant sur la notion de « négociation » comme moyen de développement substantiel de la régulation juridictionnelle du pluralisme juridique et des rapports internormatifs.

The article presents the rights concerning real estates, which are considered in noncontentious proceedings by the court. The author defines non-contentious proceedings, which are a kind of civil proceedings. The scope of non-contentious proceedings involves cases concerning different rights on real estate, for instance: ownership, co-ownership, servitude right of necessity of passage, establishing the necessity of passage, making an entry in the land and mort gage register and in the National Court Register. Besides, there is – in this article – a comparison between non-contentious and contentious proceedings and administrative proceedings. The article describes also the principle of effective judicial protection in non-contentious proceedings. The author proposes amendments in the regulation and in the practice of their application, which are connected with granting more powers to court clerks (referendarz sądowy) and assistants to judges.

The events of 2020 on the territory of the city of Khabarovsk have become a cause for surprise for almost all residents of Russia. Few people could have imagined such a sharp reaction to the detention of the former governor of the Khabarovsk Territory, S.I. Furgal, and the further development of these events among the local community. If by the winter of 2021 the bulk of the protests have outlived their usefulness, do not say that they are impossible in the future. In this regard, the main purpose of the work is to analyze the civil protest activity of the inhabitants of the city of Khabarovsk. Even a small number of factors affecting the civic activity of residents of the city of Khabarovsk explains the sharp reaction to the events taking place in the city. The results of the study allow us to expand our understanding of the phenomenon of growing civic activity in the Russian Far East. The authors of this article consider civil protest as civil activity, a set of public speeches, which are based on the dissatisfaction of individuals with the nature of the existing state-public relations, distrust of the authorities and disagreement with the policy pursued by state institutions. The mass protest movement in Khabarovsk is proposed to be analyzed from the point of view of a special sphere of the political process – contentious politics, "politics of contestation", or "protest politics" in terms of Doug McAdam and Charles Tilly, which is gaining momentum not only in the Russian Far East, but also in the world. The article uses data from sociological research and expert assessments. The conclusions indicate that the Khabarovsk Territory remains a region with serious political risks.
