Access to medication plays a dual role in the balance of interests between the monopoly created by intellectual property law and the protection of public health. Intellectual property law contributes three mechanisms to support access to medication: compulsory license, parallel importation and generic drugs. Furthermore, competition law grants another supplementary method to insure access to medication by insuring a fair competition. However, these mechanisms were not enough to guarantee equitable access to medication because developing countries have met other obstacles in multi laterals agreements. Le présent mémoire doctoral porte sur la transposition du test psychométrique dans une nouvelle langue/culture, ce que j‘ai décidé de nommer, en référence aux plus récentes avancées sur le sujet, le processus d’adaptation. La traduction à proprement parler représente une fraction du processus, lequel vise la démonstration de l‘équivalence entre le test original et le test adapté. Les matériaux de base dudit processus sont les stratégies d‘adaptation (ou simplement stratégies), qui servent à encadrer celui-ci, mais, surtout, à lui conférer sa légitimité scientifique. Dans le premier article, il est question des stratégies d‘adaptation qui font consensus dans la littérature scientifique. Les 17 stratégies d‘adaptation consensuelles ont été ciblées par le biais d‘une analyse de contenu, puis réparties en cinq phases : la Traduction initiale, la Révision interne, la Révision externe, l‘Évaluation quantitative (Testing) et la Supra phase, qui chapeaute les autres phases du processus d‘adaptation. Le deuxième article porte sur les différentes manières de rapporter, dans une publication scientifique, comment un processus d‘adaptation a été effectué. La Grille d’évaluation de la description du processus d’adaptation (G-PA) a tout d‘abord été élaborée par le biais des 17 stratégies d‘adaptation consensuelles. La G-PA a permis de catégoriser les descriptions tirées d‘une recension de la littérature, soit 131 descriptions de processus d‘adaptation effectuées au Québec de 2000 à 2014. La longueur et la complexité des descriptions ainsi que le nombre de stratégie(s) qu‘elles comportent varient énormément. De l‘analyse du corpus découle trois types de description – Libre, Positiviste et Intégrative – selon ce qui est mis de l‘avant pour légitimer le processus d‘adaptation. À la lumière des résultats obtenus, il est possible de conceptualiser le processus d‘adaptation en tant que démarche scientifique à part entière. Or, une telle démarche ne saurait servir uniquement à mesurer l‘équivalence entre la version originale et la version traduite du test. Les résultats illustrent que la démarche vise, dans un premier temps, à négocier le sens de l‘équivalence pour ensuite en extraire une mesure. Lors des trois premières phases du processus d‘adaptation, différents experts réfléchissent sur l‘équivalence des versions et en coconstruisent le sens. Ce n‘est qu‘ensuite, lors du Testing, qu‘il est possible de s‘avancer à propos d‘une mesure ou, plutôt, de la mesure de l‘équivalence. Par la force des choses, la recherche de l‘équivalence en deux temps implique des approches scientifiques distinctes. La légitimité du processus d‘adaptation repose sur ces approches, qui doivent être exposées et différenciées du moment que la connaissance scientifique est visée, ce qui est fait dans la section Conclusion.

It is related to an anthropological approach of the Health of the woman through usual practices and through juridical structure which is self explanatory. Mauritania is with no doubt the Maghreb's country where customs and practices are the most applied. First of all, excision is the one of the most antic tradition already practiced during the Pharaon period. True social and juridical norm. Even religion could not prevent it to happen. Although, no mention is made in the Holy Coran. On the other hand, there is the force-feeding practice, dedicated to the high Maure society, the predominant ethnic group in the country. Purpose is to feed to the maximum the young lady before getting married. At least, slavery, which took place since the expansion time of Islam. Despite the fact that Muslim law does forbid slavery, Mauritania did use slaves for the past. The 2007 law comes at time to cease this practice. Other elements have and influence on the women's health like the conditions of delivery and the violence on which there are subjected. These aspects will be studied in the Maghreb other countries by including a new notion of organ's donation. A comparison will be made between France and Belgium. The purpose being to check if theses usual practices could be transferred to the Occident by the immigrated population and how the old continent reacts

To carry out a comparative analysis of the networks of French and American health ; it is to highlight convergences and the differences in these two forms of assumptions of responsibility. The WHO revealed in his recent report, in 2000, that the healthcare systems of the compared countries recorded results in terms of health which were not with the height of the committed expenditure. However, the increase in the expenditure of health is a major concern with which the whole of the industrialized countries is confronted and are currently in the search of solutions to reduce this expenditure. It is in this context of regulation of self care which the comparative studies take all their direction and in particular when the experiments or the devices set up abroad can make followers and inspire the professionals of French health (insurers, economists of health, doctors, researchers, etc. ). The problems developed in this work, rest on the study of the operation of the networks of health and on that of HMOs. Risk is an inherent aspect of humanlife. Health is one's most precious asset. Undoubtedly, these statements are shared in France and in the US. Nevertheless, once combined together, these two notions not only might be dreadful but also may not be tolerated, unbearable even. Our society has become "risk averse" and individuals, whether they are citizens, patients, or consumers, demand for significantly more protection. If prevention appears to be the best tool to meet their needs, with the caveat that the risk is known, does it, nonetheless, consist in a guaranty, which can be claimed on each side of the Atlantic ? Is it a one-way commitment or do citizens have obligations as well ? The pressing need to prevent the health risk may be contrary to protected liberties, therefore a legal setting is critical to settle conflicts and manage abuses. This study will aim to point out similarities and specificities in implementing preventative health risk acitivities, from both a French and a US standpoint

University selection in access to the medical professions, through its numerus clausus system and its Classifying national tests (ECN), are at the heart of many debates and fantasies. Unique system in French higher education, this selection is justified mainly for economic reasons since the state can not afford to train too many practitioners each year. Problem, the growing impact of medical deserts compels a state that remains subject and confronted with its constitutional obligation to offer and quality care. Faced with this impasse, and to meet the demands of students who have been disappointed by their PACES program, many foreign private initiatives have emerged and offer alternative medical training. Protected by the main principles of European Union law, these establishments, whether Romanian or Portuguese, are strongly criticized by the main trade unions of health professionals, worried by the proportions that the phenomenon takes. If the latter are currently supported by the public authorities, can we, in order to meet the growing demand for care in France, avoid such circumvention?
