Although a casual reading of the Supreme Court of Canada's decisions in R. v. Nikal and R. v. Lewis might suggest otherwise, this thesis will argue that Court's decisions in two recent British Columbia aboriginal fishing cases do not apply in Ontario. Non-Interactive Key Agreement (NIKA) is a cryptographic primitive which allows two parties to agree on a shared secret key without any interaction. Identity-based Non-Interactive Key Agreement (ID-NIKA) allows each party to compute shared secret key using its own secret key and the peer’s identity.
