Annotation:
Carla L. Peterson describes her own experience of seeing one of Dave’s pots on display at the Philadelphia Museum of Art and interprets the Easter imagery in the incised poem, “Good for lard—or holding fresh meats.” Peterson conducts a thorough biblical exegesis of the inscription in connection with the Gospel of John’s account of the graveclothes left behind by the resurrected Jesus and with the figure Peterson names as the other prophet implied within it. Peterson ends by proposing Passover as another religious touchstone for Dave the Potter and thus ascribing a radical ecumenicalism to him and his jar, which is ultimately argued to be Dave the Potter’s Easter service.

Scatter 2 identifies politics as an object of perennial difficulty for philosophy—as recalcitrant to philosophical mastery as is philosophy’s traditional adversary, poetry. That difficulty makes it an attractive area of attention for any deconstructive approach to the tradition from which we inevitably inherit our language and our concepts. Scatter 2 pursues that deconstruction, often starting, and sometimes departing, from the work of Jacques Derrida, by attending to the concepts of sovereignty on the one hand, and democracy on the other. Part I follows the fate of a line from Book II of Homer’s Iliad, where Odysseus asserts that “the rule of many is no good thing, let there be one ruler, one king,” as it is quoted and misquoted, and progressively Christianized, by authors including Aristotle, Philo Judaeus, Suetonius, the early Church Fathers, Aquinas, Dante, Ockham, Marsilius of Padua, Jean Bodin, Etienne de la Boétie, up to Carl Schmitt and Erik Peterson, and even one of the defendants at the Nuremberg Trials, before being discussed by Derrida himself. Part II begins again, as it were, with Plato and Aristotle, and tracks the concept of democracy as it regularly impacts and tends to undermine that sovereignist tradition, and, more especially in detailed readings of Hobbes and Rousseau, develops a notion of “proto-democracy” as a possible name for the scatter that underlies and drives the political as such, and that will always prevent politics from achieving its aim of bringing itself to an end.

Obinger, Herbert. War Preparation, Warfare, and the Welfare State in Austria. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198779599.003.0003.

This chapter shows that war preparation and particularly the two world wars have left a strong and lasting imprint on the Austrian welfare state. First, war and war preparation are important factors for understanding the timing of programme adoption. Second, the economic and social repercussions of war strongly affected the public–private mix and financing mode of the welfare state. Third, welfare provision to the victims of wars had a strong impact on the social spending/GDP ratio that only gradually petered out. Fourth, social provision for the victims of war was a harbinger of modern social policies as it informed innovations in (civilian) disability policies, active labour market policy, and long-term care. Finally, war drastically altered the political context in a way that has allowed the welfare state to flourish in the post-war period (via e.g. democratization, a changed distribution of power resources, corporatism and consensus democracy, and centralization of government).

This is a new edition of the established authority on the law relating to directors of companies incorporated under the UK Companies Acts. The new edition features all important developments in the law including the Small Business, Enterprise and Employment Act 2015 which improves transparency (including requiring directors to be natural persons unless exceptions apply), simplifies company filing requirements, clarifies the application of general duties to shadow directors, modernises directors’ disqualification and reforms insolvency law to facilitate proceedings where there has been wrongdoing. There has been a wealth of new case law relevant to directors’ duties before the English courts, all of which are analysed and explained, including the Supreme Court decisions in Prest v Petrodel Resources, Jetivia v Bilta (UK), FHR European Ventures v Cedar Capital Partners and Eclairs Group v JKX Oil & Gas, the Court of Appeal decisions in Smithton Ltd v Naggar and Newcastle International Airport v Eversheds as well as the important High Court decisions in Universal Project Management Services v Fort Gilkicker, Madoff Securities International v Raven and the wrongful trading case, Re Ralls Builders. Non-UK cases are also analysed including Weavering Macro Fixed Income Fund Ltd v Peterson in the Cayman Islands’ Court of Appeal and the 2016 decision of the Hong Kong Court of Final Appeal Chen v Jason. In keeping with developments in case law and legislation the book now includes expanded coverage of multiple derivatives claims, directors’ exposure to third party claims and a new chapter on civil remedies for market abuse. The third edition is a complete reference work on the law relating to company directors and is the first port of call for all serious corporate lawyers and scholars on this subject.
