This chapter discusses the most common forms of treaty instrument, namely those entitled ‘treaty’, ‘convention’, ‘agreement’, and ‘protocol’. Generally speaking, the designation ‘treaty’ has been reserved for international agreements of a particularly significant character, or to mark the political importance of the particular international agreement. The designation ‘convention’ tends to be utilized for multilateral treaties of a law-making type. The term ‘agreement’, like the term ‘treaty’ itself, is used to cover any meeting of minds, or an agreement intended to be binding, but usually of a less formal or significant nature than a treaty or convention. Finally, the word ‘protocol’ may, depending upon the context in which it is used, signify an addition to a treaty, a summary of official proceedings, or a technique of the proper method of doing things, including official etiquette.

Class action litigation that includes a focus on constitutionally inadequate correctional mental health care systems has been a major and effective force in jail and prison reform during the past four decades. Benefits to correctional mental health systems resulting from such litigation have included increased resources needed to implement basic policies and procedures that are necessary for a constitutionally adequate system. Following the passage of the Prison Litigation Reform Act of 1995, newly initiated consent decrees related to class action litigation involving correctional mental health services significantly decreased. The reduction in litigation related to this act followed from limiting the discretion of judges in approving such decrees that were previously allowed. Private settlement agreements and/or memoranda of agreement or their equivalents (the “Agreement”) have been substituted for the consent decree process. Although the judicial enforcement specific to implementation of these Agreements is weak, the monitoring process of such Agreements is very similar to those previously used with consent decrees. This chapter will summarize the monitoring process frequently involved in an Agreement resulting from a class action lawsuit specific to a correctional mental health care system using a single prison mental health system as an illustrative example. Emphasis will be placed on the importance of developing a quality improvement process that should ultimately eliminate the need for a monitor external to the mental health care system.

One of the main elements setting the scope of application ratione persona of international investment agreements is the definition of the investor. An investment agreement applies only to investors who qualify for coverage under its relevant provisions; only they can submit a claim against the host State. The definition identifies the group of investors whose foreign investment the home country is seeking to protect through the agreement as its ‘nationals’, as well as the ‘clients’ and the investments the host country wishes to attract. This chapter deals with the nationality of the investor, whether a natural or legal person; the criteria used by investment agreements to attribute this nationality, and the arbitral awards that support this qualification. For natural persons, the issues are usually not problematic, although some may arise in particular with regard to dual nationality. For legal persons, the debate remains far more complex.

Preferential access to industrialized country markets can provide an important development opportunity for poorer countries. The targeted development framework suggests that industrialized states will be particularly interested in negotiating such agreements when they value development in a developing state and when the country is in a position to use trade as a catalyst for growth. This chapter analyzes the case of the Dominican Republic-Central American Free Trade Agreement (CAFTA-DR) to demonstrate the difficulty of understanding the signing of such agreements through traditional political economy explanations and the advantage of incorporating targeted development considerations. It then proceeds to a dyadic analysis of the signing of trade agreements, finding that agreements are more likely with countries where development is a high priority for the industrialized country and those that have reached a sufficient level of development to benefit from preferential market access.

Plato’s dialogues make abundant use of the verb homologein, invariably translated ‘to agree’. Plato makes extensive use of the verb in its declarative use both in narrative reports of what Socrates and/or his interlocutors said and in direct discourse, as when Socrates invites an interlocutor to homologein that such and such, reminds him that a short while ago he agreed that such and such, and so on. We misunderstand the dialectical situation represented in Socratic discussions if we translate homologein as ‘to agree’. Socrates is interested in whether an interlocutor gives it as his opinion that p, in other words whether he maintains that p. He should not be construed as inviting the interlocutor to agree with himself that p, even when he uses the verb homologein. This thesis has implications for understanding the nature of Socratic examinations and undermines some arguments for a so-called constructive reading. Many Socratic examinations are more confrontational and less co-operative than has been supposed.

The chapter then closes its first section with questions of form and terminology. The chapter also deals with the formalities in the drawing up of treaties. This chapter continues the typology of treaties begun in the previous chapter. ‘Pacts’ in an international context refer to formal agreements between States. ‘Act’ meanwhile constitutes a piece of international law-making and may embody the decisive terms of the treaty complex. ‘Modus vivendi’ is used for a temporary or provisional agreement. ‘Declarations’ may be defined under the general heading of ‘unilateral acts’. The treaty concluded in the form of an Exchange of Notes or letters is the most frequently used device for formally recording the agreement of two governments upon all kinds of transactions. An MOU records international ‘commitments’, but in a form and with wording which expresses an intention that it is not to be legally binding. Finally, the term ‘Final Act’ is normally used to designate a document recording the formal summary of the proceedings and outcome of an international conference.
