Resumen
The criminal association was a criminal offense of the Joint Plan and Conspiracy, or a special form of Crime against Peace, which was highlighted as such in the Nuremberg and Tokyo trials. In the recent practice of international criminal courts, this institute is used in a certain way, but its function is often subordinated to political abuses. By labeling certain political regimes as a “criminal association” by the so-called international political elites are provided with a wide margin of maneuver to justify their “humanitarian interventions” which are the consequence of a common criminal goal. From the middle of the 20th century until today, it is possible to identify violations of international law that occurred as a result of the activities of a criminal association, which continues with increased intensity. If the covert activities of real criminal associations continue, the main outcome will not be the achievement of world peace, but hegemony. In order to prevent this tendency, it is necessary to redefine the place of the Criminal Association in international criminal law, to point out the permanent cases of their actions, their subjects and the ways in which these same subjects avoid responsibility.

It is often maintained that the criminal law is supposed to intervene only when a certain social norm has become so significant within a given society to justify its protection by means of penal sanctions. The criminal law is thus thought to mirror a hierarchy of values it neither shapes nor contributes to building; rather, it is required to stand at least one step behind social change. This article challenges this view, presenting a normative account that contributes to the debate on what is permissible for the criminal law to try to achieve. It does so by defining and theoretically substantiating the “transformational function” of the criminal law. The term refers to the use of criminalization and punishment to change, rather than merely reflect, social norms, attitudes, and beliefs alongside, and combined with, non-penal policy-making tools in contested domains. Four operational conditions of legitimacy are identified and discussed. Within such operational boundaries, this article contends that the criminal law can play an important role in promoting social change—i.e., the establishment of new norms and values—as well as helping the coagulation of norms, attitudes, and beliefs not yet fully entrenched within the societal body.

The term criminal procedural function has historically been used by scientists. In order to identify primary issues in procedural functions, the competition principle was analyzed. This strengthened such important issues as separation of prosecution and court functions, parties’ equality, independence of courts etc. Therefore, the concept of three concept functions – prosecution, defence and adjudication – was developed in criminal proceedings. In the context of the Criminal Procedure Law having taking effect, this term was included into the law, including the principle of separation of criminal procedural functions.The aim of this paper is to offer the insight into interpretation of the concept of the criminal procedural function with the special focus on specific issues in function separation. Section 17 of Criminal Procedure Law determines the function of control of restrictions of human rights in a pre-trail. The functions of prosecution, defence and adjudication do not determine their priority over all other criminal procedural functions. These functions are claimed to be separate and therefore cannot be applied to the same person.

AbstractThe establishment of the International Criminal Court provides an opportunity to re-think international criminal law and procedure, and to develop a more coherent theory of international criminal justice. This article argues that increasingly the demands placed upon international criminal trials go beyond the process of securing convictions. There is an increasing expectation that such trials will contribute to broader processes of social recovery and reconciliation. Claims are also made for their having a pedagogical and documentary role. To this end, the author proposes the recognition of an historical function of international criminal trials. This is suggested as best forming part of the variety of policy rationales which underpin the processes of international criminal law. It is conceded that overemphasising the role of history could be dangerous and infringe upon the rights of the accused, but it is argued that underemphasising the role of theory and history is unsatisfactory. The article concludes that recognition of an historical function for international criminal trials involves tensions, but will provide a framework and rationale for a more narrative-based and victimfocused system of international criminal law which might provide an important discursive beginning for victims and affected communities, whilst balancing due process concerns.

The paper deals with the problem of criminal law reaction to behavior of mentally ill, insane offenders who violate or threaten the criminal law protected values. To the preliminary question of whether the criminal reaction is generally justified in regard to quasi-criminal acts of mentally ill persons (which are not criminal in the true sense because they lack mens rea which is a constituent element of each offense), the answer is still yes. There are no other, more appropriate forms of social control, or other legal mechanisms that could more effectively than the criminal law, while respecting the safeguards that have become indispensable in criminal law, protect important goods of the individual or society from the harmful behavior of mentally ill persons. Although the entire criminal law is based on guilt and the subjective attitude of the offender towards the criminal offense for which he is exposed to the social-ethical reprimand, it is excluded in case of mentally ill, insane offenders and implementation of appropriate security measures. Capabilities of criminal law in performing a protective function relative to mentally ill offenders are certainly more modest than in case of perpetrators who can be held accountable. The entire general prevention (whether positive or negative) underlying protective function of criminal law, is almost inconceivable in relation to potential offenders who are mentally ill. Available options are reduced to detention and psychiatric treatment of the mentally ill offender. The application of security measures to insane, mentally ill persons is limited, therefore, mainly to certain aspects of special prevention. Even exercising social control through criminal law differs, significantly, depending on whether we talk about incompetent, mentally ill persons or those who have normal mental abilities.

Executive criminal law or the right of execution of criminal sanctions is the third constituent part of the criminal proceedings which logically follows after the substantive criminal law and formal criminal procedural law. Only the proceedings of execution of types and measures of criminal sanctions prescribed by the law and pronounced in court proceedings give the purpose to its prescription, and that is suppression and prevention of criminality. Since this is a new branch of positive criminal (penal) law, the authors, on the basis of domestic and foreign legal theory, have analyzedat this paper the concept, subject, title, function, sources, characteristics, legal nature and location of this branch of criminal law.

This thesis exammes the interaction of law and medico-psychology in homicide cases, where the defences of insanity and diminished responsibility in particular are raised. If the defendant's mental state is subject to scrutiny through the defences, then expert medico-psychological evidence is required, yet law and medico-psychology have very different understandings on the mind and very different roles with regard to assessing individuals. Expert medico-psychological evidence can be submitted in the consideration of criminal responsibility, when sentencing is concerned with whether prison or hospital is most appropriate, and for release decisions involving judgments about the defendant's potential risk and dangerousness. The examination of the interaction between law and medico-psychology incorporated three dimensions. First, an exposition of the respective theoretical positions of the two disciplines on the mind, detailing the pertinent legislative and common law rules. The second analysed the judicial interpretations of the medico-psychological terms and concepts contained in the substantive law, and in addition, the controls developed through judicial reasoning on the procedural role of the expert and the admission of expert testimony. Finally, the practitioners' perspective is explicated, which was obtained by conducting interviews with lawyers and medico-psychological expert witnesses. There are two facets to the research conclusions, which simplistically stated are: first, in terms of the interaction between law and medico-psychology, the law uses medico-psychological concepts and evidence in a symbolic manner to facilitate legal objectives. Secondly, the examination of the nature of the interaction through the three dimensions exposed the fundamental difference between the theoretical legal debates and the practitioners' perspective. Although the former normally informs legislative and reform discussions, it seems from this research that consideration needs to be given to all the dimensions in future reform debates.

This article intends to analyze treatment and functions assigned to the penalty by our Peruvian Constitution and the way this legal institution is conducted at the prescribed basic penalty level (imposed by the legislator ineach type of criminal offence), the specific penalty level (imposed by the judge according to its individual characteristics in each case) and at the penitentiary enforcement level. Finally recommends some considerations for carrying out a possible legislative reform in accordance with a criminal policy plan within our constitutional framework.
El presente trabajo busca efectuar un análisis en torno al tratamiento y las funciones que nuestra Constitución política asigna a la pena, y la manera como dicha institución se desarrolla en nuestro país con respectoa la pena abstracta (la impuesta por el legislador en cada tipo penal), la pena concreta (la impuesta por el juez luego de una individualización en cada casoconcreto), y su ejecución en el ámbito penitenciario. Finaliza proponiendo algunas consideraciones para una eventual reforma legislativa conforme conun plan de política criminal que se encuentre dentro del marco constitucional.

This dissertation presents as thematic the public and criminal policies about illicit drugs consolidated in the Brazilian legal system. It will be made a critical analysis on the compatibility among the policies on drugs and the constitutional principles of the criminal law in the Democratic State under the rule Law. Due to complexity of social factors that guide the subject, a interdisciplinary approuch will be used, including theorical references of Law and sociological sciences, in onder to establish coherent bonds between those ones. The methodology consists in the bibliographical research of national and foreign sources, the search of data collected in official institutions, and finally, the study of sentences pronounced by the Brazilian Superior Tribunal Federal and of the argentinian Supreme Court. In the theoretical field, it focus in the reasons that justify the ambivalent treatment between dealers and users, as well as the social labelling that represents them. The principles of the Contemporary criminal law will be established as limits to the exercise of the social control by the State, considering the presence of new risks and the consequent expantion of the criminal norm. From there, it Will be developed a study about the preventive and symbolic functions of the criminal law in the contemporary society, especially, about the aspects involving the use of illicit drugs and the traffic s repression. This paper debates the functions of the criminal law in the democratic State undes the rule of Law and establishes the limits to the criminalization of behaviors under the principles of the minimum intervention and ofensivity. After trace these limits, it will be criticize the aspects of the criminal politics that are incompatible with the task of the contemporary criminal Law in order to demonstrate that the international policies of drugs imposes the criminalization of behaviors without considering the local features. This facts implies in the transference to the countries classified as as of transit and producers of the responsibility for the combat to the drug trafficking and in the inefficacy of the directed policies of public health to the consumer by the National System of Public Policies on Drugs (SISNAD).

Esta dissertação apresenta como temática as políticas públicas e criminais sobre drogas ilícitas consolidadas no sistema jurídico brasileiro. Será realizada uma análise crítica sobre a relação de compatibilidade estabelecida entre as políticas sobre drogas e os princípios constitucionais do direito penal no Estado Democrático de Direito. Devido à complexidade de fatores sociais que norteiam o tema, será utilizada uma abordagem interdisciplinar, englobando referenciais teóricos das Ciências jurídicas e sociológicas, preocupando-se em estabelecer vínculos coerentes entre os mesmos. No que diz respeito à metodologia utilizada, a pesquisa bibliográfica de fontes nacionais e estrangeiras e a busca de dados colhidos nas instituições oficiais foi conjugada ao estudo de decisões judiciais do Superior Tribunal Federal brasileiro e da Suprema Corte argentina. No campo teórico, enfocar-se-ão as razões que fundamentam o tratamento ambivalente entre traficantes e usuários, bem como se demonstrarão os estigmas que recaem sobre os mesmos. Os princípios do direito penal Contemporâneo serão estabelecidos como limites ao exercício do controle social pelo Estado, considerando a presença de novos riscos e a conseqüente pauta expansiva do âmbito de incidência da norma penal. Daí provém o desenvolvimento do estudo sobre as funções preventivas e simbólicas do direito penal na sociedade contemporânea, especialmente, no que diz respeito ao uso de drogas ilícitas e repressão do tráfico dessas substâncias. Este trabalho debate as funções do direito penal no Estado democrático de direito e estabelece os limites impostos à criminalização de condutas pelos princípios da intervenção mínima e ofensividade. Ao traçar esses limites, criticam-se os aspectos da política criminal que são incompatíveis com a tarefa do direito penal contemporâneo e demonstra-se que a política internacional de drogas impõe a criminalização de condutas sem considerar as especificidades locais. Isso implica na transferência aos países de trânsito e produtores da responsabilidade pelo combate ao narcotráfico e na ineficácia das políticas de saúde pública dirigidas ao consumidor dispostas pelo Sistema Nacional de Políticas Públicas sobre Drogas (SISNAD).

Legitimacy of criminal sanction is originated on its own purposes pursued in a state governed by the Rule of Law. That legitimacy should include the penalty as well as security measures, bearing in mind that both are imposed to someone breaking a rule of conduct, and therefore, someone capable to do it. Reviewing penal capacity or criminal liability concepts is required because if penal capacity means the capacity to understand the reality and adjust the behavior to it, and if every legitimate criminal sanction have to be imposed to someone who have the capacity of break it, then security measures also have to be imposed only to people responsible, capable to understand rules and act in accordance. With regard to people not subject to criminal liability they are standing outside Criminal Law and punish them would be illegitimate. In this line, criminal liability should be seen not only as a crime assumption but also as a basic statement for any dialogue the state shall have with the citizens: at the level of crime itself, proceedings and sentence execution .
La legitimación de la sanción penal se deriva de los fines que persigue en un Estado de derecho. Dicha legitimación debe abarcar tanto a la pena como a la medida de seguridad, y tener en cuenta que tanto la pena como la medida de seguridad se imponen a quien infringe una norma de conducta y, por tanto, a quien tiene capacidad para infringirla. Esto presupone revisar el concepto de capacidad penal o imputabilidad,pues si imputabilidad es capacidad para comprender la realidad y adecuar el comportamiento a dicha comprensión, y toda sanción penal legítima ha de imponerse a quien tiene dicha capacidad, también las medidas de seguridad han de ser impuestas solo a imputables. Los verdaderos inimputables son aquellos que están al margen del derecho penal y a quienes resulta ilegítimo imponer alguna sanción. En esta línea, la imputabilidad ha de ser vista no solo como presupuesto del delito, sino como presupuesto de cualquier diálogo que tenga el Estado con el ciudadano con respecto al delito, al proceso y a la ejecución de la pena.

The scientific work aims to produce knowledge. This is not put into question. Although what is the purpose of that work, or if there is any purpose at all, is a question that must be made ex ante any task. The answer resounds: all knowledge must be turned to the instrument, technology in order to improve people's lives. In legal terms, this should be put in technical terms: improving justice, democracy, human dignity, certainty. However, these basic elements - justice, democracy, human dignity, certainty - have great fluidity, which does not allow them to extract a precise meaning. Same phenomenon occurs in the large themes: people, society, State, Law, State of Law, and Democracy. Witch shall be studied in Unitarian philosophical view of the world. Therefore it is necessary to introduce certain methodological warnings, and it explains the option for analyzing these institutes under the attributes of form and function, starting from abstractions up to very precise and contextualized content of those institutes; in order to propose solutions for fighting crime in a democratic way, especially organized crime. And therefore it is to be studied the possibilities of negotiation within the police investigation in Brazilian Criminal Procedural Law
O trabalho científico visa produzir conhecimento. Isso não se questiona. Mas a que se voltará este conhecimento, ou mesmo se possui alguma finalidade, é pergunta que se deve ser feita ex ante qualquer atividade. A resposta ressoa: todo conhecimento deve ser voltado a dar instrumento, tecnologia para melhorar a vida das pessoas. Em Direito, põe-se em termos técnicos: é assistir a justiça, a democracia, a dignidade humana, segurança. Contudo, estes elementos básicos --justiça, democracia, dignidade da pessoa humana, segurança-- possuem grande fluidez, que não permite extrair-lhes um significado preciso. Fenômeno que se verifica nos grandes temas: pessoa, sociedade, Estado, Direito, Estado de Direito, Democracia. Sempre tomando visão unitarista de mundo. Por isso, necessário introduzir advertências metodológicas, e a opção por analisar estes institutos sob sua forma e função, para chegar-se, de abstrações até conteúdos muito precisos e contextualizados. E ao fim propor solução para combate democrático à criminalidade atual, em especial a organizada. E assim estudar as possibilidades de negociação no inquérito policial, principal meio de investigação no Direito Processual Penal Brasileiro

First, this work proposes a study of the origin, elements and application of the Compliance Program or, also named, Regulatory Compliance Program. The aforementioned program is understood as an internal device that corporations use not only to comply with the current legislation but also to prevent and detect legal violations they could be found in or as part of the activities they carry out.Second, it tries to explain and develop the connection between, on one hand, the new risks in the financial and technological development and, on the other hand, Criminal Law as a protective body of important legal assets for society. The aim is to analyze Criminal Compliance to get the corporationto manage its activities under current legislation, especially Criminal Law.In this regard, it enlarges the sectoral developments based on the Peruvian Government’s implementation of the the Compliance Program in the legal framework.Finally, it analyzes the impact of Criminal Compliance in the criminal legal framework. For that end, it refers to the criminal liability system in Peru and in what way it impacts on the application of Criminal Compliance.
El trabajo propone, en primer lugar, un estudio del origen, los elementos y la aplicación del Compliance Program o, también llamado, Programa de Cumplimiento Normativo, entendido como un dispositivo interno que las empresas implementan para cumplir con la normatividad vigente, así como para prevenir y detectar las infracciones legales que se produzcan dentro de las mismas o como parte de las actividades que estas realizan. Asimismo, se intenta explicar y desarrollar la relación entre los nuevos riesgos, debido al desarrollo económico y tecnológico, y el derecho penal como ente protector de bienes jurídicos de importancia para la sociedad. Esto último tiene como finalidad analizar el Criminal Compliance, destinado a que la empresa ordene su actividad conforme a la normativa aplicable, en especial la ley penal. En tal sentido, se desarrolla la aplicación que el Estado peruano ha realizado del referido Programa de Cumplimiento Normativo en el ordenamiento jurídico, en concreto los avances sectoriales. Finalmente, se analiza el impacto del Criminal Compliance en el ordenamiento jurídico penal. Para ello, se hace una referencia al sistema de responsabilidad penal adoptado en el Perú y de qué manera esto impacta en la aplicación del Criminal Compliance.

This chapter lays the conceptual groundwork for the following chapters, and is written in a both philosophical and jurisprudential ink. It starts with a critical analysis of international criminal law as both concept, discipline and placeholder for an anti-impunity agenda. Certain types of crimes are separated into core crimes on the one hand and treaty-based/transnational crimes and supranational crimes on the other hand. The chapter then proceeds along the lines of the jurisprudential foundations of crime, criminal law and punishment. The author advocates for an autonomous punitive power of the international community as the basis of an autonomous international criminal law. Criminalization is based on the protection of fundamental legal interests or the prevention of serious harm. Punishment has an expressive, norm-stabilizing purpose and is intertwined with more general goals of International Criminal Justice. International Criminal Law’s sources range from customary international law over international treaty law to general principles. The DNA of the chapter is thus an amalgamation of comparative legal concepts with the peculiarities of a ius puniendi that lies at the hear of enterprise of international criminal law.

This chapter develops the “public law conception” of the criminal law. By embodying a form of negative reciprocity, the criminal law plays an important role in stabilizing social cooperation. Stabilizing social cooperation with public institutions is the basic function of the criminal law, in the sense of a function that must be adequately discharged regardless of whatever other functions we might wish to achieve by means of the criminal law. Hence, the criminal law is subject to a “fully political standard of justification”: the criminal law is worth supporting if and only if (1) the institutions whose rules it enforces are worth supporting, and (2) its use in a particular context would be consistent with the principles that make those institutions worth supporting in the first place.

Resumen
This paper describes a survey on investigating judicial data to find patterns and relations between crime attributes and corresponding decisions made by courts, aiming to find import directions that interpretation of the law might be taking. We have developed an initial methodology and experimentation to look for behaviour patterns to build judicial sentences in the scope of Brazilian criminal courts and achieved results related to important trends in decision making. Neural networks-based techniques were applied for classification and pattern recognition, based on Multi-Layer Perceptron and Radial-basis Functions, associated with data organisation techniques and behavioral modalities extraction.
