This chapter employs qualitative analysis to apply the Index of Policy Activity (IPA) to nature protection and biodiversity policy in France over a twenty-year period. It extends the application of the IPA to include consideration of two critical aspects of implementation that can shape policy ambition: the support of the policy actors and administrative capacity. The chapter reveals that biodiversity policy has been subject to extensive reforms, which have overlapped with a devolution agenda, leading to increased regionalization of this policy sector. One outcome of this process is that under-resourced regional administrations must shoulder the burden of implementing policy. These findings suggest that France may be engaging in dismantling by arena shifting.

Even before Roman law became a dominant factor in the development of the law, the power to dispose of one’s property by last will or testament was (re-) introduced into the law of succession in many areas of Europe. Customary law restricted the freedom of testamentary disposition to certain categories of property or to a certain share of the estate. Sometimes, dispositions were only possible with the consent of close family members. In the early-modern period, the customary rules restricting testamentary freedom were amalgamated with the complicated Roman system of family protection. By way of example, this chapter examines the development in the pays de droit coutumier of northern France, and in those parts of Central Europe which were influenced by the law of the Sachsenspiegel. In both areas, the Roman rule which required testators to leave a certain amount (the portio legitima) to close relatives was introduced during the sixteenth century while the customary restrictions were loosened. The provisions of the French Civil Code of 1804 and the Prussian General Land Law of 1794 mark the respective end-points of the developments considered. Codified French law, in keeping with the tradition of the Coutumes, restricted testamentary disposition to a certain share of the estate and reserved the remaining share for close family members. Prussian law contained a simplified version of the Roman portio legitima. Both codes betrayed a sceptical attitude towards freedom of testation, which was characteristic of the teachings of many natural lawyers.

This chapter shows the nature and limits of organizational change in the production and sale of sherry over the nineteenth century. Despite an apparent flexibility in responding to increased demand in international markets, a decline in the reputation of sherry caused a rapid drop in sales, as merchants in Jerez and especially Britain sold adulterated and cheap imitation wines. Although there was much talk about protecting the name of sherry in Jerez, this proved difficult because of the diversity of interests within the producing region itself. The big export houses responded to weaker demand for their fine sherries by moving down-market to achieve volume. While the political influence of small growers in France allowed them to capture market power from the merchants by establishing regional appellations and cooperatives, this did not happen in Jerez.

In 1926 Peaches and Daddy (Frances Heenan and Edward Browning) were married, becoming one of the biggest tabloid sensations of the 1920s. Separated in age by about 40 years, their marriage led to new understandings of child marriage as a backdoor to illicit sex and to rumors of pedophilia. It also engergized a generation of reformers, feminists, and social workers, most notably Mary Ellen Richmond, who worked tirelessly to eliminate child marriage in language that placed the welfare of the child first. They worked on many fronts, targeting sexually active adolescents and immigrant families especially, despite the fact that native-born white and black girls and boys were more likely to marry as minors. Feminists in the National Woman’s Party also joined in the struggle, working to equalize the age of consent to marriage and the age of majority on the grounds of legal gender equality, not child protection.

Migration is a shared condition of all humanity. We have all been strangers in a strange land. All humanity lives today as a result of migration, by themselves or their ancestors. Migration is a matter sometimes of choice, often of need, and always an inalienable right. All helpless people deserve to be helped. Offering such help is a commandment and a blessing shared among all religions. Accordingly, as Pope Francis reminds us, our duties to migrants include ‘to welcome’, ‘to protect’, ‘to promote’, and ‘to integrate.’ National borders are not a result of primary natural law, as aren't private property and clothes, ‘because nature did not give [humans] clothes, but art invented them’. National borders depend on social, political and geographical factors. Therefore, faced with current waves of mass migration, in order to establish practices that respond to the common good we need to be guided by three levels of responsibility. The first principle being that ‘in case of need all things are common’, because ‘every man is my brother’. This principle is relative to existence or subsistence and conditions other related issues (such as accommodation, food, housing, security, etc.). Secondly, as part of the fundamental rights of people, legal guarantees of primary rights that foster an ‘organic participation’ in the economic and social life of the nation. Access to these economic and social goods, including education and employment, will allow people to develop their own abilities. Migration is a shared condition of all humanity. We have all been strangers in a strange land. All humanity lives today as a result of migration, by themselves or their ancestors. Migration is a matter sometimes of choice, often of need, and always an inalienable right. All helpless people deserve to be helped. Offering such help is a commandment and a blessing shared among all religions. Accordingly, as Pope Francis reminds us, our duties to migrants include “to welcome”, “to protect”, “to promote”, and “to integrate.” National borders are not a result of primary natural law, as aren’t private property and clothes, “because nature did not give [humans] clothes, but art invented them”. National borders depend on social, political and geographical factors. Therefore, faced with current waves of mass migration, in order to establish practices that respond to the common good we need to be guided by three levels of responsibility. The first principle being that “in case of need all things are common”, because “every man is my brother”. This principle is relative to existence or subsistence and conditions other related issues (such as accommodation, food, housing, security, etc.). Secondly, as part of the fundamental rights of people, legal guarantees of primary rights that foster an “organic participation” in the economic and social life of the nation. Access to these economic and social goods, including education and employment, will allow people to develop their own abilities. In late 1762, Ostenaco returns to a changing Appalachia. The chapter narrates the second half of his life, detailing his adventures with home life, war, land cession, and much else. The year 1763 brings the momentous news of Britain’s final victory over France. With European rivalry now removed, British settlers seem more rather than less intrusive upon Native Americans. Such a reaction prompts both an Indian backlash in the shape of Pontiac’s War and a British administrative scramble to legislate some measures of protection against settler encroachment. Ostenaco is caught up in the consequent maelstrom. Although he maintains his diplomat’s demeanour through the 1760s and the early 1770s, something snaps for Ostenaco in 1775. That year, he witnesses the Cherokee young-blood, Dragging Canoe, stamp his feet and refuse to negotiate with any whites any longer. By 1777 Ostenaco has joined Dragging Canoe’s Chickamauga secessionists. The plot twist in Ostenaco’s story, then, is in how he manages to remain, in his own mind at least, loyally Cherokee while bucking the prevailing Cherokee trend towards surrender. Through a novel turn to non-cooperation, Ostenaco maintains a sense of autonomy from empire till the very end.
