Introductory RemarksThe Islamic law of transactions (mu'amalat) has often been singled outas the most important area of contemporary research in Islamic theses, somuch so that, according to some observers, its priority is even higher thanthat of research in applied sciences and medicine. This status is due to thecritical importance of commercial transactions in the wealth generation andproductivity prospects of contemporary Muslim countries. New researchon issues of conventional fiqh al mu'amalat is essential for the viability andsuccess of economic development programs in Muslim countries. In recentdecades, research interest in fiqh al mu'amalat has been shifting increasinglyto specific themes and development of new operative formulas tostimulate profitable business in the marketplace. Evidently, futures tradingis one such theme where original ijtihad is required to enhance theprospects of economic success, especially in farming and agro-based industriesin developing Muslim countries.The futures market is where contracts for future sale and purchase canbe concluded for standardized quantities and qualities of commodities, currencies,bonds, and stocks. Ever since the large-scale inception of futuresmarkets in the early 1970s, new products and trading formulas in varioustrade sectors involving commodities, options, financial futures, and stockindex futures, among others, have increased so much that futures contractscurrently are available in over eighty commodities, ranging from foodgrains, oil and oil seeds, sugar, coffee, livestock, eggs, orange juice, cotton,rubber, precious metals, and currencies. In terms of volume, futures tradinghas far exceeded trading levels in conventional stocks and, currently, is thesingle most voluminous mode of commerce on the global scale ...

The premise of the adaptability, flexibility, and compatibility of Islamic normative teachings (sharīʿa) to new social contexts is already documented by many scholars, including John Bowen’s On British Islam: Religion, Law, and Everyday Practice in Shari‘a Councils and Michael G. Peletz’s Islamic Modern: Religious Courts and Cultural Politics in Malaysia. Unlike those works, this textbook is organized by theme which provides a unique contribution to our understanding of the overall function of contemporary Islamic law. Such an approach shows that the ‘right’ answer in one country is not necessarily the ‘right’ solution in another Muslim community, which explains the diverse application of Islamic law. The book challenges Wael Hallaq’s observation that the modern codification of Islamic law resulted in the absence of hermeneutical possibilities or led to a single mode of judicial application. Perhaps Hallaq’s proposition is accurate if we examine the function of Islamic law in a specific country. Nevertheless, the book provides concrete examples of the administrative and interpretive techniques of ‘neo-ijtihād’ today. To download full review, click on PDF.

This essay is presented in two sections. Section one is devoted to amarket analysis of options, and section two to a Shari'ah perspective onoptions trading. There is no real shortage of information in the operationalprocedures of options and the various ways in which options areutilized as trading vehicles and hedging and risk-reduction devices. Onthe other hand, there is a shortage of in-depth information analyzingoptions trading from the perspective of the Shari'ah. The second part ofthis essay is tentative, in part because certain aspects of the issue needfurther development and research. The literature on the subject is in itsearly stages and has not reached a stage where consensus on issues canbe identified. This is borne out perhaps by the divided opinion that wehave at present over the basic question of the validity or nonvalidity ofoptions from an Islamic legal perspective. I shall review these twoopposing currents of opinion in due course. Suffice it here to note thatthis presentation does not seek to advocate the validity of those varietiesof options which either directly or indirectly proceed on the charging offixed interest to accounts. This may be said to be one of the distinctivefeatures of the Shari'ah perspective on options-just as it is of all varietiesof commercial transactions in Islamic law.My review of the mechanics of options trading in the first section ofthis essay broadly indicates that options trading does not proceed oncharging of fixed interest, nor does it involve unwarranted risk takingand uncertainty (gharur). Options trading has a logic of its own, whichis dominated by the idea of risk reduction and hedging against excessivelylarge positions in its underlying assets. This book is a collection of essays presented at a conference held inApril 1988 and organized by the Center of Near and Middle Eastern Studiesand the Law Department, School of Oriental and African Studies, Universityof London.Since the mid-I970s, there has been a significant revival of fundamentalIslamic values in several Muslim countries throughout the world. Indeed,a number of Muslim (or perhaps, Islamic) countries like Iran, Pakistan, andthe Sudan have recently taken practical steps towards the total Islamizationof their economic and financial structures. Among the basic characteristicsof an Islamic financial (banking) system is the prohibition of the paymentor receipt of a predetermined (fixed) interest rate which is viewed as usuryand thus prohibited. As an alternative, the Islamic financial system operatesunder the general principle of profit-loss sharing, which effectively transformsbanks into equity-based (investment) firms.As Mallat correctly points out in his preface, the Western notion of profitmaximization does not control the Islamic system. Rather, it is the Shari'ahwhich primarily governs Islamic finance. However, some contributors to thebook, notably William Ballantyne in his introductory chapter, appear to doubtthe feasibility of the Islamic system and its ability to operate in contemporaryeconomies. He argues that "what is required in today's climate, is [amongother things] a restructuring of the Shari'a to fit Western economic concepts"(p. 9-emphasis added).Nevertheless it is my belief, and perhaps the belief of many Muslimscholars in the field, that such a view is unacceptable, for it seems to bein direct conflict with the core of Islam. A basic tenant of Islam is that theShari'ah cannot be changed or restructured to satisfy other lines of thought.Indeed, voluminous contemporary research now exists that demonstrates theviability and relevance of pure Islamic teachings to today's complex economicenvironment. This study aims to find the implementation of hypnoteaching method in fiqh (Islamic law) learning in Madrasah Tsanawiyah NU Sunan Kalijaga, Adiwerna Tegal, Central Java. This research is a qualitative research, which is a case study. Data sources of this research are interviews and varius literature on hypnoteaching. There are two big conclusions in this research. First, the hypnoteaching method is a learning method that involves cognitive, affective and psychomotor aspects of students through positive suggestions. Second, the application of hypnoteaching fiqh learning in the field works effectively related to the synergy between the principles of hypnoteaching and the existing implementation plan of learning. However, there are still inhibiting factors, namely the minimum number of teachers who have competence in the application of hypnoteaching.

Mut'ah marriage or temporary marriage or what is known as contract marriage is a phenomenon that often occurs in Indonesia, this problem must be anticipated because it is detrimental to women and has been forbidden by the Indonesian Ulama Council. The research method used is a normative juridical approach. Normative research or also known as literature law research is legal research carried out by examining library materials or secondary data. The results of the research found stated that Mut’ah marriage is temporary marriage, the Prophet Muhammmad S.A.W has justified the mut’ah marriage for three days and after that the Prophet forbade it forever. Here the Apostle once allowed it at a time which might have taken the form of an emergency as it was permissible to eat carcass meat, if there were no other foods under compulsion.

In this article, I combine textual research with ethnographic data collected at al-Azhar and Dār al-ʿUlūm to investigate how the modernization of traditional religious learning has transformed the character of Islamic legal doctrine. I argue that changes in educational techniques have produced a shift in “episteme”. Whereas traditional religious learning was dominated by language-based conceptions of knowledge, modern reforms have reoriented education towards new conceptions modeled on the natural sciences. This transformation has fundamentally altered patterns of legal reasoning, particularly with respect to ijtihād and taqlīd. I use these observations to urge a rethinking of the perspectives on ijtihād and taqlīd that currently structure Western research on Islamic legal history.

This article is devoted to the problem of Islamic law development in modern times. Economic and political backwardness of Muslim countries and especially the fall of the Ottoman Empire exacerbated the crisis of Muslim social thought. It led to searching the ways out of the current situation. Moreover, the revival movement encouraged theologian lawyers to search the ways of formalizing and popularizing Islamic law among Muslims. Within the framework of the problem, we consider the reasons that infl uenced the process of Islamic Law revival, as well as the results of this process. Economic, social and political events in the Islamic world triggered the processes of the education system modernization, led to the revaluation of Islamic Legal Heritage. All these transformations caused the creation of research centres and number of conferences and weeks devoted to the problems of Islamic law came in response to all the changes.

In recent years the popularity of Islamic insurance policies has grown rapidly with many companies across the world providing this service. London is said to be the hub for Islamic finance. It is well known for welcoming innovative financial methods. The FSA have already authorised the insurance company Salaam Halal to provide policies based on Shariah principles. The FSA, however, announced that they must operate within the same legal framework as all other insurance policies. Consequently English law has to be applied in Islamic policies taken in this country. However, in many aspects, Shariah principles contradict English insurance law. This thesis aims to discover how they contradict and recommend how the Islamic insurance policies can be applied in English law without breaking Shariah principles. As Shariah principles merely provide a wide boundary within which any law can be applied, this thesis analyses English insurance law first, and then discusses how Islamic insurance policies can operate within the English framework. In many cases, English insurance law crosses the boundary of Shairah principles due to its unfair consequences. Consequently making English insurance law fairer could be the best solution to allow the use of Islamic insurance policies under English law. Pragmatically, the thesis focuses mainly on problems within current English insurance law and recommends possible solutions. In many cases, the solutions suggested by the Law Commission are found to be incapable of establishing fairness. The majority part of this thesis is spent trying to establish a fairer framework for English insurance law. This fairer English insurance law is found to be Shariah compliant in most cases. In some cases it is not complaint due to operational differences between the two legal systems. In these cases, the thesis recommends that the Islamic insurer should incorporate certain terms to make policies Shariah compliant without breaching English insurance law.

This dissertation analyzes the development of the Islamic Society of North America (ISNA), a Muslim-American religious association, from the Iranian Revolution to the inauguration of our nation's first African-American president. This case study of ISNA, the largest Muslim-American organization in North America, examines the organization's institution-building and governance as a way to illustrate Muslim-American civic and religious participation. Using nonprofit research and theory related to issues of diversity, legitimacy, power, and nonprofit governance and management, I challenge misconceptions about ISNA and dispel a number of myths about Muslim Americans and their institutions. In addition, I investigate the experiences of Muslim-Americans as they attempted to translate faith into practice within the framework of the American religious and civic experience. I arrive at three main conclusions. First, because of their incredible diversity, Muslim-Americans are largely cultural pluralists. They draw from each other and our national culture to develop their religious identity and values. Second, a nonprofit association that embraces the values of a liberal democracy by establishing itself as an open organization will include members that may damage the organization's reputation. I argue that ISNA's values should be assessed in light of its programs and actions rather than the views of a small portion of its membership. Reviewing the organization's actions and programs helps us discover a religious association that is centered on American civic and religious values. Third, ISNA's leaders were unable to balance their desire for an open, consensus-based organization with a strong nonprofit management power structure. Effective nonprofit associations need their boards, volunteers and staff to have well-defined roles and authority. ISNA's leaders failed to adopt such a management and governance structure because of their suspicion of an empowered chief executive officer.

Die Zeit­schrift für Recht und Islam (ZRI) (vor­mals GAIR-Mitteilungen) ist die Ver­eins­zeit­schrift der Gesell­schaft für Ara­bi­sches und Isla­mi­sches Recht e.V. Neben Nach­rich­ten aus dem Ver­ein befasst sich die ZRI vor allem mit neuen Ent­wick­lun­gen zum und im Recht isla­misch gepräg­ter Staa­ten, gibt einen Über­blick über die Gesetz­ge­bung im In– und Aus­land, berich­tet über aktu­elle Recht­spre­chung und Fatawa, sich­tet jüngst erschie­nene Lite­ra­tur und ent­hält Rezen­sio­nen, Tagungs­be­richte und Auf­sätze.

Eine wissenschaftliche Gesellschaft kann ihren inneren Austausch und ihre Wirkung nach Außen nur sicherstellen, wenn sie ihren Mitgliedern und auswärtigen Interessierten ein zeitgemäßes Diskussionsforum bietet. Angesichts des gestiegenen Bedarfs an zuverlässigen Informationen über das islamische Recht und die rechtlichen Entwicklungen in islamisch geprägten Staaten besteht seitens der GAIR die Notwendigkeit, hierzu einen verantwortungsvollen Beitrag zu leisten. Um dieser Aufgabe gerecht zu werden, wird zukünftig der Schwerpunkt der GAIR-Mitteilungen deutlich stärker auf den fachlichen Diskurs gelegt. Das neue Format deckt neueste Entwicklungen in Gesetzgebung und Rechtsprechung aller Rechtsgebiete im In- und Ausland ab, soweit sie das Recht islamisch geprägter Staaten oder aber Menschen aus solchen Staaten betreffen. Wesentlich ergänzt wird dieses Angebot durch Tagungsberichte, Rezensionen und Aufsätze, in denen auch islamrechtliche Fragestellungen diskutiert werden. Ab 2010 wird darüber hinaus eine eigene Rubrik „Rechtsvergleichung“ aufgenommen, die theoretisch-methodische Aspekte aufgreifen soll. Angesichts des gestiegenen Bedarfs an zuverlässigen Informationen über das islamische Recht und die rechtlichen Entwicklungen in islamisch geprägten Staaten besteht seitens der GAIR die Notwendigkeit, hierzu einen verantwortungsvollen Beitrag zu leisten. Um dieser Aufgabe gerecht zu werden, wird zukünftig der Schwerpunkt der GAIR-Mitteilungen deutlich stärker auf den fachlichen Diskurs gelegt. Das neue Format deckt neueste Entwicklungen in Gesetzgebung und Rechtsprechung aller Rechtsgebiete im In- und Ausland ab, soweit sie das Recht islamisch geprägter Staaten oder aber Menschen aus solchen Staaten betreffen. Wesentlich ergänzt wird dieses Angebot durch Tagungsberichte, Rezensionen und Aufsätze, in denen auch islamrechtliche Fragestellungen diskutiert werden. Ab 2010 wird darüber hinaus eine eigene Rubrik „Rechtsvergleichung“ aufgenommen, die theoretisch-methodische Aspekte aufgreifen soll. This chapter summarizes the main arguments and the main empirical findings, stressing the timeliness of insights gained through this inquiry. It situates this research in the broader international law and political science literature, discussing the implications for policymakers. However disconcerting the dissonance between the Islamic legal tradition and international law may appear, there are more similarities between these two legal systems than the policy world and the scholarship take into account. The chapter discusses the importance of Islamic education in shaping states’ preferences vis-à-vis international conflict management. The inherent diversity of the Islamic milieu cannot be overlooked. International dispute resolution is what states make of it and it is up to them to define these mechanisms. In an important way, international law constitutes a broad enough framework to grant ILS space to tailor conflict management venues to their own needs and preferences, as dictated by their domestic legal systems.

A unique and independent legal framework is important to effectively adjudicate Islamic finance disputes, Sukuk bankruptcies, and Takaful disputes. Currently, these disputes are being adjudicated in common law courts or ineffective arbitration centres where often the Islamic finance transaction is inadvertently converted into a conventional transaction due to the common law nature of the dispute adjudication. In this chapter, a framework is proposed for Islamic finance dispute resolution in the form of the Dubai World Islamic Finance Arbitration Centre (DWIFAC), DWIFAC Jurisprudence Office, the Sukuk Bankruptcy Tribunal (SBT) and the Takaful Tribunal (TT).

This chapter examines the legal opinions (Arabic: fatwa, Turkish: fetva) issued by the chief Islamic legal authorities of the empire (şeyhülislam) concerning maritime violence and explores the implications of their rulings for judges and litigants throughout the empire and for the corsairs based on its margins. Drawing on research in sixteenth- and seventeenth-century fetva collections, the chapter establishes the kinds of legal questions that piracy and captivity posed for the Ottomans and how they were answered as the intensity, frequency, and focus of Mediterranean piracy mutated in sometimes alarming ways. Showing how secular, interstate, and Islamic law were harmonized through fetvas, the chapter lays the groundwork for the subsequent analysis of the convergence of theory and practice in Ottoman courts.

This study examines the potential application of forensic accounting in detecting and preventing of fraudulent activities in the administration of Islamic inheritance in Kano State, Nigeria. Data were collected through semi-structured interviews with some selected experts who are aware of Islamic inheritance and forensic accounting. Thematic analysis was used. The study established the nature and forms of the fraudulent activities committed in the administration of Islamic inheritance, such as non-compliance with the provision of Islamic inheritance law, hiding some inherited estate, the non-usage of professional valuers and the advice of experts, misappropriation of inherited cash, mismanagement of inherited wealth, etc. The key fraudsters include the eldest heirs, the parents of heirs (particularly mothers), court officials, estate valuers, relatives and the trustees of the deceased. The respondents strongly believe that forensic accounting could be used as a reliable instrument to detect and prevent such forms of fraudulent activities.

"Divorce is considered a form of family disintegration that leads to the demolition of the family and family pillars after its construction through the marriage contract and then the termination of all social ties between husband and wife and often between their relatives. Divorce rates have risen to frightening levels that threaten our Islamic societies. Among the most important causes of divorce in our society are the following: The failure of one or both spouses in the process of adapting to the other through the different nature of the spouses and their personalities, the interference of the parents, the lack of harmony and compatibility between the spouses, the bad relationship and the large number of marital problems, the cultural openness, the absence of dialogue within the family. Several parties have sought to develop possible solutions to this dangerous phenomenon in our society, including: Establishment of advisory offices to reduce divorce by social and psychological specialists, and include the issue of divorce within the educational and educational curricula in a more concerned manner that shows the extent of the seriousness of divorce and its negative effects on the individual, family and society, and the development of an integrated policy that ensures the treatment of the causes and motives leading to divorce in the community, as well as holding conferences. Scientific and enlightening seminars and awareness workshops and the need for religious institutions and their media platforms to play a guiding and awareness role of the danger and effects of divorce on family construction and society, and to educate community members about the dangers of divorce and the importance of maintaining the husband’s bond and stability. As well as reviewing some marriage legislation and regulations, such as raising the age of marriage and reconsidering the issue of underage marriage, which is witnessing a rise in divorce rates. Among the proposed solutions is the demand to withdraw the power of divorce from the man's hands and place it in the hands of the judge, to prevent certain harm to women, or as a means to prevent the frequent occurrence of divorce. The last proposition created a problem that contradicts the stereotypical image of divorce in Islamic law, for which conditions and elements have been set, especially since Islamic Sharia is the main source of personal status laws in most Islamic countries. Therefore, the importance of this research is reflected in the study of this solution and its effectiveness as a means to prevent the spread of divorce, and not deviate from the pattern specified for it according to Sharia."

Bairén fortress archaeological park. A valorisation project within the context of designing new politics of heritage tourism for the city of GandiaThis work emphasises the cultural value of archaeological heritage through the design of an archaeological park at the Islamic fortress of Gandia. The city, heavily tight to traditional tourism visitors, attracted by climatic easiness and beach facilities, tries now to develop an alternative course of action in order to complement its offer. Therefore, a wide project has been designed so as to put all the efforts together and get present a complete valorisation project within the current renewal dynamics regarding tourist local products. Beyond heritage and tourism, this text focuses on the importance of research and innovation in heritage politics driven by municipal institutions.

In the last 20 years the field of cultural heritage has experienced a revolution in terms of documentation methods. The latest technological advances in laser scanners and photogrammetry have opened the possibility of documenting in three dimensions all types of monuments and sites regardless of their size or complexity. In this revolution fortified spaces have not been an exception. Hundreds of research teams around the world have developed 3D digitization projects of castles and fortresses. However, the overall impact of these projects has been very limited, partly due to the lack of collaboration and partly due to the inability of citizens to freely access the data. Currently, the research team of the US non-profit entity Global Digital Heritage is working on the massive digitization of fortifications in Spain, regardless of their chronology or size. In this context, work has been done on digitizing the prehistoric fortified site of Motilla del Azuer in Daimiel, the Iberian oppidum of Cerro de las Cabezas in Valdepeñas, the fortified Islamic city of Calatrava La Vieja in Carrión de Calatrava, the medieval Christian castle of Calatrava La Nueva in Aldea del Rey, the medieval-Renaissance castle of Los Vélez in Mula, the watchtower of Cope in Águilas or the machine-gun bunker of the Spanish Civil War in Alhama de Murcia, to name just a few examples.

Walking is an important part of the tourist experience and comfort travel. There is increasing attention to encourage tourists to walk as a mode of sustainable transportation. Emergence of new and diverse forms of data has expand the field of research via text mining analysis. This is an alternative for common research methodology as a good analysis tool to reflect pedestrians’ opinions in spatial design and urban planning. In this regard, the novelty of this paper is to investigate the relationship between walkability and successful tourism in Doha, Qatar by utilizing text mining analysis on a readily available datasets, i.e. the customer generated contents from TripAdvisor. The collected data for tourist attractive places in Doha, Qatar shows higher frequency (connection) of words that reflect the characteristics of each research location and its respective relationship with public transportation (Doha Metro) to support the walkable environment. The findings have determined some users-friendly walking environment especially for research locations like The Pearl, Souq Waqif and Museum of Islamic Arts. On the other hand, it is indicated that the rate of Metro use is still low compared to the city’s population and this will take some time for Doha Metro to be used as main mode of transportation among the tourists. The outcome of this study will enable to propose some guidelines to enhance the walking environment for tourists within the challenging weather condition like hot and arid climate of Qatar

Background: Oil palm Dodos workers manually harvest the palm fresh fruit which can cause work related musculoskeletal disorders (WMSDS). Holistic self-care by combining stretching exercises and breathing techniques is believed to be able to overcome work related skeletal muscle disorders. The study aimed to conduct a systematic review of research articles identifying the effectiveness of holistic self-care in overcoming work-related skeletal muscle disorders in Riau palm Dodos workers, and identifying the frequency of implementing holistic self-care. Subject and Method: A systematic review was conducted through electronic database, including Google scholar, Science Open, and ScienceDirect. The keywords used were “musculoskeletal disorders” AND “stretching exercise” AND “breathing technique”. The articles were collected between 2009 to 2020. Results: The article analysis used in this study were 4 articles. The effectiveness of holistic self-care (stretching exercise and breathing technique) showed 30 minutes of exercise per day for 5 days per week for a period of 6 weeks can overcome the skeletal muscle disorders caused by work related neck, shoulder, upper, and low back pain in workers. Conclusion: Holistic self-care (stretching exercise and breathing technique) overcomes work related musculoskeletal disorders in workers.
