Carl Schmitt hat sich einer öffentlichen Klärung seiner Haltung in der NS-Zeit verweigert. Allerdings unternahm Schmitt nach 1945 eine Art indirekter Beichte in Form eines Berichts, gerichtet an den prominenten Jesuiten Przywara: Spiegelung des eigenen Selbst in der Rolle eines Kapitäns, auf dessen Schiff das Kommando in Wahrheit längst von den meuternden Sklaven übernommen worden ist (nach Melville, Benito Cereno). Annäherungsversuche an das katholische intellektuelle Milieu blieben ohne Resonanz. Der Briefwechsel mit Rudolf Smend dokumentiert die Hochachtung für Schmitts wissenschaftliche Leistungen bei gleichzeitiger Reserviertheit hinsichtlich der von Schmitt eingenommenen politischen Rolle. Von den eigenen Schülern gedrängt, geht Smend widerwillig schließlich stärker auf Distanz zu Schmitt. Der Sündenbockmythos wurde im Laufe der Zeit immer kompakter. Walter Benjamins Dankbarkeit für Schmitts Anregungen wird in der linken Szene zunächst als peinlich übergangen. Fasziniert von der starken eschatologischen Dimension im Werk Schmitts hat der jüdische Philosoph Jakob Taubes, Exponent einer linken Eschatologie „von unten“, den Kontakt zu Schmitt gesucht. Taubes, der die erheblichen Differenzen mit Schmitt nicht verschleiert, beruft sich ausdrücklich auf die höhere ethische Dignität von Verzeihung und Nachsicht. In diesem Horizont werde es möglich, die Stärken der Theorie Schmitts zu würdigen und ihre dunklen Seiten auszuhalten.

O artigo se propõe a sustentar a atualidade do pensamento schmittiano no que concerne ao conceito de guerra e a sua atual transição para a noção de guerra global. Schmitt previu, com grande clarividência, aquilo que começou a ocorrer nos últimos anos do século XX e que continua se desenvolvendo ainda mais nos dias atuais: uma “guerra global” assimétrica, conduzida pelas grandes potências dotadas de meios de destruição em massa, in primis por parte das potências capitalistas e liberais anglosaxônicas. Ao final, ver-se-á que se trata de uma guerra total, não mais submetida a limitações jurídicas e, portanto, absolutamente destrutiva, mas, todavia, considerada não somente “justa” como também “humanitária”, pois é concebida como uma ação de polícia internacional contra os inimigos da humanidade: contra os novos bárbaros e os novos piratas.

Les textes de droit international de Carl Schmitt sont analysés d’un double point de vue : l’émergence du droit international en tant que discipline universitaire dans l’Allemagne de Weimar et le dégagement de l’épistémologie sous-jacente aux analyses juridiques de Schmitt. Le premier aspect permet de mettre en lumière les sources de l’idéologie d’une génération de juristes allemands nationalistes et souverainistes. Il conduit à relativiser la singularité des positions schmittiennes. Le rapport aux événement politiques, mais aussi aux disciplines consacrées que sont le droit public et l’histoire, éclaire l’ensemble des résistances que Schmitt oppose à la construction du droit international comme science neutre et objective. Le second aspect vise à arracher Schmitt à l’univers de l’irrationalisme romantique que certains considèrent comme le sien. L’analyse de l’écriture théorique de Schmitt, notamment dans son histoire du droit international (Le nomos de la terre), sert à mettre en évidence le matérialisme et le nominalisme du juriste, sous la façade spiritualiste
The texts of international law of Carl Schmitt are analysed from a double perspective: the emergence of international law as an universitary subject in Germany of the Weimar Republic and the reconstitution of the epistemology underlying the juridical analyses of Schmitt. The first aspect allows us to throw light on the sources of souverainism and nationalism of a whole generation of legal scientists. This leads to relativize the singularity of Schmitt’s position. The relation to political events but also to the established disciplines like constitutional law or history sheds light on the resistances that Schmitt opposes to the construction of international law as a neutral and objective science. The second aspect aims at separating Schmitt from the romantic irrationalism that characterized his thought in the eyes of many people. The analysis of his epistemology, particularly in his history of international law (Nomos of the Earth), reveals Schmitt’s materialism and nominalism behind the spiritualistic façade

This study will address the life and work of Carl Schmitt, highlighting his legal theory, his relationship with the Nazi regime and the impact of his ideas on the process of Nazification of German law. Schmitt was a controversial thinker of the 20th century, whose legal reflection was intertwined with his political ideas and the historical context of his time. His theory of decisionism established a direct correlation between Law and Sovereignty, questioning formal normativism and liberalism. Despite being criticized for his affiliation with the Nazi party in 1933, his legal work is considered profound and coherent, deserving scientific study independent of ideologies. During the Weimar Republic, Schmitt feared the crisis and fragmentation of the German State and defended exceptional powers for the President of the Reich. The rise of the Nazis to power surprised him, but he tried to realize his constitutional theory of the "Total State", which ended up influencing the Nazification of law. The use of general clauses and vague concepts allowed the interpretation of norms in accordance with the Nazi worldview. Schmitt argued that judges should fill out the content of the clauses in accordance with the Führer's vision, aligning the courts' actions with the interests of the German people. Schmitt's relationship with the Nazi regime was ambiguous, oscillating between moments of support and distrust of Hitler. The work highlights the importance of historical contextualization to understand Schmitt's reflections and the impact of his ideas on the application of law during the Nazi period. The research seeks to offer a critical and independent analysis, aiming to deepen the understanding of the thinker and his legacy, which still resonate in contemporary debates on law and politics.

This work is devoted to study of transformations equations between Binstr, Ginstr, Rinstr photometric system of 28-cm Schmidt-Cassegrain telescope mounted in NCAS KFU to standard Johnson—Cousins BJ , VJ , RC using modern numerical methods. Observations of Landold Standards at the SA110 region were performed. Absolute photometry of selected stars was obtained with estimatiuon of observational errors. To transform the observational data into the standart system numerical model was built with the use of Markov Chain Monte Carlo sampling. So, we found average parameters of transformations between systems (color reduction coefficients are 0.165, −0.120, −0.378 for B0 J , V 0 J , R0C in dependence of (B − G)0 instr, (G − R)0 instr, (G − R)0 instr respectievely) and medium extinction at the observational period (0.276, 0.205, 0.159 for Binstr, Ginstr, Rinstr respectievely).

Carl Schmitt’s concept of nomos defines the control of physical territory as the fundamental action allowing an autonomous and self-regulated society to form.1 (While land control has both negative/defensive and positive/normative aspects, here I will focus solely on the later.2,3) The positive control of land defines the incremental, value based decisions as to where, when, and to what end land is developed. As Lefebvre and Harvey have shown, the totality of long-term land development decision making has a primary and recursive impact on the social, economic, and cultural trajectory of society itself.4 Contemporary planner-developer models pursue the “highest-and-best-use” of land — code for the greatest risk-adjusted financial return.5 Under neoliberalism, governmental protection of public welfare (i.e. non-economic benefits) has eroded.6 The result has been a series of spatially interdependent trends in increased housing costs7, gentrification8, food deserts9, the gig economy10, and delays in family formation11, among others.

This study focuses on the measurement and modeling of large scale geometrical aspects of turbulent jet scalar regions and interfaces. While several previous studies have focused on the small scale geometrical properties using fractal ideas, examination of the large scale geometrical aspects requires the development of what we call generalized fractals, i.e. the scale-dependent generalization of the original self-similar geometric framework. Our work involves the purely meshless approach to the determination of the generalized fractal properties, pioneered by Catrakis, that eliminates the need for grid-based box counting. We investigate the purely meshless generalized fractal approach using experimental databases generated in our laboratories on fully-developed turbulent jets with a Reynolds number of Re ∼ 20,000 and a Schmidt number of Sc ∼ 2,000. In our approach, we examine the dependence of the generalized fractal aspects of the turbulent interfaces at various spatial resolution scales. Our results indicate that the large scale geometrical aspects are strongly scale dependent and amenable to modeling using generalized fractal functions.

Modeling associations between items in a dataset is a problem that is frequently encountered in data and knowledge mining research. Most previous studies have simply applied a predefined fixed pattern for extracting the substructure of each item pair and then analyzed the associations between these substructures. Using such fixed patterns may not, however, capture the significant association. We, therefore, propose the novel machine learning task of extracting a strongly associated substructure pair (co-substructure) from each input item pair. We call this task dependent co-substructure extraction (DCSE), and formalize it as a dependence maximization problem. Then, we discuss critical issues with this task: the data sparsity problem and a huge search space. To address the data sparsity problem, we adopt the Hilbert--Schmidt independence criterion as an objective function. To improve search efficiency, we adopt the Metropolis--Hastings algorithm. We report the results of empirical evaluations, in which the proposed method is applied for acquiring and predicting narrative event pairs, an active task in the field of natural language processing.

Micromixing strongly affects the molecular-scale contact of chemical species in numerous chemical reactions. Understanding the mechanisms governing micromixing lets us explain the relationships between the turbulence structure and the selectivity of the reaction. The micromixing models in the literature for large Schmidt numbers (Sc∼1000) are of two sorts: stochastic models (principally the Curl model) and deterministic models (such as IEM and the “engulfment” model). These models are essentially based on phenomenological considerations and on the properties of small-scale eddies related to the micromixing time. Micromixing can be quantified locally by analysing the products of a local chemical reaction if this reaction is “fast” compared to the micromixing time. This so-called chemical probe method is used in the present work, following the Villermaux method [1] on the [iodide/iodate] chemical reaction. A numerical study is carried out here to compare the different micromixing models with the experimental results of Fournier [2] in a stirred tank. In order to compute the concentrations, mass transfer equations including a reactive term are solved by a pdf model using a Monte-Carlo method. A benchmark proposed here for the micromixing models shows that the engulfment model is the more efficient in evaluating the local power dissipation means of the chemical probe.

Fiber metal laminates (FML) are lightweight hybrid structural materials that combine the ductile properties of metal with high specific stiffness of fiber reinforced plastics. These advantages led to a dramatic increase in such materials for aeronautical structures over the last few years. One of the most common and vulnerable defects in FML is impact-related delamination, often invisible to the human eye. Guided ultrasonic waves (GUW) show high potential for monitoring structural integrity and damage detection in thin-walled structures by using the physical phenomena of wave propagation interacting with the defects [1]. The focus of this research project is on describing an inverse solution for the detection and characterization of defect in FML. Model-based damage analysis utilizes an accurate finite element model (FEM) of GUW interaction with the damage. The FEM is developed by project partners from mechanics at Helmut-Schmidt-University in Hamburg, Germany, and will be treated as a black-box for further analysis. A Bayesian approach (Markov chain Monte Carlo) is employed to characterize the damage and quantify its uncertainties. This inference problem in a stochastic framework requires a very large number of forward solves. Therefore, a profound investigation is carried out on different reduced-order modeling (ROM) methods in order to apply a suitable technique that significantly improves the computational efficiency. The proposed method is well illustrated on a simpler case study for the damage detection, localization and characterization using 2D elastic wave equation. The damage in this case is modeled as a reduction in the wave propagation velocity. The inference problem utilizes a parameterized projection-based ROM coupled with a surrogate model [2] instead of the underlying highdimensional model. On 20 September 2022, an outbreak of the Sudan strain of Ebola Virus Disease – SVD – was announced as the first laboratory-confirmed patient was identified in a village in Mubende District in central Uganda. Uganda’s Ministry of Health (MoH) activated the National Task Force and developed and deployed a National Response Plan, which includes the activation of District Task Forces. The target areas include the epicentre (Mubende and Kassanda districts) and surrounding areas, as well as Masaka, Jinja and Kampala cities. This is of great concern, as Kampala is the capital city with a high population and linkages to neighbouring districts and international locations (via Entebbe Airport). It is also a serious matter given that there has been no outbreak of Ebola before in the city. This brief details how Risk Communication and Community Engagement (RCCE) activities and approaches can be adapted to reach people living in Greater Kampala to increase adoption of preventive behaviours and practices, early recognition of symptoms, care seeking and case reporting. The intended audiences include the National Task Force and District Task Forces in Kampala, Mukono, and Wakiso Districts, and other city-level RCCE practitioners and responders. The insights in this brief were collected from emergent on-the-ground observations from the current outbreak by embedded researchers, consultations with stakeholders, and a rapid review of relevant published and grey literature. This brief, requested by UNICEF Uganda, draws from the authors’ experience conducting social science research on Ebola preparedness and response in Uganda. It was written by David Kaawa-Mafigiri (Makerere University), Megan Schmidt-Sane (Institute of Development Studies (IDS)), and Tabitha Hrynick (IDS), with contributions from the MoH, UNICEF, the Center for Health, Human Rights and Development (CEHURD), the Uganda Harm Reduction Network (UHRN), Population Council and CLEAR Global/Translators without Borders. The global pandemic has brought renewed attention toward the everyday challenges in informal settlements. COVID-19 reminds us that southern urban life is rooted in ‘collective’ experiences where toilets and kitchens are shared by multiple families; where the categories of work and home, private and public space overlap; and where the majority live in vulnerable conditions. Despite these challenges, some of the most innovative and collective responses to COVID-19 have emerged from these areas. While informal settlements did face a host of risks and vulnerabilities during the pandemic, local responses have highlighted the resilience of informal settlement communities. However, few informal settlements are actually ‘resilient’ and any local responses must be robustly supported by system-wide change including support from local and national governments, improvements to built infrastructure, and improved access to health care services, among other priorities. The category of ‘informal settlements’ also captures a wide range of settlement types, from a legal slum to an informal settlement with no legal status, with many other types in between. This underscores the need to address fundamental issues that ‘perpetuate conditions of inequity, exclusion and vulnerability’ while also recognising the needs and contexts of different kinds of informal settlements. Whether COVID-19 helps governments recognise conditions of insecurity and vulnerability to address safe and secure housing and infrastructures remains to be seen. This is an update to the previous SSHAP brief on ‘COVID-19 in Informal Urban Settlements’ (March 2020). This evidence review highlights local responses, grassroots efforts, and challenges around COVID-19 recovery within urban informal settlements in South Asia. It focuses on specific examples from Karachi, Pakistan and Mumbai, India to inform policy responses for COVID-19 recovery and future epidemic preparedness and response. We show how local level responses are shaped in these cities where national and international responses have not reached communities at municipal and sub-municipal levels.
