Carl Schmitt hat sich einer öffentlichen Klärung seiner Haltung in der NS-Zeit verweigert. Allerdings unternahm Schmitt nach 1945 eine Art indirekter Beichte in Form eines Berichts, gerichtet an den prominenten Jesuiten Przywara: Spiegelung des eigenen Selbst in der Rolle eines Kapitäns, auf dessen Schiff das Kommando in Wahrheit längst von den meuternden Sklaven übernommen worden ist (nach Melville, Benito Cereno). Annäherungsversuche an das katholische intellektuelle Milieu blieben ohne Resonanz. Der Briefwechsel mit Rudolf Smend dokumentiert die Hochachtung für Schmitts wissenschaftliche Leistungen bei gleichzeitiger Reserviertheit hinsichtlich der von Schmitt eingenommenen politischen Rolle. Von den eigenen Schülern gedrängt, geht Smend widerwillig schließlich stärker auf Distanz zu Schmitt. Der Sündenbockmythos wurde im Laufe der Zeit immer kompakter. Walter Benjamins Dankbarkeit für Schmitts Anregungen wird in der linken Szene zunächst als peinlich übergangen. Fasziniert von der starken eschatologischen Dimension im Werk Schmitts hat der jüdische Philosoph Jakob Taubes, Exponent einer linken Eschatologie „von unten“, den Kontakt zu Schmitt gesucht. Taubes, der die erheblichen Differenzen mit Schmitt nicht verschleiert, beruft sich ausdrücklich auf die höhere ethische Dignität von Verzeihung und Nachsicht. In diesem Horizont werde es möglich, die Stärken der Theorie Schmitts zu würdigen und ihre dunklen Seiten auszuhalten.

O artigo se propõe a sustentar a atualidade do pensamento schmittiano no que concerne ao conceito de guerra e a sua atual transição para a noção de guerra global. Schmitt previu, com grande clarividência, aquilo que começou a ocorrer nos últimos anos do século XX e que continua se desenvolvendo ainda mais nos dias atuais: uma “guerra global” assimétrica, conduzida pelas grandes potências dotadas de meios de destruição em massa, in primis por parte das potências capitalistas e liberais anglosaxônicas. Ao final, ver-se-á que se trata de uma guerra total, não mais submetida a limitações jurídicas e, portanto, absolutamente destrutiva, mas, todavia, considerada não somente “justa” como também “humanitária”, pois é concebida como uma ação de polícia internacional contra os inimigos da humanidade: contra os novos bárbaros e os novos piratas.

Kaiser shares Jean-François Kervégan’s recommendation to take up Schmitt’s positions in a modified, liberal way. She argues, however, that the way Schmitt analysed and treated problems firmly belongs to the context of his time and pleads for a careful historicization of his positions.

Der Beitrag wendet sich kritisch gegen Versuche, Schmitts Verfassungstheorie zu einer normativ attraktiven Theorie des wehrhaften Liberalismus zu stilisieren. Es wird im Zuge einer genauen Lektüre seiner verfassungsrechtlichen Schriften nachgewiesen, dass Schmitts »Verteidigung« der Weimarer Reichsverfassung eine fundamentale Doppeldeutigkeit im Begriff des »bürgerlichen Rechtsstaats« zugrunde liegt. Schmitt interpretiert den Rechtsstaat zu einer institutionellen Gesamt-Garantie der bürgerlichen Gesellschaftsordnung um. Dieses Verfassungsverständnis lässt sich nicht liberalisieren. Seine Aktualität liegt auf einer anderen Ebene: Es sensibilisiert für den Zusammenhang von »autoritärem Liberalismus« und »illiberaler Demokratie«.

Der Artikel rekonstruiert die Geschichte von Carl Schmitts Reichsbegriff. Die historische Situation im Frühjahr 1939 hatte Einfluss auf den Weg seines juristischen Werks. Der Reichsbegriff war Thema eines Vortrags, den Schmitt in das Zentrum seiner „Völkerrechtlichen Großraumordnung“ stellte. Diese im April 1939 erschienene Publikation wurde nach Ausbruch des Krieges mehrfach ergänzt. Der Abschnitt zum Reichsbegriff blieb unverändert. Schmitt unterstützte mit seinen Beiträgen zum Völkerrecht den aggressiven Weg der NS-Politik, der zum Ausbruch des Krieges im September 1939 führte. In einem Essay vom Mai 1939 über das Reich und den Untergang der europäischen Kultur zitierte er frühere Veröffentlichungen. Sie hatten ihn zu einem neuen völkerrechtlichen Gedanken geführt. Reiche, nicht Staaten sollten Träger des Völkerrechts sein. An diesem Gedanken hielt Schmitt auch während des Krieges fest. Sein Essay ist ein Selbstportrait des Juristen Schmitt. Seine Gegner erhoben den Vorwurf mangelhafter Weltanschauung. Sie forderten eine „völkische Großraumordnung“. Im Zweiten Weltkrieg schloss sich Schmitt nicht Ereignissen an, die der Ideologie vom „Lebensraum“ Taten folgen ließen. Mit dem Begriff „Ereignisse“ wurden 1941/42 Kriegsverbrechen in den „Ereignismeldungen UdSSR“ benannt. Die Stäbe des „Reichssicherheitshauptamts“ werteten sie aus. Schmitt ließ den Zusammenhang dieser Verbrechen mit dem Typus des totalen Staats unbeachtet. The article reconstructs the history of Carl Schmitt's concept of the Reich. The historical situation in the spring of 1939 had an influence on the path of his legal work. The concept of empire was the subject of a lecture that Schmitt placed at the center of his “Völkerrechtliche Großraumordnung”. This publication, which appeared in April 1939, was supplemented several times after the outbreak of World War II. The section on the concept of empire remained unchanged. Schmitt's contributions to international law supported the aggressive course of Nazi policy before September 1939. In a May 1939 essay on the Reich and the Decline of European Culture, he cited earlier publications. They had led him to a new idea of the causal connection between empires and international law. Schmitt held on to it even during the war. His essay is a self-portrait of the jurist Schmitt. His opponents raised the accusation of a deficient world view (Weltanschauung). They demanded a "völkische Großraumordnung". In the Second World War, Schmitt did not join events (Ereignisse) that gave action to the ideology of Lebensraum. The term "Ereignisse" was used in 1941/42 to name war crimes in the "Ereignismeldungen UdSSR". The staffs of the Reich Security Main Office (Reichssicherheitshauptamt) evaluated them. Schmitt ignored the connection of these crimes with the type of the total state.

Das Werk Carl Schmitts (1888-1985) wird von seinem Verlag Duncker & Humblot in vorbildlicher Weise betreut. Nahezu sämtliche monographische Titel – nur an sehr wenigen hat der Verlag nicht die Rechte – sind hier lieferbar gehalten, zunächst als fotomechanische Nachdrucke, jetzt zunehmend auf der Basis eines um die Korrekturen Schmitts in seinen Handexemplaren ergänzten und durch Register erschlossenen Neusatzes. Duncker & Humblot ist zudem nicht nur um die selbständigen Veröffentlichungen bemüht, der Verlag hat auch, neben den beiden von Schmitt selbst herausgegebenen Aufsatzbänden, weitere Aufsätze Schmitts in zwei voluminösen, von Günter Maschke vorzüglich edierten und reich kommentierten Bänden vorgelegt. Damit sind optimale Bedingungen gegeben für eine lebendige Rezeption diesseits des Mausoleums einer historisch-kritischen Gesamtausgabe.

Článek vytyčuje základní intelektuální východiska Carla Schmitta. Zabývá se především jeho koncepcí práva, hlavními rysy politické filosofie a jeho přístupem k liberalismu, parlamentarismu, demokracii a nacistické diktatuře. Bere také v potaz, jak k podepření svých tezí využíval historických argumentů. Zvláštní pozornost je věnována pojmu politično, které Schmitt pokládal za nezávislou sféru lidské existence, založenou na rozlišování přátel a nepřátel, prostřednictvím suverénního rozhodnutí držitele politické moci. A právě otázky moci a s tím spojených mocenských rozhodnutí, formují podstatu politiky. Etická a ekonomická kritéria nemusí do této sféry vůbec vstoupit. Přirozeným rámcem, kde je politično aplikováno, je stát, který se vnějškově vymezuje ve sféře zahraniční politiky. V domácí politice je stát založen na identitě vládce (vládců) a ovládaných. Podle Schmitta však ve dvacátém století prošla koncepce politiky a státu krizí se zásadními dopady, spočívající buď na invazi univerzalistických tendencí, které podemílají zvláštní charakter státu, nebo podřízení politiky (jako čistého uplatňování moci) partikulárním zájmům, zákulisním dohodám a kompromisům.

The paper addresses the theology of Carl Schmitt. Schmitt often stresses his ‘natural born Catholicism.’ At the same time he also claims repeatedly not to be a theologian in the professional sense. On the other hand, his main ideas like the concept of the political (Der Begriff des Politischen), the public character of the church (Römischer Katholizimus und politische Form), and finally, his Politische Theologie II in reaction to Erik Peterson’s refutation of Politische Theologie I show that Schmitt’s ideas imply deep and problematic theological positions. The role of the katechon, or the Grand Inquisitor and his criticism of Peterson’s patristic arguments, especially the rejection of the anti-Arian reasoning of Gregory Nazianzen show a markedly unorthodox theological stance reminiscent of Charles Maurras’ political Catholicism. Schmitt’s transcends patristic orthodoxy in order to apply his historically conditioned 19th-century theology to sacralizing his idea of the political.

Abstract“Political theology” is now a fixture within political theory's lexicon. Although Carl Schmitt'sPolitical Theology(1922) is identified as the contemporarylocus classicusfor the concept, that work's primary task is only to elaborate a “sociology of juristic concepts.” Beginning in the 1990s, however, Schmitt's entire corpus has increasingly been interpreted as one motivated by “political theology” in a stronger sense—as political action based upon faith in (Christian) revelation. I challenge this thesis by (1) examining its history, (2) drawing attention to the many aspects of Schmitt's (mostly Weimar-era) work that are deeply at odds with this thesis, and (3) reexamining his (mostly postwar) remarks ordinarily cited to bolster the thesis. Ultimately, the core of Schmitt's thought lies elsewhere; returning to the purported father of political theology brings clarity to the bourgeoning discussion of this topic within the discipline.

Y esta contextualización le permite trasladar a nuestro presente el examen y la comprensión de los problemas de Weimar habida cuenta que la historia de Weimar se encuentra perfectamente viva en el mundo de los problemas contemporáneos.In this book, Ellen Kennedy has made a great and inspiring contextualization of thought of Carl Schmitt. Through new materials has revealed some of the most important keys to the author’s thought and has exposed the reasons for Schmitt’s renaissance in the Anglo-Saxon cultural universe. The author places the constitutional texts in the context of the Weimar Republic as such texts were a chronicle of the trajectory of the German Republic since 1919. This contextualization allows her to move to our present the understanding of the problems of Weimar, experience that is still alive in the current historical live.

The paper presents a theoretical consideration of the basics of philosophy of law of Carl Schmitt, a famous German lawyer and thinker who is the author of a quite controversial law theory, which to this day will not cease to intrigue the professional researchers. The work approaches Schmitt?s thought in an impartial way, and conducts a constructive dialogue with his theory of law and the state, i.e. his philosophy of law, acknowledging Schmitt?s analytical results in defining the relationship between politics and law, but also criticizing his theory where it shows certain exaggerations. The paper presents a simultaneous research of Schmitt?s theory and Schmitt?s biography, trying to show the existential and political reasons why he tried to conform his theory of state and law to the totalitarian political circumstances in which he lived. The paper finally evaluates the value of Schmitt?s theory, which in a clear, descriptive and logical way distinguished two levels of legal thought, distinguishing the very level of constitution of the political-legal order where law is not, in real historical conditions, separate from politics - and the level of the system of positive legal norms itself. In addition to discussing the basic figures of Schmitt?s philosophy of law, the paper also pays attention to Schmitt?s treatment of particular legal-theoretical issues, such as the issue of the state of emergency and sovereignty.

Zur Geschichte dieses Diktums gehört, dass Schmitt mit seiner Äußerung über die Ausnahme in einer Politischen Theologie einen Absatz eines nicht namentlich genannten «protestantischen Theologen» kommentiert. Dass es sich bei diesem um Sören Kierkegaard handelt, ist kein Geheimnis. Der zitierte Abschnitt stammt aus Kierkegaards Schrift Die Wiederholung – Schmitt lässt jedoch stillschweigend drei Sätze daraus unter den Tisch fallen.1 Zunächst fasst Kierkegaard die Beziehung zwischen Ausnahme und Regel ontologisch auf – doch dann legt er plötzlich ihr erkenntnistheoretisches Potential offen: «und wenn man das Allgemeine so richtig studieren will, braucht man sich bloß nach einer berechtigten Ausnahme umzusehen; sie zeigt alles viel deutlicher auf als das Allgemeine selbst.»

Resumo Este trabalho visa a analisar a natureza retórica da obra de Carl Schmitt publicada durante a República de Weimar, a fim de demonstrar que o sentido de seus textos desse período se vincula à finalidade de suas intervenções teóricas. A hipótese do trabalho se sustenta no caráter antirrepublicano da produção conceitual de Schmitt, que se revelou com toda nitidez no momento decisivo da duração da constituição e da República de Weimar, o golpe de 1932 desfechado contra o governo da Prússia, de cuja legitimação Schmitt participou de dois modos: diretamente, por meio da defesa jurídica e política do golpe, e, indiretamente, por intermédio das teses por ele difundidas em sua atividade intelectual, que minaram a legitimidade da República de Weimar.

A questão da representação é central para Carl Schmitt. Em mais de um escrito, tal questão é analisada com detalhes. Além disso, é um tópico recorrente em intérpretes da obra schmittiana. Nosso propósito nesse artigo é voltar à elaboração da noção de representação em Schmitt. Veremos como ele apresenta tal noção, principalmente em sua Teoria da Constituição. A partir da exposição da análise schmittiana, realizaremos uma crítica ao modo como ele elabora tal ideia, apresentando uma maneira distinta de ver a questão: não haveria uma separação entre representação e identidade, como quer Schmitt, mas representação seria ela mesma identidade. A partir dessa crítica, podemos perceber os limites da visão de Schmitt, além de evidenciar os motivos que o levaram a tal noção de representação.

I have devoted part of my work to the political thought of Carl Schmitt, in my opinion one of the most enlightened minds of the 20th century, not only because of his intellectual acuteness, but also because the historical point of view from which he spoke was exceptional: the collapse of the Second Reich, i.e. the absolute end of a world centred on the imperial idea, the rise of the Weimar Republic and its agony in the arms of the Third Reich, and the new international order that took shape after its fall with the total humiliation of Germany, which Schmitt saw as the triumph of liberal Americanist imperialism. Many were Carl Schmitt’s correspondents during his lifetime. Thousands of letters can be found in Schmitt’s archive. Three of these letters were from Leo Strauss. We cannot find the correlative letters of Schmitt. But from the content of the letters we have to deduce that Schmitt did not reply to Strauss, at least not to these three letters. Strange for someone who was in the habit of always replying to letters. These letters were sent between 1932 and 1933 and inform us of an opinion written by Schmitt to evaluate Strauss’s research on Hobbes before the Rockefeller Foundation in order to Strauss to apply for a grant. Strauss won the grant and thanks Schmitt. Many scholars speculate on the idea of Schmitt’s silence and put it down to the dangers of corresponding with a Jew like Strauss at that time. There is undoubtedly a good biographical argument there, but that does not interest me as much as the content of their relationship through their texts.
