We can hardly underestimate the importance of privacy in our data-driven world. Privacy breaches are not just about disclosing information. Personal data is used to profile and manipulate us – sometimes on such a large scale that it affects society as a whole. What can governments do to protect our privacy? In The Governance of Privacy Hans de Bruijn first analyses the complexity of the governance challenge, using the metaphor of a journey. At the start, users have strong incentives to share data. Harvested data continue the journey that might lead to a privacy breach, but not necessarily – it can also lead to highly valued services. That is why both preparedness at the start of the journey and resilience during the journey are crucial to privacy protection. The book then explores three strategies to deal with governments, the market, and society. Governments can use the power of the law; they can exploit the power of the market by stimulating companies to compete on privacy; and they can empower society, strengthening its resilience in a data-driven world.

This book is edited by three leading authorities and written by a team of expert specialists in the field from around the EU and representing different sectors (including academia, the EU institutions, data protection authorities, and the private sector), thus providing a pan-European analysis of the GDPR. Whether they train police forces in Afghanistan or provide military assistance to governments in Africa that are battling rebel groups, private military and security companies (PMSCs), or corporations that provide security and military services for profit, have been present in numerous conflicts around the globe. In 1984 only one international PMSC intervened in a civil war; in 1989 there were 15 international PMSCs present in conflict zones, while from 2003 to 2019 over 120 of such companies provided services during the Iraq war. Why do international PMSCs sometimes help with conflict termination while in other cases their intervention is associated with prolonged wars? And in what ways does market competition affect PMSCs’ military effectiveness? Relying on quantitative analysis of original data on international PMSCs’ involvement in civil wars from 1990 to 2008 and PMSCs’ human rights and fraud violations in Iraq from 2003 to 2019, the book investigates how local and global competition impacts accountability of these non-state actors and their contribution to the termination of major and minor wars.

Abstract The monetization of personal data has become an increasingly common business practice, igniting global debate on the interface between data privacy law and competition law. Data Privacy and Competition Law in the Age of Big Data provides a comprehensive, novel, and interdisciplinary analysis of this nexus. Drawing insights from emergent properties and complexity science, it exposes the commonalities and conflicts between how data privacy law and competition law address challenges resulting from the commercialization of personal data. The book begins by identifying key shifts in big data: the growing trend of processing personal data for diverse purposes, the aggregation of data across various operations, and the shift from offering stand-alone products and services to ecosystems of several, with personal data central in connecting the different markets. These shifts engender a complex economic landscape, marked by multiple actors, a web of interactions, and non-linear, emergent outcomes. Despite this complexity, the prevailing approach to data privacy law and competition law emphasizes isolated units of analysis—whether a relevant market or a distinct processing operation. This approach overlooks system-wide (emergent) risks borne of cumulative processing operations and cross-market practices. Additionally, a mindset focused on either data privacy law or competition law overlooks the increasing intersection between the two regimes, missing opportunities for synergy. In light of these challenges, the book calls for recalibrating data privacy law and competition law for a complex economy, emphasizing a holistic, systems-level perspective that addresses emergent harms and a polycentric strategy that leverages the strengths of each legal regime.

This chapter explores the employment performance and capacities of the Tunisian private sector. The analysis relies mainly on data from the annual enterprise surveys and on the TLMPS 2014 data. The size and the structure of the Tunisian labor market are analyzed, showing that the creation of more jobs requires the private sector to invest more, especially in new technologies. The private sector must increase its share in the economy and improve its competitiveness internationally. The intra- and inter-sectoral allocation of employment and variation of labor productivity are described, analyzing the capacity of the economy to improve the quality of labor demand and absorb highly educated young people. The link between firm size and labor demand is also analyzed, showing the need for a new industrial structure with a bigger share of larger and more dynamic enterprises.

G20 leaders vowed to collect and share OTC derivatives trade data so that regulators can obtain a global picture of market and risk evolution. This chapter employs a network perspective to explain why they have failed to meet this commitment to date. It examines three networks: the OTC derivatives market itself, and those of its private and public governance. The analysis shows that the Financial Stability Board (FSB), the public supervisory entity, struggles to establish itself at the center of the global regulatory network. It failed to act as a first mover in setting global trade identification standards (legal entity identifiers), and it has not been able to establish a core of global data warehouses. This is largely the result of unilateral action by FSB members. In particular, legislators in member countries have undermined FSB-led efforts by refusing to remove legal barriers to transnational regulatory cooperation and, in some instances, by erecting new ones.

New technologies have always challenged the social, economic, legal, and ideological status quo. Constitutional law is no less impacted by such technologically driven transformations, as the state must formulate a legal response to new technologies and their market applications, as well as the state's own use of new technology. In particular, the development of data collection, data mining, and algorithmic analysis by public and private actors present unique challenges to public law at the doctrinal as well as the theoretical level. This collection, aimed at legal scholars and practitioners, describes the constitutional challenges created by the algorithmic society. It offers an important synthesis of the state of play in law and technology studies, addressing the challenges for fundamental rights and democracy, the role of policy and regulation, and the responsibilities of private actors.
