INTERNATIONAL LAW AND THE UNIVERSALITY OF THE CONCEPT OF THE SYSTEMThe key feature of international law is that states are primary subjects of this law. This results in other features of international law like high relevance of customary law, ambiguous meaning of the term “treaty”, considerable role of soft law, uncertainty about the effects of reservations to treaties, and above all, the lack of collision rules when two or more treaties bind partly different parties. This all supports the weaker thesis about systemness of international law. The weaker thesis about systemness of international law is not the answer to all questions that can be put in this respect. This is particularly evident in the case of consistency of international law which is seriously jeopardized by the progressive fragmentation. But the conviction of the systemness of international law has also somewhat different purpose than it seems. Namely, it strengthens the argument that international law is the law in the proper sense of the word. It fulfils therefore, to some extent, a persuasive function. International law confronted with domestic law is a kind of so-called “positive morality” for many lawyers. Therefore, the thesis about systemness of international law is so important. For similar reasons, H. Kelsen so firmly stressed that war is a sanction, what justified the view that international law is the law in the proper sense of the word.

A range of alternative media outlets focusing on criticizing immigration politics and mainstream media have emerged in Sweden in recent years. Although they have quite different ideological profiles, they share a clear and critical focus on immigration and mainstream journalistic representations of reality. Their message is that mainstream media conceal or distort information about negative societal and cultural consequences of immigration and that mainstream journalists have teamed up with the political elites and engage in witch-hunts of critics, while ignoring abuses by those in power. Such media outlets (especially online participatory media) need to be analyzed in the light of their position as <em>self</em>-<em>perceived correctives</em> of traditional media. There has been a remarkable surge of alternative media in Sweden with these traits in common during the past few years, and it is important to be able to discuss these media together as a phenomenon, while at the same time taking their differences into account. In relation to this, I argue that the notion of anti-systemness is useful in discussions of the impact these alternative media may (or may not) have on public discourse. In the article, I present a matrix that distinguishes between different types of anti-systemness: ideological anti-systemness and relational anti-systemness. The article therefore mainly presents a theoretical argument, rather than empirical findings, with the aim of pointing to a way forward for research about alternative media.

A growing body of work has emerged regarding the responsibilities required of district leaders in establishing plans that initiate and create conditions for sustainability of continuous improvement achieved through a systemic reform structure such as professional learning communities. However, limited research exists in respect to sustaining cultures of continuous improvement in rapid growth districts. Rapid growth districts can be described as school systems, which construct and open multiple campuses annually. The underlying premise of this study considered how humans interact with one another within a rapidly changing professional organization. Change theory, professional capital, organizational learning theory, and system reform emerge as the conceptual framework in this study of district support of professional learning communities. Data collection for this qualitative descriptive case study included interviewing six K-12 principals, administering the PLCA-DS survey to 247 K-12 staff members, and document review. Recognition of the importance of the PLC framework, building capacity, development of collaborative culture, and issues resulting from constant change due to rapid growth were the four themes generated by the participants to support continuous improvement in a rapid growth district. The four themes combined with the components of the conceptual framework outline how district leaders in a rapidly changing environment cultivate a process leading to system-wide improvement.

In this thesis, the concept of systemness in school systems is developed and tested using an integrated educational analytics framework. Based on using a contemporary meta-analytical approach, the study draws from longitudinal data of an example school system. The educational analytics framework is considered from a system-wide perspective of over 80 schools using longitudinal and real-time data. The conceptual background for this research originated from the analysis of the historical development and growth of school systems in the modern era in which researchers have given a wide-ranging account of the characteristics and attributes of school systems from their elite beginnings in the late 19th century to mass education by the mid-20th century. The study then delves deeper into the reform and transformation of school systems over the past five decades to decipher why these efforts did not succeed in most cases. The lessons learnt from this lack of success formed the basis for this study which sought to identify alternative frameworks closer to the practices and interactions surrounding school systems. A newly conceived six-lens integrated analytics framework using school and school system data is proposed as a more pragmatic, transferable, and replicable approach to gauging systemness and system characteristics before embarking towards transformational efforts. The research contends that the adoption of analytical, systems-focused approaches, complementary to many other approaches, leads to more achievable and sustainable transformation in school systems. Prevailing approaches are criticised as being too nebulous, broad brushed, and incoherent as public policy initiatives. What is needed is a new analytical approach to transformation that percolates the hierarchal layers of systems to reach into schools and classrooms to enhance schooling experiences and improve student learning outcomes. The framework is elaborated and exemplified using contemporary educational analytics to investigate system-held data pertaining to a variety of schooling processes and outcomes. The case study examples demonstrate the power of integrated analytics to drive and monitor system-wide transformation with evidence that is contextual, specific, granular, and real-time. Demonstrably quick, clear, integrated, and compelling, analytics provides new impetus, more nimble system coherence, greater momentum, and potentially a better chance of success in realising transformative strategies. The thesis makes an original contribution to school systems research in several ways. Firstly, this is the first time the novel six-lens, data-driven, integrated analytics framework has been captured and synthesised in the literature. Secondly, the thesis opens alternate paths for reform initiatives devoid of the rhetoric that often surrounds school policy and funding debates in most countries. Thirdly, the thesis unlocks opportunities to further research in analytics with educational and psychological theories (e.g., engagement, motivation, wellbeing, flow theory) to align the reform process more closely to the student and the learning process. Lastly, it provides new insights for governments, policy makers, and educational think tanks to ensure greater investments are made in student- and school system-centric initiatives than in bland compliance.

Disruptive innovators take advantage of unique opportunities. Prior to COVID-19 progress in Latin America and the Caribbean for integrating technology, learning, and system change has been exceedingly slow. In this paper we first offer a general framework for transforming education. The framework focuses on the provision of technology, innovative ideas in learning and well-being, and what we call systemness which are favorable change factors at the local, middle/regional, and policy levels. We then take up the matter of system reform in Latin America and the Caribbean noting problems and potential. Then, we turn to a specific model in system change that we have developed called New Pedagogies for Deep Learning, a model developed in partnerships with groups of schools in ten countries since 2014. The model consists of three main components: 6 Global Competences (character, citizenship, collaboration, communication, creativity, and critical thinking), 4 learning elements (pedagogy, learning partnerships, learning environments, leveraging digital), and three system conditions (school culture, district/regional culture, and system policy). We offer a case study of relative success based on Uruguay with whom we have been working since 2014. Finally, we identify steps and recommendations for next steps in Latin America for taking action on system reform in the next perioda time that we consider critical for taking advantage of the current pandemic disruption. The next few years will be crucial for either attaining positive breakthroughs or slipping backwards into a reinforced status quo.
