L' analisi si focalizza poi nell' ambito delle coperture professionali, settore in cui il modello claims made ha trovato particolare applicazione ed ha generato una nutrita dottrina e giurisprudenza nonché notevoli ambiguità ad oggi non ancora pienamente risolte. La materia delle polizze assicurative collegate ai contratti di mutuo affonda le proprie radici nel più ampio fenomeno della “bancassicurazione”. Il contratto assicurativo collegato al contratto di finanziamento è utilizzato in funzione di protezione contro i rischi della concessione del credito: il creditore si assicura contro il dannoal patrimonio che potrebbe subire e l'assicuratore si obbliga ad indennizzare il creditore della perdita totale o parziale del credito.Le polizze assicurative collegate ai contratti di mutuo sono state analizzate secondo il seguentemetodo di ricerca.Nel primo capitolo della tesi è stata esaminata la fattispecie delle polizze assicurative abbinate ai contratti di finanziamento. In particolare la fattispecie è stata analizzata dalla prospettiva del collegamento negoziale che si instaura tra il contratto assicurativo e il contratto di mutuo.
Sono state esaminate in un primo momento le categorie generali del collegamento negoziale e successivamente la categoria del collegamento negoziale è stata contestualizzata in base al tema di ricerca. Nel secondo capitolo è stata esaminata la regolamentazione introdotta dal legislatore e dall'Ivass volta ad introdurre limiti esterni alla volontà contrattuale prevedendo l’inibizione ai privati delle pattuizioni e dei comportamenti potenzialmente forieri di maggiori effetti di distorsione del mercato. Nel terzo capitolo è stata esaminata la regolamentazione volta ad introdurre alcuni obblighi di condotta positivi giustificati da finalità di interesse generale di salvaguardia delle dinamiche di mercato, che finiscono con l’incidere, in diversa misura, sull’agire dei soggetti privati. Infine nel quarto capitolo è stato esaminato il fenomento delle polizze assicurative abbinate ai finanziamenti nell'ordinamento inglese e come il Legislatore e il regolatore inglese hanno tentato di risolvere le criticità presenti su tale mercato.

Il presente lavoro riguarda la qualificazione di quei prodotti offerti da
imprese d'assicurazione, affacciatisi nella realtà italiana negli anni
80', che presentano all'interno caratteristiche sia assicurativa sia
finanziarie.
Si deve ricordare come oggi le assicurazioni sulla vita rivestano una
funzione economico/sociale di particolare rilevanza, sia dal punto di
vista del risparmio che dal punto di vista previdenziale. Un solo dato
numerico, di enorme rilevanza, può farci capire la rilevanza del
fenomeno, dato che, nel 2014, la raccolta del solo ramo III,
assicurazioni vita, è risultata di circa novantanove miliardi di euro.
Nel presente studio pertanto si intenderà esaminare la tematica delle
polizze assicurative appartenenti al ramo III vita, le polizze unit
linked ed index linked.
Tale lavoro sarà svolto avendo ben presente i contratti oggi offerti nel
panorma assicurativo italiano, cercando di analizzare se questi
particolari contratti rientrino nella fattispecie del contratto di
assicurazione, ovvero nella fattispecie degli strumenti finanziari od in
ultimo rappresentino un tertium genus rispetto a quelli tipizzati dal
legislatore italiano, nella codificazione civile, e pertanto ricadano nel
genere dei contratti atipici. La risposta a tale quesito importa una
serie di notevoli risvolti che vanno dal piano delle esecuzioni
individuali al fallimentare, sino a quello puramente civilistico.
L'analisi, partendo da una definizione generale del contratto di
assicurazione sulla vita, cercando di esporne la natura e gli elementi
essenziali, passerà a trattare la categoria del rischio, nelle specie di
rischio demografico e rischio finanziario, per poi cercare di
individuare come dottrina e giurisprudenza, anche comunitaria,
hanno cercato di interpretare tali contratti. Il fine di tale lavoro non
sarà altro che fornire all'interprete concreto un quadro completo
degli orientamenti sin qui affermatisi, ma soprattutto gli strumenti
per andare a qualificare ogni singolo contratto che si porrà alla sua
attenzione e risolvere le maggiori problematiche rinvenutesi nella
giurisprudenza che si sta formando negli ultimi anni.

Il presente lavoro “Le polizze variabili nell’ordinamento giuridico italiano” è articolata in quattro capitoli.
Nel primo capitolo, viene tracciato un quadro generale delle polizze variabili nell’ordinamento giuridico italiano, attraverso una disamina delle cause che hanno indotto le imprese assicurative alla stipulazione di contratti di assicurazione sulla vita caratterizzati da una spiccata componente finanziaria.
Nel secondo e terzo capitolo, che costituiscono il tema centrale del lavoro, vengono esaminate le polizze unit linked e index linked, nelle quali l’entità del capitale o della rendita, che l’impresa assicurativa deve corrispondere all’assicurato, non è predeterminata al momento della conclusione del contratto, ma varia in funzione dell’andamento di quote di un fondo di investimento o di determinati indici del mercato finanziario. Più specificamente, attraverso l’individuazione dei caratteri di tali fattispecie contrattuali, si è giunti alla loro qualificazione giuridica.
Il quarto capitolo, infine, ha ad oggetto la ricostruzione della disciplina normativa applicabile alle polizze linked.This dissertation, "The variable life insurances under Italian law," is structured in four chapters. The first chapter gives a general overview of variables policies under Italian law, and analyzes the causes that led insurance companies to conclude variable life insurance. The second and third chapters, which constitute the central part of this research, deal with unit-linked policies and index-linked. In these two policies the benefits are wholly or partly to be determined by reference to the value, or the income from, property of any description, or by reference to fluctuation in, or in an index of, the value of property of any description. The fourth chapter covers the law applicable to linked insurance policies.

Le polizze unit linked sono dei prodotti finanziario-assicurativi che, grazie alla loro composizione, permettono agli assicurati di usufruire delle opportunità degli investimenti finanziari e dei vantaggi dell’assicurazione sulla vita.
Questa tipologia di polizze permette agli assicurati di investire i propri premi assicurativi nei diversi fondi comuni messi a disposizione dalle compagnie di assicurazione sulla vita. Le unit linked sono, quindi, dei prodotti multifunzionali che combinano i vantaggi della condivisione del rischio, dell'assicurazione e dell'investimento.
A differenza delle polizze vita tradizionali le unit linked potrebbero non prevedere né un rendimento garantito né la restituzione del capitale, proprio per questa loro caratteristica esse si contraddistinguono per l’alto profilo di rischio.
Gli assicurati che sottoscrivono le polizze unit linked, poiché quest’ultime prevedono una componente finanziaria, devono intraprendere delle scelte di tale natura.
Quindi, lo scopo della tesi è quello di introdurre le polizze unit linked come strumento di finanza personale e quello di dimostrare che queste sono influenzate dalla finanza comportamentale. Infatti, sebbene la teoria economica classica preveda che gli individui debbano compiere delle scelte perfettamente razionali, considerando tutte le informazioni a loro disposizione, la finanza comportamentale dimostra che le decisioni risultano non sempre razionali e sono influenzate da emozioni e pregiudizi.
Pertanto, verrà analizzata sia la componente assicurativa sia la componente finanziaria di queste polizze, soffermandosi sui bias comportamentali dell’individuo.

L'obiettivo di questo lavoro è quello di illustrare lo sviluppo delle assicurazioni ramo vita, dalla loro forma più tradizionale ex art. 1882 c.c. fino alle forme più complesse, i così detti "prodotti finanziari emessi da banche e imprese di assicurazione" ex art. 25-bis T.U.F. Si analizza poi l'impiego di tali prodotti assicurativi nell'ambito della previdenza complementare e le problematiche che ne scaturiscono. Si valuterà infine l'applicabilità dell'art. 1923 c.c. a questo tipo di prodotti e si faranno ampi riferimenti alla giurisprudenza sul tema in questione.

A fronte della rapida evoluzione dello scenario demografico che negli ultimi decenni ha caratterizzato con tendenze comuni i cosiddetti “Paesi sviluppati” (in particolare con riferimento alla diminuzione generalizzata dei tassi di mortalità, alla diminuzione dei tassi di natalità e al conseguente fenomeno dell’invecchiamento della popolazione), l’elaborato si propone di indagare le problematiche legate alla crescente esposizione al rischio di longevità (longevity risk) da più punti di vista: quello del singolo individuo, degli emittenti di schemi previdenziali privati e degli assicuratori e riassicuratori. Nel capitolo 1, si descrivono le rendite vitalizie (immediate e differite) considerate, tra gli strumenti a disposizione del singolo, i più adatti a fronteggiare tale tipologia di rischio di lungo termine; si indagano la recente tendenza dei fondi pensione al passaggio verso schemi di tipo Defined Contribution, in grado di coprirli maggiormente dal longevity risk, e le tecniche di de-risking più diffuse; infine ci si concentra sulla prospettiva degli assicuratori e riassicuratori per analizzare le due componenti di incertezza legate alla futura evoluzione della mortalità (di tipo pooling e non-pooling), e per esporre gli sviluppi più recenti del mercato della longevità, visto come soluzione finale di condivisione con l’intero mercato finanziario del rischio longevità di tipo aggregato. Nel capitolo 2 si affronta l’applicazione di processi di Risk Management (RM) in ambito assicurativo, in particolare si analizzano le fasi di identificazione e quantificazione del longevity risk (con un focus sugli approcci deterministico e stocastico alla valutazione del rischio) e le azioni di RM più diffuse (contratti di riassicurazione). Nel capitolo 3 si presenta un’altra tipologia di prodotti assicurativi di recente sviluppo (la cui crescita risulta incentivata dalle tendenze demografiche di cui sopra), le polizze Long Term Care (LTC), che dal punto di vista dell’emittente pongono il problema della gestione, oltre che dell’incertezza sui futuri trend di mortalità (longevity risk), anche del cosiddetto “disability risk”. Dopo una sintetica panoramica sulla situazione dell’assistenza LTC in Italia, si ripercorrono le fasi di costruzione di un modello di valutazione del rischio demografico, dalla definizione del modello probabilistico, alla costruzione di un set di probabili scenari evolutivi, alla scelta della grandezza economica per l’analisi dell’impatto monetario del rischio in questione. Nel capitolo 4 si implementa un’analisi di sensitività rivolta a verificare le conseguenze dell’attribuzione di diversi sistemi di pesi agli scenari evolutivi ipotizzati, nell’ambito dell’applicazione di un approccio stocastico alla valutazione del rischio demografico di un portafoglio di polizze Long Term Care di tipo Stand alone.

Siamo di fronte, oggi, ad uno scenario demografico in rapida evoluzione, caratterizzato da un forte processo di invecchiamento della popolazione determinato in particolar modo dalle migliori condizioni di vita, dall’aumento della speranza di vita e dalla contemporanea riduzione delle nascite, con una forte contrazione delle donne in età fertile.
È proprio la Demografia che aiuta il comparto assicurativo ad ottenere un quadro generale, se non anche ad anticiparlo, dei bisogni assicurativi e finanziari dei propri clienti per così riuscire ad offrire una vasta gamma di prodotti e servizi strategici e differenziati per andare incontro alle effettive esigenze delle persone durante le diverse fasi del loro ciclo vitale; utilizzando per l’appunto strumenti demografici e statistici per riuscire ad avere una migliore conoscenza delle stesse persone-clienti.
In questo lavoro si vuole arrivare a presentare e studiare le caratteristiche ed il funzionamento delle recenti polizze Long Term Care, dove il rischio demografico funge da perfetta cornice.
Nel primo capitolo si introduce il panorama di riferimento per le polizze LTC, andando ad analizzare la popolazione, le sue caratteristiche e i cambiamenti in atto, prima nel contesto europeo generale e poi in quello italiano. Nel secondo capitolo ci si sofferma sul ruolo che lo Stato ha riguardo al settore pubblico di Long Term Care, evidenziandone il funzionamento e la presenza o meno di punti di forza e di debolezza. Dalle conclusioni che vengono tratte da questi primi due capitoli si arriva, poi, ad affermare l’importanza del ruolo delle Compagnie di assicurazioni in tale “nuovo” settore. In particolare nel terzo capitolo si considerano le assicurazioni sulla salute che rispondono al principio della copertura individuale e risultano particolarmente utili e necessarie nel nuovo scenario demografico e politico venutosi a delineare. Infine è nell’ultimo capitolo che si va a presentare ed analizzare, nello specifico, le polizze Long Term Care.

Il difficile inquadramento giuridico delle polizze legate ai finanziamenti le ha rese un fenomeno controverso. Nonostante le continue evoluzioni del quadro normativo finalizzate a tutelare il cliente da eventuali comportamenti opportunistici messi in atto dagli intermediari eroganti il prestito, non vi è concordanza di opinioni intorno alla natura giuridica del fenomeno. Il presente studio mira a fare chiarezza su alcuni aspetti prettamente giuridici, nello specifico l’attenzione è rivolta al tentato inquadramento di questa categoria di contratti nell’ambito di due fattispecie previste dal Codice civile, ovvero il contratto a favore di terzo e il contratto per conto altrui. Nel prosieguo del lavoro è stata avanzata una seconda ipotesi, quella di ricondurre queste polizze alla fattispecie del collegamento negoziale, il quale pur non rappresentando una categoria giuridica autonoma che gode di una solida disciplina, costituisce un “meccanismo giuridico” utile a contestualizzare le suddette polizze. Oltre alla dottrina anche gli apporti della giurisprudenza si sono dimostrati utili a colmare le lacune normative. La presente analisi ripercorre i vari dibattiti sul tema prendendo come filo conduttore i prestiti ai consumatori con un focus sui finanziamenti contro cessione del quinto dello stipendio o della pensione, i quali presentano la peculiarità di richiedere obbligatoriamente la stipula di due polizze, l’una sulla vita, l’altra contro il rischio di perdita dell’impiego.

During the violent phases of transformation in post-Soviet Georgia the power of the police passed on to paramilitary groups. Under the rule of president Shevardnadze, however, the police regained a central political role, but it remained embedded in Soviet and pre-Soviet political structures. This becomes visible by looking at the political economy of the police. Informal taxes, purchase of office, and clientelism became established practices within the police. At present, the new government tries to carry out structural reforms in the police sector, which might lead to a break with the current hybrid Georgian state model.

A perception of escalating social disorder and allegations of police corruption and ineptitude have led to a social and political imperative to reform policing. Fundamental to this reform is the modification of the core mission of the police and the operational practices of the uniformed Constable. The core characteristics of policing and the operational practices of the uniformed Constable are determined by the core mission and the operational context of policing. -- Despite an imperative to reform the quality and provision of police services to the community the core mission of the police has not fundamentally altered during the last half century and remains crime control (Zaho, 1996). The core mission of contemporary policing has been criticised for being in direct conflict with basic democratic principles and for being simply unachievable. This thesis will establish that the origins and occurrence of crime, its prevalence and persistence is detennined by social, economic and cultural factors that are beyond the control of the police. It will be argued that long-term successful law-enforcement in a democratic society requires the acceptance, cooperation and approval of the community. Community oriented policing may provide the theoretical framework for internalising normative controls and for enhancing public participation in and sharing responsibility for crime control. -- It will be demonstrated that the strategc shift in policing implicit within the theoretical framework of community policing has significant implications for the reform of police . education and training. Several commentators and various Commissions of Inquiry have recommended upgrading police education and training, and the participation of police in tertiary education. -- The reform of police practice is contingent upon the reform of the core mission and the operational context of policing. The core mission and the operational context of policing is substantially defined, controlled and manipulated by the perceptions, expectations and actions of stakeholders. Directly or indirectly these have been found to be antithetical to alternative models of policing that are service orientated; thus blocking, diluting or redirecting efforts to implement community policing. -- Unless the core mission of the police and the operational context of policing are substantially modified then police education will continue to have a limited impact upon the operational practices of the uniformed Constable.

The main objective of this work is to critically evaluate a sufficient portion of the circuit problem of software piracy and to propose solutions of sub-problems, to use the interpretation of all relevant laws and all other available resources and create a comprehensive picture of the case. The practical part should be primarily a manual for ordinary computer users, which should help them. At the same time I present a preview of the methods of the executive law enforcement authority - Police of the Czech Republic, which deals with the investigation of software piracy. Range of the methods used in my work is not wide, which is partly due to reluctance of companies to cooperate because it is a relatively sensitive information, but it fully covers the needs of work and make it possible to have a final vision of the subject.

Da anni si assiste ad una continua e incessante evoluzione del settore marittimo, nel tentativo costante di introdurre nuove tecnologie per migliorare i servizi offerti, con l’obiettivo di accelerare la velocità degli scambi commerciali e ridurre i costi delle operazioni. Nell’intento di offrire un’assistenza all’avanguardia ed in tempi ridotti, particolare importanza hanno avuto le evoluzioni in tema di Polizza di Carico. La Polizza di Carico o Bill of Lading (B/L) è il principale documento utilizzato nel trasporto marittimo a livello internazionale caratterizzandosi come ricevuta di carico, titolo rappresentativo di merce e prova del contratto di trasporto. Dagli anni Ottanta del secolo scorso, diversi sono stati i tentativi di sviluppare una polizza di carico elettronica che presenti le stesse funzionalità di quella cartacea al fine di ovviare agli inconvenienti del documento tradizionale garantendone, al tempo stesso, la medesima sicurezza ed efficacia. Di recente, il progresso scientifico e l’innovazione digitale, hanno contribuito all’introduzione nel settore dello shipping di una polizza di carico basata sulla Blockchain. Nonostante sia indubbio che tale tecnologia possa garantire molteplici vantaggi, il reale utilizzo di una Blockchain Bill of Lading risulta, a tuttora, un’ipotesi in piena evoluzione.For years we have witnessed a continuous evolution of the maritime sector, in the constant attempt to introduce new technologies with the aim of improving the services offered, accelerating the speed of trade and reducing the cost of operations. In order to offer a cutting-edge assistance in a short time, the evolution in terms of Bill of Lading have had particular importance. The Bill of Lading (B / L) is the main document used in maritime transport at an international level, characterized as a receipt of cargo, document of title and proof of contract. Since the 80’s of the last century, there have been several attempts to develop an electronic bill of lading that has the same functionality as the paper one in order to overcome the drawbacks of the traditional document while guaranteeing the same safety levels and effectiveness. Recently, scientific progress and digital innovation have contributed to the introduction of a Blockchain based bill of lading in the shipping sector. Although there is no doubt that the digital in the maritime transport sector can lead to multiple advantages, the actual use of a Blockchain Bill of Lading is still evolving.

Soziologische Polizeiforschung hebt zumeist folgende Aspekte der Polizei hervor: Ihre Zuständigkeit für öffentliche Sicherheit, ihr Einsatz von Gewalt im Namen eines staatlichen Gewaltmonopols, die Tätigkeit des Polizisten als Beruf. Häufig wird auch die Verwurzelung des Polizeiwesens in okzidentalen Kulturen hervorgehoben.
In dieser kulturvergleichenden Studie werden diese Punkte anhand historischer und nicht-deutscher Polizeien untersucht.
1. Sicherheit: Wie in Gesellschaften, in denen es eine Öffentlichkeit im polizeigesetzlichen Sinne gar nicht gibt Sicherheit und Ordnung garantiert werden, interessiert Franziska Harnisch und Anja Bruhn, die sich mit dem Phänomen der Blutrache auseinandergesetzt haben.
2. Staatlichkeit: Die Beobachtung, dass die moderne Polizei an die Existenz einer differenzierten Staatlichkeit gebunden ist, ermuntert zu weiterführenden der Frage, wie die Polizei in verschiedenen nationalen Rechtskontexten eingerichtet ist. Während Mathias Graßmann die Polizei der Bundesrepublik Deutschland analysiert, betrachtet Björn Schülzke die Lage in den USA. Wie eine über staatliche Grenzen hinaus agierende Polizeibehörde funktionieren kann, hat Frederick Sixtus anhand der Beispiele von Europol und Interpol untersucht.
3. Gewalt: Die soziologische Literatur interessiert sich besonders für die Verkörperung des Gewaltmonopols in der Polizei. Inwieweit dieses Interesse berechtigt ist und wie sehr polizeiliche Arbeit tatsächlich mit der Ausübung von Gewalt zu tun hat, ist für alle Beiträge in diesem Buch richtungsweisend, insbesondere aber für den von Christiane Mochan über Gewalt und Polizei. Inwieweit diese Gewalt auch als staatlicher Terror ausgeübt werden kann, ist eine leitende Frage des Kapitels über die Opritschnina von Julia Fatianova.
4. Gehalt: Vieles spricht dafür, von Polizei dann zu sprechen, wenn ihre Mitarbeiter ein regelmäßiges Einkommen beziehen. Viele Vertreter von Vorformen der Polizei lebten hingegen von anlassbezogenen Prämien. Die Liktoren im Alten Rom mit ihrem regelmäßigen Einkommen durchkreuzen allerdings die These, dass es ein Phänomen der Moderne sei, Polizisten regelmäßig zu entlohnen. Deswegen interessiert sich Tanja Zischke in ihrem Beitrag für diese antike Frühform der Polizei.
5. Okzident: Häufig geht die polizeisoziologische Forschung stillschweigend davon aus, dass die Polizei ein Phänomen der okzidentalen Moderne sei. Max Weber z.B. unterstellt orientalischen Gesellschaften, nichts mit der Polizei vergleichbares hervorgebracht zu haben. Vor diesem Hintergrund geht Jonas Grutzpalk der Frage nach, wie eine originär orientalische Polizei, nämlich die saudi-arabische Mutawa, entstehen konnte. Wie die nach okzidentalen Vorbildern eingerichtete Polizei in Kambodscha arbeitet und in der Bevölkerung angenommen wird, analysiert Saskia Ellenbeck.
Ziel dieses Buches ist, durch den Vergleich der hier erfassten Polizeikulturen mehr über die Polizei als solche zu erfahren. Diese Sammlung soll die Polizeisoziologie auf dem Feld der kulturvergleichenden Forschung bereichern.The majority of the research work in sociology that deals with the phenomenon of the police force usually focuses on some major issues: it seeks to describe the function of the police as the provider of social security in a given society, to examine the use of violence through the police in the name of the state monopoly on violence and to investigate the structure of the occupational field of policemen. Some studies also highlight the rootedness of police in occidental cultures. This book aims to contribute to the study of these major questions of police sociology through applying them to different historical and modern examples of police structures in different cultures. 1. Public security: Are there ways to guarantee public order and security in a society where there is no such public in the sense of the police laws? This question was the central point of interest for the essay by Franziska Harnish and Anja Bruhn that deals with the phenomenon of blood feuds. 2. The state: The fact that the police in modern society is bound to a certain state context leads to a question about how police structures differ in various law contexts. While Mathias Graßmann analyzes the features of police in Germany, Björn Schülzke takes a look at the situation in the USA. In his essay on Interpol and Europol, Frederick Sixtus examines police structures that have to function beyond given state borders. 3. Violence: The embodiment of the state monopoly on violence through the police is commonly the central point of interest for sociologers. This interrelation was particularly important for the essay by Christiane Mochan on police and violence. An essay on oprichnina by Julia Fatianova deals with the question about whether this monopoly on violence can also serve to create state terror. 4. Salary: Has being a policeman always been a form of wage labour? Many premodern forms of police structures were not practicing continuous wage payment but regarding premiums. The example of Lictors in Ancient Rome, however, shows that regular payment in the police force is not just a modern phenomenon. Tanja Zischke took a detailed look at the Lictors in her essay provided in this book. 5. The Occident: Many sociologists take it for granted that the police force is an attribute of the Western modernity. Max Weber, for instance, says that oriental cultures have not brought about anything comparable. In this context the essay of Jonas Grutzpalk poses a question about the origins of such essentially oriental police structures as the Saudi-Arabian Mutawa. Saskia Ellenbeck analyzes the functioning of the police in Cambodia, which was formed according to the occidental models, and the way it is perceived in Cambodian society. The aim of this book is to contribute to our knowledge about the police through a comparative study of examples of police forms in different cultures.

This study examined the impact of four categories of variables (demographics,
neighborhood context variables, contact with the police, and vicarious influence variables)
on juvenile perceptions of the police and police services. Data analyzed in this study were
collected as part of a larger research evaluation that examined the impact of law
enforcement efforts in relation to violent crime. Students from one middle school were
surveyed. Statistical analysis consisted of a series of One-Way ANOVA tests and several
ordinary least squares regression (OLS) models. The study found significant results for
both dependent variables within all four categories of independent variables. Policy
implications and suggestions for further research are discussed.

This paper will look back on the history of interrogation tactics used by police as well as the court's efforts to regulate those tactics. Starting with the definition of interrogation and tactics, the paper will slowly delve into the history of U.S. police interrogation tactics. Beginning with the early formulation of modern police departments and working through the important Wickersham Report. The paper will discuss the ban on physical third degree tactics and the impact of Miranda warnings. Finally, the paper will walk through one of the most popular interrogation methods, The Reid Technique, before briefly proposing eight suggestions on how to move forward with interrogation regulation.

Ce travail s’intéresse à la police et pose la question des transformations des modes de production du contrôle et du consensus social dans les sociétés postmodernes. Quel est le rôle joué par la police de proximité dans ces transformations ? Comment participe la population au développement de ces nouvelles tendances ? Et dans quelle mesure la police va changer son rapport avec le pouvoir central pour devenir une véritable police citoyenne ? Les réponses s’appuient sur un examen de la littérature théorique et sur une enquête de terrain menée essentiellement dans les villes de Paris et Milan. Les sources utilisées sont l’observation directe, plus de 80 entretiens et un focus group. La recherche s’est développée autour de trois phases successives. Premièrement, j’ai examiné les sources théoriques, pour pouvoir définir les concepts de déviance et contrôle, et pour comprendre le rôle joué par la police dans les sociétés modernes. Deuxièmement, je me suis concentré sur la police de proximité, un modèle d’approche policière qui récemment a été introduit dans les deux contextes étudiés. Enfin, j’ai reconstruit les nouvelles tendances de l’action de police autour les trois interrogatifs de recherche. Dans la conclusion je spécifie comment les deux piliers de l’action de police (contrôle et consensus) sont traduit dans les sociétés postmodernes. Dans une façon à la fois nouvelles et ancienne, la police transforme son identité traditionnelle de pouvoir régalien, mais continue essentiellement à faire ce qu’elle a toujours fait : une sélection entre individus à rassurer et protéger et individus à exclure et punirThis work addresses the issue of police and focuses on the problem of the new ways of production of social control and public consent in the post-modern societies. Which is the role of proximity police in these transformations? How does population participate to development of the new tendencies? And to what extent is police changing their connection with the central power, to become a real “citizen police”? The answer is based on theoretical work and on fieldwork essentially carried out in Paris and Milan. The sources employed include direct observation, more than 80 interviews and a focus group. The research have been developed in three successive phases. First, I examined the theoretical sources to define the concepts of deviance and social control and to understand the role played by police in modern societies. Second, I concentrated on the proximity police, a model of policing approach early introduced within the two national contexts I have studied. Finally, I reconstructed the new tendencies of police action across the three starting questions. Within the conclusion I specify how the two pillars of police action (control and consent) are translated in the post-modern societies. In a way at the same time new and ancient, police is transforming his traditional identity of power dependent by State, but still does what she has always done: a social selection between individuals to reassure and protect and individuals to exclude and punish

L'obiettivo dell'elaborato consiste nel determinare se lo strumento parametrico possa considerarsi idoneo nei confronti dell'ordinamento italiano vigente in materia. Anzitutto si individuano le peculiarità del prodotto parametrico, che viene opportunamente confrontato con gli strumenti finanziari emessi dalle imprese di assicurazione e i prodotti derivati. A partire dalla definizione conseguente a tale processo è possibile osservare se vi siano barriere legislative che impediscano al prodotto parametrico di operare in Italia; tale fase si suddivide in due percorsi principali: il primo si dedica al confronto tra la polizza parametrica e le norme del Codice delle Assicurazioni private e del Codice Civile, mentre il secondo rivolge la propria attenzione alla compatibilità della stessa con la direttiva c.d Solvency II.
Infine si individuano le fasi operative peculiari dello strumento parametrico per determinare se esse siano compatibili con l'ordinamento presente e futuro.

This thesis explores successive police reform agendas over the period 1979 – 2012 in terms of the relationship between political ideology, police reform and police occupational culture. The thesis addresses the interplay between ideologically driven police reform and the reception of reform agendas within the central mindset of policing. It examines the significance of political and economic drivers in police reform agendas and literature on police occupational culture, with emphasis upon change and reform and the response within the police. As a means of exploring the relationship between reform and police culture the thesis gathers data through empirical research based upon documentary analysis and semi-structured interviews. Research upon street and management cops (Reuss-Ianni 1983) and the analytical model of cultural knowledge and change outlined by Chan (1997), was used to analyse and present the research findings. The main conclusions concern how ideology in police reform agendas was received by police occupational culture. Utilising the theoretical frameworks of Reuss-Ianni and Chan, the thesis argues that the ideology in police reform agendas is received and assessed through cultural knowledge. This places into context documented features of police occupational culture such as the sense of mission, conservatism, resistance to change and the street – management divide. As a result, this thesis contributes to the understanding of police occupational culture through the prism of reform and the implications for practice, outlining how ideologically driven police reform agendas are received and interpreted through police occupational culture.

The purpose of this research is to analyze Colombian police policy with particular reference to the police and urban policing after the promulgation of the Constitution of 1991. This study examines how the Constitution of 1991 has impacted on the configuration, professionalization and institutionalization of the Colombian police. This dissertation concludes that the new Constitution of 1991 was crucial in transforming an insignificant organization into a noteworthy public institution with its own corporate aims and ethos and a certain autonomy regarding the government, parties, ministries and the military. This research is divided into three main parts. The first one will focus on the police as a structure emphasizing the process of formation, development and institutionalization. It dissects the police structure into five aspects: historical configuration, structural organization, personnel, expenditure and controls. This part shows that the current importance of the police in the Colombian institutional landscape in terms of international aid, personnel and budget increase and public exposure has no precedents prior to 1991.The second part will be devoted to the study of the organizational life of the police force stressing the role played by high-ranking officers in improving the image of the police and, more importantly, in creating a vigorous institution difficult to control from outside, but at the same time, not easy to manage internally as a consequence of the distinction existing between high-ranking and low-ranking officers. The final part of this work examines urban and community policing in large urban areas taking the case of Bogotá. It focuses on the role played by the police in its implementation, successes and failures, concluding that the reluctance of the police to adopt these programmes of policing has limited their productive effects on the actual job and indeed the whole organization.

Two classes are designed in the building, each for 25 children, kitchen, technical background and facilities for staff. Part of the building is a large garden. It is a detached building with one floor and the part of the building with the basement. The surrounding terrain is slightly sloping. The building is made of masonry system on the concrete strip foundations. The building is insulated with contact thermal insulation system. The part of building is roofed with mono-pitched roof and the other parts are roofed with a flat roof.

Considering police-public consultation forums as a device, or tactic, to ‘civilize’ policing, the possibilities and limitations of ‘civilizing policing’ using this method can be shown. Police-public consultation forums can ‘civilize’ policing – in the sense Loader and Walker (2007) use the term – by contributing to police reform, democratic policing, and police legitimacy. Using the case of Edinburgh, Scotland, the achievements of police-public consultation forums for reform, democratic policing, and legitimacy, are examined and an argument made that consultation forums can make positive contributions in each of these areas. However, the example of consultation forums also reveals significant conceptual and structural limitations to the ideas of reform, democracy, and legitimacy when applied to the police. These limitations are articulated using the social theory of Simmel, Weber, and Lukes: Simmel and Weber reveal the inflexibility and non-negotiable aspects of the police that defies reform and democratic ambitions; Lukes provides an important precautionary perspective on the ‘democraticness’ of democratic devices; and, comparing Lukes with the work of Weber provides a view on legitimacy that reveals advanced complexities to ‘police legitimacy’. In sum, police-public consultation forums contribute to ‘civilizing policing’, but it is also useful to reflect and consider the non-negotiable limits the ‘form’ of the police applies to possible positive change.

Diploma thesis deals with the evaluation of the efficiency using DEA models focusing on the use of dedicated software tools. There are four chapters in the thesis where different approaches to efficiency are briefly presented. The method of data envelopment analysis (DEA) with its modifications is described in detail -- basic models, CCR, BCC and additive model. The main part of the work is presented in the second part of this thesis where I describe how to work with each program and summarize its advantages and disadvantages. The last chapter applies prior knowledge on real situation -- the evaluation of the efficiency of the regional police stations in the Czech Republic.

This study analyses the dynamics of the police decision to invoke deadly force in a particular situation called encounters, using the Mumbai police as a case study. Police encounters in India are officially portrayed as spontaneous, unplanned 'shoot-outs' between the police and alleged criminals, in which the criminal almost invariably is killed but there are hardly any injuries on the part of the police. However the 'cover story' is always the same raising the suspicion that it is a cover up for facts that might not be legally defensible or permissible. The core of this study is to understand why in a free and democratic society like India, such abuse of police use of deadly force is not only tolerated, but also in many ways (both overtly and tacitly) encouraged. The study adopts a qualitative approach to understand police officers' perspectives of the issues surrounding the use of deadly force and compares it with the perspectives of a few influential opinion makers via in-depth semi-structured interviews. A broader examination of media, social, organisational and governmental responses towards police use of deadly force helps contextualize police justifications within the Denial Theory framework and the study draws upon wider policing literature in the UK, USA, South Africa and certain Latin American countries to explain why this form of police violence occurs. The abuse of deadly force has to be understood as not only a social problem, but also a sociological one. It gives rise to fiindamental questions such as - what makes ordinary, 'decent' human beings do horrible things. What motivational techniques and justifications are used to override social norms governing moral conduct. This problem has received little attention in the Indian context, to that extent the research will fill a gap in the existing criminological literature and allow for a more comprehensive understanding of these issues. Also, by drawing lessons from the experience of other countries who have tackled similar problems, it will provide broad guidelines and recommendations for reforms in policing policy and practice.

L'objectif de notre recherche est de vérifier le postulat que l'organisation policière turque pourrait tirer d'une application de la Police de Proximité. L'expérience de la Police de Proximité constitue un laboratoire formidable dans lequel le cas turc peut tirer des enseignements, des méthodes, dispositifs et procédés. La Police de Proximité est un exemple pour un Etat centralisé par rapport au modèle Community Policing sous l'autorité régionale ou communale. Face à la recrudescence de la délinquance et la montée en puissance du sentiment d'insécurité, l'organisation policière turque cherche à trouver des réponses anachroniques en privilégiant l'ordre public et la grande délinquance dont le terrorisme au détriment de la prévention et de la sécurité publique. Un changement profond et durable s'impose pour répondre à la demande sociale. En France, la Police de Proximité est en suspends. Par contre, les gouvernements français ont déployé des efforts considérables pour l'application de ce modèle. Même si le degré d'application de la Police de Proximité demeure encore très controversée, ce modèle a donné naissance à un nombre important d'applications. Dans le contexte de la mise en œuvre d'une politique publique de sécurité en Turquie, cette réforme dépend de trois démarches successives : une démarche politico-administrative, une démarche juridique qui prévoit des modifications dans la législation et une démarche opérationnelle au sein de l'organisation policière expérimentales. L'enseignement de l'expérience française nous permettra de planifier un nouveau modèle turc de la Police de ProximitéThe objectif of our research project is to verify the postulate that the organisation of the Turkish Police could put into practice an application of the Police de Proximité. The experiment of the Police de Proximité constitute an formidable laboratory in which the Turkish Police can learn new lessons, methods, devices, proceedings. The Police de Proximité is an example of a centralised system compared to the model of Community Policing under the regional and local authorities. Facing the renewal of delinquency and the increased feeling of insecurity, the Turkish police are looking for anachronic solutions in the optical of public order and serious crime, such as terrorism, instead of focusing on preventative measures and public safety. A sustainable and effective change can be achieved by responding to social needs. In France the project of Police de Proximité was supended. But the French government is making enormous efforts to integrate this model into the existing system. Even if there are controversial opinions regarding the extent of the application of the Police de Proximité, the concept has been an inspiration to other important field experiments in this research area. The lessons learned by the French experiment allow us to design a new Turkish concept of the Police de Proximité. In order to implement a public policy of security in Turkey, this reform is dependent upon three successive phases: the political administrative phase, the juridic phase including legal modifications and the operational phase within the organisation of the police. As the French experiment has shown, the mere implementation of the reform is not sufficient to change the system. Success implementation of this reform, is dependent upon the support of politicians and people as well as the determination of the police

Le travail présente ici une étude philosophique de la police, prise dans son sens contemporain. Il procède de l'idée que la police n'est pas un simple moyen de la politique, mais un élément constitutif de sa structure, qu'elle participe de la définition de ses fins et qu'elle n'est pas dénuée de sens. Il ne s'agit donc pas ici de se demander comment agit la police, mais de tenter de dire ce qu'elle est. Une telle approche conduit à aborder la politique autrement que comme « haute politique » et a tenter de prendre les choses « par le bas ». La recherche des normes et des principes, l'opposition du légitime et de l'illégitime, du juste et l'injuste en matière de constitution et de régime ne sauraient ici servir de fil directeur. Il s'agit de se demander non ce qui doit être, mais pourquoi ce qui est ce qu'il est. Dans ce cas, l'étude de la police devient non seulement possible, mais souhaitable. Une telle recherche se développe dans la cadre de la philosophie appliquée. Parce que la police a été considérée comme un concept philosophique seulement par quelques philosophes son étude requiert une approche interdisciplinaire. Toutefois, les éléments empruntés au droit, à l'histoire, à la science politique et à la sociologie sont repris dans une problématique. La première partie est consacrée a l'analyse la police est comme intelligence de la politique. Basse politique, elle l'est alors comme politique appliquée. La deuxième partie analyse la police comme instance du maintien de l'ordre : elle semble alors incarner ce qu'il y a de plus bas dans la politique. La troisième partie porte sur le grand thème de la mythologie policière : « œil ». L'oeil semble l'instrument adéquat de la basse politique. Il est non ce qui permet d'observer et d'informer l'Etat, et ce qui assure l'ordre.
